R. 2455</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210412">April 12, 2021</action-date><action-desc><sponsor name-id="S001185">Ms. Sewell</sponsor> (for herself and <cosponsor name-id="B001260">Mr. Buchanan</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the IMPACT Act of 2014 to reset data collection and the development of a payment system technical prototype for post-acute care providers under the Medicare program to take into account the effects of COVID–19.</official-title></form><legis-body id="HB618DF21B4AD418EA6C17F3778103BC2" style="OLC"><section id="H4E9DA133B82E4B82B369E5C973B10F37" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resetting the Impact Act of 2021</short-title></quote> or the <quote><short-title>TRIA Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="HD099B46B70F14460BB7C8AAF12DEB051"><enum>2.</enum><header>Resetting data collection and the development of a payment system technical prototype for post-acute care providers under the Medicare program to take into account the effects of COVID–19</header><subsection id="H4D40C210DF934ECB9917F4D265C454E0"><enum>(a)</enum><header>In general</header><text>Section 2(b)(2) of the IMPACT Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/185">Public Law 113–185</external-xref>) is amended—</text><paragraph id="HA05DCA5834C4489989C76A6F68F8F4B7"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="HA6B453C3ADF44D42B75D05AED8B4C921"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>Not later than</quote> and all that follows through <quote>subsection (a),</quote> and inserting <quote>Not earlier than the date that is 2 years after the later of January 1, 2022, and the date by which the Secretary of Health and Human Services has collected at least 8 specified calendar quarters (as defined in subparagraph (C)) of standardized patient assessment data under subsection (b) of section 1899B of the Social Security Act, of data on quality measures under subsection (c) of such section, and of resource use and claims data under subsection (d) of such section from each of the PAC payment systems (as defined in subsection (a)(2)(D) of such section),</quote>; and</text></subparagraph><subparagraph id="H81796A583CCF4FFA9EF6193AC0281BE3"><enum>(B)</enum><text>in clause (i)—</text><clause id="HC804779D7B8746DCAB34F7E2582D5439"><enum>(i)</enum><text>in subclause (III), by striking <quote>and</quote> at the end;</text></clause><clause id="H2C5F6E58D3F24DB1805B0300B577BC1F"><enum>(ii)</enum><text>in subclause (IV), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="H085608978D9641C1B909A93AAE55D52C"><enum>(iii)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="OLC" id="H17461F4FBE4C477D8A03F28AC2354E30" display-inline="no-display-inline"><subclause id="HF44437C0EBCD4209B368E7EBA05D6828"><enum>(V)</enum><text display-inline="yes-display-inline">account for the role that each type of PAC provider may play during public health emergencies, taking into account the value of each such type of provider during the COVID–19 public health emergency, such as the percent of patient populations served by each such type of provider with or recovering from COVID–19, as well as the acuity levels of such populations. </text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H23D474706DA649F68C23ABFD40C89A01"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H810A3490335E41A889F7F705F9770C4E" display-inline="no-display-inline"><subparagraph id="H8F84285E18934FCCA58B462BFA9B2899"><enum>(C)</enum><header>Specified calendar quarter defined</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term <quote>specified calendar quarter</quote> means a calendar quarter—</text><clause id="H155C4AEC2EBC409ABDA65FA70749CE3E"><enum>(i)</enum><text display-inline="yes-display-inline">beginning after the prospective payment system for home health agencies under section 1895 of the Social Security Act has incorporated the Patient-Driven Groupings Model (as described at 83 Fed. Reg. 56446 et seq.);</text></clause><clause id="H340412D6C99F4D0992F0620F7D1729DC"><enum>(ii)</enum><text display-inline="yes-display-inline">beginning after the prospective payment system for skilled nursing facilities under section 1888(e) of such Act has incorporated the Patient-Driven Payment Model (as described in 83 Fed. Reg. 39162 et seq.); and</text></clause><clause id="HE358AE7096734A008A17EDD7F1DF25CE"><enum>(iii)</enum><text>no portion of which occurs during a nationwide public health emergency declared by the Secretary pursuant to section 319 of the Public Health Service Act with respect to which any waiver has been effectuated by the Secretary pursuant to section 1135 of the Social Security Act.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H226C1AA8F6B94358822D0EAF0A6581CC"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of the IMPACT Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/185">Public Law 113–185</external-xref>).</text></subsection></section></legis-body></bill>
