<official-title display="yes">To require the Director of the Government Publishing Office to establish and maintain a single online portal accessible to the public that allows the public to obtain electronic copies of all congressionally mandated reports, and for other purposes.</official-title>

<section section-type="section-one" id="H2C3C890E362E4B40ABFBA365CE501234"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Access to Congressionally Mandated Reports Act</short-title></quote>.</text></section> <section id="H559F1BE5B4AB44EDA9FA7DE334CB6E46"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H6E95DC1DA7DB4B4196B4B7FF2E84F568"><enum>(1)</enum><header>Congressionally mandated report</header> 
<subparagraph id="H4F08E805DC7344E29317FE6BB53384B9"><enum>(A)</enum><header>In general</header><text>The term <term>congressionally mandated report</term> means a report of a Federal agency that is required by statute to be submitted to either House of Congress or any committee of Congress or subcommittee thereof.</text></subparagraph> <subparagraph id="H0B038773310540B3B5DBF0B3FB3B02B2"><enum>(B)</enum><header>Exclusions</header> <clause id="HBAF969FB21FD4380B76B41429CF83583"><enum>(i)</enum><header>Patriotic and national organizations</header><text>The term <term>congressionally mandated report</term> does not include a report required under part B of subtitle II of title 36, United States Code.</text></clause> 
<clause id="H5CED812644D3431DB3915794E36E26B6"><enum>(ii)</enum><header>Inspectors general</header><text>The term <term>congressionally mandated report</term> does not include a report by an office of an inspector general.</text></clause></subparagraph></paragraph> <paragraph id="H21A9AB72BADE4FF480B14C0A05F588B3"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Government Publishing Office.</text></paragraph> 
<paragraph id="H02F9B76B4E8042C685114A75721840EB"><enum>(3)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> has the meaning given the term <term>federal agency</term> under section 102 of title 40, United States Code, but does not include the Government Accountability Office or an element of the intelligence community. </text></paragraph> <paragraph id="H7595020DBACF4E1DB95C774AEAA55485"><enum>(4)</enum><header>Intelligence community</header><text>The term <term>intelligence community</term> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph> 
<paragraph id="H602DA48CA9684D9AAF78CD61B1104041"><enum>(5)</enum><header>Open format</header><text>The term <term>open format</term> means a file format for storing digital data based on an underlying open standard that—</text> <subparagraph id="HEFAA53A2B12D4578849FE446B3F94A61"><enum>(A)</enum><text>is not encumbered by any restrictions that would impede reuse; and</text></subparagraph> 
<subparagraph id="HCAA56CC614604FE3AAB1FEE27725CF74"><enum>(B)</enum><text>is based on an underlying open data standard that is maintained by a standards organization.</text></subparagraph></paragraph> <paragraph id="HCF4052CAA3404108BA0488D859FB4A30"><enum>(6)</enum><header>Reports online portal</header><text>The term <term>reports online portal</term> means the online portal established under section 3(a).</text></paragraph></section> 
<section id="H2951880CB5B0468399AD482FEC978E1F"><enum>3.</enum><header>Establishment of online portal for congressionally mandated reports</header> 
<subsection id="HA0138D8CAA624189ABAED41E88CCE39F"><enum>(a)</enum><header>Requirement To establish online portal</header> 
<paragraph id="H54E97972BAA34A96AA278F7094B1FAFD"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall establish and maintain an online portal accessible by the public that allows the public to obtain electronic copies of congressionally mandated reports in one place.</text></paragraph> <paragraph id="H5915F23ECA3B4B8F942DA791DB31BABB"><enum>(2)</enum><header>Existing functionality</header><text>To the extent possible, the Director shall meet the requirements under paragraph (1) by using existing online portals and functionality under the authority of the Director.</text></paragraph> 
<paragraph id="HB925618FEC104B4F838ECCA60853CD8C"><enum>(3)</enum><header>Consultation</header><text>In carrying out this Act, the Director shall consult with the Clerk of the House of Representatives, the Secretary of the Senate, and the Librarian of Congress regarding the requirements for and maintenance of congressionally mandated reports on the reports online portal.</text></paragraph></subsection> <subsection id="HC2659F43FCE347BD81904F16701E1CEB"><enum>(b)</enum><header>Content and function</header><text>The Director shall ensure that the reports online portal includes the following:</text> 
<paragraph id="HFB247CD7CA6942A88617CA10ED845C68"><enum>(1)</enum><text>Subject to subsection (c), with respect to each congressionally mandated report, each of the following:</text> <subparagraph id="H58F08A01446A41819326539F58EDA984"><enum>(A)</enum><text>A citation to the statute requiring the report.</text></subparagraph> 
<subparagraph id="HC14FDFB961C94D20B6B2B57D2A85D136"><enum>(B)</enum><text>An electronic copy of the report, including any transmittal letter associated with the report, in an open format that is platform independent and that is available to the public without restrictions, including restrictions that would impede the re-use of the information in the report.</text></subparagraph> <subparagraph id="H0FB5AA561C624BA4A80E43149D1FD476"><enum>(C)</enum><text>The ability to retrieve a report, to the extent practicable, through searches based on each, and any combination, of the following:</text> 
<clause id="H2643BEB937DA4E5CA5B0758186C7C6E8"><enum>(i)</enum><text>The title of the report.</text></clause> <clause id="H0400BD70D515483C82097278BE2D84EF"><enum>(ii)</enum><text>The reporting Federal agency.</text></clause> 
<clause id="H3DD70E2A70174151BE20B541145A4028"><enum>(iii)</enum><text>The date of publication.</text></clause> <clause id="H9D3EBFEB4A0F4FB9B6A655A6CB10FFAC"><enum>(iv)</enum><text>Each congressional committee or subcommittee receiving the report, if applicable.</text></clause> 
<clause id="HCE0940EB2CA04247AFC71C02CEF9DAE1"><enum>(v)</enum><text>The statute requiring the report.</text></clause> <clause id="H2E57859D78ED452FB69A164A60CCB18C"><enum>(vi)</enum><text>Subject tags.</text></clause> 
<clause id="H0D000EC628AE45949969BB30C23316B1"><enum>(vii)</enum><text>A unique alphanumeric identifier for the report that is consistent across report editions.</text></clause> <clause id="H25B429DC0A3D4A6D9E7CD7FF847E4F83"><enum>(viii)</enum><text>The serial number, Superintendent of Documents number, or other identification number for the report, if applicable.</text></clause> 
<clause id="HAF32AAACA466489DA9A69B26388FEBC4"><enum>(ix)</enum><text>Key words.</text></clause> <clause id="HA34A02DC6E124455A9A99AEA5EE1A49F"><enum>(x)</enum><text>Full text search.</text></clause> 
<clause id="H96197C9437D648579BE5A4EB845BCC0A"><enum>(xi)</enum><text>Any other relevant information specified by the Director.</text></clause></subparagraph> <subparagraph id="H2E7A231CB59446069F9987E55800558B"><enum>(D)</enum><text>The date on which the report was required to be submitted, and on which the report was submitted, to the reports online portal.</text></subparagraph> 
<subparagraph id="H805C7CE82FE74AE3968761760BEEE02F"><enum>(E)</enum><text>To the extent practicable, a permanent means of accessing the report electronically.</text></subparagraph></paragraph> <paragraph id="HA79A99ABE593460894952854652F782B"><enum>(2)</enum><text>A means for bulk download of all congressionally mandated reports.</text></paragraph> 
<paragraph id="H87B86E0B7989458D8C9500A5458D86FD"><enum>(3)</enum><text>A means for downloading individual reports as the result of a search.</text></paragraph> <paragraph id="H875AF9D86F4E41B6A63B3C2C5EB29498"><enum>(4)</enum><text>An electronic means for the head of each Federal agency to submit to the reports online portal each congressionally mandated report of the agency, as required by section 4.</text></paragraph> 
<paragraph id="H5692BC88488C45DE9DB2AB74E4EB9682"><enum>(5)</enum><text>In tabular form, a list of all congressionally mandated reports that can be searched, sorted, and downloaded by—</text> <subparagraph id="HBA939CAAFEAB444B87B53BEDA76FEF08"><enum>(A)</enum><text>reports submitted within the required time;</text></subparagraph> 
<subparagraph id="HCF0348945FF042E4A6FF33254DA00334"><enum>(B)</enum><text>reports submitted after the date on which such reports were required to be submitted; and</text></subparagraph> <subparagraph id="HD53260241F2441A8944328EACA3201F6"><enum>(C)</enum><text>to the extent practicable, reports not submitted.</text></subparagraph></paragraph></subsection> 
<subsection id="H99B1F793B2F64598BE6B1FADD1ADB168"><enum>(c)</enum><header>Noncompliance by Federal agencies</header> 
<paragraph id="H8F22375E1F45455BA8D63F37A00F6B88"><enum>(1)</enum><header>Reports not submitted</header><text>If a Federal agency does not submit a congressionally mandated report to the Director, the Director shall to the extent practicable—</text> <subparagraph id="H4927380677674735AFCA9E8D43C75B51"><enum>(A)</enum><text>include on the reports online portal—</text> 
<clause id="H11B957B05417421183725AFE6397D239"><enum>(i)</enum><text>the information required under clauses (i), (ii), (iv), and (v) of subsection (b)(1)(C); and</text></clause> <clause id="HBB2CDF4C70224875AB8F0F91F77AF010"><enum>(ii)</enum><text>the date on which the report was required to be submitted; and</text></clause></subparagraph> 
<subparagraph id="HC1D15223D7A648608A185FCA9C3A0BC9"><enum>(B)</enum><text>include the congressionally mandated report on the list described in subsection (b)(5)(C).</text></subparagraph></paragraph> <paragraph id="H26118553325445D381595B11286B65BF"><enum>(2)</enum><header>Reports not in open format</header><text>If a Federal agency submits a congressionally mandated report that is not in an open format, the Director shall include the congressionally mandated report in another format on the reports online portal.</text></paragraph></subsection> 
<subsection id="H1FE89E59DC634864834EADE213C260BB"><enum>(d)</enum><header>Deadline</header><text>The Director shall ensure that information required to be published on the online portal under this Act with respect to a congressionally mandated report or information required under subsection (c) of this section is published—</text> <paragraph id="H75E38CA6B604429EB80C7BCE1EBFA69D"><enum>(1)</enum><text>not later than 30 days after the information is received from the Federal agency involved; or</text></paragraph> 
<paragraph id="H3D02142C316D466CBC590057AB92A587"><enum>(2)</enum><text>in the case of information required under subsection (c), not later than 30 days after the deadline under this Act for the Federal agency involved to submit information with respect to the congressionally mandated report involved.</text></paragraph></subsection> <subsection id="H48B8739B3EF348ADAB43A0B9C3D2DBFD"><enum>(e)</enum><header>Exception for certain reports</header> <paragraph id="H04537BEF28D245DEB79F4C913E6392CD"><enum>(1)</enum><header>Exception described</header><text>A congressionally mandated report which is required by statute to be submitted to a committee of Congress or a subcommittee thereof, including any transmittal letter associated with the report, shall not be submitted to or published on the reports online portal if the chair of a committee or subcommittee to which the report is submitted notifies the Director in writing that the report is to be withheld from submission and publication under this Act.</text></paragraph> 
<paragraph id="HBBEF051381FB4FF3B73874458AFA2420"><enum>(2)</enum><header>Notice on portal</header><text>If a report is withheld from submission to or publication on the reports online portal under paragraph (1), the Director shall post on the portal—</text> <subparagraph id="H60D3A8437CC647C4A99A5D5CF3E84A22"><enum>(A)</enum><text>a statement that the report is withheld at the request of a committee or subcommittee involved; and</text></subparagraph> 
<subparagraph id="HF1E9340844684CD0A0672458F1A67F05"><enum>(B)</enum><text display-inline="yes-display-inline">the written notification provided by the chair of the committee or subcommittee specified in paragraph (1).</text></subparagraph></paragraph></subsection> <subsection id="H12AC3BC749FC4A74B1DBB3638CAE545E"><enum>(f)</enum><header>Free access</header><text>The Director may not charge a fee, require registration, or impose any other limitation in exchange for access to the reports online portal.</text></subsection> 
<subsection id="H92CE934BA5E44CE4A7A5DC0201B6B357"><enum>(g)</enum><header>Upgrade capability</header><text>The reports online portal shall be enhanced and updated as necessary to carry out the purposes of this Act.</text></subsection></section> <section id="H78A9E1C90B4D4FF1A6F64278D9F34685"><enum>4.</enum><header>Federal agency responsibilities</header> <subsection id="H9319ED2932DA4BDF847D0D0B00289DE0"><enum>(a)</enum><header>Submission of electronic copies of reports</header><text>Not earlier than 30 days or later than 45 days after the date on which a congressionally mandated report is submitted to either House of Congress or to any committee of Congress or subcommittee thereof, the head of the Federal agency submitting the congressionally mandated report shall submit to the Director the information required under subparagraphs (A) through (D) of section 3(b)(1) with respect to the congressionally mandated report. Notwithstanding section 6, nothing in this Act shall relieve a Federal agency of any other requirement to publish the congressionally mandated report on the online portal of the Federal agency or otherwise submit the congressionally mandated report to Congress or specific committees of Congress, or subcommittees thereof.</text></subsection> 
<subsection id="HF5FBFFAAE6C94556B30C0A3F99725E8A"><enum>(b)</enum><header>Guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget, in consultation with the Director, shall issue guidance to agencies on the implementation of this Act.</text></subsection> <subsection id="H760DB3CFCA3A4FBA9566E884A7F425CC"><enum>(c)</enum><header>Structure of submitted report data</header><text>The head of each Federal agency shall ensure that each congressionally mandated report submitted to the Director complies with the open format criteria established by the Director in the guidance issued under subsection (b).</text></subsection> 
<subsection id="H66273EA333144EB58D4CF6861214151A"><enum>(d)</enum><header>Point of contact</header><text>The head of each Federal agency shall designate a point of contact for congressionally mandated reports.</text></subsection> <subsection id="HE3008A24DCED4F1BB8B1C8D6C7801157"><enum>(e)</enum><header>Requirement for submission</header><text>The Director shall not publish any report through the online portal that is received from anyone other than the head of the applicable Federal agency, or an officer or employee of the Federal agency specifically designated by the head of the Federal agency. </text></subsection></section> 
<section id="HAFAD02822F9D427AA26FEC3AA4837D52"><enum>5.</enum><header>Changing or removing reports</header> 
<subsection id="HFC3ECE7B26D54519993FC5DFEABC7B56"><enum>(a)</enum><header>Limitation on authority To change or remove reports</header><text>Except as provided in subsection (b), the head of the Federal agency concerned may change or remove a congressionally mandated report submitted to be published on the reports online portal only if—</text> <paragraph id="H354B77E6CFF64F23BCA0725793D318A5"><enum>(1)</enum><text>the head of the Federal agency consults with each committee of Congress or subcommittee thereof to which the report is required to be submitted (or, in the case of a report which is not required to be submitted to a particular committee of Congress or subcommittee thereof, to each committee with jurisdiction over the agency, as determined by the head of the agency in consultation with the Speaker of the House of Representatives and the President pro tempore of the Senate) prior to changing or removing the report; and</text></paragraph> 
<paragraph id="H93A2C02E05664122B4D3BBF93C44F990"><enum>(2)</enum><text>a joint resolution is enacted to authorize the change in or removal of the report.</text></paragraph></subsection> <subsection id="H074D0D0FF8014878B3D9E21C1CC7A4B8"><enum>(b)</enum><header>Exceptions</header><text>Notwithstanding subsection (a), the head of the Federal agency concerned—</text> 
<paragraph id="HD3C1F447C6FE41BDB870A854FFB1D635"><enum>(1)</enum><text>may make technical changes to a report submitted to or published on the online portal; </text></paragraph> <paragraph id="HFFBC437D34DF4B3F89CC62AF1E0BABD8"><enum>(2)</enum><text>may remove a report from the online portal if the report was submitted to or published on the online portal in error; and</text></paragraph> 
<paragraph id="H6C75BEADED944D30A9CF7EEFFA130491"><enum>(3)</enum><text>may withhold information, records, or reports from publication on the online portal in accordance with section 6. </text></paragraph></subsection></section> <section id="H4E3ADC7FC8894CF68BA86D99F0234017"><enum>6.</enum><header>Withholding of information</header> <subsection id="H73ADA05068814EEDB8ECB6C52B0CA0A2"><enum>(a)</enum><header>In general</header><text>Nothing in this Act shall be construed to—</text> 
<paragraph id="H45915B689D344D5F8AB4327B8AF75712"><enum>(1)</enum><text>require the disclosure of information, records, or reports that are exempt from public disclosure under section 552 of title 5, United States Code, or that may be withheld under section 552a of title 5, United States Code; or</text></paragraph> <paragraph id="HA0290B78470F49E0889EA24CFB9700C9"><enum>(2)</enum><text>impose any affirmative duty on the Director to review congressionally mandated reports submitted for publication to the reports online portal for the purpose of identifying and redacting such information or records.</text></paragraph></subsection> 
<subsection id="H027D010042614CFAB00A658F8C6C061E"><enum>(b)</enum><header>Withholding of information</header> 
<paragraph id="HF5E10431247F461FB5C5CAC507F3F8B3"><enum>(1)</enum><header>In general</header><text>Consistent with subsection (a)(1), the head of a Federal agency may withhold from the Director, and from publication on the online portal, any information, records, or reports that are exempt from public disclosure under section 552 of title 5, United States Code, or that may be withheld under section 552a of title 5, United States Code.</text></paragraph> <paragraph id="H589D6584FEC146539AEB565BA1143A1D"><enum>(2)</enum><header>National security</header><text>Nothing in this Act shall be construed to require the publication, on the online portal or otherwise, of any report containing information that is classified, or the public release of which could have a harmful effect on national security.</text></paragraph></subsection></section> 
<section id="HE9ED77565D8C4BCF9BBD23F117672207"><enum>7.</enum><header>Implementation</header> 
<subsection id="H1C64293B6FDC48AB888DD5545306F1C6"><enum>(a)</enum><header>Reports submitted to Congress</header> 
<paragraph id="H04DB6EA1BC1E48CFB6EF4241C33B7958"><enum>(1)</enum><header>In general</header><text>This Act shall apply with respect to any congressionally mandated report which—</text> <subparagraph id="H9D431CD5FA9045488E77D1533F3ED42F"><enum>(A)</enum><text display-inline="yes-display-inline">is required by statute to be submitted to the House of Representatives, or the Speaker thereof, or Senate, or the President or President Pro Tempore thereof, at any time before, on, or after the date of the enactment of this Act; or</text></subparagraph> 
<subparagraph id="HDD919735984F49C784CAE2388BC87D92"><enum>(B)</enum><text>is included by the Clerk of the House of Representatives or the Secretary of the Senate (as the case may be) on the list of reports received by the House of Representatives or Senate (as the case may be) at any time before the date of the enactment of this Act.</text></subparagraph></paragraph> <paragraph id="H4314A11BF8CE4074B4E895299943B678"><enum>(2)</enum><header>Transition rule for previously submitted reports</header><text>To the extent practicable, the Director shall ensure that any congressionally mandated report described in paragraph (1) which was required to be submitted to Congress by a statute enacted before the date of the enactment of this Act is published on the online portal under this Act not later than 1 year after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H2268CC6902374996876E3CC0ABA47064"><enum>(b)</enum><header>Reports submitted to committees</header><text>In the case of congressionally mandated reports which are required by statute to be submitted to a committee of Congress or a subcommittee thereof, this Act shall apply with respect to—</text> <paragraph id="H85C890B6564C4066851EE764DCF9A3E0"><enum>(1)</enum><text>any such report which is first required to be submitted by a statute which is enacted on or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="H586F98B456AF484A9E2AA6A7347D6DBB"><enum>(2)</enum><text>to the maximum extent practical, any congressionally mandated report which was required to be submitted by a statute enacted before the date of enactment of this Act unless—</text> <subparagraph id="H847D28A8B656415C893CDE5A4301212A"><enum>(A)</enum><text>the chair of the committee, or subcommittee thereof, to which the report was required to be submitted notifies the Director in writing that the report is to be withheld from publication; and</text></subparagraph> 
<subparagraph id="H8CA9B89403124D7C9773EEF56B058427"><enum>(B)</enum><text>the Director publishes the notification on the online portal.</text></subparagraph></paragraph></subsection></section> <section id="HFC384FB8FCB54ED7BC2674D5F3BA5434"><enum>8.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section>
