analyze Federal collateral underwriting standards and guidance, and for other purposes.</official-title></form><legis-body id="H1D0CFB7A0F1E4E01877375D6A8FAC3CE" style="OLC"><section id="H576E25E87C944E8B95193DF1DD79730E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Real Estate Valuation Fairness and Improvement Act of 2021</short-title></quote>.</text></section><section id="HEEF9B5ADA35D4BF7A7299098117DB874"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H94E13A20643E43D49FB4B4CF3FFB3DF0"><enum>(1)</enum><text display-inline="yes-display-inline">Two Federal agencies, the Federal Home Owners’ Loan Corporation and the Federal Housing Administration played a major role in the development of the modern home mortgage origination industry.</text></paragraph><paragraph id="H31AC36C0D78F4443BE46AC87E9104DCF"><enum>(2)</enum><text>Both Federal agencies explicitly considered the racial and ethnic make up of neighborhoods when underwriting loans and valuing the real estate to be used as home loan collateral.</text></paragraph><paragraph id="H428950E426F748AA85B369A324C2B30C"><enum>(3)</enum><text>Both agencies devalued property or refused to make loans secured by property in communities of color.</text></paragraph><paragraph id="HB4BC626211DF4977B0C92BC87D78D21C"><enum>(4)</enum><text display-inline="yes-display-inline">The harmful consequences of this discrimination remain unresolved.</text></paragraph></section><section id="H91044C9B8B2644FE86580921519274BE"><enum>3.</enum><header>Real Estate Valuation Task Force</header><subsection id="H3258FBAA6153433AB7F7BB202063A2E4"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Appraisal Subcommittee of the Financial Institutions Examination Council shall facilitate the establishment and convening of an Interagency Task Force on Real Estate Valuation (in this section referred to as the <quote>Task Force</quote>).</text></subsection><subsection id="HCCE347486EA04623AAE963EA08006B45"><enum>(b)</enum><header>Members</header><text>The Task Force shall consist of the following members or their designees:</text><paragraph id="H816FB17774864000B9458DFE04458D18"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of the Federal Housing Finance Agency.</text></paragraph><paragraph id="H434AEA33EDC04A278212B8DBB1E0D28E"><enum>(2)</enum><text>The Chair of the Board of Directors of the Federal National Mortgage Association.</text></paragraph><paragraph id="HD708924169574492A561D84E70D0435D"><enum>(3)</enum><text>The Chair of the Board of Directors of the Federal Home Loan Mortgage Corporation.</text></paragraph><paragraph id="H11A4ED01CB7D450EAB45D90114409C6A"><enum>(4)</enum><text display-inline="yes-display-inline">The President of the Government National Mortgage Association.</text></paragraph><paragraph id="H78F0571AE1DD4459A14773B7C8316FE0"><enum>(5)</enum><text>The Chairperson of the Board of Directors of one of the Federal home loan banks, selected by the Chairpersons of the Boards of Directors of all of the Federal home loan banks.</text></paragraph><paragraph id="HB9E56B37078545039D98426DC0C36276"><enum>(6)</enum><text>The Assistant Secretary of the Department of Housing and Urban Development who is the Federal Housing Commissioner.</text></paragraph><paragraph id="H8D42F15FA42048F999A38F09C84A3EAA"><enum>(7)</enum><text display-inline="yes-display-inline">The Undersecretary for Rural Development of the Department of Agriculture.</text></paragraph><paragraph id="HA3453DE3D38D4B92908B75B79041CC78"><enum>(8)</enum><text>The Secretary of Veterans Affairs.</text></paragraph><paragraph id="H65526E7EE7C844878478CC5287140BEF"><enum>(9)</enum><text display-inline="yes-display-inline">The Director of the Bureau of Consumer Financial Protection, who shall serve as the Chairperson of the Task Force.</text></paragraph><paragraph id="H0BF9817FA0A442AEBA587D57A0636A40"><enum>(10)</enum><text display-inline="yes-display-inline">The Comptroller of the Currency.</text></paragraph><paragraph id="HCE0BA636D5214717BC692DA2830388DF"><enum>(11)</enum><text display-inline="yes-display-inline">The Chairperson of the Board of Directors of the Federal Deposit Insurance Corporation.</text></paragraph><paragraph id="H30ACE4AB45374A398BA2B3E9A964D2B5"><enum>(12)</enum><text display-inline="yes-display-inline">The Chairman of the Board of Governors of the Federal Reserve System.</text></paragraph><paragraph id="HF242946E70C646FCBB897E943EC79AC0"><enum>(13)</enum><text display-inline="yes-display-inline">The Chairman of the National Credit Union Administration Board.</text></paragraph><paragraph id="H1874E4FD80D4459BA68943A55F525325"><enum>(14)</enum><text display-inline="yes-display-inline">The Chairman of the State Liaison Committee.</text></paragraph></subsection><subsection id="H0F5C158B420344DBA23B29F611385D58"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Task Force shall—</text><paragraph id="HDCC4CE5AA19643DAA6BF8990DD8845F9"><enum>(1)</enum><text display-inline="yes-display-inline">harmonize to the greatest extent possible the various collateral underwriting standards and guidance of the agencies and entities represented on the Task Force governing residential and commercial real estate valuations, including standards and guidance with respect to appraisals, non-traditional and alternative methods of providing real estate property evaluations such as automated valuation models, processes and procedures for managing reconsiderations of value by consumers, and standards and guidance with respect to common collateral underwriting challenges, such as energy efficient housing and limited or inactive markets;</text></paragraph><paragraph id="H8246F7F7BE82400ABB34DCEE5D614ADE"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent that standards or guidance described under paragraph (1) are not harmonized, the Task Force shall issue a report to Congress explaining why harmonization cannot or should not be implemented;</text></paragraph><paragraph id="H23C51495116443BD81AADC6D975FC149"><enum>(3)</enum><text display-inline="yes-display-inline">establish specific definitions for limited or inactive housing markets in which comparable sales are limited or unavailable over a certain period of time, and establish greater flexibilities and guidance for appraisals and any underwriting processes associated with appraisals conducted in such markets, such as the ability to consider market evidence for similar properties in other geographic areas or utilizing a range of value;</text></paragraph><paragraph id="HE63B04CFD2084B1693F600CDDD5473C3"><enum>(4)</enum><text display-inline="yes-display-inline">aggregate data across Task Force members and conduct a study to determine whether there are racial disparities at both the borrower and community level in the valuation and price of the residential real estate to be used as collateral for mortgage applications processed by Task Force members;</text></paragraph><paragraph id="HE6C4EE35E0794EDAAAEE2E0DB86823B4"><enum>(5)</enum><text display-inline="yes-display-inline">identify specific causes of such racial disparities and—</text><subparagraph id="HB5B677D1C7AF453BAC82BF3D73C1514E"><enum>(A)</enum><text>adopt changes to address such causes; or</text></subparagraph><subparagraph id="H00C7AE7AEB1648089E73F8C8058F3151"><enum>(B)</enum><text>if the Task Force determines that additional statutory authority is needed to adopt such changes, issue a report to Congress describing the needed statutory authority; and</text></subparagraph></paragraph><paragraph id="HFFA7C51EC34C4F36B15031F5BD1B750D"><enum>(6)</enum><text display-inline="yes-display-inline">evaluate whether there are any barriers to entry that are disproportionately preventing minorities from entering into the appraisal profession, such as current minimum requirements established by the Appraiser Qualifications Board, the cost and availability of education, the content of the State appraiser exam questions, or the time it takes to finish training.</text></paragraph></subsection><subsection id="H5798AF50CD314B3B82F66AA7863F669E" display-inline="no-display-inline"><enum>(d)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Task Force shall convene regularly, including with the advisory committee described under subsection (g), to carry out the duties under subsection (c) and submit the reports required under subsection (f).</text></subsection><subsection id="H34F46539F6AD48CC90CB0138D58167FC"><enum>(e)</enum><header>Sharing of information</header><text>Each agency and entity represented on the Task Force shall share with the Task Force any data of the agency or entity necessary for the Task Force to carry out the duties of the Task Force under this Act.</text></subsection><subsection id="HE6C4036E68824AC7955AF7B1E94F3D41"><enum>(f)</enum><header>Reports</header><paragraph id="H290582CC3638409E83832DF04913BBF1"><enum>(1)</enum><header>Initial</header><text display-inline="yes-display-inline">The Chairperson of the Task Force shall submit a report to the Congress not later than the expiration of the 24-month period beginning on the date of the enactment of this Act detailing the findings and any actions taken to further the duties of the Task Force as of such time and describing any planned efforts and activities.</text></paragraph><paragraph id="HFA65562AD46249D999BD5EE23B3A2949"><enum>(2)</enum><header>Ongoing</header><text display-inline="yes-display-inline">Periodically after the submission of the report pursuant to paragraph (1), the Chairperson shall submit reports to the Congress setting forth updates of the findings and actions taken to further the duties of the Task Force.</text></paragraph></subsection><subsection id="H852F1E45E28841F0A406307F16B49E75"><enum>(g)</enum><header>Advisory Committee</header><text>The Task Force shall establish an advisory committee to provide advice with respect to the duties of the Task Force. The advisory committee shall consist of—</text><paragraph id="HCC4F8355CDAB4DDD9C702645AF972C39"><enum>(1)</enum><text display-inline="yes-display-inline">at least 2 civil rights advocates;</text></paragraph><paragraph id="HEB70F765ACF04FDC81B2510D4C6B3DB6"><enum>(2)</enum><text>at least 2 consumer advocates;</text></paragraph><paragraph id="H8238A2DCCFF64FBDB6042251AF31D4D5"><enum>(3)</enum><text>at least 2 real estate appraisers (or representatives of real estate appraiser trade groups);</text></paragraph><paragraph id="H808C3265B79344CBB95B225970CAF2A0"><enum>(4)</enum><text>at least 1 small lender (or representative of a trade group for small lenders);</text></paragraph><paragraph id="H07C24A65B56B4BAEBFB7150C81A344C2"><enum>(5)</enum><text display-inline="yes-display-inline">at least 1 representative of a trade group that represents private investors;</text></paragraph><paragraph id="H84DD45875C4F450DB26D2C2775414CD3"><enum>(6)</enum><text display-inline="yes-display-inline">at least 2 representatives of appraisal management companies or trade groups for such companies;</text></paragraph><paragraph id="H22E54757E51F49828238648E2CFCEE57"><enum>(7)</enum><text>at least 2 individuals who are industry experts on alternative valuation models; and</text></paragraph><paragraph id="HEEBBF012C11242EFBFE8560FD105ABCE"><enum>(8)</enum><text display-inline="yes-display-inline">at least 1 representative of the organization that adopts the appraisal standards and appraiser qualification criteria under title XI of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3331">12 U.S.C. 3331</external-xref> et seq.).</text></paragraph></subsection><subsection id="HFFE924547BEA41B482B3A8E9DAAD3F09"><enum>(h)</enum><header>Sunset</header><text>The Task Force shall terminate upon the expiration of the 5-year period beginning on the date of the enactment of this Act.</text></subsection></section><section id="HC10A6F748432495D99449DEFFAE9B46B"><enum>4.</enum><header>Promoting diversity and inclusion in the appraisal profession</header><text display-inline="no-display-inline">The Financial Institutions Reform, Recovery, and Enforcement Act of 1989 is amended—</text><paragraph id="HB9F268EBAC5E44999CCB2F638F9812BA"><enum>(1)</enum><text display-inline="yes-display-inline">in section 1103(a) (<external-xref legal-doc="usc" parsable-cite="usc/12/3332">12 U.S.C. 3332(a)</external-xref>)—</text><subparagraph id="H8145C2024D1B485A8E8D4FA3691A5991"><enum>(A)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H564308EC287A44A798DA2D705D081D1D"><enum>(B)</enum><text>in paragraph (4), by striking the period at the end and inserting a semicolon;</text></subparagraph><subparagraph id="HEC103BFB6F0A420FA3CC56EBB2985CF2"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking the period at the end and inserting a semicolon;</text></subparagraph><subparagraph id="HB94DDA27BDA3415F93066F638F38419F"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking the period at the end and inserting <quote>a semicolon; and</quote>; and</text></subparagraph><subparagraph id="H49CC9650999C4803B7785FA3FF3E497B"><enum>(E)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H0688A182C27F4005AC7F4DB34100B0BA" display-inline="no-display-inline"><paragraph id="H869E9E56FCF34C39AE8ECEA39467042A"><enum>(7)</enum><text display-inline="yes-display-inline">administer the grant program under section 1122(j).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE67BB03AD9B147B8BA574D5C942B0FA7"><enum>(2)</enum><text>in section 1106 (<external-xref legal-doc="usc" parsable-cite="usc/12/3335">12 U.S.C. 3335</external-xref>)—</text><subparagraph id="H634873474E004F7CA9C1D7A64F9AEFE2"><enum>(A)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—</quote> before <quote>The Appraisal Subcommittee</quote>;</text></subparagraph><subparagraph id="HDC868A45C56A48EF9167FBD2E3C00907"><enum>(B)</enum><text>by striking the comma after <quote>comment</quote>;</text></subparagraph><subparagraph id="H4A1E69A624894E258B0B3A2E946CC46D"><enum>(C)</enum><text>by inserting before <quote>Any regulations</quote> the following: </text><quoted-block style="OLC" id="HA9B2AD0C77754C76A745A6F5541F831B" display-inline="no-display-inline"><subsection id="HC5FFA575F6474D9388380DB8E2E45FCA"><enum>(b)</enum><header>Regulations</header></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H37B03467FB104E0EBD4B1F86B3BB34FA"><enum>(D)</enum><text>in subsection (a) (as so designated by subparagraph (A) of this paragraph), by adding at the end the following: <quote>The Appraisal Subcommittee may coordinate, and enter into agreements, with private industry stakeholders (including appraisal management companies and industry associations) to facilitate activities and practices that ensure diversity among individuals newly hired as appraisers in their first employment positions in the appraisal industry.</quote>; and </text></subparagraph></paragraph><paragraph id="H519F67D78E044D6EA6C9652BC5074531"><enum>(3)</enum><text>in section 1122 (<external-xref legal-doc="usc" parsable-cite="usc/12/3351">12 U.S.C. 3351</external-xref>), by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HCCC35235E91641A6BC7635FB62D114F1" display-inline="no-display-inline"><subsection id="H3995FBD8B49E42C49F7040B3BBD7030C"><enum>(j)</enum><header>Grant program To promote diversity and inclusion in the appraisal profession</header><paragraph id="H8BF34399240948B8A864AFE5918BEC71"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Appraisal Subcommittee shall carry out a program under this subsection to makes grants to State agencies, nonprofit organizations, and institutions of higher education to promote diversity and inclusion in the appraisal profession.</text></paragraph><paragraph id="H1BBE6735F6234E9FB095CFA4527F7C1B"><enum>(2)</enum><header>Eligible activities</header><text display-inline="yes-display-inline">Activities carried out with amounts from a grant under this Act shall be designed to promote diversity and inclusion in the appraisal profession, and may include—</text><subparagraph id="HBD4A976332FA4A0CA5090CFB136D31E6"><enum>(A)</enum><text>funding scholarships;</text></subparagraph><subparagraph id="H6B24C2C95D2A4BEF8BCDD774D27884C1"><enum>(B)</enum><text>providing training and education;</text></subparagraph><subparagraph id="H128BA506784C40609AF8B846F1DD04C2"><enum>(C)</enum><text display-inline="yes-display-inline">providing implicit bias training for appraisers; and</text></subparagraph><subparagraph id="H23FC1751011545128934C272CC4675F7"><enum>(D)</enum><text>other activities as determined appropriate to further the purposes of this grant program by the Appraisal Subcommittee.</text></subparagraph></paragraph><paragraph id="H4848A47020D14D6493A3F0638B2C5951"><enum>(3)</enum><header>Allocation of funds</header><text display-inline="yes-display-inline">In making grants under this subsection, the Appraisal Subcommittee shall—</text><subparagraph id="H0599673A25CE4092BE0536C01D30BA2F"><enum>(A)</enum><text display-inline="yes-display-inline">allocate 50 percent of the funds made available to Historically Black Colleges and Universities or universities with degree programs approved by the Appraiser Qualifications Board or a relevant State regulatory agency for—</text><clause id="H45BCF4D6591B4913B0B3F3CCAD8A2284"><enum>(i)</enum><text>scholarships for students of color who want to pursue a career in real estate appraisal; and</text></clause><clause id="H0A16BBFEF7C34BDCB134453F07EC3099"><enum>(ii)</enum><text>subsidizing living expenses for those students while in training; and</text></clause></subparagraph><subparagraph id="H33F087E04B1D4D3080DEFF3F2BB19897"><enum>(B)</enum><text>allocate 20 percent of the funds to cover the cost of fulfilling the experience requirements or other applicable requirements that the students described under subparagraph (A) will need to complete in order to become appraisers.</text></subparagraph></paragraph><paragraph id="HED75787FC85C42D08A6F0B1BFC0FE24C"><enum>(4)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">The Appraisal Subcommittee may use 1 percent of amounts appropriated pursuant to paragraph (6) to cover the administrative costs of carrying out this subsection.</text></paragraph><paragraph id="HEFFEC9D2B54242959DBF66B99A5AFDA0"><enum>(5)</enum><header>Reports</header><text display-inline="yes-display-inline">For each fiscal year during which grants are made under the program under this subsection, the Appraisal Subcommittee shall submit a report to the Congress regarding implementation of the program and describing the grants made, activities conducted using grant amounts, and the number of individuals served by such grants, disaggregated by race, ethnicity, age, and gender.</text></paragraph><paragraph id="HA9C27C6A102F4FFD917CB9AF9B5CDF0C"><enum>(6)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Appraisal Subcommittee for grants under this subsection $50,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
