which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide support for urban forests, and for other purposes.</official-title></form><legis-body id="H8F2C6D4B177D4C6E91FB124422F336CC" style="OLC"><section id="HDE2A53E55DD247EF94E316BDE3765EF6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Urban Forests Act of 2021</short-title></quote>.</text></section><section id="H7892DB88F5F64D2396A93FA4C0756EE8"><enum>2.</enum><header>Urban and community forestry assistance</header><subsection id="H4A20A7BB77CD456B9F4244B939097F77"><enum>(a)</enum><header>Tree City USA Grant Program</header><text display-inline="yes-display-inline">Section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>) is amended—</text><paragraph id="H0CA6CE3C0FC74B808DB9FB38D1C64ABA"><enum>(1)</enum><text>by redesignating subsections (h) and (i) as subsections (j) and (k), respectively; and</text></paragraph><paragraph id="H7B102B4853C94F5F9D55CA3F9617CEBC"><enum>(2)</enum><text>by inserting after subsection (g) the following;</text><quoted-block style="OLC" id="HE9C1FE375EF94FBEB525DA643ABFA755" display-inline="no-display-inline"><subsection id="H0F25C3EAD98E42138090626DC98C4D34"><enum>(h)</enum><header>Tree City USA Grant Program</header><paragraph id="H1444D3FEBBBA42ED8CE6217259B3DE17"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a grant program to be known as the <quote>Tree City USA Grant Program</quote> to provide competitive grants to eligible entities to enhance and maintain urban forests.</text></paragraph><paragraph id="H30DAD07167B346FA956D86BEA1A62FFA" commented="no"><enum>(2)</enum><header>Application</header><subparagraph id="HEBADA9B042584F0EB498C9588E426E4D"><enum>(A)</enum><header>In general</header><text>To be eligible to be awarded a grant under paragraph (1), an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including a proposal to enhance and maintain urban forests.</text></subparagraph><subparagraph id="H2D97E7B613FE435CAD8F804D0596A030"><enum>(B)</enum><header>Application assistance</header><text display-inline="yes-display-inline">A non-profit organization that partners with an eligible entity may submit an application under subparagraph (A) on behalf of such eligible entity.</text></subparagraph></paragraph><paragraph id="H33DE95EB1BA8439192928FAC6EE46FC2"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under paragraph (1), the Secretary shall give priority to eligible entities that submit proposals under paragraph (2)(A) that—</text><subparagraph id="HE4AF47738E254DCE81EC912DCC8BB66C"><enum>(A)</enum><text>enhance, maintain, or improve access to urban forests in—</text><clause id="H1108D47F30974248AA24A70EED85087B"><enum>(i)</enum><text>typically underserved areas; or</text></clause><clause id="H3FAC59345DCA414EA11847851DBFEE9A"><enum>(ii)</enum><text>areas with low tree or environmental equity;</text></clause></subparagraph><subparagraph id="H8E96C229222D496CBEC567EFA881D959"><enum>(B)</enum><text>further a statewide assessment or local government initiative to enhance and maintain urban forests;</text></subparagraph><subparagraph id="H70C5237E3A98467B88610926542D35AE"><enum>(C)</enum><text>include a plan to mitigate risks from insects, disease, and non-native invasive species; and</text></subparagraph><subparagraph id="HEA663570218840B0A1B6A60F2CB858A5"><enum>(D)</enum><text>include a plan to monitor and maintain new and existing trees.</text></subparagraph></paragraph><paragraph id="HE7CCCA6159894D6282621EBB06B97894"><enum>(4)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance to local governments to assist such local governments with—</text><subparagraph id="H19489EC9A54D4BA2A6D0F30EF1DF813F"><enum>(A)</enum><text>becoming eligible entities; and</text></subparagraph><subparagraph id="HD005C2AA4E7644ABA01140A47B6519CD"><enum>(B)</enum><text>proposals under paragraph (2)(A).</text></subparagraph></paragraph><paragraph id="HA1920BFD3DA147B392760FDE484E8B6D"><enum>(5)</enum><header>Matching funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this subsection shall contribute an amount of non-Federal funds (in cash or in kind) that is at least equal to the amount of the Federal funds received.</text></paragraph><paragraph id="HD5EE2B20A52446D795FD2C1542756A02" commented="no"><enum>(6)</enum><header>Premier tree city</header><text>Not later than 1 year after the date of the enactment of the Urban Forests Act of 2021, and annually through 2030 thereafter, the Secretary shall designate as a <quote>Premier Tree City</quote> one eligible entity awarded a grant under this subsection to recognize the superior efforts of such eligible entity in enhancing and maintaining urban forests. </text></paragraph><paragraph id="H978E3F57FD344C1BAD1ACB1F59E0FC3E"><enum>(7)</enum><header>Authorization of appropriations</header><text>In addition to the amounts authorized under subsection (k), there are authorized to be appropriated $1,000,000 for each of fiscal years 2021 through 2030 to carry out this subsection. </text></paragraph><paragraph id="H6389A4B45DDF4BCFB2814AC68D370E91"><enum>(8)</enum><header>Eligible entity defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible entity</term> means a local government that—</text><subparagraph id="H5052F31AD5544E52A4CD1C73040A78DA"><enum>(A)</enum><text>serves an urban and community area; and</text></subparagraph><subparagraph id="HAF208AFA398740B09B8502E60C9548D5"><enum>(B)</enum><text>a tree planting non-profit organization recognizes as having—</text><clause id="H6B9B620F268B4EA8BE447A1D4A358B88" display-inline="no-display-inline"><enum>(i)</enum><text>a tree board or department;</text></clause><clause id="H4CE1FFEEBFA9420BB0B217999E2FA72B"><enum>(ii)</enum><text>a tree care ordinance;</text></clause><clause id="HEEC6D64654684C81A3B5F683FE36937C" display-inline="no-display-inline"><enum>(iii)</enum><text>a community forestry program with an annual budget of at least $2 per capita; and</text></clause><clause id="H291DEDBFF0A34C49A0698560D518A93C" display-inline="no-display-inline"><enum>(iv)</enum><text>an Arbor Day observance and proclamation.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF360DA9B6DC740BC8800FEA0DA2C132C"><enum>(b)</enum><header>Cooperative agreements for urban wood utilization</header><text>Section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>), as amended by subsection (a), is further amended by inserting after subsection (h) the following:</text><quoted-block style="OLC" id="HCB4F3EBA6228435CBADA2ED130F79EBD" display-inline="no-display-inline"><subsection id="HB6B22E51A7074113A6A270E81DFD8A67"><enum>(i)</enum><header>Pilot project for cooperative agreements for urban wood utilization</header><paragraph id="HEFFDB4390A5541139867352E2290456C"><enum>(1)</enum><header>Cooperative agreements</header><text>The Secretary may enter into cooperative agreements with State and local governments, institutions of higher education, private or non-profit organizations, and other entities that support projects that create wood products from dead and fallen trees in urban and community areas.</text></paragraph><paragraph id="HDBD532E3BE384FD5B0DEA1280E94D3CD"><enum>(2)</enum><header>Prioritization</header><text>The Secretary shall prioritize entering into cooperative agreements that—</text><subparagraph id="H433F45C7ED4D41AF919A67E9C3988D45"><enum>(A)</enum><text>support local job creation;</text></subparagraph><subparagraph id="H01109647E8EB4244B6622F22D4B5A365"><enum>(B)</enum><text>are located in typically underserved areas or areas with low tree or environmental equity;</text></subparagraph><subparagraph id="HD8DF8F36FFA24D0497F5E1DCF6B71A00"><enum>(C)</enum><text>develop new uses for dead and fallen trees; and</text></subparagraph><subparagraph id="H69B63C71F9934C79A47E57F346ED7698"><enum>(D)</enum><text>improve urban forest health and resiliency. </text></subparagraph></paragraph><paragraph id="H924D761AEBDF442E949E4E42490D1775"><enum>(3)</enum><header>Technical and financial assistance</header><text>The Secretary may provide technical or financial assistance to entities that enter into a cooperative agreement under paragraph (1) to facilitate—</text><subparagraph id="H19533923FEC044469D4E58137826BC68"><enum>(A)</enum><text>research on new uses for dead and fallen trees in urban and community areas; and</text></subparagraph><subparagraph id="H8C50740F996A48C99658B0BB3D82D67F"><enum>(B)</enum><text>market expansion opportunities for products made from dead and fallen trees in urban and community areas.</text></subparagraph></paragraph><paragraph id="HD337BEEA0B4A4E089156E388C0E1F4CD"><enum>(4)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of the Urban Forests Act of 2021, the Secretary shall provide a report to the relevant committees on—</text><subparagraph id="HA49C56804C964FED84E49D4142E0248E"><enum>(A)</enum><text>the implementation of this subsection; and</text></subparagraph><subparagraph id="H7C181183796A49769FD26E5AB0062651"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations to encourage economic development and job creation by creating new markets for wood products made from urban timber sources.</text></subparagraph></paragraph><paragraph id="HA5445452DA6041C095B21093BFC0C88D"><enum>(5)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="HFCC1BA56871D412A81DF62A1E7523D77"><enum>(A)</enum><header>Dead and fallen trees</header><text>The term <term>dead and fallen trees</term> means trees that—</text><clause id="HAE0257095C774CC3ACBBFE82CCCDC2CB"><enum>(i)</enum><text>are dying or have died;</text></clause><clause id="H26B467CEEBD143998DDB14DFA02A749D"><enum>(ii)</enum><text>have partially or completely fallen over; or</text></clause><clause id="HA1777557774B4FA4BD590394E5FF26B8"><enum>(iii)</enum><text>have been negatively impacted by insects, disease, or weather-related disturbances.</text></clause></subparagraph><subparagraph id="H14F5B8E8F74E4223838F46BE688D0875"><enum>(B)</enum><header>Relevant committees</header><text>The term <term>relevant committees</term> means—</text><clause id="HAAFB49DD3087494DB6CD1854350A8784"><enum>(i)</enum><text display-inline="yes-display-inline">the Committees on Natural Resources and Agriculture of the House of Representatives; and</text></clause><clause id="HD4B510C0B10A49FFB68107B0B698C0E8"><enum>(ii)</enum><text>the Committees on Energy and Natural Resources and Agriculture, Nutrition, and Forestry of the Senate.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9522D957B7DB447FBF6EA0EE0A293D4C"><enum>(c)</enum><header>Program of education and technical assistance clarification for carbon storage</header><text>Section 9(d)(3) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105(d)(3)</external-xref>) is amended—</text><paragraph id="H56F0F7D0027D4C76A605E815019032C4"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="HD3A5A43F4C8C49D99CD8CC04E81EF811"><enum>(2)</enum><text>in subparagraph (D), by inserting <quote>and</quote> after the semicolon; and</text></paragraph><paragraph id="HDB6435B87F1B47BF9D8AE95994F4AAE2"><enum>(3)</enum><text>by inserting at the end the following new subparagraph:</text><quoted-block id="HEB26538C023A4A6999F994BEAA211CAF" style="OLC"><subparagraph id="HF0AA0D5C58BA46A7BB0D171372670C12"><enum>(E)</enum><text>identifying opportunities to increase carbon storage through afforestation and scientific urban and community forestry management;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H891EF726AB694A1F8339936DC2B20DE9"><enum>(d)</enum><header>National urban and community forestry advisory council</header><text>Section 9(g) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105(g)</external-xref>) is amended—</text><paragraph id="H9789CFEB1A314C79A5205857894785B4"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following new subparagraph:</text><quoted-block id="HC8903E777FA84B0091BCEA7120D9D33D" style="OLC"><subparagraph id="H79BBC85006094A6C8061268A714C8300"><enum>(F)</enum><header>Meetings</header><text>The Council established under this subsection shall meet not less than twice annually.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HF678A99E5CA04643B3BBF4257FE61C3F"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H50DC0B2089574E308BAFEB525A5FCFDA" style="OLC"><paragraph id="HF197C54CFBF54A87A07F13E3F93DEE2E"><enum>(7)</enum><header>Renewal of council</header><subparagraph id="H38243FECFBF64D18909F058D892FFBBF"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of the Urban Forests Act of 2021, the Secretary shall renew the Council.</text></subparagraph><subparagraph id="H599C37BFEAAA47FDAF6B1F50D1528B99"><enum>(B)</enum><header>Termination</header><text>The Council shall not terminate except as provided by an Act of Congress.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0AE57DB90F7046C091D7927D6E95621C"><enum>(e)</enum><header>Urban and community forestry action plan clarification for carbon storage</header><text>Section 9(g)(3) of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105(g)(3)</external-xref>) is amended by adding at the end the following: </text><quoted-block id="HFBF478CD2CDB4F2E93216437C830FE57" style="OLC"><subparagraph id="HC9D982DA4F464812BB1BF74E1155BE2B"><enum>(G)</enum><text>Recommendations for identifying opportunities to increase carbon storage through afforestation and scientific urban and community forestry management.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H36BF8177D91742998E9FD3BBC8B063A2"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Subsection (k) of section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>), as redesignated by subsection (a), is amended—</text><paragraph id="H803F4CAA85E94B95B84F0345C765791C"><enum>(1)</enum><text>by striking <quote>$30,000,000</quote> and inserting <quote>$50,000,000</quote>; and</text></paragraph><paragraph id="H0DD4F2EC6C1F4BC3BE6AE0A6CF097DEB"><enum>(2)</enum><text>by striking <quote>fiscal years 1991 through 1995</quote> and inserting <quote>fiscal years 2021 through 2025</quote>.</text></paragraph></subsection></section><section id="H7D093C590B0641CFA26007DE493980A4"><enum>3.</enum><header>Civilian Conservation Center urban forestry demonstration program</header><text display-inline="no-display-inline">Section 147(d) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3197">29 U.S.C. 3197(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HE56787E565DD45ADA9C93E37BB546CCA" display-inline="no-display-inline"><paragraph id="HFDC72505BFEA4572AA799C08CA90E94F"><enum>(4)</enum><header>Urban forestry</header><subparagraph id="H7605BE7F98CF4D8BA8CC5A8DEE6C56DC"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph, the Secretary of Agriculture and the Secretary of Labor shall jointly establish Civilian Conservation Centers in urban and community areas (as defined in subsection (j) of section 9 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2105">16 U.S.C. 2105</external-xref>)).</text></subparagraph><subparagraph id="H6A5557554A4B4AFCB1E7D4F3287199CF"><enum>(B)</enum><header>Focus</header><text>In addition to the training and skills required under paragraph (1), the Civilian Conservation Centers established pursuant to subparagraph (A) shall provide training on urban forestry issues, including urban forest conservation, management, maintenance, and monitoring.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H93C35931D0CD4FA9ADE1F202630C72D5"><enum>4.</enum><header>Forest inventory 5-year reports</header><text display-inline="no-display-inline">Section 3(e)(3) of the Forest and Rangeland Renewable Resources Research Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/1642">16 U.S.C. 1642(e)(3)</external-xref>) is amended—</text><paragraph id="H345C3BA9D0FB4BF4B930A3FA3F6ED2BB"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HC0D14997F01847249F0F264674C56CFD"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph id="HF709AF1E5AFF44DBB4F1701D0EC51899"><enum>(A)</enum><text>by inserting <quote>, including forest carbon</quote> before <quote>over the previous</quote>; and</text></subparagraph><subparagraph id="HF295B5858B1E48678AB1739A21D2E7FD"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HA702B40C778141C3BB6D498A3E287CE0"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H58A1FEBB67A4406783B280746DBCF6B0" display-inline="no-display-inline"><subparagraph id="HDEDF9252D5874B8F85D1109B93985C7E"><enum>(D)</enum><text display-inline="yes-display-inline">demonstrates the efforts taken by the Forest Service to—</text><clause id="H8D60939C66AD47279B59D3B7D306BEBC"><enum>(i)</enum><text>conduct a strategic national forest inventory by measuring a statistically designed consistent historical series of field plots in combination with advanced technology to improve data, information, and estimates of precision; and</text></clause><clause id="HED2FB559F1EE40FC9230641E272284C7"><enum>(ii)</enum><text>use advanced geospatial technologies to improve the area and volume estimates described in clause (i), especially for sub-State regions and smaller areas. </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="HF71FFA7BC47F4A008176D4AA0A6F198A"><enum>5.</enum><header>Memorandum of understanding to coordinate urban forestry programs</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Agriculture shall enter into a memorandum of understanding with the Secretaries of Health and Human Services, Housing and Urban Development, Interior, Labor, and Transportation and the Administrator of the Environmental Protection Agency to—</text><paragraph id="HE1B38AD5EDEC4CA3A06BA146CF4A2D2B"><enum>(1)</enum><text>identify strategies to increase equitable access to urban forests through existing programs and authorities;</text></paragraph><paragraph id="HED427F105D9641888FCB881014D87F07"><enum>(2)</enum><text>coordinate existing urban forestry programs;</text></paragraph><paragraph id="HEB544E535A064E9DA751E33E2D806836"><enum>(3)</enum><text>conduct research on the benefits of urban forests for air quality, heat island mitigation, energy burden reduction, and enhanced shading for heat-resilient housing and active transit; and</text></paragraph><paragraph id="HC40690725CAF4427A9D6932DEA815F9B"><enum>(4)</enum><text>conduct research on improving coordination between the agencies to address insects, disease, and non-native invasive species in urban and community areas.</text></paragraph></section></legis-body></bill>
