<official-title display="yes">To amend title 38, United States Code, to provide for the eligibility of certain individuals exposed to burn pits for hospital care, medical services, and nursing home care furnished by the Department of Veterans Affairs, and for other purposes.</official-title>

<section id="H9B5A3F1380194498A8AF7D4C7D96B328" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jennifer Kepner Healthcare for Open air burn Pit Exposure Act</short-title></quote> or the <quote><short-title>Jennifer Kepner HOPE Act</short-title></quote>.</text></section> <section id="HA56C1B0D0F554EBC9D72EF5CE395A293"><enum>2.</enum><header>Eligibility of individuals exposed to burn pits for hospital care, medical services, and nursing home care furnished by the Department of Veterans Affairs</header> <subsection id="HC6E8DF0EAAB54C44BAA4855857EDBB9D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1710 of title 38, United States Code, is amended—</text>
<paragraph id="H45CE3B3C3D5E47CEB45A048C986043AD"><enum>(1)</enum><text>in subsection (a)(2)(F), by inserting <quote>burn pit,</quote> after <quote>radiation,</quote>; and</text></paragraph> <paragraph id="H5A5AD46C44D4469EB5784614FC949702"><enum>(2)</enum><text>in subsection (e)—</text>
<subparagraph id="HCF95CB012AFA404FB4CA95FADC2846E9"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H98D723C5C05F4BFC9B03E44DBD4822C0" style="USC"> <subparagraph id="H4404F38F4ACA460CB6848141A98CB7FC" indent="up2"><enum>(G)</enum> <clause commented="no" display-inline="yes-display-inline" id="HC99235DF1C9E429C9DE9DF5D8F81A19A"><enum>(i)</enum><text>Subject to paragraph (2), an individual described in clause (ii) is eligible for hospital care, medical services, and nursing home care under subsection (a)(2)(F) notwithstanding that there is insufficient medical evidence to conclude that a disease or disability of the individual is or is not associated with exposure to an open air burn pit.</text></clause>
<clause id="H7711200058A6430FB8B6E00C1CCB9E44" indent="up1"><enum>(ii)</enum><text>An individual described in this clause is an individual who, on or after January 1, 1990, served as a member of the Armed Forces in support of a contingency operation and was based or stationed at a location where an open air burn pit was in use.</text></clause> <clause id="H542716C273324B538DD5129BF3E3E9AF" indent="up1"><enum>(iii)</enum><text>In this subparagraph, the term <quote>open air burn pit</quote> means a place where—</text>
<subclause id="H384789BA64E14E21A5D927ED4128B181"><enum>(I)</enum><text display-inline="yes-display-inline">solid waste is disposed of by burning in the outdoor air; and</text></subclause> <subclause id="H45B09717565C4E7FA3097A68A98C41F7"><enum>(II)</enum><text display-inline="yes-display-inline">a commercially manufactured incinerator or other equipment specifically designed and manufactured for the burning of solid waste is not in use.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="H83345262C53345A486C0DF39F104BE23"><enum>(B)</enum><text>in paragraph (2)(B), by striking <quote>or (F)</quote> and inserting <quote>(F), or (G)</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H2474B5D8D0344C7595974D7D4A6A7393"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to hospital care, medical services, and nursing home care furnished on or after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section>
