R. 2580</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210415">April 15, 2021</action-date><action-desc><sponsor name-id="H001081">Mrs. Hayes</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for a presumption of service connected disability for certain veterans who served in Palomares, Spain, and for other purposes.</official-title></form><legis-body id="H11BFBF2D69954129AC5980CB698060BE" style="OLC"><section id="HD51829DFF8C84FE88CC1543644A16FA1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Palomares Veterans Act of 2021</short-title></quote>.</text></section><section id="HA8A46440664640BC8AD80F010132717C"><enum>2.</enum><header>Presumption of service connected disability for certain veterans who served in Palomares, Spain</header><subsection id="H25BBA537177F4FEABA8AD05CB0741B74"><enum>(a)</enum><header>Disability compensation</header><text display-inline="yes-display-inline">Section 1112(c)(3)(B) of title 38, United States Code, is amended by adding at the end the following new clause:</text><quoted-block display-inline="no-display-inline" id="H09371B36DD654660B1E9FD45A7D95556" style="OLC"><clause id="HF866CF654A934AA197524EB2831DAF56" indent="up1"><enum>(v)</enum><text>Onsite participation in the response effort following the collision of a United States Air Force B–52 bomber and refueling plane that caused the release of four thermonuclear weapons in the vicinity of Palomares, Spain, during the period beginning January 17, 1966, and ending March 31, 1967.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1AED24FE7F0344DA834E2FD4F71DD590"><enum>(b)</enum><header>Effective date and applicability</header><paragraph id="H3BA7FEFC39E247738DD6B774BC2AD2AF"><enum>(1)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act.</text></paragraph><paragraph id="H9D45B358A9CC44A59727938CB826CD12"><enum>(2)</enum><header>Applicability concerning dependency and indemnity compensation</header><text>For purposes of section 1310 of title 38, United States Code, the amendment made by subsection (a) shall apply with respect to a death notwithstanding whether such death occurred before, on, or after such date.</text></paragraph></subsection></section></legis-body></bill>
