which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Nutrition Act of 1966 to establish a grant program to provide grants to local agencies and clinics to improve the health of mothers and infants, and for other purposes.</official-title></form><legis-body id="H84D81B2E37E145C4BAE2E48A3C83E039" style="OLC"><section id="HA519B242E3F542DFB7D6437C9E129B3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Access, Resources, and Education for Families Act</short-title></quote> or the <quote><short-title>CARE for Families Act</short-title></quote>.</text></section><section id="H99DCBFF8C296465EB2D74D6E3BA28514"><enum>2.</enum><header>Funds for community health partnership outreach</header><text display-inline="no-display-inline">Section 17(h) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(h)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5CCE2318829D41B2B8C2CE8EF5BE0187" style="OLC"><paragraph id="HA0654DEF9740471291C0A35F162F77D2"><enum>(15)</enum><header>Community health partnerships grants</header><subparagraph id="HE5E5DEC9139941F9AE4E2DD54C17446F"><enum>(A)</enum><header>Program established</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph, the Secretary shall carry out a grant program to make grants to local agencies and clinics to carry out the activities described in subparagraph (B).</text></subparagraph><subparagraph id="H0D626BE14BDF47A69D4536525E521DBD"><enum>(B)</enum><header>Grant program activities</header><text>A local agency or clinic that receives a grant under this paragraph shall use the grant funds to carry out activities to enhance collaboration between—</text><clause id="HDA8511499587477CA2D5F0C26B68EDF5"><enum>(i)</enum><text>local agencies, clinics, and community health partners, including other health care providers, social services programs, and early childhood learning and care providers, for the purposes of—</text><subclause id="H4E511355ACA64DDB903D85F8868AD48B"><enum>(I)</enum><text display-inline="yes-display-inline">establishing linkages between such entities, such as through participation in community coalitions;</text></subclause><subclause id="H4C866C6FBB9442E283650A63839C35FF"><enum>(II)</enum><text>facilitating referrals between such entities;</text></subclause><subclause id="HEB0AC45056ED4B1CA4F4CB51B9935CCE"><enum>(III)</enum><text>implementing evidence-based strategies to—</text><item id="HDB71F88C1BCF4740AF541A96C5ADF089"><enum>(aa)</enum><text>improve the health of communities;</text></item><item id="H4A8F33386D36472EA1B4BE754ACC9B3B"><enum>(bb)</enum><text>conduct outreach to potential program participants; and</text></item><item id="H563C17581F994BD6B917EEB5CFB60DCD"><enum>(cc)</enum><text>promote breastfeeding and access to healthy foods; and</text></item></subclause><subclause id="HC0B74D9F6E604B57BB2AFC188A29263B"><enum>(IV)</enum><text display-inline="yes-display-inline">increasing awareness among such entities and program participants (including potential program participants) of the eligibility requirements for, and health benefits of, the program; and</text></subclause></clause><clause id="H932774AEA6EA495FAAC5B02A0AE5F65A"><enum>(ii)</enum><text>local agencies, clinics, and health care entities for the purposes of—</text><subclause id="H37E7FD77DD8A4039A517B04B0F55224A"><enum>(I)</enum><text display-inline="yes-display-inline">facilitating and improving access to comprehensive prenatal, postnatal, and postpartum care for program participants;</text></subclause><subclause id="H2D2025550E334FA7B6FD7C193622E85E"><enum>(II)</enum><text display-inline="yes-display-inline">facilitating certification of eligibility of persons for participation in the program and provision of program benefits at the hospital bedside for eligible postpartum women and infants;</text></subclause><subclause id="H5C7A111345744C5789F32F7E35AD8522"><enum>(III)</enum><text display-inline="yes-display-inline">improving the coordination, quality, and cost effectiveness of health care services; and</text></subclause><subclause id="HBB127CE9526A497895D591139F271366"><enum>(IV)</enum><text display-inline="yes-display-inline">ensuring consistent nutrition education and breastfeeding messages are provided to program participants.</text></subclause></clause></subparagraph><subparagraph id="H0067EF3F5A884629B05F4270D8C29634"><enum>(C)</enum><header>Application</header><text>To be eligible to receive a grant under this paragraph, a local agency or clinic shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph><subparagraph commented="no" id="HF0D12BE691D948F38D4A1B40F45A668F"><enum>(D)</enum><header>Authorization of appropriations</header><clause commented="no" id="HE606538B0A8A471CA96EFB8191C24C67"><enum>(i)</enum><header>In general</header><text>From amounts appropriated under subsection (g), $15,000,000 may be made available to carry out this paragraph for each of fiscal years 2020 through 2025. </text></clause><clause commented="no" id="HD4AFCCB99CB949F29E94EF730B2A5C4D"><enum>(ii)</enum><header>Adjustment</header><text display-inline="yes-display-inline">The amount specified in clause (i) shall be adjusted annually for inflation by the same factor used to determine the national average per participant grant for nutrition services and administration for the fiscal year under paragraph (1)(B).</text></clause></subparagraph><subparagraph id="H9042C2061F7A46BBB1829938616F632E"><enum>(E)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause id="H2B87892F01B648AE868A61B4551C3F9C"><enum>(i)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the special supplemental nutrition program under this section.</text></clause><clause id="HAE08FD5F24F34835B10F65DB39FE29FD"><enum>(ii)</enum><header>Program participant</header><text display-inline="yes-display-inline">The term <term>program participant</term> means a participant in the program.</text></clause><clause id="H127089743F294AF98182D82E97B50C0F"><enum>(iii)</enum><header>Health care entities</header><text>The term <term>health care entities</term> includes pediatricians, obstetricians-gynecologists, family physicians, advance practice nurses, nurse midwives, community health centers, health departments, hospitals, facilities funded by the Indian Health Service and rural health clinics.</text></clause></subparagraph></paragraph><paragraph id="H32C3F50832C343EB900680BC0146AD5E" commented="no"><enum>(16)</enum><header>Initiative for coordinating health information exchange</header><subparagraph id="H295E6CFD7998425F92E3AC577C5E2D10" commented="no"><enum>(A)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this paragraph, the Secretary shall establish an initiative to improve communication between State agencies and local agencies and medical providers with respect to program participant health information related to services provided under the program.</text></subparagraph><subparagraph id="H95D45ADF03E44B19BFF280CB0DC0105F" commented="no"><enum>(B)</enum><header>Requirements</header><text>In carrying out the initiative established under subparagraph (A), the Secretary—</text><clause id="H93C7E5F6FEEA4015B384046FDB4DD2B7" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">may only disclose program participant health information if the disclosure of such information is permitted under the Federal regulations (concerning the privacy of individually identifiable health information) promulgated under section 26(c) of the Health Insurance Portability and Accountability Act of 1996; and</text></clause><clause id="HF6B2B9C872B84C6096F2AB81C39DA211" commented="no"><enum>(ii)</enum><text>shall—</text><subclause id="HFB9F135D59944EC08CDFD58714671866"><enum>(I)</enum><text display-inline="yes-display-inline">consult with the Director of the Office for Civil Rights of the Health and Human Services Department, the National Coordinator for Health Information Technology, the Administrator for the Health Resources and Services Administration, the Administrator of the Centers for Medicare &amp; Medicaid Services, and the Director of the Indian Health Service; </text></subclause><subclause id="H1DE366390ACB4257A54E6AF953719072"><enum>(II)</enum><text>promote bidirectional interoperability between management information systems and electronic health record systems of health care providers; and</text></subclause><subclause id="H5036675C35C5492E835B2958E252A90C" commented="no"><enum>(III)</enum><text>support development of model software or systems that could be utilized by multiple State agencies for the communication described in subparagraph (A).</text></subclause></clause></subparagraph><subparagraph id="H1E7B664D16C34FE6BD3C36E273AD50B1" commented="no"><enum>(C)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">From amounts appropriated under subsection (g), $50,000,000 may be made available to carry out this paragraph for fiscal year 2022, to be available until expended.</text></subparagraph><subparagraph id="HF827263395C54AC484F6628A5D559999"><enum>(D)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="HA04008DD5C274D9386A0F514B213CEFD"><enum>(i)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the special supplemental nutrition program under this section.</text></clause><clause id="H2F31842466BD451085F1FA7D8AD0DB66"><enum>(ii)</enum><header>Program participant</header><text display-inline="yes-display-inline">The term <term>program participant</term> means a participant in the program.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
