<section id="H36EAD976B855418893505ECBC5311F44"><enum>140B.</enum><header>Unfair credit practices</header> 
<subsection id="H22895B6F9C8549409BC147B342628FFA"><enum>(a)</enum><header>In general</header><text>In connection with the extension of credit or creation of debt in or affecting commerce, as defined in section 4 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>), including any advance of funds or sale or assignment of future income or receivables that may or may not be credit, no person may directly or indirectly take or receive from another person or seek to enforce an obligation that constitutes or contains a cognovit or confession of judgment (for purposes other than executory process in the State of Louisiana), warrant of attorney, or other waiver of the right to notice and the opportunity to be heard in the event of suit or process thereon.</text></subsection> <subsection id="H52CFE744AEF3457E9F8259C9A6211A52"><enum>(b)</enum><header>Exemption</header><text>The exemptions described in section 104 shall not apply to this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD2BD4CDF2A3945E0AF9E8E35BB92B6B7"><enum>(b)</enum><header>Technical and conforming amendments</header> 
<paragraph id="HF1F21BDA1A30436EB3296AD02F7CB844"><enum>(1)</enum><text>Section 130 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1640">15 U.S.C. 1640</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H5159452B35C34DE78F42C0A386D90D78" display-inline="no-display-inline"> <subsection id="HF393F30CF57347A489E9406C08F8A64B"><enum>(m)</enum><header>Creditor</header><text display-inline="yes-display-inline">In this section, the term <quote>creditor</quote> refers to any person charged with compliance that is not the obligor.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC1D73840E46E4BCA9B4A566FF0873009"><enum>(2)</enum><text display-inline="yes-display-inline">The table of sections in chapter 2 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631</external-xref> et seq.) is amended by adding at the end the following: </text> <quoted-block style="USC" id="HD0B8CFF399C647B5877F57A41AEB7F47" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">140B. Unfair credit practices.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="HF2DE085DA8764AF7A78C68648D65623A"><enum>103.</enum><header>Enforcement of security interests</header><text display-inline="no-display-inline">Section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H9DE9B97F822B4E74AE1F19B0D498A3E6"> 
<subsection id="HD283011969504B8FA76F129352B3CFC6"><enum>(ff)</enum><text display-inline="yes-display-inline">The term ‘debt’ means any obligation of a person to pay to another person money—</text> <paragraph id="HED06555860F94E80B1FC9EE7E0D3062F"><enum>(1)</enum><text display-inline="yes-display-inline">that includes the right of the person providing the money to a legal or an equitable remedy for breach of performance if the breach gives rise to a right to payment; and</text></paragraph> 
<paragraph id="H0046CFA6F0634AB9A622C39E16B1ED36"><enum>(2)</enum><text display-inline="yes-display-inline">regardless of whether the obligation or right to a remedy described in paragraph (1) is absolute or contingent, has been reduced to judgment, is fixed, matured, unmatured, disputed, undisputed, recourse, nonrecourse, secured, or unsecured</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title> <title id="H4218A14C616D4EB0ADAF098E5F39ACFA"><enum>II </enum><header>Fair Debt Collection Practices for Servicemembers Act</header> <section id="HA284295EF056409BB92FA6F2CB83CBA6" section-type="subsequent-section"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Fair Debt Collection Practices for Servicemembers Act</short-title></quote>.</text></section> 
<section id="H2D895EB0F5ED48ADAAD0587ABB1F921C"><enum>202.</enum><header>Enhanced protection against debt collector harassment of servicemembers</header> 
<subsection id="H11E1E0DA856945DDB75383AD9513EE6F"><enum>(a)</enum><header>Communication in connection with debt collection</header><text display-inline="yes-display-inline">Section 805 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692c">15 U.S.C. 1692c</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H50B5CEBC54334DAE95EEEFF95D0907A2" style="OLC"> <subsection id="H62CD0CD1B64A42BB9B6F7E2648BAEC52"><enum>(e)</enum><header>Communications concerning servicemember debts</header> <paragraph id="HC3A592201F064AECA489A7BE49695486"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered member</term> means—</text> 
<subparagraph id="H204D058186024174BE539320C897AF16"><enum>(A)</enum><text>a covered member or a dependent as defined in section 987(i) of title 10, United States Code; and</text></subparagraph> <subparagraph id="H8A31311C79BA4D21869A8C541EE9ECF3"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="H64E242F0056A4C4F813974DBD9A98B6D"><enum>(i)</enum><text>an individual who was separated, discharged, or released from duty described in such section 987(i)(1), but only during the 365-day period beginning on the date of separation, discharge, or release; or</text></clause> 
<clause id="HC0855E809D3640648BB4345100C7EC69" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a person, with respect to an individual described in clause (i), described in subparagraph (A), (D), (E), or (I) of section 1072(2) of title 10, United States Code.</text></clause></subparagraph></paragraph> <paragraph id="HE7777099E6854CC9AC35CC0E2AA74945"><enum>(2)</enum><header>Prohibitions</header><text>A debt collector may not, in connection with the collection of any debt of a covered member—</text> 
<subparagraph id="H9D3D9756D45C46A4B8B13068461B5A56"><enum>(A)</enum><text display-inline="yes-display-inline">threaten to have the covered member reduced in rank;</text></subparagraph> <subparagraph id="HA5132150ADEF4503AB18ABBF3336991C"><enum>(B)</enum><text>threaten to have the covered member’s security clearance revoked; or</text></subparagraph> 
<subparagraph id="HED3FBC950D674BD89504833AF3EF6C7B"><enum>(C)</enum><text display-inline="yes-display-inline">threaten to have the covered member prosecuted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7C8291AE955E4E0A981747A007D91AC3"><enum>(b)</enum><header>Unfair practices</header><text>Section 808 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692f">15 U.S.C. 1692f</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H09F56A9210C5470BBA94BF12B6D3EF6E" style="OLC"> 
<paragraph id="HAC14B5B03C504CF2A77F9560BD7FCB31"><enum>(9)</enum><text>The representation to any covered member (as defined under section 805(e)(1)) that failure to cooperate with a debt collector will result in—</text> <subparagraph id="H3E394A1D9918484A8E7F0B6256F4D8D4"><enum>(A)</enum><text>a reduction in rank of the covered member;</text></subparagraph> 
<subparagraph id="HB9A7C76204B246AD87F11A717FE7B68D"><enum>(B)</enum><text display-inline="yes-display-inline">a revocation of the covered member’s security clearance; or</text></subparagraph> <subparagraph id="H32FDEC57385D4BBB88D319676B39CE81"><enum>(C)</enum><text>prosecution under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H7C78E2581A0D475682938EC703F08760"><enum>203.</enum><header>GAO study and report</header> 
<subsection id="H809ECAF6533F48E78189A7C19F1B06CE"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study on the impact of debt collection on covered members (as defined under section 805(e)(1) of the Fair Debt Collection Practices Act, as added by section 202), which shall—</text> <paragraph id="HE6D28CB59B00459B834C587A009E7D2F"><enum>(1)</enum><text>identify types of false, deceptive, misleading, unfair, abusive, and harassing debt collection practices experienced by covered members and make recommendations to eliminate these practices;</text></paragraph> 
<paragraph id="HB9022C0AD10E4EC1A0246A8A11341EA8"><enum>(2)</enum><text display-inline="yes-display-inline">identify collection practices of creditors and debt collectors experienced by covered members;</text></paragraph> <paragraph id="H37D99A3524D34972A75D6B7F571E5B09"><enum>(3)</enum><text>discuss the effect of these practices on military readiness; and</text></paragraph> 
<paragraph id="H3DA4391D403B469E9278AFD137786A3C"><enum>(4)</enum><text>discuss any national security implications, including the extent to which covered members with security clearances would be impacted by uncollected debt.</text></paragraph></subsection> <subsection id="H18F63EDF9E4C433BBFB09A7EA4F80330"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the completed study required under subsection (a).</text></subsection></section></title> 
<title id="H7AB8CD204E5A44FFAC25CB8F95E44198"><enum>III</enum><header>Private Loan Disability Discharge Act</header> 
<section id="H992771F3D03B4991A66C9D6B3BC672EA" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Private Loan Disability Discharge Act of 2021</short-title></quote>.</text></section> <section id="HFC3FF602BC7740A59D9072C72B97FA60"><enum>302.</enum><header>Protections for obligors and cosigners in case of death or total and permanent disability</header> <subsection id="HA5ED6A41E18843C783332C5E0B739621"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 140(g) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650(g)</external-xref>) is amended—</text> 
<paragraph id="H8250B551CD224D0FA02A4D2503A6FB14"><enum>(1)</enum><text>in paragraph (2)—</text> <subparagraph id="H9F1092543B2C4D2CA1EA58D1D3231F29"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">in case of death of borrower</header-in-text></quote>;</text></subparagraph>

<paragraph id="HA29F0283F69A4CDA8717935EDEB36B31"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HEA992044E4E84837A48D0973A86C4FA2" style="OLC"> <paragraph id="H1B74DD292774424388C618A13BE13EA5"><enum>(3)</enum><header>Discharge in case of death or total and permanent disability of borrower</header><text display-inline="yes-display-inline">The holder of a private education loan shall, when notified of the death or total and permanent disability of a student obligor (and any cosigner), discharge the liability of the student obligor on the loan and may not, after such notification—</text> 
<subparagraph display-inline="no-display-inline" id="H67539AB58CF44E05AA07656E5E4B68F8"><enum>(A)</enum><text>attempt to collect on the outstanding liability of the student obligor; and</text></subparagraph> <subparagraph id="H5AFF02272960443AB7ED733B58DD4F7A"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of total and permanent disability, monitor the disability status of the student obligor at any point after the date of discharge.</text></subparagraph></paragraph> 
<paragraph id="H06005FC864F04BDC8513D070E78BA0F6" display-inline="no-display-inline"><enum>(4)</enum><header>Private discharge in cases of certain discharge for death or disability</header><text display-inline="yes-display-inline">The holder of a private education loan shall, when notified of the discharge of liability of a student obligor on a loan described under <external-xref legal-doc="usc" parsable-cite="usc/26/108">section 108(f)(5)(A)</external-xref> of the Internal Revenue Code of 1986, discharge any liability of the student obligor (and any cosigner) on any private education loan which the private education loan holder holds and may not, after such notification—</text> <subparagraph id="H82FD531C5840428ABB081765CC6ED4C3"><enum>(A)</enum><text>attempt to collect on the outstanding liability of the student obligor; and</text></subparagraph> 
<subparagraph id="H17C192591A1E4577B19D5D5C7380255E"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of total and permanent disability, monitor the disability status of the student obligor at any point after the date of discharge.</text></subparagraph></paragraph> <paragraph id="H709C36E494B942F985470A7281C9B2D2"><enum>(5)</enum><header>Total and permanent disability defined</header><text>For the purposes of this subsection and with respect to an individual, the term <term>total and permanent disability</term> means the individual is totally and permanently disabled, as such term is defined in section 685.102(b) of title 34, Code of Federal Regulations.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="H4359BDB8510B4101B77049923CA09951"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="USC" id="H943DE2EB79D6409EBB7FCD0E4FF7AF91" display-inline="no-display-inline"> <subsection id="H19B7132CCB5D44FD94A26A58B6A9ADDE"><enum>(bb)</enum><header>Medical debt</header><text display-inline="yes-display-inline">The term <term>medical debt</term> means a debt arising from the receipt of medical services, products, or devices.</text></subsection> 
<subsection id="HCA8222EB05624A17AAA48E64933A53E9"><enum>(cc)</enum><header>Medically necessary procedure</header><text display-inline="yes-display-inline">The term <term>medically necessary procedure</term> means—</text> <paragraph id="HF171F23EFAFD4C5CA95099D69141EFB7"><enum>(1)</enum><text>health care services or supplies needed to diagnose or treat an illness, injury, condition, disease, or its symptoms and that meet accepted standards of medicine; and</text></paragraph> 
<paragraph id="H2105D12E98D845D9B8B0FFDC30D6052F"><enum>(2)</enum><text display-inline="yes-display-inline">health care to prevent illness or detect illness at an early stage, when treatment is likely to work best (including preventive services such as pap tests, flu shots, and screening mammograms). </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7D529DCBB39C4E319DDE27E4458EC55B"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(a)</external-xref>) is amended by adding at the end the following new paragraphs:</text>

<section id="H558104EACBD341F4AD14079E2F0C31AF"><enum>404.</enum><header>Requirements for furnishers of medical debt information</header> 
<subsection id="HB6DEB4CC2430407390BCEF9F09A77157"><enum>(a)</enum><header>Additional notice requirements for medical debt</header><text display-inline="yes-display-inline">Section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H73187161FB534C92AA515B2DA0C0D672" style="OLC"> <subsection id="HFC76DA37DD1F4B55BA6E4C4605E49108"><enum>(f)</enum><header>Additional notice requirements for medical debt</header><text display-inline="yes-display-inline">Before furnishing information regarding a medical debt of a consumer to a consumer reporting agency, the person furnishing the information shall send a statement to the consumer that includes the following:</text> 
<paragraph id="H9FDC155B684B4420A2312BD2549848D8"><enum>(1)</enum><text display-inline="yes-display-inline">A notification that the medical debt—</text> <subparagraph id="H7992DF60A59A4BA9A7AB6523949FDE04"><enum>(A)</enum><text display-inline="yes-display-inline">may not be included on a consumer report made by a consumer reporting agency until the later of the date that is 365 days after—</text> 
<clause id="HFB9B0FFFB16A4BB9B2277816216DE55B"><enum>(i)</enum><text>the date on which the person sends the statement;</text></clause> <clause id="HC9D1E9CD1E534ADFB21676928DEDEA37"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to the medical debt of a borrower demonstrating hardship, a date determined by the Director of the Bureau; or</text></clause> 
<clause id="H9AF5B9D0AA274A659755B27816EC8A9C"><enum>(iii)</enum><text>the date described under section 605(a)(10); and</text></clause></subparagraph> <subparagraph id="H18217C55BFDA4AA8ACA2A4335C447EDF"><enum>(B)</enum><text display-inline="yes-display-inline">may not ever be included on a consumer report made by a consumer reporting agency, if the medical debt arises from a medically necessary procedure.</text></subparagraph></paragraph> 
<paragraph id="H8ED5A9D82C9C41229E240DE320F80CC9"><enum>(2)</enum><text>A notification that, if the debt is settled or paid by the consumer or an insurance company before the end of the period described under paragraph (1)(A), the debt may not be reported to a consumer reporting agency.</text></paragraph> <paragraph id="H6199F8A833A2404384C940113879AB37"><enum>(3)</enum><text>A notification that the consumer may—</text> 
<subparagraph id="H84A897FB32C64AB8A9243E66712EF909"><enum>(A)</enum><text>communicate with an insurance company to determine coverage for the debt; or</text></subparagraph> <subparagraph id="HBEAC99FEFEA6415D985480EECA905AE5"><enum>(B)</enum><text>apply for financial assistance.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H965769E9A8C84743928C1FEBD685B7E7"><enum>(b)</enum><header>Furnishing of medical debt information</header><text display-inline="yes-display-inline">Section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>), as amended by subsection (a), is further amended by adding at the end the following:</text> <quoted-block style="USC" id="HC79151020BFE433D944F6C8272FF9E32" display-inline="no-display-inline"> <subsection id="HAE13D2A4E8EF47D0B65FAB410CB5549F"><enum>(g)</enum><header>Furnishing of medical debt information</header> <paragraph id="HBD4DB80CECBC4FADB572D889FD4F3FBD"><enum>(1)</enum><header>Prohibition on reporting debt related to medically necessary procedures</header><text display-inline="yes-display-inline">No person shall furnish any information to a consumer reporting agency regarding a debt arising from a medically necessary procedure.</text></paragraph> 
<paragraph id="H0200FB53B9B84F1B85BEDCCB9F5C193F"><enum>(2)</enum><header>Treatment of other medical debt information</header><text>With respect to a medical debt not described under paragraph (1), no person shall furnish any information to a consumer reporting agency regarding such debt before the end of the 365-day period beginning on the later of—</text> <subparagraph id="H9753A65FA457437883A15BB0CCDE2D00"><enum>(A)</enum><text>the date on which the person sends the statement described under subsection (f) to the consumer;</text></subparagraph> 
<subparagraph id="H7F1AA1FB22214A40B971CDA8EA1A4F26"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to the medical debt of a borrower demonstrating hardship, a date determined by the Director of the Bureau; or</text></subparagraph> <subparagraph id="HD30DA76D2EA241D3863CB0D7ED403F04"><enum>(C)</enum><text>the date described in section 605(a)(10).</text></subparagraph></paragraph> 
<paragraph id="HAE62A989A88740E9836AAF1256FC25C8" commented="no"><enum>(3)</enum><header>Treatment of settled or paid medical debt</header><text display-inline="yes-display-inline">With respect to a medical debt not described under paragraph (1), no person shall furnish any information to a consumer reporting agency regarding such debt if the debt is settled or paid by the consumer or an insurance company before the end of the 365-day period described under paragraph (2).</text></paragraph> <paragraph id="H0BF206D5F2184F74A86D89FB66EED3E9"><enum>(4)</enum><header>Borrower demonstrating hardship defined</header><text display-inline="yes-display-inline">In this subsection, and with respect to a medical debt, the term <term>borrower demonstrating hardship</term> means a borrower or a class of borrowers who, as determined by the Director of the Bureau, is facing or has experienced extenuating life circumstances or events that result in severe financial or personal barriers such that the borrower or class of borrowers does not have the capacity to repay the medical debt.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title> 
<title id="HCB387B695290471C9D07890458EA00A9"><enum>V</enum><header>Ending Debt Collection Harassment Act</header> 
<section id="HFAFD10AA449C4E068037EFB15F4B6676" section-type="subsequent-section" commented="no"><enum>501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Ending Debt Collection Harassment Act of 2021</short-title></quote>. </text></section> <section id="H5FD1E24F65DC4AF78ADCEC63CBD7D90C"><enum>502.</enum><header>Consumer protections relating to debt collection practices</header> <subsection id="H4EAD3CDB16F74E99B8021071BA4D25A3"><enum>(a)</enum><header>Reports on debt collection complaints and enforcement actions</header> <paragraph id="H193B2DABF953405181F6C3C3238A32A2"><enum>(1)</enum><header>Semi-annual report</header><text>Section 1016(c) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5496">12 U.S.C. 5496(c)</external-xref>) is amended—</text> 
<subparagraph id="HA1846E372BCC4F4C92A32B84CD2BF213"><enum>(A)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="HDD6B8D98A75F425996D8A378A78E981A"><enum>(B)</enum><text>in paragraph (9), by striking the period at the end and inserting a semicolon; and</text></subparagraph>

<paragraph id="HA12FA9B8A7834F208D5ED776567A21BC" display-inline="no-display-inline"><enum>(11)</enum><text display-inline="yes-display-inline">an analysis of the number of people unable to pay a debt because a debt collector is unable to accept a cash payment; and</text></paragraph> <paragraph id="H639214DDDDE24794818148BEE7070822"><enum>(12)</enum><text>a list of enforcement actions taken against debt collectors during the preceding year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H142AA8C4421E491CB0AA0F234BFA5DD6"><enum>(2)</enum><header>Annual report</header><text display-inline="yes-display-inline">Section 815(a) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692m">15 U.S.C. 1692m(a)</external-xref>) is amended by adding at the end the following new sentence: <quote>Each such report shall also include an analysis of the impact of electronic communications by debt collectors on consumer experiences with debt collection, including a consideration of consumer complaints about the use of electronic communications in debt collection.</quote>.</text></paragraph></subsection> <subsection id="H64167114AB97438DAEB30326F0FD8E79"><enum>(b)</enum><header>Limitation on debt collection rules</header><text display-inline="yes-display-inline">Section 1022 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H5D6CFA13039D4EB18F1369A1D7A9A4A1"><enum>(e)</enum><header>Limitation on debt collection rules</header><text display-inline="yes-display-inline">The Director may not issue any rule with respect to debt collection that does not prohibit a debt collector to send unlimited email, text messages, and direct messages through social media to a consumer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H043E0FD1C8304972A9FF4D410B9EB90F"><enum>(c)</enum><header>Protection of consumers from unlimited texts, emails, and social media messages used in debt collection</header><text>Section 806 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692d">15 U.S.C. 1692d</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H705D1741F59E468AA9FD3D44BDD7A70E"><enum>(7)</enum><text display-inline="yes-display-inline">Contacting the person electronically, including by email, text message, and direct message through social media, if—</text> <subparagraph id="HC3D1C483F5034E8C96164D75A14EB2BB"><enum>(A)</enum><text>the communication is required to be in writing and the person has not consented to receive the communication electronically in accordance with the requirements of the Electronic Signatures in Global and National Commerce Act;</text></subparagraph> 
<subparagraph id="HD1777E315ED34F6D82BD1581AAA3DC3D"><enum>(B)</enum><text>the communication is governed by the Telephone Consumer Protection Act and the person has not consented to receive such communication in accordance with the requirements of such Act;</text></subparagraph> <subparagraph id="HB8AA15A43F914606BBC698CBB888421A"><enum>(C)</enum><text>consent by the person to receive the communication was not provided directly to the debt collector;</text></subparagraph> 
<subparagraph id="HA2EA52E8902A4BBF9D45EF65467E9216"><enum>(D)</enum><text>consent by the person to receive the communication electronically has been withdrawn; or</text></subparagraph> <subparagraph id="HAF6EB2E23C11485A9524A04CFA863168"><enum>(E)</enum><text>the frequency of contact by the debt collector is greater than consented to by the person.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3AB25492ECEE45728B3E77BCC7F0D064" display-inline="no-display-inline"><enum>(d)</enum><header>Protection Of Consumers From Social Media Communications In Debt Collection</header><text display-inline="yes-display-inline">Section 808(7) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692f">15 U.S.C. 1692f</external-xref>) is amended by inserting the following before the period: <quote>or through a social media platform if the communication is viewable by the general public or the person’s social media contacts</quote>.</text></subsection> <subsection id="H9DF6A241EEFE43CC850E9C9358718411"><enum>(e)</enum><header>Ensuring consumers receive notice of debt collection protections</header><text>Section 809(a) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692g">15 U.S.C. 1692g(a)</external-xref>) is amended in the matter preceding paragraph (1)—</text> 
<paragraph id="H20686A3D18164571A63182306220342E"><enum>(1)</enum><text>by striking <quote>Within five days</quote> and all that follows through <quote>any debt,</quote> and inserting the following: <quote><header-in-text level="subsection" style="OLC">Notice of debt; contents.—</header-in-text>Within five days after the initial communication with a consumer in connection with the collection of any debt,</quote>; and</text></paragraph> <paragraph id="H2CC07F7DAF054852AEC359AFBC8A10B0"><enum>(2)</enum><text>by striking <quote>, unless the following information is contained in the initial communication or the consumer has paid the debt,</quote>. </text></paragraph></subsection> 
<subsection id="HE3E25497F1E44BAE9B1F6D63E104BE46" display-inline="no-display-inline"><enum>(f)</enum><header>Improved limitations on debt collection rules</header><text>Section 814(d) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692l">15 U.S.C. 1692l(d)</external-xref>) is amended by adding at the end the following: </text> <quoted-block style="OLC" id="H54C57B64D503451B8ECF2780DE52402B" display-inline="yes-display-inline"><text>Such rules—</text> 
<paragraph id="H6E7F509BA0044B13AC69F9CEC3374E41"><enum>(1)</enum><text display-inline="yes-display-inline">may not allow a debt collector to send unlimited electronic communications to a consumer;</text></paragraph> <paragraph id="HB64D3834B2FB4941BE36502F7E1CFC49"><enum>(2)</enum><text>shall require debt collectors to obtain consent directly from consumers before contacting them using a method other than by postal mail or by telephone;</text></paragraph> 
<paragraph id="H2778181B6EB84B10831FCD3A0E1546EC"><enum>(3)</enum><text display-inline="yes-display-inline">may not waive the requirements of the Electronic Signatures in Global and National Commerce Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7001">15 U.S.C. 7001</external-xref> et seq.); and</text></paragraph> <paragraph id="HD78D49713A424740881F2828BA643366" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">shall allow consumers to opt out of any method of communication that the debt collector uses to communicate with consumers, including a method for which such consumer had given prior consent.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title>

<paragraph id="H8C2ED41F7FEC41CE9B9E702954E92350"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>facilitating collection of such debt for another</quote> and inserting <quote>collection of such debt</quote>;</text></paragraph> <paragraph id="HF1DD5071781049C6AD47F55092E648DF"><enum>(2)</enum><text>by amending paragraph (5) to read as follows:</text>

<subparagraph id="H57E2E69C6101474D9AB58C160CDB3842"><enum>(B)</enum><text display-inline="yes-display-inline">to pay a loan, overpayment, fine, penalty, restitution, fee, or other money currently or originally owed to or guaranteed by a Federal or State government, including any courts or agencies; or</text></subparagraph> <subparagraph id="H0B5ADF7B19CB4ACD83144BA8D806F482" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">which is secured by real or personal property that is used or was obtained primarily for personal, family, or household purposes, where such property is subject to forfeiture or repossession upon nonpayment of the obligation or alleged obligation. </text></subparagraph><continuation-text continuation-text-level="paragraph">The enforcement of a debt described in subparagraph (C) is deemed to be a collection of a debt.</continuation-text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>

<subclause id="H677D4C2F99D84B838173567F07D371AB" commented="no"><enum>(II)</enum><text>concerns a debt which was originated by such person;</text></subclause> <subclause id="H611C9D60B2F443A4AEC80FA0C2079394" commented="no"><enum>(III)</enum><text>concerns a debt which was not in default at the time it was obtained by such person; or</text></subclause> 
<subclause id="HF4F84B5EC6564868A89762C8B5435A78" commented="no"><enum>(IV)</enum><text>concerns a debt obtained by such person as a secured party in a commercial credit transaction involving the creditor.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HB845C71AFDD74E07B91A889F883EFE78" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">by striking the paragraph designation and the first and second sentences and inserting the following:</text>

<clause id="H3D5A4FAD8CA0495B8CA4BBBD4BE246B4" indent="up1" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">notwithstanding subparagraph (B)(vi), any creditor who in the process of collecting debts of such creditor, uses another name that would indicate that a third person is collecting or attempting to collect such debts.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H25AB839446CF4E34BD55D8FA20198790" commented="no"><enum>(E)</enum><text>in the fourth sentence, by striking <quote>The term does not include</quote> and inserting the following: </text>

<subsection id="H61C94DA3D09E4BBFBB46A98C4D3E525C"><enum>(a)</enum><header>Limitation on time To turn debt over to debt collector</header><text>A Federal agency that is a creditor may not sell or transfer a debt described in section 803(5)(B) to a debt collector earlier than 90 days after the date on which the obligation or alleged obligation becomes delinquent or defaults.</text></subsection> <subsection id="H9153D88E70BA4E9987A8205CBAC4F846"><enum>(b)</enum><header>Required notice</header> <paragraph id="H4E000FF2061D4400966DDD4DD728FFFD"><enum>(1)</enum><header>In general</header><text>Before transferring or selling a debt described in section 803(5)(B) to a debt collector or contracting with a debt collector to collect such a debt, a Federal agency shall notify the consumer not fewer than 3 times that the Federal agency will take such action.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6C2E7A0F35674FEB8A79B1B5DE6B5214"><enum>(2)</enum><header>Frequency of notifications</header><text>The second and third notifications described in paragraph (1) shall be made not less than 30 days after the date on which the previous notification is made.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HE5BBDFEAFB2B4B4886624ED7B3F7E436"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Fair Debt Collection Practices Act is amended by inserting after the item relating to section 812 the following:</text>

<section id="H379E91305B3C4CE186A8A77D6AFA3623"><enum>604.</enum><header>Unfair practices</header><text display-inline="no-display-inline">Section 808 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692f">15 U.S.C. 1692f</external-xref>) is amended by striking paragraph (1) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HAC46E5EDB10D4393B27698B8E7463A6A" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="HD8A4A885C58242569CB8739D47B7BBAF"><enum>(1)</enum><text display-inline="yes-display-inline">The collection of any amount (including any interest, fee, charge, or expense incidental to the principal obligation) unless—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H63985B67ADFA46ADBDD833CCB3DA3BB0"><enum>(A)</enum><text display-inline="yes-display-inline">such amount is expressly authorized by the agreement creating the debt or permitted by law; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB4D116D232AC4E01BBFEED66D5072AB0"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of any amount charged by a debt collector collecting a debt described in section 803(5)(B), such amount is—</text> 
<clause commented="no" display-inline="no-display-inline" id="H3933BDA77BEA443AB0A87CA955B573C3"><enum>(i)</enum><text>reasonable in relation to the actual costs of the collection;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H18EC6314363741E7A8E9224A84E64EE0"><enum>(ii)</enum><text>authorized by a contract between the debt collector and the Federal or State government; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H609C49A39E40482683A5431C5403170A"><enum>(iii)</enum><text>not greater than 10 percent of the amount collected by the debt collector.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H349120B699C64EB488E5088887127235"><enum>605.</enum><header>GAO study and report</header> <subsection id="H920A074BEA4E4F0B8081AB38C4BE1005"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall commence a study on the use of debt collectors by Federal and State government agencies, including—</text> 
<paragraph id="H0539E91BAD9C44B5B0998517FD055DD8"><enum>(1)</enum><text display-inline="yes-display-inline">the powers given to the debt collectors by Federal and State government agencies;</text></paragraph> <paragraph id="HB3A2F92FB3DF4431BD80ABD334CD6731"><enum>(2)</enum><text>the contracting process that allows a Federal or State government agency to award debt collection to a certain company, including the selection process;</text></paragraph> 
<paragraph id="H904F434AAA3644A0B5539E13F2EF8073"><enum>(3)</enum><text>any fees charged to debtors in addition to principal and interest on the outstanding debt;</text></paragraph> <paragraph id="H6725E56FEE66446695F246B29FC6E2DC"><enum>(4)</enum><text>how the fees described in paragraph (3) vary from State to State;</text></paragraph> 
<paragraph id="HEAAB9E6932964CE38622579D00C133D0"><enum>(5)</enum><text>consumer protection at the Federal and State level that offer recourse to those whom debts have been wrongfully attributed;</text></paragraph> <paragraph id="HE4FF3C2A7F474AC8B63827E9B1DD3F91"><enum>(6)</enum><text>the revenues received by debt collectors from Federal and State government agencies;</text></paragraph> 
<paragraph id="HBFD38E42E00C48B4B211F5B1B413CC39"><enum>(7)</enum><text>the amount of any revenue sharing agreements between debt collectors and Federal and State government agencies;</text></paragraph> <paragraph id="H7A0EE2B1E3E4422C8F9C1D9CF7CB55F6"><enum>(8)</enum><text>the difference in debt collection procedures across geographic regions, including the extent to which debt collectors pursue court judgments to collect debts;</text></paragraph> 
<paragraph id="H4341B46C9E714A3C8785E84B29071EDB"><enum>(9)</enum><text>information regarding the amount collected by Federal and State government agencies through debt collectors, including the total amount and the percentage of the amount referred to the debt collectors;</text></paragraph> <paragraph id="H43072C8A21F142ACA9C4DB52C1C1CFDD"><enum>(10)</enum><text>the full cost of outsourcing collection to debt collectors;</text></paragraph> 
<paragraph id="H27491097E8514C4FB55F3C40DC559005"><enum>(11)</enum><text display-inline="yes-display-inline">government agency oversight of debt collectors to ensure that the rights of a consumer (as defined in section 803(3) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a(3)</external-xref>)) are protected and that any debt relief and payment options legally available to consumers is effectively communicated and made available;</text></paragraph> <paragraph id="H91865A6AF71A47AEB06326FE77173EF2"><enum>(12)</enum><text>the extent to which Federal and State contracts with debt collectors reflect or omit effective measures to encourage debt collectors to align their practices with public policy concerns (including relief for consumers experiencing financial hardship) beyond maximizing debt collection;</text></paragraph> 
<paragraph id="HFBB3343BD95D4ECF8D42D86D551EE287"><enum>(13)</enum><text>the extent to which debt collectors induce payment through use or threat of adverse government actions, such as arrest warrants or suspension of licenses or vehicle registration; and</text></paragraph> <paragraph id="HADFD97BB328A4E0FA41D8037B248016A"><enum>(14)</enum><text>demographic data, including race and income information, regarding the individuals subject to private collection of debts owed to government entities.</text></paragraph></subsection> 
<subsection id="H44BDFFFA74CF405091799F9BD60EFC6A"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the completed study required under subsection (a).</text></subsection> <subsection id="HB3C9F3F7744248649A502A4BC92D32F4"><enum>(c)</enum><header>State defined</header><text display-inline="yes-display-inline">For the purposes of this section, the term <quote>State</quote> has the meaning given the term section 803 of the Fair Debt Collection Practices Act. </text></subsection></section></title>

<section id="H42DDF77C546F4063A74EBB68E5AD38FA" section-type="subsequent-section"><enum>701.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Debt Collection Practices Harmonization Act</short-title></quote>.</text></section> <section id="HF18183756CD94824832A3723091B30D6"><enum>702.</enum><header>Award of damages</header> <subsection id="HBFA004DBEA124965BAD9D81871593FEA"><enum>(a)</enum><header>Additional damages indexed for inflation</header> <paragraph id="H32543BF9C95A4140BCF100BD1EC89DCF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 813 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692k">15 U.S.C. 1692k</external-xref>) is amended—</text> 
<subparagraph id="HC15D714AAE8D4214B293C941FD759B73"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(2)—</text> <clause id="HA610B56929584EEE9B847BBB7B698C66"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>; or</quote> and inserting the following: <quote>with respect to any one action taken by a debt collector in violation of this subchapter; or</quote>;</text></clause>

<subparagraph id="H9C3D2EEF7FD44258B78CFEED7042F19E"><enum>(A)</enum><text>the Consumer Price Index for All Urban Consumers (all items, United States city average) for the 12-month period ending on the June 30 preceding the date on which the percentage increase is provided, exceeds</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H29F57980AD4040729671B8DF21EE260F"><enum>(B)</enum><text>the Consumer Price Index for the 12-month period preceding January 1, 1978.</text></subparagraph></paragraph> 
<paragraph id="H4B0C805380FD473EB31DD7F390928B3F"><enum>(2)</enum><header>Annual adjustments</header><text>With respect to any fiscal year beginning after the date of the increase provided under paragraph (1), the Bureau shall provide a percentage increase (rounded to the nearest multiple of $100 or $1,000, as applicable) in the amounts set forth in this section equal to the percentage by which—</text> <subparagraph id="H58E80AC71E2544F483A65D71350C7192"><enum>(A)</enum><text>the Consumer Price Index for All Urban Consumers (all items, United States city average) for the 12-month period ending on the June 30 preceding the beginning of the fiscal year for which the increase is made, exceeds</text></subparagraph> 
<subparagraph id="HC528D40E6A88447D87A08C31A9587F5C"><enum>(B)</enum><text>the Consumer Price Index for the 12-month period preceding the 12-month period described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H1E10953A2C79462A93AFC000DA7C53EB"><enum>(2)</enum><header>Applicability</header><text>The increases made under section 813(f) of the Fair Debt Collection Practices Act, as added by paragraph (1)(C) of this subsection, shall apply with respect to failures to comply with a provision of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601</external-xref> et seq.) occurring on or after the date of enactment of this section.</text></paragraph></subsection> 
<subsection id="H36CEC8BCA3A84727AF6410A2CBB6F2CA"><enum>(b)</enum><header>Injunctive relief</header><text>Section 813(d) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692k">15 U.S.C. 1692k(d)</external-xref>) is amended by adding at the end the following: <quote>In a civil action alleging a violation of this title, the court may award appropriate relief, including injunctive relief.</quote>.</text></subsection></section> <section id="HBBEE58374AB34B1887CB18DA96214658"><enum>703.</enum><header>Prohibition on the referral of emergency individual assistance debt</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/3">Chapter 3</external-xref> of title 31, United States Code, is amended—</text> 
<paragraph id="H550394FBC9C9476996B8F9FFC383611E"><enum>(1)</enum><text>in subchapter II, by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H3B41BB93760B4C69B18A2FCF70ADA89F" style="USC"> <section id="HCC8A7C00BE6041DC884F7B96C4435A0D"><enum>334.</enum><header>Prohibition on the referral of emergency individual assistance debt</header><text display-inline="no-display-inline">With respect to any assistance provided by the Federal Emergency Management Agency to an individual or household pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref> et seq.), if the Secretary of the Treasury seeks to recoup any amount of such assistance because of an overpayment, the Secretary may not contract with any debt collector as defined in section 803(6) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a(6)</external-xref>) or other private party to collect such amounts, unless the overpayment occurred because of fraud or deceit and the recipient of such assistance knew or should have known about such fraud or deceit.</text></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>

<section id="HD22B84A1F3D6458591E3BAF7ED3C0A30"><enum>802.</enum><header>Enforcement of security interests</header><text display-inline="no-display-inline"> Section 803(6) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a(6)</external-xref>) is further amended by striking <quote>For the purpose of section 808(6), such term also includes any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the enforcement of security interests.</quote>. </text></section></title> <title id="HE043FB957A95413EB6D16BEC506B505C"><enum>IX</enum><header>Securing Consumers Against Misrepresented Debt Act</header> <section id="H35C1D700022D4F8F869E7192A24EA368"><enum>901.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Securing Consumers Against Misrepresented Debt Act of 2021</short-title></quote> or the <quote><short-title>SCAM Debt Act</short-title></quote>.</text></section> 
<section id="H0329D625408944B5BC2F924041F3921E"><enum>902.</enum><header>Legal actions by debt collectors</header><text display-inline="no-display-inline">Section 811 of the Fair Debt Collections Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692i">15 U.S.C. 1692i</external-xref>) is amended—</text> <paragraph id="HB9019419575249A187DA3A90469485EC"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph> 
<paragraph id="H254FEE93005B416A8E0498D229B33423"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following new subsection:</text> <quoted-block style="OLC" id="HC971E5014AB542DBA3C28760FD3EBE5C" display-inline="no-display-inline"> <subsection id="H21C7AA6C03224413A08A36C6F05B4CEF" commented="no"><enum>(b)</enum><header>Requirements for debt collectors</header><text display-inline="yes-display-inline">A debt collector that takes legal action to collect or attempt to collect a debt shall comply with the following requirements:</text> 
<paragraph id="H43CD6F37E7F54100B78F10D91D7CA69A" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Provide the consumer written notice of the intent to take legal action, sent to the consumer’s last known address at least 30 days and not later than 60 days in advance of commencing the legal action, that shall include—</text> <subparagraph id="H945994290FB147B190D860B7EB07B3F2" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">all methods that the consumer can use to contact the debt collector; and</text></subparagraph> 
<subparagraph id="H5EFC8E74F8AB496D9D3A00093A2CFC1C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">all information contained in the notice required under section 809(a) (excluding the information described in paragraphs (3), (4), and (5) of such section), updated to ensure correctness.</text></subparagraph></paragraph> <paragraph id="HACF1FB0F6E9F4589A6386DD6E1F9CDC7" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">In the initial pleading filed by a debt collector to commence a legal action to collect a debt, include—</text> 
<subparagraph id="H7CD35AA7DEB94EB085F49EDB2396A30B" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">all information contained in the notice required under section 809(a) (excluding the information described in paragraphs (3), (4), and (5) of such section), except any account numbers and any personally identifiable information, updated to ensure correctness;</text></subparagraph> <subparagraph id="H1C150E79B98F43F5A055619131DD75CF" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the last four digits of the account number of the original debt;</text></subparagraph> 
<subparagraph id="HDD1417BCA41C43C1A7184B1695D2E2D4" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">admissible documentary evidence of—</text> <clause id="HAFB72E7AD0064B829D8987DB867E2E60"><enum>(i)</enum><text display-inline="yes-display-inline">the written agreement, contract, or instrument creating the debt, if any, or other documents showing that the consumer agreed to the agreement, contract, or instrument creating the debt;</text></clause> 
<clause id="HD703CC19DEEE420EAA2E5BA7E15D4DCC"><enum>(ii)</enum><text>any terms and conditions relevant to the debt;</text></clause> <clause id="HCBEDCE4BD2ED4A87A27758C57D2BE79B"><enum>(iii)</enum><text>that the consumer incurred the debt and the amount owed; and</text></clause> 
<clause id="H76ACC603B4CD442084316277339198EA"><enum>(iv)</enum><text>that there is a chain of title of the ownership of debt and the right to collect the debt, including documents showing the date of each transfer of ownership of the debt and the identity of each owner of the debt; and</text></clause></subparagraph> <subparagraph id="H7B131FF2AFF34C9E8AE4CCC5E9A3FCE9"><enum>(D)</enum><text display-inline="yes-display-inline">a sworn affidavit stating—</text> 
<clause id="H78C5128E24454A0CBD386C7387FCC53D"><enum>(i)</enum><text>that the applicable statute of limitations for collecting the debt has not expired and the date on which such statute of limitations expires; and</text></clause> <clause id="HDFE433F57B7644D28FB7BE2FF27817BE"><enum>(ii)</enum><text>that the debt collector personally reviewed all applicable records and documents relating to the debt to be collected.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> 
<title id="H35438923ABE44A209CFA8EAB1E70CA99"><enum>X</enum><header>Temporary relief for private student loan borrowers</header> 
<section id="HD6E689034A78454D9CF80381884A6675"><enum>1001.</enum><header>Temporary relief for private student loan borrowers</header> 
<subsection id="H532B5210AD964D34B2577D7E0660A298"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A servicer of a private education loan shall not report an adverse item of information relating to the nonpayment of a private education loan that occurred during the covered period.</text></subsection> <subsection id="HF4228AA0DF6A4EBFAAE15ACFB2BFFA56"><enum>(b)</enum><header>Consumer reporting agencies</header><text display-inline="yes-display-inline">During the covered period, a consumer reporting agency—</text> 
<paragraph id="H0DAEED932F1343B7A26BAD2B24215FFF"><enum>(1)</enum><text>may not make a consumer report containing adverse information relating to the nonpayment of a private education loan by a covered borrower; and</text></paragraph> <paragraph id="HB081B5F368C94F6B99DB33DB04F372AF"><enum>(2)</enum><text display-inline="yes-display-inline">shall promptly remove, in a period of time as determined by the Director of the Consumer Financial Protection Bureau, from a consumer report any such adverse information reported during the covered period.</text></paragraph></subsection> 
<subsection id="HF8B4C1FA21334AD6ABBAA0228326E139"><enum>(c)</enum><header>Implementation</header><text>The Director of the Consumer Financial Protection Bureau may issue guidance or rules to implement this section, including—</text> <paragraph id="H0B3BEA044B2447549B463FEDEB49D742"><enum>(1)</enum><text>requiring any notifications and other requirements that may be necessary to carry out this section; and</text></paragraph> 
<paragraph id="H0783B81F0AC44ED1BEE7ADD144137A57"><enum>(2)</enum><text>ensuring a covered borrower is aware of their rights under this section relating to the exclusion or removal of any relevant adverse information the consumer report of the consumer.</text></paragraph></subsection> <subsection id="HC0F34782CE3F497CB7DF08581CAF9505"><enum>(d)</enum><header>Effective date</header><text>This section shall take effect 30 days after the date of the enactment of this Act.</text></subsection> 
<subsection id="HFC5AFCB4A7774773B3319D97BDC05F10"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H3A7B4BBE578544B6879A3327F1FD5BF0"><enum>(1)</enum><header>Covered borrower</header><text display-inline="yes-display-inline">The term <term>covered borrower</term> means a borrower of a private education loan.</text></paragraph> 
<paragraph id="H6D0FB1790A7F4D2AB6736A81C28A73C5"><enum>(2)</enum><header>Covered period</header><text display-inline="yes-display-inline">The term <term>covered period</term> means the period beginning on March 13, 2020 (the date the President declared the emergency under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref> et seq.) relating to the Coronavirus Disease 2019 (COVID–19) pandemic) and ending on the date that is 30 days after the end of the incident period for such emergency.</text></paragraph> <paragraph id="H961850FF594C48EFBF3BAFA64E282549"><enum>(3)</enum><header>Fair Credit Reporting Act definitions</header><text display-inline="yes-display-inline">The terms <term>consumer report</term> and <term>consumer reporting agency</term> have the meanings given, respectively, in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>).</text></paragraph> 
<paragraph id="HB65AD1F5BF0E460592606AA68893F5BB"><enum>(4)</enum><header>Private education loan</header><text display-inline="yes-display-inline">The term <term>private education loan</term> has the meaning given the term in section 140 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650</external-xref>).</text></paragraph></subsection></section></title> <title id="H058A5D08C03B42C78BC01536264C3797"><enum>XI</enum><header>Reports</header> <section id="HCAD23432006D4C5EA212A09AFF2CEFDC"><enum>1101.</enum><header>Report on COVID–19 pandemic debt collection practices</header> <subsection id="HDD03981201434881B5260DFE0F02BDEA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this section, the Director of the Bureau of Consumer Financial Protection shall submit a report to Financial Services Committee of the House of Representatives and Banking Committee of the Senate that—</text> 
<paragraph id="H86A9394FF45B4530996D7176C357F359"><enum>(1)</enum><text display-inline="yes-display-inline">analyzes available data relating to consumer complaints about debt collection practices during the COVID–19 pandemic, including the collection of medical debt and the collection of debt from servicemembers; </text></paragraph> <paragraph id="H9CD1547F314043B69231DCD789B04140"><enum>(2)</enum><text display-inline="yes-display-inline">lists all enforcement actions taken by the Bureau during the COVID–19 pandemic that related to debt collection; and </text></paragraph> 
<paragraph id="H905361EA1E034989AFE2E85AEC7F9805"><enum>(3)</enum><text display-inline="yes-display-inline">describes how the Bureau will use regulatory, supervisory and enforcement tools to combat predatory debt collection practices identified during the COVID–19 pandemic.</text></paragraph></subsection> <subsection id="H59632A7C832C46F59319193B319C7A53"><enum>(b)</enum><header>Additional required information</header> <paragraph id="HC3E39AEB648D4C04B76EB07913890C60"><enum>(1)</enum><header>In general</header><text>The Director shall require each larger participant in the consumer debt collection market (as such term is defined in section 1090 of title 12 of the Code of Federal Regulations to provide to the Director information about any default judgements pursued by such larger participant through litigation during the COVID–19 pandemic.</text></paragraph> 
<paragraph id="HA95B059FE35E441D84EAA54D50B930FD"><enum>(2)</enum><header>Inclusion in report</header><text>The Director shall compile all information received from larger participants under paragraph (1) and shall include such information in the report required under subsection (a).</text></paragraph></subsection> <subsection id="HACE11B84DC0B43E5A8B3EF0F9A8213F9"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>

<paragraph id="H3FEB6E967346457F883EC5B3322FA66F"><enum>(2)</enum><header>Languages</header><text>The Director may, as determined appropriate by the Director, make the website available in languages other than English.</text></paragraph></subsection> <subsection id="H60D27D4105904ED697FB8EB700E93205"><enum>(c)</enum><header>Contents</header><text display-inline="yes-display-inline">The website established pursuant to subsection (a) may include—</text> 
<paragraph id="H1F7B02F6ECA94174A8999846694043E8"><enum>(1)</enum><text>a description of acceptable and unacceptable practices that debt collectors may engage in while attempting to collect debt; and</text></paragraph> <paragraph id="HB6F98B844748418884196A8254B5019D"><enum>(2)</enum><text>know your rights information that—</text> 
<subparagraph id="H661BC0CA2AB54661AFCBBB306197B2F3"><enum>(A)</enum><text>outlines actions a consumer may take if they are experiencing abusive or inappropriate debt collection practices;</text></subparagraph> <subparagraph id="HD816FBF25C754239A3707DF267EF0A93"><enum>(B)</enum><text display-inline="yes-display-inline">provides resources to take action to prevent or stop abusive or inappropriate debt collection practices;</text></subparagraph> 
<subparagraph id="H8C5B2F9F64864CD798EAE2D36EEC8408"><enum>(C)</enum><text display-inline="yes-display-inline">contact information and other available resources for a consumer to learn more to prevent or stop such abusive practices; and </text></subparagraph> <subparagraph id="HD34ED16AB9EF44E2ADBA45C8A1B27101"><enum>(D)</enum><text>any other information the Bureau deems appropriate to better inform consumers of their rights with respect to debt collection practices.</text></subparagraph></paragraph></subsection>

<paragraph id="H83DD1E4E2CD644528860470A07FF728C"><enum>(1)</enum><text display-inline="yes-display-inline">the frequency and nature of private student lenders challenging undue hardship bankruptcy petitions made by borrowers of private education loans; and</text></paragraph> <paragraph id="H847F30C96DCE4B6E92ED439F89A4E375"><enum>(2)</enum><text display-inline="yes-display-inline">whether private student lenders disproportionately challenge undue hardship petitions made by low-income or otherwise vulnerable borrowers of private education loans.</text></paragraph></section></title> 
<title id="HA7795F64FAE74A3F9F97990079D59E78"><enum>XV</enum><header>Reports</header> 
<section id="HE84E357797264D02AE9B366728681863"><enum>1501.</enum><header>Report on use of electronic and telephone communications in the debt collection industry</header><text display-inline="no-display-inline">Not later than 12 months after the date of the enactment of this section, the Comptroller General of the United States shall submit a report to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate that—</text> <paragraph id="HCCE046E9BCAF4F8C82F7208E35242E6D"><enum>(1)</enum><text display-inline="yes-display-inline">analyzes trends and impacts associated with the use of electronic and telephone communications in the debt collection industry, including a study of the annoyance, abuse, and harassment of consumers by debt collectors, and methods for reducing the frequency of electronic and telephone communications by debt collectors to consumers; and</text></paragraph> 
<paragraph id="H83218E3E30E14851AFF8B7E2954A9EE9"><enum>(2)</enum><text>contains specific regulatory and legislative proposals to accomplish those goals.</text></paragraph></section></title> <title id="H487866E588E0482EAED90577F23EF2C9"><enum>XVI</enum><header>Reports</header> <section id="H3BB9B6B55ECA4E48A73AF8257FAF5FBF"><enum>1601.</enum><header>Report on debt collection practices and racial disparities</header><text display-inline="no-display-inline">Not later than 18 months after the date of the enactment of this section, the Director of the Bureau of Consumer Financial Protection shall submit a report to the Financial Services Committee of the House of Representatives and Banking Committee of the Senate that—</text> 
<paragraph id="H80AB7F57A4F74E639B950FF4DE8162FC"><enum>(1)</enum><text>identifies and analyzes racial disparities relating to debt collection practices; and</text></paragraph> <paragraph id="HE27D72E5EB5D4EF688BD47FBD75E84F4"><enum>(2)</enum><text display-inline="yes-display-inline">provides administrative and legislative recommendations to address such disparities.</text></paragraph></section></title>

<section id="HA60E86E75C854CDCBB74973BCCC6C710" display-inline="no-display-inline"><enum>1701.</enum><header>Discretionary surplus funds</header>

<subsection id="H03B44B9D5BAA43869C1354D35463A377"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Effective on the date of enactment of the Economic Growth, Regulatory Relief, and Consumer Protection Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/174">Public Law 115–174</external-xref>), section 601(b) of such Act is amended to read as follows: </text> <quoted-block style="OLC" id="H8FFAAEB3E4394928A79C55881C6D2A54" display-inline="no-display-inline"> <subsection id="H5AC498539C434A82B3329FA74CF8B855"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to private education loan agreements entered into before, on, or after the date of enactment of this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H801CD80CCEF246168317872BEC99835A"><enum>(b)</enum><header>Treasury loan purchase program</header> 
<paragraph id="HE9BDF3497EB5489E8B0BD209B5657F13"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall establish a program under which the Secretary shall purchase and retire outstanding private education loans—</text> <subparagraph id="H7E14A72AD782427A80BB79D5D2DD300F"><enum>(A)</enum><text>where the borrower on such loan is deceased;</text></subparagraph> 
<subparagraph id="HEE5BDE065E10476EB6C132EDAE0D196A"><enum>(B)</enum><text>where there remains a cosigner on the loan;</text></subparagraph> <subparagraph id="H68F787E286DF464EA42A45871E79F70E"><enum>(C)</enum><text display-inline="yes-display-inline">that were entered into before the date that is 180 days after the date of enactment of the Economic Growth, Regulatory Relief, and Consumer Protection Act; and</text></subparagraph> 
<subparagraph id="HBB905781B49D451ABC331E2A836C40AC"><enum>(D)</enum><text>only upon an application from a holder of such loan pursuant to paragraph (2) that demonstrates the holder has suffered financial injury as a result of the amendment made by subsection (a).</text></subparagraph></paragraph> <paragraph id="H76F57A573F0D484C963784691B87D058"><enum>(2)</enum><header>Application</header><text>The holder of a loan described under paragraph (1) may apply to the Secretary of the Treasury to have the Secretary purchase and retire such loan by submitting an application in such form and manner as the Secretary may require.</text></paragraph> 
<paragraph id="H6648ED1280B24B9090536A81AD1FCA44"><enum>(3)</enum><header>Authorization of appropriation</header><text>There is authorized to be appropriated to the Secretary of the Treasury $5,000,000 to carry out this subsection.</text></paragraph> <paragraph id="H636FF6E53E9A4F4685A39F0BDAF5B2BE"><enum>(4)</enum><header>Truth in Lending Act terms</header><text>In this subsection, the terms <quote>cosigner</quote> and <quote>private education loan</quote> have the meaning given those terms, respectively, under section 140 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650</external-xref>).</text></paragraph></subsection> 
<subsection id="H470FDECBC3344D0CA9F0C0203620F008"><enum>(c)</enum><header>Severability</header><text display-inline="yes-display-inline">The provisions of this Act are severable.
