R. 2402</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210408">April 8, 2021</action-date><action-desc><sponsor name-id="F000449">Mr. Fortenberry</sponsor> (for himself, <cosponsor name-id="S001200">Mr. Soto</cosponsor>, <cosponsor name-id="F000446">Mr. Feenstra</cosponsor>, and <cosponsor name-id="D000629">Ms. Davids of Kansas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To transfer administrative jurisdiction of certain Federal lands from the Army Corps of Engineers to the Bureau of Indian Affairs, to take such lands into trust for the Winnebago Tribe of Nebraska, and for other purposes.</official-title></form><legis-body id="HA47636C73EDB4BF7A25A5A7241E8F3B0" style="OLC"><section id="HC142567456764EB685220007535F3011" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Winnebago Land Transfer Act of 2021</short-title></quote>.</text></section><section id="HC934137843574D529CB78C663263A821" section-type="subsequent-section"><enum>2.</enum><header>Land to be taken into trust</header><subsection id="HBB8DBB5A98A14AD0BF6EEB7FED20B9C9"><enum>(a)</enum><header>In general</header><text>Subject to all valid existing rights, all right, title, and interest (including improvements and appurtenances) of the United States in and to the Federal lands described in subsection (b), the Federal lands—</text><paragraph id="H12576B03E644420DBA8C04AA28ADFC78"><enum>(1)</enum><text>are declared to be part of the Winnebago Reservation created by the Treaty between the United States and the Winnebago Tribe in 1865; and</text></paragraph><paragraph id="H228A0518AC604BFCB8896D09467DE829"><enum>(2)</enum><text>shall be held in trust by the United States for the benefit of the Winnebago Tribe of Nebraska subject to the same terms and conditions as those lands described in the Treaty with the Winnebago Tribe, 1865 (14 Stat. 671).</text></paragraph></subsection><subsection id="HF54444B221324CAA97B986BF366E4C61"><enum>(b)</enum><header>Federal lands described</header><text>The Federal lands described in this subsection are as follows:</text><paragraph id="H383EA4EA514C428F88F2DB443929AE63"><enum>(1)</enum><text>That portion of Tract No. 119, the description of which is filed in U.S. District Court for the Northern District of Iowa (Western Division), Civil Case No. 70–C–3015–W, executed May 11, 1973, said tract being situated in Section 8 and the accretion land thereto, the Southwest Quarter of Section 9, the West Half of Section 16, the East Half of Section 17, Township 86 North, Range 47 West of the Fifth Principal Meridian, Woodbury County, Iowa, lying Easterly of the Nebraska/Iowa State Line and Southerly of the Eastern extension of the North line of the Winnebago Reservation.</text></paragraph><paragraph id="H55A806B4A0DA4BA090C90BF332F6C6E7"><enum>(2)</enum><text>All of Tract 210, in Iowa, the description of which is filed in a Federal condemnation action in U.S. District Court for the Northern District of Iowa (Western Division), in Civil Case No. 70–C–3015–W.</text></paragraph><paragraph id="HA4EE4012C46B4B36B5F895C389ACC667"><enum>(3)</enum><text>All of Tract 113, in Iowa, the description of which is filed in a Federal condemnation action in U.S. District Court for the State of Nebraska, in Civil Case No. 70–C–03498.</text></paragraph></subsection></section></legis-body></bill>
