<official-title display="yes">To require the Secretary of Transportation to issue regulations relating to the authorization of foreign manufacturers of cylinders, and for other purposes.</official-title>

<section id="H39DCCEA8EEF24B12B552C0B64F04F4AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Compressed Gas Cylinder Safety and Oversight Improvements Act of 2021</short-title></quote>.</text></section> <section id="HD929790E1DF04E9985416BD98C7556BE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text>
<paragraph id="H96BA35364D12428DB975E54973B3D094"><enum>(1)</enum><header>Foreign manufacturer of cylinders; FMOC</header><text>The terms <quote>foreign manufacturer of cylinders</quote> and <quote>FMOC</quote> mean an entity that manufactures cylinders outside of the United States intended to be represented, marked, certified, or sold as qualified for use in transporting hazardous material in commerce in the United States.</text></paragraph> <paragraph id="HAD953D19B6454045934845AEC7EFE769"><enum>(2)</enum><header>In good standing</header><text>The term <quote>in good standing</quote> means an FMOC that—</text>
<subparagraph id="H7A6F9477C5614DA29204270C4BBFB410"><enum>(A)</enum><text>is has been authorized by the Secretary pursuant to section 107.807 of title 49, Code of Federal Regulations; and</text></subparagraph> <subparagraph id="HC2A8D77B42D54E738E2AA4C3378459ED"><enum>(B)</enum><text>has demonstrated 3 years of compliance with section 107 of title 49, United States Code, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">chapter 51</external-xref> of title 49, United States Code.</text></subparagraph></paragraph>
<paragraph id="H109A3A0964424B4B843E4636A73D5AA9"><enum>(3)</enum><header>Cylinder</header><text>The term <quote>cylinder</quote> means any cylinder specified under sections 178.36 through 178.68 of title 49, Code of Federal Regulations.</text></paragraph> <paragraph id="H1C4DBCDC8FC34BE095B3A2AFEAF33D36"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Transportation.</text></paragraph></section>
<section id="H3353DF793D3341CEB0B13FF1CBCBB991"><enum>3.</enum><header>Authorization of foreign manufacturer of cylinders</header>
<subsection id="HF9388691D91346C4A43F56E155E8C63F"><enum>(a)</enum><header>In General</header><text>The Secretary shall issue regulations to provide that an authorization provided to an FMOC pursuant to section 107.807 of title 49, Code of Federal Regulations, or any similar successor regulation, shall be for a period of not longer than 1 year, except as provided for in subsection (b).</text></subsection> <subsection id="HE24AC73B28934E269A77250DCD94BE9C"><enum>(b)</enum><header>5-Year authorization</header><text display-inline="yes-display-inline">The Secretary may approve a 5-year authorization of an FMOC pursuant to such section if the following requirements are met:</text>
<paragraph id="HD76D4BD03F174BC38861822A068CC8B2"><enum>(1)</enum><text>The FMOC attests that none of the cylinders made by such manufacturer are prohibited from entry to the United States under section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>).</text></paragraph> <paragraph id="H0FA293450FC34D9482D5140F3AAC05D5"><enum>(2)</enum><text>The FMOC certifies that—</text>
<subparagraph id="HFE0B55D5AEFA47EE8EADFE97AB6093F2"><enum>(A)</enum><text>the information provided pursuant to section 7 is accurate; and</text></subparagraph> <subparagraph id="H43826FE4C38F46209C6A80799451F73B"><enum>(B)</enum><text>the FMOC has a proactive responsibility to inform the Secretary if any such information materially changes.</text></subparagraph></paragraph>
<paragraph id="H0A50CACFC6B94E8A8DCA3748260DB13A"><enum>(3)</enum><text>The FMOC provides proof of the minimum financial responsibility required under section 4.</text></paragraph> <paragraph id="H5B2C2EC511EC4C35B7DFA1EC64C61B1E"><enum>(4)</enum><text>The Secretary determines the FMOC is in good standing.</text></paragraph></subsection>
<subsection id="H6FC98F6AF95E4C0F8CD9A00E6DB5F273"><enum>(c)</enum><header>Facility inspections</header>
<paragraph id="HC89130BF63914E42A7BE665DF6BF5CC6"><enum>(1)</enum><header>Penalties</header><text>The Secretary may suspend or terminate an authorization of an FMOC described in this Act if such FMOC obstructs or prevents the Secretary from carrying out an inspection under section 107.807(c) of title 49, Code of Federal Regulations.</text></paragraph> <paragraph id="H02C8BB4091214243864A861F6141C8AD"><enum>(2)</enum><header>Definition of obstructs</header><text>For the purposes of this subsection, the term <quote>obstructs</quote> means taking actions that are known, or reasonably should be known, to prevent, hinder, or impede an inspection.</text></paragraph></subsection>
<subsection id="H5BFFCFEE5B984EA4857D4D14A993B048"><enum>(d)</enum><header>Interaction with other statutes, agreements, regulations</header><text>Nothing in this section may be construed to prevent the harmonization of cylinder standards otherwise authorized by law or regulation. </text></subsection> <subsection id="HE560F8E2D63F4283ADA259DAE86CFD3E"><enum>(e)</enum><header>Other cause for suspension or termination</header><text>The Secretary may suspend or terminate an authorization of an FMOC described in this Act upon determination that the FMOC knowingly or intentionally misrepresented responses to the Secretary required by law or regulation or the requirements of sections 4 and 7.</text></subsection></section>
<section id="HF89BE5CAD5D04A73AD45E64D537E4C21"><enum>4.</enum><header>Proof of minimum financial responsibility required at time of application</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall issue such regulations as are necessary to establish minimum levels of financial responsibility required for entities to receive approval pursuant to section 107.807 of title 49, Code of Federal Regulations.</text></section> <section id="HB1467757C194405DBFDFF1DC4665F091"><enum>5.</enum><header>Reevaluation by request for related violations</header> <subsection id="H4F38FE9BBA4A489FAA31CEDF3EB7EAAC"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall issue such regulations as necessary to establish a process for any interested party to request a reevaluation of the authorization of FMOC cylinders under section 107.807 of title 49, Code of Federal Regulations, to review the accuracy and safety of the actions of such manufacturer.</text></subsection>
<subsection id="H0FBE34F32F1346A69F77202C83FCB309"><enum>(b)</enum><header>Petition for reevaluation</header><text>Such regulations shall allow an interested party to file a petition if such party has evidence of inaccurate, changed, or fraudulent attestations or responses made by an FMOC to the Secretary under section 3 or 7.</text></subsection></section> <section id="HA279DF4D0FF04E09BBDC28B0CA4FC671"><enum>6.</enum><header>Notice and comment for applications by foreign manufacturers of cylinders</header><text display-inline="no-display-inline">Upon receipt of an application for approval under section 107.807 of title 49, Code of Federal Regulations, or any similar successor regulation, the Secretary shall timely publish notification of such application in the Federal Register and provide 30 days for public comment on such application prior to approval.</text></section>
<section id="H1BFC6C038783495EA5DCB0B7C487246F"><enum>7.</enum><header>Additional questions to ensure safety and compliance with DOT process</header>
<subsection id="H830B09C3377D401CBDC9822DF9E73E1F"><enum>(a)</enum><header>Additional questions</header><text>The Secretary shall require as part of an application for approval pursuant to section 107.807 of title 49, Code of Federal Regulations, or any similar successor regulation, that the applicant answer the following questions:</text> <paragraph id="HF0DA85DA1FE84BBC9600DE93499A7090"><enum>(1)</enum><text>Whether the FMOC applying, or any entity controlling more than 10 percent of such FMOC, has ever been subject to a civil monetary penalty under title 49, United States Code, relating to any actions carried out as an authorized FMOC or during the application for authorization under such section.</text></paragraph>
<paragraph id="H2AA30015325A4C238B84709445A13FD2"><enum>(2)</enum><text display-inline="yes-display-inline">Whether the FMOC applying, or any entity controlling more than 10 percent of such FMOC, has been delinquent in the payment of any civil monetary penalties or other fines or fees under title 49, United States Code.</text></paragraph> <paragraph id="HF84A3779D56947BE8CA61C3AB91B11ED"><enum>(3)</enum><text display-inline="yes-display-inline">Whether the FMOC applying, or any entity controlling more than 10 percent of such FMOC, is subject to the Do Not Pay Initiative established under section 3354 of title 31, United States Code, as of the date of application.</text></paragraph>
<paragraph id="HD4D17731E0104EB8A0636FA82D54431D"><enum>(4)</enum><text display-inline="yes-display-inline">Whether the FMOC applying, or any entity controlling more than 10 percent of such FMOC, is listed in the Military End User List of the Department of Commerce as of the date of application.</text></paragraph> <paragraph id="H848FDABBE9BE410DB820070A9B5FDDB9"><enum>(5)</enum><text display-inline="yes-display-inline">Whether the FMOC applying, or any entity controlling more than 10 percent of such FMOC, is identified by the Department of Defense as an entity listed under section 1237 of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) as of the date of application.</text></paragraph>
<paragraph id="H97C801F0D7E944CD8EA87CD60F1F9734"><enum>(6)</enum><text>Does the FMOC applying certify that the FMOC has the requisite minimum financial responsibility as required in section 4, and that such financial responsibility will continue throughout entirety of the requested authorization period.</text></paragraph> <paragraph id="H52C5AB5AF9384D1C85DCC96D938C7559"><enum>(7)</enum><text display-inline="yes-display-inline">Whether the FMOC applying, or any entity controlling more than 10 percent of such FMOC, has been found guilty of a criminal penalty or assessed a civil penalty under section 1760 John S. McCain National Defense Authorization Act for Fiscal Year 2019 section (<external-xref legal-doc="usc" parsable-cite="usc/50/4819">50 U.S.C. 4819</external-xref>).</text></paragraph>
<paragraph id="HCA2456CE76D24CC2873B193EF33392ED"><enum>(8)</enum><text display-inline="yes-display-inline">Whether the FMOC applying, or any entity controlling more than 10 percent of such FMOC, is currently subject to a final antidumping or countervailing duty order from the Department of Commerce as of the date of application.</text></paragraph></subsection> <subsection id="H519468C059BD4343A03E2D9F83D88639"><enum>(b)</enum><header>Denial of application</header><text>The Secretary may deny an application for approval under section 107.807 of title 49, Code of Federal Regulations, based on the responses to the questions required under subsection (a).</text></subsection></section>
<section id="H060B6EA8D3F04D15B1A98E1AD76D87BF"><enum>8.</enum><header>Foreign manufacturers listing approvals</header><text display-inline="no-display-inline">Not less than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall publish and maintain on the website of the Department of Transportation, a list of authorized FMOCs and the duration of such authorization.</text></section> <section id="HDCBB2199390848399EDF8839A32EC128"><enum>9.</enum><header>Authorizing foreign inspections</header><text display-inline="no-display-inline">Not less than 180 days after the date of enactment of this Act, the Secretary shall update section 107.807(d) of title 49, Code of Federal Regulations, to—</text>
<paragraph id="HAA781BB9BD514D559FE2BDD4CC3A7E1E"><enum>(1)</enum><text>require that in any case in which the Associate Administrator determines there is good cause, an inspection under such section shall be carried out annually for such duration as the Associated Administrator determines appropriate; </text></paragraph> <paragraph id="HA4DB41502A5E44FB830ECEC03F143CDF"><enum>(2)</enum><text>specify that a refusal of inspection under such section shall result in a loss of a status of in good standing;</text></paragraph>
<paragraph id="HE1D80803A8D04D93A935602312BBF985"><enum>(3)</enum><text>allow the Associate Administrator to request at the discretion of the Administrator, production of test and production records and random sample testing; and</text></paragraph> <paragraph id="HA9F996619ABB49058C21918E042309C0"><enum>(4)</enum><text>allow for the recovery of all associated costs of foreign inspections to include travel, time, and other costs, as determined by the Secretary.</text></paragraph></section>
