which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To address the nationwide shortage of tree seedlings, and for other purposes.</official-title></form><legis-body id="HFDBFC55B9B0C4D7EAA6462E005291DB8" style="OLC"><section id="HE9428056CC9F449893DCE48B66DC90C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Solving Our Shortages for Seedlings Act</short-title></quote> or the <quote><short-title>SOS for Seedlings Act</short-title></quote>.</text></section><section id="HB4C2E168AA8B499BB30164CC11B5AC61"><enum>2.</enum><header>Seedling strategy</header><subsection id="HD882F14A79A64D5C9A8C39ADEC502266"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretary of Agriculture, acting through the Chief of the Forest Service, shall develop and implement a national strategy to increase the capacity of Federal, State, Tribal, and private nurseries to address the nationwide shortage of tree seedlings.</text></subsection><subsection id="H1F10DB78BB174E2A86F54657470276DD"><enum>(b)</enum><header>Elements</header><text>The strategy required under subsection (a) shall—</text><paragraph id="H8BC72DD9AA014EEA971CE5561B220324"><enum>(1)</enum><text>be based on the best available science and data; and</text></paragraph><paragraph id="H8753B9214F704D07A8D83E6C2A0D4A41"><enum>(2)</enum><text>identify and address—</text><subparagraph id="HE2C17917C652414D8029E9E9543B969B"><enum>(A)</enum><text display-inline="yes-display-inline">regional seedling shortages of bareroot and container tree seedlings;</text></subparagraph><subparagraph id="HFBDC184B261C42F7991E019E5B079766"><enum>(B)</enum><text>regional reforestation opportunities and the seedling supply necessary to fulfill such opportunities; </text></subparagraph><subparagraph id="H02E43576622841E69C63D7BDD85F90EE"><enum>(C)</enum><text>opportunities to enhance seedling diversity and close gaps in seed inventories; and</text></subparagraph><subparagraph id="HC8F5E9BD2A3040C6AC8CA0E7C8C916C2"><enum>(D)</enum><text>barriers to expanding, enhancing, or creating new infrastructure to increase nursery capacity.</text></subparagraph></paragraph></subsection></section><section id="HC4669CF31E41432D9A37652DD35EF4E4"><enum>3.</enum><header>Federal nurseries</header><text display-inline="no-display-inline">Section 2 of the Act of June 9, 1930 (<external-xref legal-doc="usc" parsable-cite="usc/16/576a">16 U.S.C. 576a</external-xref>; commonly known as the <quote>Knutson-Vandenberg Act</quote>), is amended by striking <quote>each fiscal year after year ending June 30, 1934, not to exceed $400,000,</quote> and inserting <quote>each of fiscal years 2021 through 2030, $25,000,000,</quote>.</text></section><section id="H410CEFF473D64FB4A1476EFC76C0EB05"><enum>4.</enum><header>Loan program for State, Tribal, and private nurseries</header><subsection id="H2EC0F4AF1F584A489D92773357ED7CF8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall carry out a loan program to make or guarantee qualified nursery loans to eligible entities under this section.</text></subsection><subsection id="HA8CF0E1343DC42F4A57B667A5DE71E2D"><enum>(b)</enum><header>Application</header><text>To be eligible to receive a qualified nursery loan or loan guarantee under this section, an eligible entity shall submit to the Secretary of Agriculture an application at such time, in such manner, and containing such information as the Secretary may require, including a plan to maintain the genetic and physical quality of seedlings of the eligible entity.</text></subsection><subsection id="H844BF81B17CE4AAB86C93F49D7694076"><enum>(c)</enum><header>Priority</header><text>In making qualified nursery loans or loan guarantees under this section, the Secretary of Agriculture shall give priority to eligible entities that—</text><paragraph id="H7660386A55FA49E9A0E67A0311283EDA"><enum>(1)</enum><text>are small businesses, in particular small businesses located in rural areas;</text></paragraph><paragraph id="HCD62A4E4297946E297A0F6E3FD65AFBB"><enum>(2)</enum><text>create or support jobs, particularly in rural areas; and</text></paragraph><paragraph id="H65EE2FE8B3FB48EDBC2B13B693FFDB72"><enum>(3)</enum><text>serve regions with high demand for reforestation. </text></paragraph></subsection><subsection id="H3687830280904675986DB6A58756C74D"><enum>(d)</enum><header>Qualified nursery project</header><text>A loan or loan guarantee under this section may only be used to carry out a qualified nursery project to—</text><paragraph id="HE41592DDFF394155990DEC5F562ACCAD"><enum>(1)</enum><text>develop, expand, enhance, or improve nursery capacity or infrastructure;</text></paragraph><paragraph id="H304E02E263B448798BFD88EFEC55EFFE"><enum>(2)</enum><text>establish nurseries; or</text></paragraph><paragraph id="HE590DA825B894EACBA5CA113224E96E1"><enum>(3)</enum><text>develop or implement quality control measures at nurseries.</text></paragraph></subsection><subsection id="HBB8A588ED43C402DB3B9AA987F1E1C72"><enum>(e)</enum><header>Loan and loan guarantee terms</header><paragraph id="H9B69591F61104B9DA1F402FDFA3112A7"><enum>(1)</enum><header>Amount guaranteed</header><text>The portion of a loan that the Secretary of Agriculture may guarantee under this section may not be greater than 80 percent of the principal amount of such loan.</text></paragraph><paragraph id="HAAB03B9EA32D414BAA13EF8B8112169C"><enum>(2)</enum><header>Repayment</header><text>The period of repayment for a loan made under this section shall not exceed 20 years.</text></paragraph></subsection><subsection id="H6D779B585FEF4D99B50CEF08C1E81CA4"><enum>(f)</enum><header>Administrative provisions</header><paragraph id="HED1EB1F2EF354770A1FEE3FD5D6E6DB7"><enum>(1)</enum><header>Limitation on authority</header><text>The total amount of qualified nursery loans made or guaranteed under this section by the Secretary may not exceed $1,000,000,000.</text></paragraph><paragraph id="H095BA87F5F9846D2B198749ACEA05540"><enum>(2)</enum><header>Distribution</header><text>The Secretary shall ensure, to the maximum extent practicable, that loans made or guaranteed under this section are distributed across diverse geographic regions.</text></paragraph></subsection><subsection id="H6DB025BB380B453687D5E301F247BC91"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HCCDAFE07A828401BB77A65CF7C779DFA"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="HBFCE37C1D8084B61803CB1A609B9DB7B"><enum>(A)</enum><text>a State, Tribal, or local government; or </text></subparagraph><subparagraph id="H1CD5E50998BE49588D33BCBBC30BC393"><enum>(B)</enum><text>a domestic private, non-profit, or cooperative organization. </text></subparagraph></paragraph><paragraph id="HE8F5FB7B1C784C2CA0510889638BEE66"><enum>(2)</enum><header>Nursery</header><text>The term <term>‘nursery</term> means a State, Tribal, or local government or private owned facility that grows, stores, extracts, or monitors bareroot or container tree seedlings.</text></paragraph><paragraph id="H058867749AFF4135B34A7F1C321EFA49"><enum>(3)</enum><header>Qualified nursery loan</header><text display-inline="yes-display-inline">The term <term>qualified nursery loan</term> means a low-interest loan, the proceeds of which are used to cover the costs to the borrower of carrying out a qualified nursery project described in subsection (d).</text></paragraph></subsection></section></legis-body></bill>
