Maloney of New York</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="E000297">Mr. Espaillat</cosponsor>, <cosponsor name-id="C001067">Ms. Clarke of New York</cosponsor>, <cosponsor name-id="E000296">Mr. Evans</cosponsor>, <cosponsor name-id="W000788">Ms. Williams of Georgia</cosponsor>, and <cosponsor name-id="C001072">Mr. Carson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Education to make grants for hate crime prevention and prejudice reduction education, and for other purposes.</official-title></form><legis-body id="HD99853EDB92D4B2385BBA45FD11450D6" style="OLC"><section id="HF6E123EA089D42709E5A4DCD3C2F8A4C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Education Against Hate Crimes Act of 2021</short-title></quote>.</text></section><section id="HF760EBA5C74D4B6A8A0D41B325D223BF"><enum>2.</enum><header>Grants for hate crime prevention and prejudice reduction education</header><subsection id="H7A41913C465C4C2399EF268921498501"><enum>(a)</enum><header>Grants authorized</header><text>Beginning not later than one year after the date of enactment of this Act, the Secretary of Education shall award grants, on a competitive basis, to eligible entities to assist such entities in conducting hate crime prevention and prejudice reduction education for secondary school students and students in middle grades.</text></subsection><subsection id="HD1D8186FB7F043B8A5C665FECDC42267"><enum>(b)</enum><header>Curriculum requirements</header><text>Not later than 180 days after the date of enactment of the Act, the Secretary of Education, in consultation with Secretary of Homeland Security and the Attorney General, shall develop requirements for the curriculum of the hate crime prevention and prejudice reduction education conducted with a grant under this section.</text></subsection><subsection id="H8F7A54CFD3C548E0A0FF37CEC5ECA820"><enum>(c)</enum><header>Grant amount</header><text>The amount of a grant awarded under this section shall not exceed $1,500,000 for any fiscal year.</text></subsection><subsection id="H88F44A14775749209363BE98F1B4B238"><enum>(d)</enum><header>Applications</header><paragraph id="H943D849431EF4B358B73D3951F30A5CE"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="H3F31D42BC6C94530BED07A31BA4B2147"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give priority to eligible entities that will provide hate crime prevention and prejudice reduction education in geographic areas where there is disproportionate hate crime activity relative to the total population of the area. The Secretary may consult with the Attorney General to identify eligible entities that meet the requirements for priority consideration under this paragraph.</text></paragraph></subsection><subsection id="H1F9120B820A34F2880F173300DC31BDB"><enum>(e)</enum><header>Reporting requirements</header><text>On an annual basis in each year for which an eligible entity receives a grant under this section, the entity shall submit to the Secretary a report that includes—</text><paragraph id="H10EDD1C8889E4506AB4B032EAC301E6F"><enum>(1)</enum><text>a description of how the grant was used;</text></paragraph><paragraph id="H987B2472D9874831B926D804CA02244B"><enum>(2)</enum><text display-inline="yes-display-inline">the number of secondary school students who enrolled in and completed a program of hate crime prevention and prejudice reduction education;</text></paragraph><paragraph id="H1165FB2A50A74932A793B56536E87D09"><enum>(3)</enum><text>the number of teachers who provided instruction to students in hate crime prevention and prejudice reduction education; and</text></paragraph><paragraph id="H1783619AAC0C404BAB15873C1BD35A48"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the strategies and best practices employed to achieve the objectives under the grant. </text></paragraph></subsection><subsection id="H60D260C797D342D79293D99D7A157848"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF89DB89091ED452A936F1C636AEEBD3F"><enum>(1)</enum><header>Hate crime and prejudice reduction education</header><text display-inline="yes-display-inline">The term <term>hate crime and prejudice reduction education</term> means culturally relevant education (available in multiple languages, consistent with census data and demographics of the area which the education will be provided) to prevent, address, deter, and dissuade crimes against persons or an individual’s property due to the actual or perceived race, color, religion, national origin, ethnicity, gender, gender identity, disability, age, or sexual orientation of any person.</text></paragraph><paragraph id="HAE7596F2C89942C486C8E675971C903B"><enum>(2)</enum><header>Eligibile entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a State, a local educational agency, or a nonprofit organization.</text></paragraph><paragraph id="HDD411BA16E5B4EBDAC0D453C4B2A2602"><enum>(3)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <term>local educational agency</term>, <quote>middle grades</quote>, <term>secondary school</term>, and <term>Secretary</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="HB93D8D06496046F98BB557D3CDA77203"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the United States Virgin Islands.</text></paragraph></subsection><subsection id="H226E544B07F5436788D806BB60601C5C"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal years 2022 through 2032.</text></subsection></section></legis-body></bill>
