which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Secretary of the Interior to establish the January 8<superscript>th</superscript> National Memorial in Tucson, Arizona, as an affiliated area of the National Park System, and for other purposes.</official-title></form><legis-body id="H43997F1A19554762BACCB595B75C21EF" style="OLC"><section id="H365B2783F8E74F25B8A5F2E789FE2941" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>January 8<superscript>th</superscript> National Memorial Act</short-title></quote>.</text></section><section id="H578F6FBE6DFB40DEB673A2519A0A2F5A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H800765FF552542AB93093995232E0C53"><enum>(1)</enum><text display-inline="yes-display-inline">The tragedy of January 8, 2011, at Congresswoman Gabrielle Gifford’s <quote>Congress on Your Corner</quote> event resulted in the deaths of 6 people (Christina-Taylor Green, Dorothy Morris, U.S. District Court Judge John Roll, Phyllis Schneck, Dorwan Stoddard, and Gabe Zimmerman) and injury of 13 others (Congresswoman Giffords, Bill Badger, Ron Barber, Kenneth Dorushka, James Eric Fuller, Randy Gardner, Susan Hileman, George Morris, Mary Reed, Pam Simon, Mavanell Stoddard, Jim Tucker, and Kenneth Veeder).</text></paragraph><paragraph id="H6D4ED6D9CB78456780EDD605AD5D55EC"><enum>(2)</enum><text display-inline="yes-display-inline">This was the first time in the history of the United States that an assassination attempt was made upon a Congressional Member while she was meeting with constituents.</text></paragraph><paragraph id="H790AF4BA730A4570BFDDE3FC53CAB9C2"><enum>(3)</enum><text>Congresswoman Giffords sustained severe injuries that affect her to this day.</text></paragraph><paragraph id="H773149AE668B447CB7FEF68888A4D903"><enum>(4)</enum><text display-inline="yes-display-inline">Gabe Zimmerman was the first Congressional staffer to be assassinated in the line of duty.</text></paragraph><paragraph id="HC36B4A217999463380F0C7D756115226"><enum>(5)</enum><text display-inline="yes-display-inline">The Arizona community and people from all over the world came together in the days that followed the tragedy to provide comfort and support to one another at three spontaneous memorial vigil sites—</text><subparagraph id="H9E6941DF773A478EA54CD501A0AFB2B7"><enum>(A)</enum><text>the shopping center where the shooting took place;</text></subparagraph><subparagraph id="H338CC3CDDADA411F8A00EDA7A60FBE1C"><enum>(B)</enum><text>the front lawn of University Medical Center, where many of the victims were treated; and</text></subparagraph><subparagraph id="H2BAA3ADE9D534521B629383511BDF2BA"><enum>(C)</enum><text>at Congresswoman Giffords’ Tucson district office.</text></subparagraph></paragraph><paragraph id="H95413BEBC3F546C68244BC767D255BB8"><enum>(6)</enum><text display-inline="yes-display-inline">Tucson’s January 8<superscript>th</superscript> Memorial will not only be a tribute to those who died that day, but also to the local, national, and international response to the tragedy.</text></paragraph><paragraph id="HA57D073795AB4ECFB5EDB0522207724B"><enum>(7)</enum><text>The memorial will be constructed, managed, and maintained to be a place where visitors, young and old, can learn not only about one horrific event, but about the resilience of a community and the durability of democracy in the United States.</text></paragraph></section><section id="H51AA6F7090AA4CC2B0329FF13FA179E0" section-type="subsequent-section"><enum>3.</enum><header>January 8<superscript>TH</superscript> National Memorial</header><subsection id="H1F0795E27C6D469986D6938C5102BF5F"><enum>(a)</enum><header>Definitions</header><paragraph id="H7E6AFD7F0BF64BBBB5D229FDEEB9A437"><enum>(1)</enum><header>Memorial</header><text display-inline="yes-display-inline">The term <term>Memorial</term> means the January 8<superscript>th</superscript> National Memorial.</text></paragraph><paragraph id="H87027733A9CC44AA8DB70E76FD83C20B"><enum>(2)</enum><header>Foundation</header><text display-inline="yes-display-inline">The term <term>Foundation</term> means the Tucson’s January 8<superscript>th</superscript> Memorial Foundation, an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></paragraph><paragraph id="H34775001432943649F481A9792290348"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Phase 1 Siteplan + Survey Plan</quote>, numbered LA_2.01, and dated November 11, 2016.</text></paragraph><paragraph id="H9FC11BCB4B7D46A795BE7A18BC723000"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="HFD624FBA448343359978F2F5774B34EC"><enum>(b)</enum><header>January 8<superscript>TH</superscript> National Memorial</header><paragraph display-inline="no-display-inline" id="H53036A384E4A45BBB00E5E26A9AF4D71"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">As soon as practicable, the Secretary shall establish the Memorial as an affiliated area of the National Park System.</text></paragraph><paragraph id="H74A3D60AA4D8494D924EEE06601E37A5"><enum>(2)</enum><header>Funding</header><text display-inline="yes-display-inline">The Foundation shall transfer to Pima County amounts equal to final funding pledges, in addition to amounts that the Foundation has raised and transferred to Pima County for construction of the Memorial.</text></paragraph><paragraph id="HDCED9AA0009D4952BFD6D043B602E456"><enum>(3)</enum><header>Memorial construction</header><text display-inline="yes-display-inline">The Memorial shall be constructed on property owned by Pima County. Pima County shall be responsible for managing the Memorial construction contract using funds provided by the Foundation.</text></paragraph><paragraph id="HA058A89866D54ADEB0751F6DD084ECF0"><enum>(4)</enum><header>Foundation dissolution</header><text display-inline="yes-display-inline">The Foundation shall cease to operate after—</text><subparagraph id="H73F516F8692E4989ABB2E88D284227C3"><enum>(A)</enum><text display-inline="yes-display-inline">final funding pledge amounts have been paid to Pima Country; and</text></subparagraph><subparagraph id="H6D2AB3D7DEE34E56A31232255A3BB79D"><enum>(B)</enum><text>construction of the Memorial is complete.</text></subparagraph></paragraph><paragraph id="H2EDC9466DB334CEDBBBE30BCFE054EA5"><enum>(5)</enum><header>Management entity</header><text display-inline="yes-display-inline">Pima County shall be—</text><subparagraph id="HA8F65DE5F5914A99A2AF6ECA243BB88B"><enum>(A)</enum><text display-inline="yes-display-inline">the management entity for the Memorial; and</text></subparagraph><subparagraph id="HD44329CD8CE14D6B80547308185233A1"><enum>(B)</enum><text>responsible for the construction, operation, maintenance, and management of the Memorial.</text></subparagraph></paragraph><paragraph id="HF8ACF0EA79934A1B9D5F2BE89816B7A5"><enum>(6)</enum><header>Availability of map</header><text>The map shall be on file and available for public inspection at the appropriate offices of the National Park Service.</text></paragraph><paragraph id="HF923DC53E46D4E508B91B7B1DDBBB300"><enum>(7)</enum><header>Cooperative agreements</header><text display-inline="yes-display-inline">The Secretary may provide technical assistance and enter into cooperative agreements with Pima County for the purpose of providing financial assistance with marketing of the Memorial.</text></paragraph><paragraph id="H666A6AF5C53B405293E5443A0D37D679"><enum>(8)</enum><header>Limited role of the Secretary</header><text display-inline="yes-display-inline">Nothing in this Act authorizes the Secretary to acquire property or to use Federal funds for the construction, operation, maintenance, or management of the Memorial.</text></paragraph><paragraph commented="no" id="H3F4E8EB394254D0F8B00C127DFDD4C93"><enum>(9)</enum><header>General management plan</header><subparagraph commented="no" id="H2D55BA2749E84413AE510B51614CCB33"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Pima County, shall develop a general management plan for the Memorial. The plan shall be prepared in accordance with section 100502 of title 54, United States Code.</text></subparagraph><subparagraph commented="no" id="H9F0A3E4D380B482CB8F2E50B9C62455D"><enum>(B)</enum><header>Transmittal</header><text display-inline="yes-display-inline">Not later than 3 years after the Memorial is established by the Secretary, the Secretary shall provide of a copy of the completed general management plan to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
