which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To conduct fire salvage on certain National Forest System lands burned by wildfire, and for other purposes.</official-title></form><legis-body id="H3EB97AAB92844021AC202260468CD7BB" style="OLC"><section id="H2BA9B7EAFD7A4AB48533D86EA7813F3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forestry Improvements to Restore the Environment Act of 2021</short-title></quote> or the <quote><short-title>FIRE Act of 2021</short-title></quote>.</text></section><section id="H39E9055E26BE483E883A9A54EF83B271"><enum>2.</enum><header>Forest management activities required after wildfire</header><subsection id="H9FEE0E23ABA3499C81E6A1817106BE86"><enum>(a)</enum><header>Survey of National Forest System lands impacted by wildfire</header><paragraph id="H3EA110795F064BDA8548A0A453A7AAEE"><enum>(1)</enum><header>Survey required</header><text display-inline="yes-display-inline">To the maximum extent practicable, not later than 60 days after a wildfire is contained on National Forest System lands, the Secretary of Agriculture, acting through the Chief of the Forest Service, shall complete a survey of the National Forest System lands that were impacted by such wildfire. </text></paragraph><paragraph id="HEC21E3EEEEE14AA580FDBAEC8BDDA9FD" commented="no"><enum>(2)</enum><header>Priority of land surveyed</header><text display-inline="yes-display-inline">In carrying out a survey required under paragraph (1), the Secretary of Agriculture shall give priority to National Forest System lands in the following order:</text><subparagraph id="HF5C2B27F94334B17B6F70303305D977F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Lands for which there is, at the time of such survey—</text><clause id="H0E63550C798040FFA9A8E9CC2AE9C9AB"><enum>(i)</enum><text display-inline="yes-display-inline">timber under a contract pursuant to section 14(a) of the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a</external-xref>); or</text></clause><clause id="H0E46358EC2874E5F83FE79F74F5D8A91"><enum>(ii)</enum><text display-inline="yes-display-inline">a stewardship contract under section 604 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c</external-xref>). </text></clause></subparagraph><subparagraph id="H6504D08F953041288E1A9AA02FF354DD" commented="no"><enum>(B)</enum><text>Lands for which, at the time of such survey—</text><clause id="HBB808C7E348C4145A6657A580A62F560" commented="no"><enum>(i)</enum><text>a timber sale described in subparagraph (A)(i) or a stewardship contract described in subparagraph (A)(ii) is planned; and</text></clause><clause id="H1D4DBD1065F94A198C1D83E5C55D5DDB" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to such sale or contract, an environmental decision document has been completed pursuant to section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></clause></subparagraph></paragraph></subsection><subsection id="HEF62BC2F66DF44B58165A60FDE73D676"><enum>(b)</enum><header>Conversion of timber sales</header><paragraph id="H01DFE038B4C8409ABAC38E5750987CEE"><enum>(1)</enum><header>Timber sales to salvage sales</header><text display-inline="yes-display-inline">Not later than 60 days after a wildfire is contained on National Forest System lands, the Secretary of Agriculture shall, with respect to the timber sales applicable to such lands that were impacted by such wildfire, convert such timber sales to salvage sales.</text></paragraph><paragraph id="H56F304B5A1B74473867D6E3C5668D796" commented="no"><enum>(2)</enum><header>Treatment of converted timber sales</header><text display-inline="yes-display-inline">In the case of a project relating to the timber sales applicable to the National Forest System lands described in paragraph (1), the conversion of such timber sales to salvage sales under such paragraph shall be deemed to meet the purpose and need of such project for purposes of an environmental assessment or an environmental impact statement pursuant to section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></paragraph></subsection><subsection id="HF6A2A92829D242C6AAA07742EB838B1B"><enum>(c)</enum><header>Supplemental information reports</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall give priority to completing supplemental information reports that determine, with respect to a pending project planned for National Forest System lands prior to a wildfire, whether—</text><paragraph id="HCBF7818945474E9382E2E9329CB79EBE"><enum>(1)</enum><text>timber salvage constitutes substantial changes to the proposed action that are relevant to environmental concerns; and</text></paragraph><paragraph id="H77C47D2532494A569661CBAADF92CA88"><enum>(2)</enum><text>wildfire constitutes significant new circumstances or information relevant to environmental concerns.</text></paragraph></subsection></section><section id="H92C653F05FC740C3BE98C3AD7CEAAF40"><enum>3.</enum><header>Roadside salvage categorical exclusion</header><subsection id="H993B83A359624DD3A576A7DDC8498003"><enum>(a)</enum><header>Categorical exclusion established</header><text>Forest management activities described in subsection (b) are a category of actions hereby designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement pursuant to section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection><subsection id="H4D5124D140344D8790E29092F60E0EC9"><enum>(b)</enum><header>Forest management activities designated for categorical exclusion</header><text>The category of forest management activities designated under this section for a categorical exclusion are forest management activities carried out by the Secretary of Agriculture on National Forest System lands where the primary purpose of such activity is for roadside salvage activities that allow for the removal of hazard trees that are within 200 feet of a roadway center line.</text></subsection><subsection id="H894E583D708B4BB09B3E4CF55601D890"><enum>(c)</enum><header>Availability of categorical exclusion</header><text>On and after the date of the enactment of this Act, the Secretary of Agriculture may use the categorical exclusion established under subsection (a) in accordance with this section.</text></subsection><subsection id="H672E6375D8FC4B26A2494A272CD3B0CD"><enum>(d)</enum><header>Acreage limitations</header><text>The categorical exclusion established under subsection (a) shall not be limited in size or scope.</text></subsection><subsection id="H68D2BA93460C40A7BDEE995D934C18D0" commented="no"><enum>(e)</enum><header>Exclusion of extraordinary circumstance procedures</header><text display-inline="yes-display-inline">The procedures relating to extraordinary circumstances under section 220.6 of title 36, Code of Federal Regulations (or a successor regulation), shall not apply to the use of the categorical exclusion established under subsection (b). </text></subsection></section><section id="HF63A35985B61430DA4CF132D652A5F38" commented="no"><enum>4.</enum><header>Judicial review</header><subsection id="H6B2BBC3884C143AB8819D063C8C25F61" commented="no"><enum>(a)</enum><header>Objection period</header><text>For any action taken pursuant to the authorities in this Act, the objection time described in section 219.56 of title 36, Code of Federal Regulations (or successor regulations), shall be 30 days. </text></subsection><subsection id="H25C22C0C5C9A489D8078F8821BAC55BC" commented="no"><enum>(b)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Except as provided in subsection (c), an activity carried out pursuant to this Act shall be subject to judicial review in the same manner as an authorized hazardous fuels reduction project is subject to judicial review under section 106 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6516">16 U.S.C. 6516</external-xref>). </text></subsection><subsection id="H5944E32987C84FCAAEE7E0A1EE51B08C" commented="no"><enum>(c)</enum><header>Preliminary injunction prohibited</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a court may not order a preliminary injunction enjoining the Secretary of Agriculture from proceeding with timber sales authorized under this Act. </text></subsection></section><section id="H7EAE96D23C264774961AFCF9EF356178" commented="no"><enum>5.</enum><header>Rule of application for National Forest System lands</header><text display-inline="no-display-inline">The authorities provided by this Act may not apply with respect to any National Forest System lands—</text><paragraph id="H2BD3290A3E7243F19596637250BD1647" commented="no"><enum>(1)</enum><text>that are included in the National Wilderness Preservation System;</text></paragraph><paragraph id="HFFD00DFD94344CDE896B6305859EA938" commented="no"><enum>(2)</enum><text>that are located within a national or State-specific inventoried roadless area established by the Secretary of Agriculture through regulation, unless—</text><subparagraph id="H19AA61AECD664570AD91C87F9EEF461D" commented="no"><enum>(A)</enum><text>the forest management activity to be carried out under such authority is consistent with the forest plan applicable to the area; or</text></subparagraph><subparagraph id="HD8DBBCA292464BE4949F3E4A3F1CF0BA" commented="no"><enum>(B)</enum><text>the Secretary of Agriculture determines the forest management activity is permissible under the applicable roadless rule governing such lands; or</text></subparagraph></paragraph><paragraph id="HF5B1C5F0CA714C5DB66AB63D3A548CCB" commented="no"><enum>(3)</enum><text>on which timber harvesting for any purpose is prohibited by Federal statute.</text></paragraph></section></legis-body></bill>
