which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to include affordable housing incentives in certain capital investment grants, and for other purposes.</official-title></form><legis-body id="H53B81FA1FBBC4EDC82F0CCD71A4BEB93" style="OLC"><section id="H11B9C3CF3AF34262A16A1AC20FC15C1E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Build More Housing Near Transit Act of 2021</short-title></quote>.</text></section><section id="HAC34F126E525454E8B7F08E9446EDAED" section-type="subsequent-section"><enum>2.</enum><header>Affordable housing incentives in capital investment grants</header><text display-inline="no-display-inline">Section 5309 of title 49, United States Code, is amended— </text><paragraph id="H07C0D9C7256B41BD86D548F18D816FE8"><enum>(1)</enum><text>in subsection (g)—</text><subparagraph id="HFB3A2CDD828E4AAEBE190F2331104461"><enum>(A)</enum><text>in paragraph (2)(B)—</text><clause id="HFC1E24CE7E2E4ABB96CED91E99BBE239"><enum>(i)</enum><text>in clause (i) by striking <quote>; and</quote> and inserting a semicolon; </text></clause><clause id="H6FAC5F56ECB54E38972CD8AE94588D6F"><enum>(ii)</enum><text>in clause (ii) by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="H5E923E1B0E054177BE4CC9BB178C4D83"><enum>(iii)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H60B35B343180430DAB9A4AD0B037E7D2" display-inline="no-display-inline"><clause id="H8442536591AC4129B47E90F687A74F72"><enum>(iii)</enum><text display-inline="yes-display-inline">allow a weighting of up to five percentage points greater to the criteria relating to economic development under subsection (d)(2)(A)(iii) or (e)(2)(A)(iv), as applicable, and up to five percentage points lesser to the lowest scoring criteria under either such subsection, if the applicant demonstrates substantial effort to preserve or encourage affordable housing near the project by—</text><subclause id="H952DA1434BBC45A49EEE9E66549E3C08"><enum>(I)</enum><text>providing documentation of policies that allow for the approval of multi-family housing, single room occupancy units, and accessory dwelling units without a discretionary review process;</text></subclause><subclause id="H5AF02BE1E4DD4AEE94D6D4108CDD83BC"><enum>(II)</enum><text>providing local capital sources for transit-oriented development; or</text></subclause><subclause id="H9109D068C2C84D18880BE0A0C7B5EAFA"><enum>(III)</enum><text>other methods, as determined appropriate by the Secretary.</text></subclause></clause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H1B7666115C0341B382EEA3FEE3A6C4E2" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><clause id="H0F789AD1D61D49B5A63F8EDB0C5CB06B"><enum>(i)</enum><text>in subparagraph (C) by striking <quote>and</quote> at the end;</text></clause><clause id="H7A4C4280FB694C7E8C79DD853BA1CA38"><enum>(ii)</enum><text>by redesignating subparagraph (D) as subparagraph (E); and</text></clause><clause id="H28F0E2A19B2B4BF8B7817400352AF01B"><enum>(iii)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="USC" id="H41FCD96A6DE94AAA9BFBF61EC0FD21F3" display-inline="no-display-inline"><subparagraph id="H10F64BD9B7C1431B9A6C6942D09A846F"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of a warrant that applies to the criteria relating to economic development under subsection (d)(2)(A)(iii) or (e)(2)(A)(iv), the applicant that requests the use of such warrant has completed and submitted a housing feasibility assessment; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H8A9185F3BAF24AE3AC5536E13A4C3CAB"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H97D3C714FD114A199237A425143D253C" display-inline="no-display-inline"><paragraph id="H03ED64AE474847E0A3D6571CA1E40147"><enum>(8)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>housing feasibility assessment</quote> means an analysis of the physical, legal, and financial viability of developing additional housing along a project corridor.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF870B941FA1F4270B2586B83900FAA47"><enum>(2)</enum><text>in subsection (l)(4)—</text><subparagraph id="H0153C572F7A4420A8A21EA86EC1853D0"><enum>(A)</enum><text>in subparagraph (B) by striking <quote>; or</quote> and inserting a semicolon; </text></subparagraph><subparagraph id="H1AB8954BE6654337BF3417647E26DE32"><enum>(B)</enum><text>in subparagraph (C) by striking the period at the end and inserting <quote>; or</quote>; and </text></subparagraph><subparagraph id="H2669D211DE124478B7DDB7B47C70D7E5"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="HDCB9A954293F45AD9132674C2C8722EF" display-inline="no-display-inline"><subparagraph id="H78D21D0D11D243B4A31C15F454209757"><enum>(D)</enum><text display-inline="yes-display-inline">from grant proceeds distributed under section 103 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5303">42 U.S.C. 5303</external-xref>) or section 201 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3141">42 U.S.C. 3141</external-xref>), except that—</text><clause id="H3F3DB00FAAF24DBF9EC79D1503B4B226"><enum>(i)</enum><text display-inline="yes-display-inline">such proceeds are used in conjunction with the planning or development of affordable housing; and</text></clause><clause id="H23582607AF814FA1B8D4D29CFE91F6CA"><enum>(ii)</enum><text display-inline="yes-display-inline">such affordable housing is located within one-half of a mile of a new defined station.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
