Maloney of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To strengthen and enhance certain ethics requirements for the Federal Government, and for other purposes.</official-title></form><legis-body id="HABE0E272E491443E88B875B59E1CAD76" style="OLC"><section id="H04204DA047A04F76BD74D3357E81E684" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Executive Branch Conflict of Interest Act</short-title></quote>.</text></section><section id="H758D620E0AEA4A329D33921AF204CE8E"><enum>2.</enum><header>Restrictions on private sector payment for government service</header><text display-inline="no-display-inline">Section 209 of title 18, United States Code, is amended—</text><paragraph id="HE6D00AA8B9F443BA991F24BF79C60A47"><enum>(1)</enum><text>in subsection (a), by striking <quote>any salary</quote> and inserting <quote>any salary (including a bonus)</quote>; and</text></paragraph><paragraph id="HE1816A9069894FA7BAA922734D1A00C9"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H82DEF8EEA3444821834D9ADED0D3A157"><enum>(A)</enum><text>by inserting <quote>(1)</quote> after <quote>(b)</quote>; and</text></subparagraph><subparagraph id="H3A9401E699CF41DFAA185C6DB830118F"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H80A9C0C2B88C44688041061F9F127AB2" style="OLC"><paragraph id="H3635168C7E4B4B23930151BA498597DD"><enum>(2)</enum><text>For purposes of paragraph (1), a pension, retirement, group life, health or accident insurance, profit-sharing, stock bonus, or other employee welfare or benefit plan that makes payment of any portion of compensation contingent on accepting a position in the United States Government shall not be considered bona fide.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H67E11937CB344AAF9D8A65E2AF3DEEEF"><enum>3.</enum><header>Requirements relating to slowing the revolving door</header><subsection commented="no" id="H8790CB9703CD49059C082F4A66B7BE1C"><enum>(a)</enum><header>In general</header><text>The Ethics in Government Act of 1978 (5 U.S.C. App.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HABC04EE9E3884D33850F7F945CFEEEF6" style="OLC"><title commented="no" id="H3A3F881A29084BFE926415877B01EB78"><enum>VI</enum><header>Enhanced Requirements for Certain Employees </header><section commented="no" id="HE194658A15B943A6A1E68B77F27D5A55"><enum>601.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph commented="no" id="H55D8CA7E715D4D8CBA9E72CAF4DB9C22"><enum>(1)</enum><header>Covered agency</header><text>The term <quote>covered agency</quote>—</text><subparagraph commented="no" id="H9B80BC0D06CE4E4885C25D8693E7E9EA"><enum>(A)</enum><text>means an Executive agency, as defined in section 105 of title 5, United States Code, the Postal Service and the Postal Rate Commission, but does not include the Government Accountability Office or the Government of the District of Columbia; and</text></subparagraph><subparagraph commented="no" id="H976DD0D9C85D4AFA9478B590D3049BDC"><enum>(B)</enum><text>shall include the Executive Office of the President.</text></subparagraph></paragraph><paragraph commented="no" id="H051BA17C20BE4BE2BA85CA56393663B6"><enum>(2)</enum><header>Covered employee</header><text>The term <quote>covered employee</quote> means an officer or employee referred to in paragraph (2) of section 207(c) of title 18, United States Code.</text></paragraph><paragraph commented="no" id="H471A4A575EEE4A4EBD4662FDA996DE6A"><enum>(3)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Office of Government Ethics.</text></paragraph><paragraph id="H3737641ED9B64EFD9DF1A4E8983C5290"><enum>(4)</enum><header>Executive branch</header><text>The term <quote>executive branch</quote> has the meaning given that term in section 109.</text></paragraph><paragraph commented="no" id="H8EEFAC0FE46B415B8333994CF40EB9DB"><enum>(5)</enum><header>Former client</header><text>The term <quote>former client</quote>—</text><subparagraph commented="no" id="H31F1284ACA02423AB53AD2AE5929C9BC"><enum>(A)</enum><text>means a person for whom a covered employee served personally as an agent, attorney, or consultant during the 2-year period ending on the date before the date on which the covered employee begins service in the Federal Government; and</text></subparagraph><subparagraph commented="no" id="H953AB7B4E1464B8B937F8389809282FF"><enum>(B)</enum><text>does not include—</text><clause commented="no" id="H9EEDA79DA4E1404192680DDBA25568F5"><enum>(i)</enum><text display-inline="yes-display-inline">instances in which the service provided was limited to a speech or similar appearance by the covered employee; or</text></clause><clause commented="no" id="HBDB5DC8DB2164CEA8B2D7B79E5FA02AF"><enum>(ii)</enum><text>a client of the former employer of the covered employee to whom the covered employee did not personally provide such services.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HBACD412DD0314EC48A8E46F1EC5AD9D7"><enum>(6)</enum><header>Former employer</header><text>The term <quote>former employer</quote>—</text><subparagraph commented="no" id="H7CE431EAE9F04D31A7C42A020B15BEED"><enum>(A)</enum><text>means a person for whom a covered employee served as an employee, officer, director, trustee, or general partner during the 2-year period ending on the date before the date on which the covered employee begins service in the Federal Government; and</text></subparagraph><subparagraph commented="no" id="H1EA68C723E85449CA4494F64C6CF3957"><enum>(B)</enum><text>does not include—</text><clause commented="no" id="H4D98E6CA8B6B45688A58292185B695A8"><enum>(i)</enum><text>an entity in the Federal Government, including an executive branch agency;</text></clause><clause commented="no" id="HB68F3BD766F54B1985521B50D52AE7C5"><enum>(ii)</enum><text>a State or local government;</text></clause><clause commented="no" id="H2396F4E3BDB44611BA0A740011BD628D"><enum>(iii)</enum><text>the District of Columbia;</text></clause><clause commented="no" id="H6C57E648FC014D969A5D016D1439AA58"><enum>(iv)</enum><text>an Indian tribe, as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>); or</text></clause><clause commented="no" id="H04343A74808846F9B819322464311FDF"><enum>(v)</enum><text>the government of a territory or possession of the United States.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H283CCC82B8A04B2A8DBF1A49B78F8425"><enum>(7)</enum><header>Particular matter</header><text>The term <quote>particular matter</quote> has the meaning given that term in section 207(i) of title 18, United States Code.</text></paragraph></section><section commented="no" id="H6CB0E1C23E0E442CB053F8762CEDAC1A"><enum>602.</enum><header>Conflict of interest and eligibility standards</header><subsection commented="no" id="HA6F5A7197C434E97BB0C3BC8F6B5A06A"><enum>(a)</enum><header>In general</header><text>A covered employee may not use, or attempt to use, the official position of the covered employee to participate in a particular matter in which the covered employee knows a former employer or former client of the covered employee has a financial interest.</text></subsection><subsection commented="no" id="H5F1D666F9F654A4796BB175DD28A8876"><enum>(b)</enum><header>Waiver</header><paragraph commented="no" id="H4F2070DF1F1045D4A28B2CD27C4651BE"><enum>(1)</enum><header>In general</header><text>The head of the covered agency employing a covered employee, in consultation with the Director, may grant a written waiver of the restrictions under subsection (a) prior to engaging in the action otherwise prohibited by subsection (a) if, and to the extent that, the head of the covered agency certifies in writing that—</text><subparagraph commented="no" id="H8AA6573CCE3B47A0AC3BF26B10990312"><enum>(A)</enum><text>the application of the restriction to the particular matter is inconsistent with the purposes of the restriction; or</text></subparagraph><subparagraph commented="no" id="H56740362415E4DD6B189E07A7E3F2431"><enum>(B)</enum><text>it is in the public interest to grant the waiver.</text></subparagraph></paragraph><paragraph commented="no" id="H9E86305D820C4EF09E3C9C2CE673C454"><enum>(2)</enum><header>Publication</header><text display-inline="yes-display-inline">The head of the covered agency shall provide a waiver under paragraph (1) to the Director and post the waiver on the website of the agency within 30 calendar days after granting such waiver.</text></paragraph></subsection></section><section commented="no" id="H288CD4A0D9A545868B2AB34982162DE7"><enum>603.</enum><header>Penalties and injunctions</header><subsection commented="no" id="HC49E7BA006CA4E56861EA1572D838E00"><enum>(a)</enum><header>Criminal penalties</header><paragraph commented="no" id="H429D3EA0DE0246AAB7871A0BDE3F6358"><enum>(1)</enum><header>In general</header><text>Any person who violates section 602 shall be fined under title 18, United States Code, imprisoned for not more than 1 year, or both.</text></paragraph><paragraph commented="no" id="H1D9AF8308FF74D7F90A98F05169C3763"><enum>(2)</enum><header>Willful violations</header><text>Any person who willfully violates section 602 shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both.</text></paragraph></subsection><subsection commented="no" id="HEB8911B4B2DD42798F38FDB6F6830B1F"><enum>(b)</enum><header>Civil enforcement</header><paragraph commented="no" id="H7DC68C6067ED43568195B8EA597C2E26"><enum>(1)</enum><header>In general</header><text>The Attorney General may bring a civil action in an appropriate district court of the United States against any person who violates, or whom the Attorney General has reason to believe is engaging in conduct that violates, section 602.</text></paragraph><paragraph commented="no" id="HA44818C00CDD4FD29CFBCEC902F281D8"><enum>(2)</enum><header>Civil penalty</header><subparagraph commented="no" id="H0FCCBE34841549CDAB25CBD0516CAC6C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the court finds by a preponderance of the evidence that a person violated section 602, the court shall impose a civil penalty of not more than the greater of—</text><clause commented="no" id="H1D06A596E1774D35BCBCCFE8D28ABAA1"><enum>(i)</enum><text>$100,000 for each violation; or</text></clause><clause commented="no" id="HFC04BACD5AA64C45A1219C21A6D6E819"><enum>(ii)</enum><text>the amount of compensation the person received or was offered for the conduct constituting the violation.</text></clause></subparagraph><subparagraph commented="no" id="HA0B8B8C28C3240C88BFE91E39B170377"><enum>(B)</enum><header>Rule of construction</header><text>A civil penalty under this subsection may be in addition to any other criminal or civil statutory, common law, or administrative remedy available to the United States or any other person.</text></subparagraph></paragraph><paragraph commented="no" id="H9DDE47E300BF4A2D8AB154326F28B4C4"><enum>(3)</enum><header>Injunctive relief</header><subparagraph commented="no" id="HC2381364F8714BA7B6D974417504D761"><enum>(A)</enum><header>In general</header><text>In a civil action brought under paragraph (1) against a person, the Attorney General may petition the court for an order prohibiting the person from engaging in conduct that violates section 602.</text></subparagraph><subparagraph commented="no" id="H956B1AD5E7B4427B98F2CF4F78C77A8F"><enum>(B)</enum><header>Standard</header><text>The court may issue an order under subparagraph (A) if the court finds by a preponderance of the evidence that the conduct of the person violates section 602.</text></subparagraph><subparagraph commented="no" id="H6181272C33F44E3AA2A3BA86DA605765"><enum>(C)</enum><header>Rule of construction</header><text>The filing of a petition seeking injunctive relief under this paragraph shall not preclude any other remedy that is available by law to the United States or any other person.</text></subparagraph></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H1BC45C1DDC164EC5B5986B95BA616C50"><enum>4.</enum><header>Prohibition of procurement officers accepting employment from government contractors</header><subsection id="H7EB266656EFA4535B43ACD7EF4203D8A"><enum>(a)</enum><header>Expansion of prohibition on acceptance by former officials of compensation from contractors</header><text>Section 2104 of title 41, United States Code, is amended—</text><paragraph id="H06DC13E77A6B4C60847A08C552974639"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HC85372ABD7284A58AEB16C53A92EBD81"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="H7B7CC255A3184F3082AEEAA4A1DDB4B6"><enum>(i)</enum><text>by striking <quote>or consultant</quote> and inserting <quote>attorney, consultant, subcontractor, or lobbyist</quote>; and</text></clause><clause id="H3B04060CD61F4F6091B464659FE1F610"><enum>(ii)</enum><text>by striking <quote>one year</quote> and inserting <quote>2 years</quote>; and</text></clause></subparagraph><subparagraph id="H3823D23F20EE40389CEF43E23017ED58"><enum>(B)</enum><text>in paragraph (3), by striking <quote>personally made for the Federal agency</quote> and inserting <quote>participated personally and substantially in</quote>; and</text></subparagraph></paragraph><paragraph id="H65241F5EF1F74230BD4E77ECED42ABF1"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block id="H4EB3052DE06743C0BD34DAE2FE2358BB" style="OLC"><subsection id="HE7010F2A6FA64838B21D2C2F9FCD3908"><enum>(b)</enum><header>Prohibition on compensation from affiliates and subcontractors</header><text>A former official responsible for a Government contract referred to in paragraph (1), (2), or (3) of subsection (a) may not accept compensation for 2 years after awarding the contract from any division, affiliate, or subcontractor of the contractor.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA0F5AD20531541C7958C5E8305CBC74A"><enum>(b)</enum><header>Requirement for procurement officers To disclose job offers made on behalf of relatives</header><text>Section 2103(a) of title 41, United States Code, is amended in the matter preceding paragraph (1) by inserting after <quote>that official</quote> the following: <quote>, or for a relative (as defined in section 3110 of title 5) of that official,</quote>.</text></subsection><subsection id="HE411C362C77149BEB38D98F0B968EAD8"><enum>(c)</enum><header>Requirement on award of government contracts to former employers</header><paragraph id="HC69A24FCEC2B4392B3617ED39834B45C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 21 of division B of subtitle I of title 41, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H315D4B79DDFC431EA631B3E48D4D3F83" style="USC"><section id="HA82FA4B23CED46E7956DD4DC4604B5FB"><enum>2108.</enum><header>Prohibition on involvement by certain former contractor employees in procurements</header><text display-inline="no-display-inline">An employee of the Federal Government may not be personally and substantially involved with any award of a contract to, or the administration of a contract awarded to, a contractor that is a former employer of the employee during the 2-year period beginning on the date on which the employee leaves the employment of the contractor.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H8AA50AB3174540E0B7723F1C7EDCEF5A"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/21">chapter 21</external-xref> of title 41, United States Code, is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="H90C711717EEB4676931B33856D666E83" style="USC"><toc regeneration="no-regeneration"><toc-entry level="item">2108. Prohibition on involvement by certain former contractor employees in procurements. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9E7424684DC04E80A235843E1165F6BC"><enum>(d)</enum><header>Regulations</header><text>The Administrator for Federal Procurement Policy and the Director of the Office of Management and Budget shall—</text><paragraph id="H36D978C99DD741C8841D72063C6E9ECD"><enum>(1)</enum><text>in consultation with the Director of the Office of Personnel Management and the Counsel to the President, promulgate regulations to carry out and ensure the enforcement of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/21">chapter 21</external-xref> of title 41, United States Code, as amended by this section; and</text></paragraph><paragraph id="HDDED49B33FE2424293A2EDA49D1CE6D1"><enum>(2)</enum><text>in consultation with designated agency ethics officials (as that term is defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /109">section 109(3)</external-xref> of the Ethics in Government Act of 1978 (5 U.S.C. App.)), monitor compliance with that chapter by individuals and agencies.</text></paragraph></subsection></section><section id="HE77C20A2439A459E84BC793CDEDCDA33"><enum>5.</enum><header>Revolving door restrictions on employees moving into the private sector</header><subsection id="HF41B48EB882B4055B980DEEEA4889E48"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (c) of section 207 of title 18, United States Code, is amended—</text><paragraph id="HB7151B2019A847B5B5C41A442DBDCE9F"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="USC">One-year</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Two-year</header-in-text></quote>;</text></paragraph><paragraph id="H03B52CB8941D4AD8B34FBDD476E88066"><enum>(2)</enum><text>in paragraph (1), by striking <quote>1 year</quote> in each instance and inserting <quote>2 years</quote>; and</text></paragraph><paragraph id="HE369F0FEFFB94BD0A7B01C9A609B657E"><enum>(3)</enum><text>in paragraph (2)(B), by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text></paragraph></subsection><subsection id="H1002D7E2EE7846E0BC2BF4D3E71EF015"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to any individual covered by subsection (c) of section 207 of title 18, United States Code, separating from the civil service on or after the date of enactment of this Act.</text></subsection></section><section id="HA22CCC0E32ED401EA788FACDA66A56DF"><enum>6.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or amendment made by this Act, or the application of a provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of this Act and amendments made by this Act, and the application of the provisions and amendment to any person or circumstance, shall not be affected by the holding.</text></section></legis-body></bill>
