which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committee on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a biochar demonstration project and biochar grant program, and for other purposes.</official-title></form><legis-body id="HB649938C4BC545658242D344D48FD028" style="OLC"><section id="H0EDEADA839EF43778D12E9FC1B68D6F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Biochar Innovations and Opportunities for Conservation, Health, and Advancements in Research Act of 2021</short-title></quote> or the <quote><short-title>BIOCHAR Act of 2021</short-title></quote>.</text></section><section id="H14F33AC77C214AE28C6C933AD9E6688E"><enum>2.</enum><header>BIOCHAR demonstration project</header><subsection id="HFFD17F175DC34B239849F43C98A12FFF"><enum>(a)</enum><header>Demonstration projects</header><paragraph id="H94BC14B43D024CE49DDEE762ED991C6D"><enum>(1)</enum><header>Establishment</header><subparagraph id="HFEDEFE5AE8D5416F9A0E9F335870B78F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section, the Secretaries shall establish a program to enter into partnerships with eligible entities to carry out demonstration projects to support the development and commercialization of biochar in accordance with this subsection.</text></subparagraph><subparagraph id="H3A8EB1FBA1614CD1A179029E780C8BBF"><enum>(B)</enum><header>Location of demonstration projects</header><text>The Secretaries shall, to the maximum extent practicable, establish at least one biochar demonstration project in each Forest Service region. </text></subparagraph></paragraph><paragraph id="H7D251CD117E141D5AE3D47CD5EB385C4"><enum>(2)</enum><header>Proposals</header><text>To be eligible to enter into a partnership to carry out a biochar demonstration project under paragraph (1)(A), an eligible entity shall submit to the Secretaries a proposal at such time, in such manner, and containing such information as the Secretaries may require.</text></paragraph><paragraph id="HFD58D8644C31457189B2BEA74FC0C5C4"><enum>(3)</enum><header>Priority</header><text>In selecting proposals under paragraph (2), the Secretaries shall give priority to partnering with eligible entities that submit proposals to carry out biochar demonstration projects that—</text><subparagraph id="H3721EE3EE05F418B9E98451159876182"><enum>(A)</enum><text>have the most carbon sequestration potential;</text></subparagraph><subparagraph id="H62D5C9FDD7FC4D58AB129A16BFC1CDC9"><enum>(B)</enum><text>will create new jobs and contribute to local economies, particularly in rural areas;</text></subparagraph><subparagraph id="H59ABC841D42544F4ABF84F4C497B6C0F"><enum>(C)</enum><text>will demonstrate—</text><clause id="H79B40D4FBAE24498B968E2BD9F6478C3"><enum>(i)</enum><text>new and innovative uses of biochar;</text></clause><clause id="H2BE7A46762134A4AA5EE4D17B0BD86D9"><enum>(ii)</enum><text>viable markets for cost effective biochar-based products;</text></clause><clause id="HE7440CE770714A2E9ED0D23E92FCD9EE"><enum>(iii)</enum><text>the ecosystem services of biochar;</text></clause><clause id="H67E09E772212411DA03EFF7983367BDD"><enum>(iv)</enum><text>the benefits of biochar to restore forest heath and resiliency, including for forest soils and watersheds; or</text></clause><clause id="HF035560E01DE4665BE3030702226BEFD"><enum>(v)</enum><text>any combination of purposes specified in clauses (i) through (iv);</text></clause></subparagraph><subparagraph id="H6FF4291274CB45AC8CA720C6520B610C"><enum>(D)</enum><text>are located in local markets that have the greatest need for the biochar production units due to—</text><clause id="H58FC220103F547B7A97CD6EAA439B19B"><enum>(i)</enum><text>nearby lands identified as having high or very high or extreme risk of wildfire;</text></clause><clause id="HC732F46FFE974A0C83A2D1034C2250F8"><enum>(ii)</enum><text>availability of sufficient quantities of feedstocks; or</text></clause><clause id="H1D0827AB043249149A078B48492D9BF7"><enum>(iii)</enum><text>a high level of demand for biochar or other commercial byproducts of biochar; or</text></clause></subparagraph><subparagraph id="HA708AEF970354281AF6708F5B1289164"><enum>(E)</enum><text>any combination of purposes specified in subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="H99C9701087244214941207986CB45A0F"><enum>(4)</enum><header>Use of funds</header><text>In carrying out the program established under paragraph (1)(A), the Secretaries may enter into partnerships and provide funding to carry out demonstration projects that—</text><subparagraph id="HFAE3089B34B54F1EBD3A5305CB9EF0C8"><enum>(A)</enum><text>acquire and test various feedstocks and their efficacy;</text></subparagraph><subparagraph id="H870207C325E846D8B95891600A40A7B1"><enum>(B)</enum><text>develop and optimize commercially and technologically viable biochar production units, including mobile and permanent units;</text></subparagraph><subparagraph id="HBD3E07B0C6634AA381E91BF1D88E5A4D"><enum>(C)</enum><text display-inline="yes-display-inline">demonstrate the production of biochar from forest residues and the use of biochar to restore forest health and resiliency;</text></subparagraph><subparagraph id="H7E595E133B5C47E2A8CF419787AAE151"><enum>(D)</enum><text>build, expand, or establish biochar facilities;</text></subparagraph><subparagraph id="HBD30205C1EEC44C291A37B39ED099AB9"><enum>(E)</enum><text display-inline="yes-display-inline">conduct research on new and innovative uses of biochar or demonstrate cost-effective market opportunities for biochar and biochar-based products;</text></subparagraph><subparagraph id="H5E40B7DA6044440AA13EA3890ADAA964"><enum>(F)</enum><text>carry out any other activities the Secretaries determine appropriate; or</text></subparagraph><subparagraph id="HB430C776C8E74B86A456D8450987AB5B"><enum>(G)</enum><text display-inline="yes-display-inline">any combination of the purposes specified in subparagraphs (A) through (F). </text></subparagraph></paragraph><paragraph id="H4E44B361F0274942AB3E591BC0A4AEA1"><enum>(5)</enum><header>Feedstock requirements</header><text>To the maximum extent practicable, a biochar demonstration project under this subsection shall, with respect to the feedstock used under such project, derive at least 50 percent of such feedstock from forest thinning and management activities, including mill residues, conducted on National Forest System lands.</text></paragraph><paragraph id="HEAF83DFB59F8460089E8FEF1F99CED2A"><enum>(6)</enum><header>Review of biochar demonstration</header><subparagraph id="H2F27488775DF48428597204D410D287B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretaries shall conduct regionally specific research, including economic analyses and life-cycle assessments, on the biochar produced from the demonstration projects under this subsection, including—</text><clause id="HD17004FB71D442BABE024D518017C7E9"><enum>(i)</enum><text>the effects of such biochar on—</text><subclause id="H0020F036E1A5426AB21FE77485C18792"><enum>(I)</enum><text>forest health and resiliency;</text></subclause><subclause id="HF904B917C1684B7F94DF95861FD6B198"><enum>(II)</enum><text>carbon capture and sequestration, including increasing soil carbon in the short-term and long-term;</text></subclause><subclause id="H87AB317A46BF4EBC9A5AB16DA2C7C844"><enum>(III)</enum><text>productivity, reduced input costs, and water retention in agricultural practices;</text></subclause><subclause id="HDE550ECEE512420B9D58ECAD59920593"><enum>(IV)</enum><text>soil and grassland health for grazing activities, including grazing activities on Federal land;</text></subclause><subclause id="H81D6CC34AFE44A459B5B0D2734352125"><enum>(V)</enum><text>environmental remediation activities, including abandoned mine land remediation; and</text></subclause><subclause id="HB1B95281B3C944459BFF1E514C494538"><enum>(VI)</enum><text display-inline="yes-display-inline">other ecosystem services of biochar;</text></subclause></clause><clause id="H598B9A05A85A4E5095A14AFF78AB93E3"><enum>(ii)</enum><text display-inline="yes-display-inline">the efficacy of biochar as a co-product of biofuels or in biochemicals; and </text></clause><clause id="H4320FA7D12664E7799C0E59114ED5D7E"><enum>(iii)</enum><text>whether biochar can effectively be used to produce any other technologically and commercially viable outcome.</text></clause></subparagraph><subparagraph id="HC39D6B09C2884C43A4CA9501F9F360AE"><enum>(B)</enum><header>Coordination</header><text>The Secretaries shall, to the maximum extent practicable, provide data, analysis, and other relevant information collected under subparagraph (A) to eligible institutions conducting research and development activities on biochar pursuant to receiving a grant under subsection (b).</text></subparagraph></paragraph><paragraph id="H3D0669D86A35469AA983B4F4DB5952D7"><enum>(7)</enum><header>Limitation on funding for establishing biochar facilities</header><text>In the case of an eligible entity that enters in to a partnership to carry out a biochar demonstration project under this subsection and seeks to establish a biochar facility under such demonstration project, the Secretaries may not provide funding to such eligible entity in an amount greater than 35 percent of the capital cost of establishing such biochar facility. </text></paragraph></subsection><subsection id="H45BD6AB7233941DBB135D8345AB5D4A1"><enum>(b)</enum><header>Biochar research and development grant program</header><paragraph id="H8E2EA7195DDF42858BEDDCE4637F7D20"><enum>(1)</enum><header>Establishment</header><text>The Secretary of Agriculture shall establish an applied biochar research and development grant program to make competitive grants to eligible institutions to carry out the activities described in paragraph (3).</text></paragraph><paragraph id="H352F0C94711441C3B5D90EE654FD8DB7"><enum>(2)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this subsection, an eligible entity shall submit to the Secretary a proposal at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="H2F4320FF9D7A44DD833FDF2EE461BF83"><enum>(3)</enum><header>Use of funds</header><text>An eligible institution that receives a grant under this subsection shall use the grant funds to conduct applied research on—</text><subparagraph id="H0876E7F2B52C467984BA9E35FC1508E6"><enum>(A)</enum><text>the effect of biochar on forest health and resiliency, accounting for variations in biochar, soil, climate, and other factors;</text></subparagraph><subparagraph id="H6924CEE565BB42F798294D8A624921C5"><enum>(B)</enum><text display-inline="yes-display-inline">the effect of biochar on soil health and water retention, accounting for variations in biochar, soil, climate, and other factors;</text></subparagraph><subparagraph id="H1AC17AFD757C42ED94F24E5AF4396363"><enum>(C)</enum><text>the long-term carbon sequestration potential of biochar;</text></subparagraph><subparagraph id="H8D0C536033584B789BF450F156EF3330"><enum>(D)</enum><text>the best management practices of biochar and biochar based-products to—</text><clause id="H568DFC0DD51D456DA9F8C7C65FAE8819"><enum>(i)</enum><text>maximize carbon sequestration benefits; and</text></clause><clause id="H5BE77022D04E446EA905A2BA297B4A71"><enum>(ii)</enum><text>maximize the commercial viability and application of such products in forestry, agriculture, environmental remediation, water quality improvement, and other uses;</text></clause></subparagraph><subparagraph id="H4F46CD53C1BB4D0293B6977845662B5F"><enum>(E)</enum><text>the regional uses of biochar to increase productivity and profitability, including—</text><clause id="H4A9EFEE6DE48466F9F7F585CE09276C4"><enum>(i)</enum><text>uses in agriculture and environmental remediation; and</text></clause><clause id="H7062A035F0034815A23AE1F8E5A97218"><enum>(ii)</enum><text>use as a co-product in fuel production;</text></clause></subparagraph><subparagraph id="H43B49336F8E54B1DA86CFA154AFEA6A8"><enum>(F)</enum><text>new and innovative uses from biochar byproducts; and</text></subparagraph><subparagraph id="H664E1EEE51CF4660BC180C5D7FD9A84E"><enum>(G)</enum><text>opportunities to expand markets for biochar and create jobs, particularly in rural areas.</text></subparagraph></paragraph></subsection><subsection id="H1BDB72F9C73541F797B86B6B93C15377"><enum>(c)</enum><header>Reports</header><paragraph id="H07FA212E183B41488F0529517F05C7F4"><enum>(1)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section, the Secretaries shall submit a report to Congress that—</text><subparagraph id="H0155D0E31B134437906D9B5F173FA53B"><enum>(A)</enum><text display-inline="yes-display-inline">includes policy and program recommendations to improve the widespread use of biochar;</text></subparagraph><subparagraph id="HA607D45A7DD248B3AD6E188288890479"><enum>(B)</enum><text>identifies the areas of research needed to advance biochar commercialization; and</text></subparagraph><subparagraph id="HB42360CAA5D64928956EB3FBF1D88FEA"><enum>(C)</enum><text display-inline="yes-display-inline">identifies barriers to further biochar commercialization, including permitting and siting considerations.</text></subparagraph></paragraph><paragraph id="HBE39B302BC32499D9B41CC4E4DC91EEB"><enum>(2)</enum><header>President’s annual budget request</header><text display-inline="yes-display-inline">Beginning 2 years after the date of the enactment of this section and annually until the date described in subsection (d), the Secretaries shall include in the budget materials submitted to Congress in support of the President’s annual budget request (submitted to Congress pursuant to section 1105 of title 31, United States Code) for each fiscal year a report on the status of the demonstration projects carried out under subsection (a) and the research and development grants carried out under subsection (b).</text></paragraph></subsection><subsection id="HA3B3A01A4C6648EC8C18EDC8D831F175"><enum>(d)</enum><header>Sunset</header><text>The authority to carry out this section shall terminate on the date that is 10 years after the date of the enactment of this section.</text></subsection><subsection id="HF82343B9D3584B2E8B7E1E45DDEE693D"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5E6F69D156C3486C8292772A3D9CE75A"><enum>(1)</enum><header>Biochar</header><text display-inline="yes-display-inline">The term <term>biochar</term> means carbonized biomass produced by converting feedstock through reductive thermal processing for non-fuel uses.</text></paragraph><paragraph id="H582E33A5470143E59AD23D858FEBBDE7"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H8916BFFCF0A1432395CC8F2663B9817E"><enum>(A)</enum><text>State, local, and Tribal governments;</text></subparagraph><subparagraph id="HAC704F14E73E4CB29893D7A57C9052F6"><enum>(B)</enum><text>eligible institutions; and</text></subparagraph><subparagraph id="HCEA7FEEA82874F2CA5347D7864B109A8"><enum>(C)</enum><text>private, non-private, or cooperative entities.</text></subparagraph></paragraph><paragraph id="H026040AE83E6438EB26A651F1E345EC6"><enum>(3)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means land-grant colleges and universities, including institutions eligible for funding under the—</text><subparagraph id="HE88F5B8DD4C340049E0BE55FC4582009"><enum>(A)</enum><text>Act of July 2, 1862;</text></subparagraph><subparagraph id="HBC8DCC62B23543CE81BD93B41CB9D959"><enum>(B)</enum><text>Act of August 30, 1890, including Tuskegee University;</text></subparagraph><subparagraph id="H48A267F0EBCE4B90B6269F30417CF912"><enum>(C)</enum><text display-inline="yes-display-inline">Public Law 87–788 (commonly known as the <quote>McIntire-Stennis Act of 1962</quote>); or</text></subparagraph><subparagraph id="HDD3D8AA604A6443084D7D8B15C9AB94C"><enum>(D)</enum><text>Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note). </text></subparagraph></paragraph><paragraph id="H21D2B74D19EC47909267D214A7A6EF56"><enum>(4)</enum><header>Feedstock</header><text>The term <term>feedstock</term> means excess biomass in the form of plant matter or materials that serves as the raw material for the production of biochar.</text></paragraph><paragraph id="H48621B38BBBF4F4EA9801436E7E64C47"><enum>(5)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means—</text><subparagraph id="H6DE59E44C47B4B75A88134CE15CC3464"><enum>(A)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service; and</text></subparagraph><subparagraph id="HF2312D67A307481AA789DE5E2878FD97"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Energy, acting through the Director of the Office of Science.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
