which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Administrator of the Environmental Protection Agency to award grants to entities to enable such entities to participate in decisions impacting the health and safety of their communities in connection with the release of certain hazardous air pollutants and the permitting of solid waste disposal facilities and hazardous waste facilities, and for other purposes.</official-title></form><legis-body id="H57171BCBE0B64510BAB9C16387D41588" style="OLC"><section id="HB4A30D35A2C54C45B0984E5C19EC683A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voices for Environmental Justice Act</short-title></quote>.</text></section><section id="H3E58F3FDD2FA453F97197F887F0C7D59"><enum>2.</enum><header>Environmental justice community technical assistance grants</header><text display-inline="no-display-inline">Title III of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7601">42 U.S.C. 7601</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H0DC70C60EB0C4F338C8F71D4670B3C6B" display-inline="no-display-inline"><section id="HC452348216C14494B7FF5E4B3A3495DF"><enum>330.</enum><header>Environmental justice community technical assistance grants</header><subsection id="H2919328D21A949359E023B5EEBFCA5E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may award grants to eligible entities to enable such entities to participate in decisions impacting the health and safety of their communities in connection with an actual or potential release of a covered hazardous air pollutant.</text></subsection><subsection id="HA8F0EAC4D1CB4D85B538D0223DCBA8F8"><enum>(b)</enum><header>Timing</header><paragraph id="H6EB9C9F6EED847EBA1CB1284FACFA9FE"><enum>(1)</enum><header>Guidance</header><text>Not later than 12 months after the date of enactment of this section, the Administrator shall publish guidance describing the process for eligible entities to apply for a grant under this section, including the required content and form of applications, the manner in which applications must be submitted, and any applicable deadlines.</text></paragraph><paragraph id="HACFBCCD4E6954964B059604732559DDB"><enum>(2)</enum><header>First grant</header><text>Not later than 180 days after the issuance of guidance under paragraph (1), the Administrator shall award the first grant under this section.</text></paragraph></subsection><subsection id="H3050C929518A4901BDE2A4E0FFA644EC"><enum>(c)</enum><header>Eligible entity</header><text>To be eligible for a grant under this section, an applicant shall be a group of individuals who reside in a community that—</text><paragraph id="H2489FF7EFDE649958E9DD0B03F987540"><enum>(1)</enum><text display-inline="yes-display-inline">is a population of color, a community of color, an indigenous community, or a low-income community; and</text></paragraph><paragraph id="HC9FB7AA5DFD7464ABEE432F479BC4A31"><enum>(2)</enum><text>is in close proximity to the site of an actual or potential release of a covered hazardous air pollutant.</text></paragraph></subsection><subsection id="HA22CBF0D1DDF4DC5A791DD5C6F6FAEBC"><enum>(d)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall use the grant to participate in decisions impacting the health and safety of the community involved in connection with an actual or potential release of a covered hazardous air pollutant, including—</text><paragraph id="H55F0611760E24CE6A601BD6D851F49AC"><enum>(1)</enum><text>interpreting information with regard to the nature of the hazard, cumulative impacts studies, health impacts studies, remedial investigation and feasibility studies, agency decisions, remedial design, and operation and maintenance of necessary monitors; and</text></paragraph><paragraph id="H12CE909994C0421FA16E0106943748CF"><enum>(2)</enum><text>performing additional air pollution monitoring. </text></paragraph></subsection><subsection id="H76DDD447D4B84F08AEFB8D91814390D1"><enum>(e)</enum><header>Limitations on amount; renewal</header><paragraph id="H816EB17DCFCB4D81889E13B05CA9E41D"><enum>(1)</enum><header>Amount</header><subparagraph id="H15B26BFCE72B450D8C448703B7E6C8C8"><enum>(A)</enum><header>In general</header><text>The amount of a grant under this section (excluding any renewals of the grant) may not exceed $50,000 for any grant recipient.</text></subparagraph><subparagraph id="H190444567E96429BABF283C4E8F64B52"><enum>(B)</enum><header>Exception</header><text>The Administrator may waive the limitation in subparagraph (A) with respect to an applicant in any case where the Administrator determines that such waiver is necessary for the community involved to obtain the necessary technical assistance.</text></subparagraph></paragraph><paragraph id="HE950C0EAA5764DF8A7DF07E07BDF1592"><enum>(2)</enum><header>Renewal</header><text>Grants may be renewed for each step in the regulatory, removal, or remediation process in connection with a facility with the potential to release a covered hazardous air pollutant.</text></paragraph></subsection><subsection id="H559580489F614DECA2DD520AA3DFC05A"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE9B7C4A660AF4A7F9082261F87F46F55"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>community of color</term> means any geographically distinct area the population of color of which is higher than the average population of color of the State in which the community is located.</text></paragraph><paragraph id="H9E5E7E3B9CE542689CFB5A83F21B6389"><enum>(2)</enum><text>The term <term>covered hazardous air pollutant</term> means a hazardous air pollutant (as defined in section 112 of the Clean Air Act) that—</text><subparagraph id="H782BB68543E2465999D7814436DF4439"><enum>(A)</enum><text>is listed on the toxics release inventory under section 313(c) of the Emergency Planning and Community Right-To-Know Act of 1986; or</text></subparagraph><subparagraph id="HE18190FDAF484745A22E8407FD8BC376"><enum>(B)</enum><text>is identified as carcinogenic by an assessment under the Integrated Risk Information System (IRIS) of the Environmental Protection Agency.</text></subparagraph></paragraph><paragraph id="H9432F3611D584F6C95044ED793524571"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>indigenous community</term> means—</text><subparagraph id="H988DAA7E8DC84E92A313F0D0B0B68894"><enum>(A)</enum><text>a federally recognized Indian Tribe;</text></subparagraph><subparagraph id="H9A2B57D699BB41F4AE47FC6184203DCC"><enum>(B)</enum><text>a State-recognized Indian Tribe;</text></subparagraph><subparagraph id="H6BE547A22ED44B5EBDE91418FE1E6566"><enum>(C)</enum><text>an Alaska Native or Native Hawaiian community or organization; and</text></subparagraph><subparagraph id="HE55E05879ED74035966BF07D69819352"><enum>(D)</enum><text>any other community of indigenous people, including communities in other countries.</text></subparagraph></paragraph><paragraph id="H435800A4930F4A6D8A2E74AB3FE23F4B"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>low income</term> means an annual household income equal to, or less than, the greater of—</text><subparagraph id="H98C3400B42534933B603240E6FDFAEF1"><enum>(A)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="H38D2E6D1BDF641F18752E74F7043E85D"><enum>(B)</enum><text>200 percent of the Federal poverty line.</text></subparagraph></paragraph><paragraph id="HAD8FCEBBF0D34420882D3AF0D9A026EE"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>population of color</term> means a population of individuals who identify as—</text><subparagraph id="H0237AAD27BF343608A83DF8A882CB2A7"><enum>(A)</enum><text>Black;</text></subparagraph><subparagraph id="HCF9051277F20417F84A3A0A4D3C09764"><enum>(B)</enum><text>African American;</text></subparagraph><subparagraph id="H31DA59315D4443AC85DD66561E6A4172"><enum>(C)</enum><text>Asian;</text></subparagraph><subparagraph id="HCF2E7B8AE3C8471FBC4305CBFC2B69A2"><enum>(D)</enum><text>Pacific Islander;</text></subparagraph><subparagraph id="H9C394505FDD34CC3BFDD41B46F8B69F7"><enum>(E)</enum><text>another non-White race;</text></subparagraph><subparagraph id="HD8489D9AC20B4470825F8C0A74AFC6B2"><enum>(F)</enum><text>Hispanic;</text></subparagraph><subparagraph id="HC89CB83A6F16431AB7A45372A3FDF74E"><enum>(G)</enum><text>Latino; or</text></subparagraph><subparagraph id="HD17E7A7D37754B2BBBDC476B35F112CE"><enum>(H)</enum><text>linguistically isolated.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HAF3C8D8A64FE46BD82D5D099D6486211"><enum>3.</enum><header>Environmental justice community solid waste disposal technical assistance grants</header><subsection id="HED1314F747DD41DC8E7B3C5372099E5B"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">Subtitle D of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6941">42 U.S.C. 6941</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block id="H898484386BA6402A9A626F96AC978FD0" style="OLC"><section id="HF1724C7EDC314A4DAA1A14FBAB130BCA"><enum>4011.</enum><header>Environmental justice community technical assistance grants</header><subsection id="HFC5D082AA227425BBDF4E4E2822AF6DF"><enum>(a)</enum><header>In general</header><text>The Administrator may award grants to eligible entities to enable such entities to participate in decisions impacting the health and safety of their communities relating to the permitting or permit renewal of a solid waste disposal facility or hazardous waste facility. </text></subsection><subsection id="H495B9FD80089414C9F78797C059F8453"><enum>(b)</enum><header>Timing</header><paragraph id="H90B4E9444C8A4775ABC72D169543A554"><enum>(1)</enum><header>Guidance</header><text>Not later than 12 months after the date of enactment of this section, the Administrator shall publish guidance describing the process for eligible entities to apply for a grant under this section, including the required content and form of applications, the manner in which applications must be submitted, and any applicable deadlines.</text></paragraph><paragraph id="H0577002287AF4362BF649003330BE9AD"><enum>(2)</enum><header>First grant</header><text>Not later than 180 days after the issuance of guidance under paragraph (1), the Administrator shall award the first grant under this section.</text></paragraph></subsection><subsection id="HB4E7F27946D2488782A43A9D6FCB7F0A"><enum>(c)</enum><header>Eligible entity</header><text>To be eligible for a grant under this section, an applicant shall be a group of individuals who reside in a community that—</text><paragraph id="H110F60C42BC947CDB2137C36AA63DE10"><enum>(1)</enum><text>is a population of color, a community of color, an indigenous community, or a low-income community; and</text></paragraph><paragraph id="H392B27FBE5044CCF83251CC472A6E49F"><enum>(2)</enum><text>is in close proximity to a facility described in subsection (a) for which a decision relating to a permit or permit renewal for such facility is required.</text></paragraph></subsection><subsection id="H0338EFE01BD04F80BFD3D4928E09B72C"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity receiving a grant under this section shall use the grant to participate in decisions impacting the health and safety of the community involved that are related to the permitting or permit renewal of a solid waste disposal facility or hazardous waste facility, including—</text><paragraph id="H909459975A22478F9A7A42E54841F5E7"><enum>(1)</enum><text>interpreting information with regard to—</text><subparagraph id="H71764DFE3FA3438DA1035B911595614D"><enum>(A)</enum><text>cumulative impacts studies;</text></subparagraph><subparagraph id="H2D060A03D18748C5BE0789BA460CC541"><enum>(B)</enum><text>health impacts studies;</text></subparagraph><subparagraph id="H930182C115F14BB38E7C6B6EB60810AE"><enum>(C)</enum><text>relevant agency decisions; and</text></subparagraph><subparagraph id="H1F1A2ECB252941608E5D5306136459E7"><enum>(D)</enum><text>operation and maintenance of necessary monitors; and</text></subparagraph></paragraph><paragraph id="H948B62361C6B4D33AC379A73194B3B4F"><enum>(2)</enum><text>performing environmental monitoring.</text></paragraph></subsection><subsection id="H4F4CA1D09BD44C71B5D909CBD1ADC1CD"><enum>(e)</enum><header>Limitations on amount; or</text></subparagraph><subparagraph id="H55D02E5F0DF84E05ACFEEE67DBCA8EA1"><enum>(H)</enum><text>linguistically isolated.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H37CFB98A6CEC4D869F5B8FB279B13235"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Solid Waste Disposal Act is amended by adding after the item relating to section 4010 the following: </text><quoted-block style="OLC" id="H771871CD10114DE9ADC012B22C2E50B7" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 4011. Environmental justice community technical assistance grants.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HCC8E9C9E743F405794030BCC1F967CFF"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out section 330 of the Clean Air Act (as added by section 2 of this Act) and section 4011 of the Solid Waste Disposal Act (as added by section 3 of this Act) $5,000,000 for each of fiscal years 2022 through 2026.</text></section></legis-body></bill>
