NATIONAL PLANS TO SECTION 134</header><section id="HE3D7E3EFDF2F491499CBB556AA9F223E"><enum>1001.</enum><header>Policy</header><text display-inline="no-display-inline">Section 134(a)(1) of title 23, United States Code, is amended to read as follows:</text><quoted-block id="HB0F243AD934646A28FCC71BCA61B9889" style="OLC"><paragraph id="H8296BAD6F5D3439DBA8AF3DFDFDDCB51"><enum>(1)</enum><text>to encourage and promote the safe and efficient management, operation, and development of surface transportation systems and support Transportation demand management expectations and goals that will serve the mobility needs of the people and freight, foster economic growth and development within and between States and urbanized areas, and to take into consideration resiliency needs while minimizing transportation related fuel consumption, congestion, and air pollution through metropolitan and Statewide transportation planning processes in this chapter; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5F24213BCD764F4682E7F3FA7075445F"><enum>1002.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101(a) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block id="H585E4EF64D6440C2AD919BAADF383877" style="OLC"><paragraph id="HDBA0F6F1205B482782CE55FA387947EA"><enum>(35)</enum><header>Transportation demand management; tdm</header><text>The terms <quote>Transportation Demand Management</quote> and <quote>TDM</quote> mean the use of strategies to inform and encourage travelers to maximize the efficiency of a transportation system leading to improved mobility, reduced congestion, and lower vehicle emissions.</text></paragraph><paragraph id="H304F6D672A75440DADB9DCE373A9E4A6"><enum>(36)</enum><header>Transportation demand management strategies</header><text>The term <quote>Transportation Demand Management Strategies</quote> means the use of planning, programs, policy, marketing, communications, incentives, pricing, data, and technology to shift travel mode, routes used, departure times, number of trips, and location and design of work spaces or public attractions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H75A97C309A3A458BB57C9DC514CD49A0"><enum>1003.</enum><header>Requirements</header><text display-inline="no-display-inline">Section 134(c) of title 23, United States Code, is amended—</text><paragraph id="HE2402CBEC59249138968E6F9C5D400E6"><enum>(1)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block id="H3375A3D8705B4F9892A819E2F4B25452" style="OLC"><paragraph id="HBA5CF0F6E779442A81BC410F37560A53"><enum>(2)</enum><header>Contents</header><text>The plans and TIPs for each metropolitan area shall provide for the development and integrated management, including transportation demand management, and operation of transportation systems and facilities (including accessible pedestrian walkways, bicycle transportation facilities, and intermodal facilities that support intercity transportation and reduce the need of single-occupancy vehicles and intercity bus facilities and commuter vanpool providers) that will function as an intermodal transportation system for the metropolitan planning area and as an integral part of an intermodal transportation system for the State and the United States.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HADA2F202544B4FD69B12ADBFB5B6FE8D"><enum>(2)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block id="H552A58BCF29B464AB9CF968F85A68A9A" style="OLC"><paragraph id="H523777793555420CB162DA9E195C6C91"><enum>(3)</enum><header>Process of development</header><text>The process for developing the plans and TIPs shall provide for consideration of all modes of transportation and transportation demand management and shall be continuing, cooperative, and comprehensive to the degree appropriate, based on the complexity of the transportation problems to be addressed.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H1EAF9BA4D19149D1A92A2778E7704DB5"><enum>1004.</enum><header>Planning</header><text display-inline="no-display-inline">Section 134(h) of title 23, United States Code, is amended—</text><paragraph id="H7F17A25FA6D34ED489E44D0F229EFA5E"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HC8B79B8690E44FA9ABC529368B2C7895"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (I);</text></subparagraph><subparagraph id="HB94EA1DEE99240138EAB0801D3B3DC15"><enum>(B)</enum><text>by striking the period at the end of subparagraph (J) and inserting a semicolon; and</text></subparagraph><subparagraph id="HA39A25E52673447EA7A0CA18C0BB8037"><enum>(C)</enum><text>by adding at the end, the following:</text><quoted-block id="HF23BEA924739415CB0EF1BB004E93D3C" style="OLC"><subparagraph id="HADD8ACC4284B4D318F9EDD601DFC1774"><enum>(K)</enum><text>summarize the issues, problems, barriers and existing policies and programs of transportation demand management;</text></subparagraph><subparagraph id="HF5CEE75C6DD74681AF0C1FF4D963889F"><enum>(L)</enum><text>incentivize equitable and lower-cost options for transportation systems, including transportation demand management;</text></subparagraph><subparagraph id="HFBBB25EEBF384B22AC53BC0AB9709964"><enum>(M)</enum><text>identify strategies which provide multimodal choices to single-occupancy vehicle travel on the road; and</text></subparagraph><subparagraph id="H2F5C73CBE2EF4548A0A030CEB3600D36"><enum>(N)</enum><text>mitigate congestion-related issues and identify alternative transportation routes and options during times of severe weather storms and other natural disasters declared local, State, and Federal state of emergencies.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H029CDBBCDB09478B875FAE462477CD20"><enum>(2)</enum><text>in paragraph (2)(B), by inserting after clause (ii) the following:</text><quoted-block id="H3B1B3C75440B4E1DA73FAA1992B55CEC" style="OLC"><clause id="HFCFC2BFA04F04601B231DDC2FAB76BE2"><enum>(iii)</enum><header>Transportation demand management targets</header><text display-inline="yes-display-inline">Each Metropolitan planning organization that is considered to be in nonattainment or maintenance areas for at least one National Ambient Air Quality Standard as defined under the Clean Air Act shall establish demand management targets that address the objectives, issues, and goals of transportation demand management described in subsection (b), where applicable, to use in tracking progress toward attainment of such critical outcomes for the region of the metropolitan planning organization.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H2D8DF2E0A4744C7C913699D9019B4090"><enum>II</enum><header>ADOPTING THE STATE PLANS TO SECTION 135</header><section id="H1998B78B564B421A8E73F4758F249333"><enum>2001.</enum><header>Requirements</header><text display-inline="no-display-inline">Section 135(a)(2) of title 23, United States Code, is amended to read as follows:</text><quoted-block id="H739FB1DA333A4B2C9C4CAB7C6FC44EE9" style="OLC"><paragraph id="H6BE373AEF41644D9AB91C6F6ADCC2480"><enum>(2)</enum><header>Contents</header><text>The statewide transportation plan and the transportation improvement program developed for each State shall provide for transportation demand management issues, objectives development, and integrated management and operation of transportation systems and facilities (including accessible pedestrian walkways, bicycle transportation facilities, and intermodal facilities that support intercity transportation, including intercity buses and intercity bus facilities and commuter van pool providers) that will function as an intermodal transportation system and reduce the need of single occupancy vehicles for the State and an integral part of an intermodal transportation system for the United States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF0ABA61319D949DBB86A4E90AD601318"><enum>2002.</enum><header>Planning</header><text display-inline="no-display-inline">Section 135(d)(1) of title 23, United States Code, is amended—</text><paragraph id="HF0109B77403C488EAF33CE53711564F3"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subparagraph (I);</text></paragraph><paragraph id="H972EBB2885EF4CDFBD0DFDE504BD42D1"><enum>(2)</enum><text>by striking the period at the end of subparagraph (J) and inserting a semicolon; and</text></paragraph><paragraph id="H681CAC885C744A6EAC5DD150A0801394"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block id="H08FF98C54BCE4A55B7980F92284D9931" style="OLC"><subparagraph id="H007AE43BB9EF43FA8FDF014F8B95692B"><enum>(K)</enum><text>resolve issues, problems, and barriers of transportation demand management;</text></subparagraph><subparagraph id="HD0EBE64F2D534EDCA92882980C531345"><enum>(L)</enum><text>guide transportation investment decisions including transportation demand management policies, strategies, and performance measures of the State;</text></subparagraph><subparagraph id="H0A5614FE285D444D8A4E6328987C908E"><enum>(M)</enum><text>enhance private-sector and disadvantaged community involvement in providing multimodal and multioccupancy transportation programs and services that promote environmental, safety, and equity goals and increase economic activity; and</text></subparagraph><subparagraph id="HC5E583F26C1443429B2385CDD0C1B6F6"><enum>(N)</enum><text>improve operations and facilities with mobility issues within the State, and a description of the strategies the State is employing to address them, considering the objectives of transportation demand management.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H3C20EC7D4E574372AC2ECA1C507FF5E2"><enum>2003.</enum><header>Relationship to long-range plan</header><text display-inline="no-display-inline">Section 135(f)(1) of title 23, United States Code, is amended to read as follows:</text><quoted-block id="H5A8AAC252EB748E3A828BBA4E0E700FE" style="OLC"><paragraph id="H7C7CF367FE4542A49685FB7305ABB6E2"><enum>(1)</enum><header>Development</header><text>Each State shall develop a long-range Statewide transportation plan, with a minimum 20-year forecast period for all areas of the State, that provides for the development and implementation of the intermodal transportation system and supports the objectives of transportation demand management of the State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H1F39E5E7FB884849BCD2E15759E0B5FA"><enum>III</enum><header>APPROPRIATIONS AND GRANT PROGRAMS</header><section id="HC3CCB85D758D4802818B26E5E3E3DE11"><enum>3001.</enum><header>Authorizations of appropriations</header><subsection id="H4DDAC9B9A0B54AD2AEE187D56BAC9682"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/23/170">section 170</external-xref> the following:</text><quoted-block id="H9D648C4EE292446AABDF1AE479D19D5F" style="USC"><section id="HC43279EEDCDE4EC69150768BB03A2C7A"><enum>171.</enum><header>Transportation Demand Management implementation program</header><text display-inline="no-display-inline">The Secretary of Transportation shall establish a program to encourage and assist the development and funding of Transportation Demand Management related projects in accordance with this section and to further direct Federal resources, as authorized in this section, towards implementation of Transportation Demand Management objectives described in section 134(b).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H34DB5EA2588B457380BC265EC6940673"><enum>(b)</enum><header>In general</header><text>The following sums are authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account): $250,000,000 for each of fiscal years 2022 through 2026, to carry out section 171 of title 23, United States Code.</text></subsection><subsection id="H61623C2206E946DAB388C9333873AD2F"><enum>(c)</enum><header>Division of funds among states</header><text>The Secretary shall distribute the funds authorized in subsection (b) to the 50 States and the District of Columbia in accordance with the formula described in subsection (d).</text></subsection><subsection id="H79D7941A895F43839193D23B9C0FD26A"><enum>(d)</enum><header>Calculation of State amounts</header><text>For each of fiscal years 2022 through 2026, funds shall be distributed to each State and the District of Columbia in a formula that mirrors the allocation/apportionment percentage each State or the District of Columbia receives under section 104(c) of title 23, United States Code.</text></subsection><subsection id="H803A18861034490888A8FCE7D260DA13"><enum>(e)</enum><header>Use of funds</header><paragraph id="H2A103945F24B424F9A2C2A66BF9FE161"><enum>(1)</enum><header>In general</header><text>States shall distribute funds authorized under the TDM Implementation Program in the form of competitive grants to eligible entities to support the implementation of projects and programs identified within a State adopted Transportation Demand Management plan to support the movement of people and result in reduced congestion, environmental benefits, improved equity within transportation systems, and support economic activity.</text></paragraph><paragraph id="H7AC5C06468BA4F9987F6B6FB551FD4C6"><enum>(2)</enum><header>Eligible projects</header><text>Funds apportioned to the State under this section for the TDM Implementation program may be obligated to carry out one or more of the following:</text><subparagraph id="HF83E4787D0EC4F809C4C2785B3FCD8E7"><enum>(A)</enum><text>Technologies designed to inform and promote the use of non-single occupancy vehicles.</text></subparagraph><subparagraph id="HE37E2375FF164DB3A9B07226F7E948EF"><enum>(B)</enum><text>Technologies designed to inform and promote alternative trip mode options that improve and assist the movement of all people.</text></subparagraph><subparagraph id="H2BCF6878089446E79B489CDCC7950E59"><enum>(C)</enum><text>Marketing and promotional efforts to promote mode choice and reduce the environmental impacts of commuter movement.</text></subparagraph><subparagraph id="HEF6221B978584E40BC14683853ED37A7"><enum>(D)</enum><text>Real-time traffic and multimodal transportation information systems that aim to influence travel mode decisions and behavior.</text></subparagraph><subparagraph id="HA6FE439574D14111B100C44A6F24F949"><enum>(E)</enum><text>Work zone management and information systems that aim to shift travel modes during construction.</text></subparagraph><subparagraph id="HD38B1A72A74A45F0A2920AD4AE02137D"><enum>(F)</enum><text>Support the development of plans that enhance disaster preparedness and mitigate congestion along major travel routes during times of emergency, natural disasters, and construction that impacts existing road capacity.</text></subparagraph><subparagraph id="H8A1F3BCFB9F6446B8C4A3FF079DF6C34"><enum>(G)</enum><text>Any other multimodal surface transportation project to improve the equitable flow of all people and goods within the existing national highway infrastructure network.</text></subparagraph></paragraph><paragraph id="H3B6A5B3AD0964BCB915A2FD0CC4DD555"><enum>(3)</enum><header>Eligible entities</header><text>States are authorized to award competitive grant funds, as identified in this section, to the following organizations or entities:</text><subparagraph id="HAA8B7D3E4B3349A99B4E34ED9495F4BE"><enum>(A)</enum><text>Transportation Demand Management product and service providers, and related Transportation Demand Management associations.</text></subparagraph><subparagraph id="HD5DA89A14DC94F1D8B53C5BE87E7ED26"><enum>(B)</enum><text>Transportation Management Associations and Transportation Management Organizations.</text></subparagraph><subparagraph id="HF439C413892840B9B3F93DAF451E98F6"><enum>(C)</enum><text>Metropolitan Organizations.</text></subparagraph><subparagraph id="H3AC5EBFB3CC144B098802FC311EA925A"><enum>(D)</enum><text>Regional Planning Organizations.</text></subparagraph><subparagraph id="H760D690224F74440A34E532D197AF66B"><enum>(E)</enum><text>Public transportation Agencies.</text></subparagraph><subparagraph id="H968278A54E0A49B296D942839ECCBFD8"><enum>(F)</enum><text>Local governments.</text></subparagraph></paragraph></subsection><subsection id="HC26AEFB649A64636BBEE61B76D01BF70"><enum>(f)</enum><header>Definitions</header><text>For purposes of this section, the terms <quote>Transportation Management Associations</quote> or <quote>TMAs</quote> and <quote>Transportation Management Organizations</quote> or <quote>(TMOs)</quote> mean associations, organizations, or cooperatives that provide transportation services and education to businesses, property owners, residents, and employees in a defined geographic area, combining their efforts to expand transportation options and reduce program costs. TMAs and TMOs are not-for-profit collaborations of private and public sector entities working together toward common goals, such as congestion mitigation, transportation services, and pollution reduction.</text></subsection><subsection id="HA82D68CA8DFC46B0B26D428AD71CAE22"><enum>(g)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/170">section 170</external-xref> the following:</text><quoted-block id="H6E65851368DE40209638F2F685553677" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">171. Transportation Demand Management implementation program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H12A1138A9EFF4F18863BB48D8FAC5703"><enum>3002.</enum><header>Grants</header><subsection id="HBEE528DA1F58429B95E3F1452218513F"><enum>(a)</enum><header>Authorization</header><text>The Secretary shall make grants under this section to eligible nonprofit institutions of higher education to establish and operate a university transportation center for research and development related to Transportation Demand Management and Transportation Demand Management Strategies.</text></subsection><subsection id="H482A0C995AF046AD8528ABCB05B331B2"><enum>(b)</enum><header>Authorized funds</header><text>The Secretary may distribute $3,000,000 for the creation of a University Transportation Center dedicated towards the advancement of transportation demand management, the understanding of behavior in mobility decisions, and the development of mobility as a service applications.</text></subsection><subsection id="HD970FAFE084F4CE7A5410F437C977C4D"><enum>(c)</enum><header>Eligible use of funds</header><text>The funds authorized in this section shall be used for the establishment of university transportation dedicated towards the research and development of transportation demand management and transportation demand management strategies. Funds may be used for the research of TDM related topics, as defined under section 1002.</text></subsection><subsection id="H3D665BF78D8B4347BDE335BD7BE46D42"><enum>(d)</enum><header>Eligible applicants</header><text>To receive a grant under this section, applicants must be in accordance with requirements outlined in title 49, United States Code.</text></subsection><subsection id="H0BDD0743B5694252A97D67BD27FE3FF1"><enum>(e)</enum><header>Competitive selection process</header><text>To receive a grant under this section—</text><paragraph id="H38220E9F68E84947BEB2AFD7E6002FC8"><enum>(1)</enum><text>a consortium of nonprofit institutions of higher education shall submit to the Secretary an application that is in such form and contains such information as the Secretary may require; and</text></paragraph><paragraph id="H6B1F2A0FE5824D7BA2A6A02698EEA5E6"><enum>(2)</enum><text>the awardee must follow and be in accordance with the process as described in section 5505(b) of title 49, United States Code.</text></paragraph></subsection></section></title><title id="HC0D9D3C90F6D41FE8AE75BE8139DC151"><enum>IV</enum><header>NATIONAL AND STATE ADVISORY COMMITTEES ON TRANSPORTATION DEMAND MANAGEMENT</header><section id="H4E5B36AA232F42678E036692667395EA"><enum>4001.</enum><header>National and State advisory committees on transportation demand management</header><subsection id="HFC6FD388E8D941AAA249B5CB934F685C"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/23/171">section 171</external-xref> the following:</text><quoted-block id="HA7E78850AF04478B92C998A1F9A59053" style="USC"><section id="H11C4A324F1AA4B8780E92953BF5AEFB7"><enum>172.</enum><header>National and State advisory committees on transportation demand management</header><subsection id="H7308DF414BC3418B88F11B359FDF3A90"><enum>(a)</enum><header>Establishment of national advisory committee of transportation demand management</header><paragraph id="H3C9DE93F382948EFA7E6F5D91D1BDE5F"><enum>(1)</enum><header>In general</header><text>The Administrator of Federal Highways Administration shall establish a National Advisory Committee for Transportation Demand Management in accordance with this section to strategically direct Federal resources and policies toward implementation of Transportation Demand Management objectives described in section 134(b).</text></paragraph><paragraph id="HA7FAA95701114FB9860BC070D8775B6C"><enum>(2)</enum><header>Committee membership</header><text>The National Advisory Committee of Transportation Demand Management shall include no fewer than 11 representatives with at least one Transportation Demand Management––Certified Professional and the others chosen from—</text><subparagraph id="HABAFC150340D48E6946313320C8247CE"><enum>(A)</enum><text>the transportation industry, product and service providers, and related Transportation Demand Management associations;</text></subparagraph><subparagraph id="HBC67678E1F6E4A6989F5B43FFA0DEBD2"><enum>(B)</enum><text>large corporations, large nonprofits, and universities who need to move large numbers of students and employees;</text></subparagraph><subparagraph id="H0932DA1C40314652B6E653ADD628B4AB"><enum>(C)</enum><text>organizations representing commuters;</text></subparagraph><subparagraph id="H899877850AA94402A36D5D5A8D296346"><enum>(D)</enum><text>State Transportation Demand Management workforce;</text></subparagraph><subparagraph id="HB0774D5A2E71409691EE6A2C19EEC5B6"><enum>(E)</enum><text>State departments of transportation;</text></subparagraph><subparagraph id="H17CC79EE86DE4147B8BA092A9128CAF2"><enum>(F)</enum><text>public transportation entities;</text></subparagraph><subparagraph id="H57030572A1E048CCA1778E04175FBCC5"><enum>(G)</enum><text>regional and metropolitan planning organizations; and</text></subparagraph><subparagraph id="HE425FD2FE6194C3DBECC21D6BB8BF305"><enum>(H)</enum><text>local governments.</text></subparagraph></paragraph><paragraph id="H9C04FF38ECE6472489A5E694E423D217"><enum>(3)</enum><header>Transportation demand management conditions and performance reports</header><text>Not later than 2 years after the date of enactment of this section, and every 5 years thereafter, the Administrator shall prepare and submit to Congress a report that describes the conditions and performance of the National Transportation Demand Management Program in the United States.</text></paragraph></subsection><subsection id="HA76CDF340A6D469C8BC9547EE780E25B"><enum>(b)</enum><header>Establishment of state advisory committees on transportation demand management</header><paragraph id="H45CB9B69FC144CE9A9F94361C4D3FED2"><enum>(1)</enum><header>In general</header><text>Each State shall develop advisory committees focused on the development and furthering of the principles of transportation demand management within their respective jurisdiction.</text></paragraph><paragraph id="HEE48556A1A80463BB7A07AB9D60875E2"><enum>(2)</enum><header>Purpose</header><text>The State Transportation Demand Management Advisory Committees shall Serve as a body of transportation demand management experts from within a State that will draft and approve State Transportation Demand management plans.</text></paragraph><paragraph id="HDD3ED1F3C0914745B7A7F192EDC3ED20"><enum>(3)</enum><header>Submission</header><text>Approved State Transportation Demand Management plans shall be submitted to the Administrator of the Federal Highways Administration before a State is eligible to receive funds authorized under section 104(b).</text></paragraph><paragraph id="H9E392B3D4E83485B87307D3F95B459B1"><enum>(4)</enum><header>Role</header><text>The State Transportation Demand Management Advisory Committees shall—</text><subparagraph id="HAD6C60796EBD4397AB6243A74B5EAD82"><enum>(A)</enum><text>advise the State on transportation demand management-related priorities, issues, projects, and funding needs;</text></subparagraph><subparagraph id="H2B24B5D8C81D47048EAC394B9AE650D8"><enum>(B)</enum><text>serve as a forum for discussion for State transportation decisions affecting the movement of people;</text></subparagraph><subparagraph id="H6FB9A291CC784651AE5FF6435E58BD7C"><enum>(C)</enum><text>communicate and coordinate regional priorities with other organizations;</text></subparagraph><subparagraph id="HB53A1BFE6EB54BABA166592D908372B2"><enum>(D)</enum><text>promote the sharing of information between the private and public sectors on efficiency of transportation infrastructure systems and transportation demand management best practices;</text></subparagraph><subparagraph id="H20EAE315AE1F4E71BCB8DB82ACF44B22"><enum>(E)</enum><text>facilitate coordination and collaboration between public and private organizations; and</text></subparagraph><subparagraph id="H96EDD9EB739049F496E0FA10C6224AB4"><enum>(F)</enum><text>participate in the development of the transportation demand management plan of the State and region.</text></subparagraph></paragraph><paragraph id="HA05B7285EFA54CABB6F20AC6A4D16F1F"><enum>(5)</enum><header>Membership</header><subparagraph id="H7B221150CF7E40569512C8441E4FDE88"><enum>(A)</enum><header>In general</header><text>A State Transportation Demand Management Advisory Committee shall consist of representatives from a cross-section of public and private sector transportation stakeholders.</text></subparagraph><subparagraph id="H5E15B0B1FC7440DFBFB1C710C31C8A88"><enum>(B)</enum><header>Representatives</header><text>A State Advisory Committee shall consist of not fewer than 11 eligible representatives.</text></subparagraph><subparagraph id="HF3116625C67F468BBDFD49CFFB26F0AA"><enum>(C)</enum><header>Eligible appointees</header><text>Eligible State Advisory Committee appointees includes representatives from—</text><clause id="H72BA8B6F239A4BCFBE6BDA0C78851959"><enum>(i)</enum><text>transportation product and service providers;</text></clause><clause id="H132499566FCF486690DB2B86A39B4C4D"><enum>(ii)</enum><text>large nonprofits and universities who need to move large numbers of students and employees;</text></clause><clause id="H5596A6737E4A4D40B59C514D997D815C"><enum>(iii)</enum><text>large corporations with large numbers of employees;</text></clause><clause id="H58DD155CB9EA430A937CAAF531AD01EE"><enum>(iv)</enum><text>transportation demand management-related associations;</text></clause><clause id="H7D7C9C1EEFF846E5BFDC43E825E7C174"><enum>(v)</enum><text>organizations representing commuters;</text></clause><clause id="H6D3710E968DE47D882DBF79036A5114F"><enum>(vi)</enum><text>regional and metropolitan planning organizations;</text></clause><clause id="H580A43DDAD4F4B4F97AEA4018DF56860"><enum>(vii)</enum><text>the transportation department of the State;</text></clause><clause id="H2B888E4E61F247C0B57AD2165A11BF31"><enum>(viii)</enum><text>public transportation entities;</text></clause><clause id="HC2C44143E6B44A7A9ABDDA10F772D392"><enum>(ix)</enum><text>association representing commuters; and</text></clause><clause id="HD6DBFB1C313F4E06AF8259A1BA16380A"><enum>(x)</enum><text>local governments.</text></clause></subparagraph></paragraph><paragraph id="HD55A6DD65F17448AA0D2BD88E28126A1"><enum>(6)</enum><header>Appointment of advisory committee</header><text>The head of the department of transportation for a State shall have the power to appoint the members of the applicable State Transportation Demand Management Advisory Committee.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5296E7922D174B62BDA8D94EE9A58B11"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is further amended by inserting after the item relating to section 171 the following:</text><quoted-block style="USC" id="H402C10AF526F4C3BA0C0FA192BF7EFF5" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">172.
