R. 242</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210111">January 11, 2021</action-date><action-desc><sponsor name-id="D000631">Ms. Dean</sponsor> (for herself and <cosponsor name-id="N000002">Mr. Nadler</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 11 of the United States Code to increase the amount of the allowable homestead exemption.</official-title></form><legis-body id="H095B80DB9D3C4676ABF1D1AF42DF74ED" style="OLC"><section id="HAACCBC6367DD462D9C92C2BA4DAB69C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Homeowners in Bankruptcy Act of 2021</short-title></quote>.</text></section><section id="HE9C05D69C1A74DB29E5B48F1F60A6D32"><enum>2.</enum><header>Increasing the homestead exemption</header><text display-inline="no-display-inline">Section 522 of title 11 of the United States code, is amended—</text><paragraph id="H0DD18015014244A2966355871F6CC515"><enum>(1)</enum><text>in subsection (d)(1) by striking <quote>$15,000</quote> and inserting <quote>$100,000</quote>; and</text></paragraph><paragraph id="H377A3CFD376E4A4798D4100C0B79A1C5"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H2BB94BB2FB1047D58875CA1A6361305B" style="OLC"><subsection id="H5DE9CE5F839A46E2AE3C7F4C1F0A6DCD"><enum>(r)</enum><text>Notwithstanding any other provision of applicable nonbankruptcy law, a debtor in any State may exempt from property of the estate the property described in subsection (d)(1) not to exceed the value in subsection (d)(1) if the exemption for such property permitted by applicable nonbankruptcy law is lower than that amount.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HCA401ED5271C4EBAB5A42089B710747A" section-type="subsequent-section" commented="no"><enum>3.</enum><header>Effective Date; Application of Amendments</header><subsection id="HD5E7278F264F4D0080BF5483CF053802" commented="no"><enum>(a)</enum><header>Effective Date</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act and the amendments made by this Act shall take effect on the date of the enactment of this Act.</text></subsection><subsection id="HE8773B5A003946E38C598715438F3909" commented="no"><enum>(b)</enum><header>Application of Amendments</header><text>The amendments made by this Act shall not apply to cases commenced under title of the United States Code before the effective date of this Act.</text></subsection></section></legis-body></bill>
