which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committees on <committee-name committee-id="HED00">Education and Labor</committee-name>, and <committee-name committee-id="HSM00">Small Business</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit recipients of Federal COVID relief and Federal agencies from engaging in certain conduct that discriminates against individuals who have not been vaccinated against COVID–19, and for other purposes.</official-title></form><legis-body id="H4C589DB68A8B452DB6967DC8B2066D75" style="OLC"><section id="H004D6DE8BE80414081CF5C80C211887D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Vaccines Voluntary Act</short-title></quote>.</text></section><section id="HC755433BF91146C18B3D064AAF23339A" section-type="subsequent-section"><enum>2.</enum><header>Discrimination based on COVID vaccination status</header><subsection id="H629E2924EE9D484E9697B27CB1F02013"><enum>(a)</enum><header>COVID relief conditions</header><paragraph id="H3E44048660C646D48DCCA19CDA9E3BCA" display-inline="no-display-inline"><enum>(1)</enum><header>Businesses</header><subparagraph id="HE0022A4BBADB438AB076A5451D7EA9DD"><enum>(A)</enum><header>In general</header><text>No person or entity may receive a grant or loan under paragraphs (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), section 7(b)(2) of such Act pursuant to section 1110 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>), section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), or any subsequent COVID–19 relief package, unless such person or entity certifies that the person or entity—</text><clause id="H5649F21A13CD48018FE1B88065D93D0C"><enum>(i)</enum><text>will not condition providing service to any individual solely on such individual having been vaccinated against COVID–19; and</text></clause><clause id="HF373795A74D74E32A7BAE2DF386D4E2A"><enum>(ii)</enum><text display-inline="yes-display-inline">will not, solely on the basis that an individual has not been vaccinated against COVID–19—</text><subclause id="H31A40C7128BA4DA286423FD313AB212C"><enum>(I)</enum><text display-inline="yes-display-inline">terminate the employment or adversely affect the compensation, terms, conditions, or privileges of employment of such individual if such individual is employed by such person or entity; or</text></subclause><subclause id="HA2421E57AF32485C829658ABCE0110A4"><enum>(II)</enum><text>fail or refuse to hire such individual.</text></subclause></clause></subparagraph><subparagraph id="H4ED9FFFBAEEC4BB0858C808DC25BC260"><enum>(B)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subparagraph (A) shall apply only with respect to agreements for grants or loans entered into after the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="HF3D18B6CFAF046999EC4F15ED1A0BE43"><enum>(2)</enum><header>Institutions of higher education</header><subparagraph id="H9002B077CCB147019288EA8C2D76182D"><enum>(A)</enum><header>In general</header><text>No institution of higher education (as defined under section 101 or 102 of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> et seq.)) may receive Federal funds under section 2003 of the American Rescue Plan of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) or any subsequent COVID–19 relief package unless such institution certifies that no rule or policy that requires any separation of individuals who are vaccinated against COVID–19 from individuals who are not so vaccinated on the property of such institution or at the activities of such institution will be implemented by such institution.</text></subparagraph><subparagraph id="HF132972A5F8B43B58B0FA9142EA38D1E"><enum>(B)</enum><header>Applicability</header><text>Subparagraph (A) shall apply only with respect to—</text><clause id="H9789038E4608478382FE1BB753A03144"><enum>(i)</enum><text>payments made after the date of the enactment of this Act; and</text></clause><clause id="HBD2F5ABC639F45C5952F49B8771D8E90"><enum>(ii)</enum><text>grants or loans initially made after the date of the enactment of this Act.</text></clause></subparagraph></paragraph><paragraph id="H4FEFF0F1AA554B7595A94AE0A6A931E6"><enum>(3)</enum><header>State and local governments</header><subparagraph id="HE5C8A89284644FD999C3A6A2F5A5E06C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No covered State or local government may receive a payment under sections 602 through 605 of title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801</external-xref> et seq.) unless such covered State or local government certifies that no law, regulation, rule, or policy (other than a Federal law) that requires any separation of individuals who are vaccinated against COVID–19 from individuals who are not so vaccinated at any public location, business, or other place of public accommodation will be enacted, implemented, or enforced by such covered State or local government. </text></subparagraph><subparagraph id="H3B106639717743279F67514E5953DC5C"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="H77BE540F3FCF43768EDD9885BC948D40"><enum>(i)</enum><header>County; metropolitan city; nonentitlement unit of local government; unit of general local government</header><text>The terms <term>county</term>, <term>metropolitan city</term>, <term>nonentitlement unit of local government</term>, and <term>unit of general local government</term> have the meaning given such terms in section 603(g) of title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/803">42 U.S.C. 803(g)</external-xref>).</text></clause><clause id="HB6BE6864B4B54A28B90AEAB52C7C7D04"><enum>(ii)</enum><header>Covered State or local government</header><text display-inline="yes-display-inline">The term <term>covered State or local government</term> means a State, territory, Tribal government, metropolitan city, nonentitlement unit of local government, unit of general local government, or county.</text></clause><clause id="H30901E26087047E3BFC18E058DD69A6A"><enum>(iii)</enum><header>Public accommodation</header><text>The term <term>public accommodation</term> has the meaning given such term in section 301 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181</external-xref>). </text></clause><clause id="HCD07622CB7A24140BB7503CF859BBB56"><enum>(iv)</enum><header>State; territory; Tribal government</header><text>The terms <term>State</term>, <term>territory</term>, and <term>Tribal government</term> have the meaning given such terms in section 602(g) of title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/802">42 U.S.C. 802(g)</external-xref>).</text></clause></subparagraph><subparagraph id="HCAEC90B743614B61A60EB24573887384"><enum>(C)</enum><header>Applicability</header><text>Subparagraph (A) shall apply only with respect to payments made after the date of the enactment of this Act. </text></subparagraph></paragraph></subsection><subsection id="HB120A357EEB14A40A62A34E8CD5A57C5"><enum>(b)</enum><header>Federal employment</header><text display-inline="yes-display-inline">No Federal agency (as defined in section 105 of title 5, United States Code) may condition the appointment of an individual to any position in the civil or uniformed services (as such terms are defined in section 2101 of title 5, United States Code) on such individual being vaccinated against COVID–19.</text></subsection></section></legis-body></bill>
