which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Motor Carrier Safety Improvement Act of 1999 to modify certain agricultural exemptions for hours of service requirements, and for other purposes.</official-title></form><legis-body id="H6065BEEBE15B4930BE39AFE1E04F3391" style="OLC"><section section-type="section-one" id="HD7448046DDF448D19E2B8EB24ADB03E2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Haulers of Agriculture and Livestock Safety Act of 2021</short-title></quote> or the <quote><short-title>HAULS Act of 2021</short-title></quote>.</text></section><section id="H224422B31D864227A067C2596C66AA61"><enum>2.</enum><header>Transportation of agricultural commodities and farm supplies</header><text display-inline="no-display-inline">Section 229 of the Motor Carrier Safety Improvement Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/49/31136">49 U.S.C. 31136</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/159">Public Law 106–159</external-xref>) is amended—</text><paragraph id="H357C0972225A4F2D82FA3A8F3BC84D4C"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="H89E66C7E54E343A28543C1244A40B226"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>during planting and harvest periods, as determined by each State,</quote>; and</text></subparagraph><subparagraph id="H1FC8076D41144B649049577492249C39"><enum>(B)</enum><text>by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H28CBC8B7A7364EA9A69F836647E5F06A"><subparagraph id="H038BC19DDD5449A08FDB7E1290D76671"><enum>(A)</enum><text>drivers transporting agricultural commodities within a 150 air-mile radius from—</text><clause id="HCE15EE39A6CD4A38A5C7B5C93EB59C79"><enum>(i)</enum><text>the source of the agricultural commodities; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H07B1274A8F5A4FF78A63E41845F54524"><enum>(ii)</enum><text>the destination of the agricultural commodities;</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA732D8636D30477D85BDD3941573715B"><enum>(2)</enum><text>in subsection (e)(8), by striking <quote>during the planting and harvesting seasons within each State, as determined by the State, and livestock feed at any time of the year</quote> and inserting <quote>and livestock feed</quote>. </text></paragraph></section><section id="H4BDE6B83CFC84A52BF9DBEEA5DFE32C0"><enum>3.</enum><header>Definition of agricultural commodity</header><subsection commented="no" id="HACDD946D2ACA423E98B03A4F92A51C75"><enum>(a)</enum><header>In general</header><text>Section 229(e) of the Motor Carrier Safety Improvement Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/49/31136">49 U.S.C. 31136</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/159">Public Law 106–159</external-xref>) is amended by striking paragraph (7) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2FDBFA6E6F384456AF7093498E2D98F0"><paragraph commented="no" id="H83E088D9253C4574A8AA730683C52313"><enum>(7)</enum><header>Agricultural commodity</header><text>The term <term>agricultural commodity</term> has the meaning given the term in section 395.2 of title 49, Code of Federal Regulations (or a successor regulation).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA828C6737ED744808BD5D8EF64C579D1"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall revise the definition of the term <term>agricultural commodity</term> in section 395.2 of title 49, Code of Federal Regulations, to include—</text><paragraph id="H76F3F7B9A94E4F8C8CADA1ED4B0E71A0"><enum>(1)</enum><text>any nonprocessed product planted or harvested for food, feed, fuel, or fiber;</text></paragraph><paragraph id="H15650AB6DBB44FBEBC0891F7FEF409D5"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H42FD3AB971D8442D85DF07806B5995E7"><enum>(A)</enum><text>any nonhuman living animal, including—</text><clause id="H521294E4815244C4B2BD36C0B8908AB3" indent="up1"><enum>(i)</enum><text>fish; </text></clause><clause indent="up1" id="H9611A123AC314216B3F93F393B697A40"><enum>(ii)</enum><text>insects; and </text></clause><clause indent="up1" id="H594F008BE5954CB0A3254810BCBC358A"><enum>(iii)</enum><text>livestock (as defined in section 602 of the Emergency Livestock Feed Assistance Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/7/1471">7 U.S.C. 1471</external-xref>)); and </text></clause></subparagraph><subparagraph id="H63E225CA810C4D10883D59ACE55D15FB" indent="up1"><enum>(B)</enum><text>the nonprocessed products of any nonhuman living animal, including—</text><clause id="H670E3095DF9E426980276EB2C9BAEDFF"><enum>(i)</enum><text>milk; </text></clause><clause id="HB43783F249804369B403EBE046FC48F9"><enum>(ii)</enum><text>eggs; and</text></clause><clause id="HC029B2A71D8C48C589FAAF247CBD5D92"><enum>(iii)</enum><text>honey;</text></clause></subparagraph></paragraph><paragraph id="HEBFC6800CFD84703863C6088B362AF22"><enum>(3)</enum><text>nonprocessed forestry, aquacultural, horticultural, and floricultural commodities;</text></paragraph><paragraph id="H852E73D2C9CB450BB7A6EB793D8F7ED4"><enum>(4)</enum><text>fresh or minimally processed fruits and vegetables, including fruits and vegetables that are rinsed, cooled, cut, ripened, or otherwise minimally processed, as determined by the Secretary; and</text></paragraph><paragraph id="H2FA02BCF902049E1895654A1E17EA673"><enum>(5)</enum><text>animal feed, including the ingredients of animal feed.</text></paragraph></subsection></section></legis-body></bill>
