<section id="H0DEBAA2237884BA994FB15071D8D2809" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>High Risk Rural Roads Safety Grant Program Act of 2021</short-title></quote>.</text></section> <section id="H0BD9BD229305487C891359D70AC16A59"><enum>2.</enum><header>High risk rural roads safety grant program</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<section id="HFF1B2EBA1458445E9B85CBDAC08A07E5"><enum>171.</enum><header>High risk rural roads safety grant program</header>
<subsection id="H06197AA8FEDE49ADB779D2405B642B3C"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a program to award grants, on a competitive basis, to eligible entities for projects to improve safety on high risk rural roads in the United States.</text></subsection> <subsection id="H8B231F13823C4DDAACE3D574729F6584"><enum>(b)</enum><header>Eligible projects</header> <paragraph id="H18B2B2F522EE44C39A78A1136753AA28"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity may use funds provided under this section only for a project described in paragraph (2) that makes improvements to a high risk rural road.</text></paragraph>
<paragraph id="H55CCC85B2D644638AE4BE692FCE2DD35"><enum>(2)</enum><header>Projects described</header><text>A project referred to in paragraph (1) only includes 1 or more of the following activities:</text> <subparagraph id="H5CD6EAACF9894BD29CDC01F4260B0B0C"><enum>(A)</enum><text>A road safety audit.</text></subparagraph>
<subparagraph id="HBCD76335FF734A17A320E5B3711BD3A6"><enum>(B)</enum><text>An intersection safety improvement.</text></subparagraph> <subparagraph id="HA40EBF3A6157401ABF6A327F511656AE"><enum>(C)</enum><text>Installation of rumble strips or another warning device, if the rumble strips or other warning devices do not adversely affect the safety or mobility of bicyclists, pedestrians, and individuals with disabilities.</text></subparagraph>
<subparagraph id="H34AABBA21CF747A9879CA6C698AA6B9A"><enum>(D)</enum><text>Activities that improve the safety of pedestrians, bicyclists, or individuals with disabilities.</text></subparagraph> <subparagraph id="H43133055871E4DE1A1851B451EF60967"><enum>(E)</enum><text>Construction of a railway-highway crossing safety feature, including installation of protective devices.</text></subparagraph>
<subparagraph id="H0690F05E8BFA4DD1B5B52D2F4EC301D8"><enum>(F)</enum><text>Construction of a traffic calming feature.</text></subparagraph> <subparagraph id="HAC469588263B44898116689DE59A38DB"><enum>(G)</enum><text>Improvement of highway signage and pavement markings, including to meet minimum levels of retroreflectivity established by the Department of Transportation.</text></subparagraph>
<subparagraph id="HF48037B2B16F4AAD9B07E49594EEFE0C"><enum>(H)</enum><text>Installation of a priority control system for emergency vehicles at signalized intersections.</text></subparagraph> <subparagraph id="H3ACE86DC633F4ECC8B1221DBF256E455"><enum>(I)</enum><text>Installation of a traffic control or other warning device at a location with high accident potential.</text></subparagraph>
<subparagraph id="HAE0449EA8F1F4E0E8B3124E6F5399EF6"><enum>(J)</enum><text>Installation of guardrails, barriers (including barriers between construction work zones and traffic lanes for the safety of motorists and workers), and crash attentuators.</text></subparagraph> <subparagraph id="H283C330325F747B58FE13C2D3EC0F5CB"><enum>(K)</enum><text>The addition or retrofitting of structures or other measures to eliminate or reduce accidents involving vehicles and wildlife.</text></subparagraph>
<subparagraph id="HF23A50E7FFD1455D9CB0B6101D7DCA4E"><enum>(L)</enum><text>Installation and maintenance of signs (including flurorescent, yellow-green signs) at pedestrian-bicycle crossings and in school zones.</text></subparagraph> <subparagraph id="H05728355210A4A2785A72949E6F268FF"><enum>(M)</enum><text>Installation of a skid-resistant surface at any intersection or other location with a high frequency of accidents.</text></subparagraph>
<subparagraph id="H89ECE97A5D4A4C738B88A85A8D9DAC5A"><enum>(N)</enum><text>Improvement of an edge drop-off that is greater than 4 inches.</text></subparagraph> <subparagraph id="H4598EC039B2A49F787627E884E8F4B5A"><enum>(O)</enum><text>Spot pavement and shoulder widening.</text></subparagraph>
<subparagraph id="H2000EE76DE7047F2ABE9A56C79719539"><enum>(P)</enum><text>Elimination of a roadside obstacle.</text></subparagraph> <subparagraph id="H194B342F52A84575BEB34CAC77143636"><enum>(Q)</enum><text>Systemic improvements focusing on low-cost safety infrastructure investments.</text></subparagraph>
<subparagraph id="H4B1022DBB1304E0A848246BE5CBF28BC"><enum>(R)</enum><text>Traffic enforcement or other activities relating to work zone safety.</text></subparagraph> <subparagraph id="HEC96E5292DED49E3ADBA9050F1773C94"><enum>(S)</enum><text>Installation of vehicle-to-infrastructure communication equipment.</text></subparagraph>
<subparagraph id="H3AF09CD718BF450199C1E06389903E6B"><enum>(T)</enum><text>Installation or improvement of highway signage and pavement markings to accommodate advanced technologies to assist with the deployment of automated and connected vehicles.</text></subparagraph></paragraph></subsection> <subsection id="H8361B1B9D0424B1291E76C8F7730E2CE"><enum>(c)</enum><header>Set-Aside</header><text>Of the total amounts made available under this section for each fiscal year, not less than $100,000,000 shall be for grants to Indian Tribes. </text></subsection>
<subsection id="H7DF1A44567F24C3CB97308A684B71C2C"><enum>(d)</enum><header>Federal share</header><text>The Federal share of the cost of a project carried out with funds made available under this section may be 100 percent.</text></subsection> <subsection id="HAA3BC8CE4AF74E9BB0ECCC0A6CDC94CE"><enum>(e)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H8818FD54B46A4BF3A418372AF27CA7F4"><enum>(1)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text> <subparagraph id="H7324E11C601048558A5E0FFEA559BA2C"><enum>(A)</enum><text>a unit of local government;</text></subparagraph>
<subparagraph id="H00F37E432851410CA605A980DA1321C7"><enum>(B)</enum><text>a special purpose district or public authority with a transportation function;</text></subparagraph> <subparagraph id="H738F324EF9EC4864B1C6AD405A9CCA68"><enum>(C)</enum><text>a metropolitan planning organization (as defined in section 134(b));</text></subparagraph>
<subparagraph id="H379DE3FC4C7C411CB688C0F6391E63F8"><enum>(D)</enum><text>a regional transportation authority; or</text></subparagraph> <subparagraph id="H04CB1FBF5D6540BE958431898D091C33"><enum>(E)</enum><text>an Indian Tribe (as defined in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>)). </text></subparagraph></paragraph>
<paragraph id="H80B97716D82B49C192A4E87B0068CE18"><enum>(2)</enum><header>High risk rural road</header><text>The term <quote>high risk rural road</quote> means any roadway functionally classified as a rural major or minor collector or a rural local road with respect to which—</text> <subparagraph id="HBCF8CC37AC74460CB8AA95B89D65021C"><enum>(A)</enum><text>there is a significant likelihood of accidents resulting in fatalities or incapacitating injuries; or</text></subparagraph>
<subparagraph id="H501DF31A74244D4FBB79B85CB8D4DEB3"><enum>(B)</enum><text>there is a physical condition that presents to users of the roadway an increased risk of an accident, including an accident resulting in serious injury. </text></subparagraph></paragraph></subsection> <subsection id="HB9E143706B3C48009847223836DCCC8A"><enum>(f)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) to carry out this section $600,000,000 for each of fiscal years 2022 through 2027, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
