R. 23</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="L000582">Mr. Lieu</sponsor> (for himself and <cosponsor name-id="H001071">Mr. Hice of Georgia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require congressional notification for certain changes in status of inspectors general, and for other purposes.</official-title></form><legis-body id="HD85CB8E590E04ACE8063CFC61B78AFCB" style="OLC"><section id="HB161FBE18FCC45ED88B5971134D77ED8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inspector General Protection Act</short-title></quote>.</text></section><section id="HC22E41CDE3594559B7FAD14D23759313"><enum>2.</enum><header>Congressional notification of change in status of Inspector General</header><subsection display-inline="no-display-inline" id="HA280D426B7DD4FE091FA88A41117B1E3"><enum>(a)</enum><header>Change in status of Inspector General of offices</header><text display-inline="yes-display-inline">Section 3(b) of the Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text><paragraph id="H78CE41D76F4745A9B68E261FEB29B9A9"><enum>(1)</enum><text>by inserting <quote>, is placed on paid or unpaid non-duty status,</quote> after <quote>is removed from office</quote>;</text></paragraph><paragraph id="H7207EE21B16D4CF890499FD5F3FA0E26"><enum>(2)</enum><text>by inserting <quote>, change in status,</quote> after <quote>any such removal</quote>; and</text></paragraph><paragraph id="H606B4C87CE7E4862B73D5BB4A00F9A59"><enum>(3)</enum><text>by inserting <quote>, change in status,</quote> after <quote>before the removal</quote>.</text></paragraph></subsection><subsection id="HB99E5C4A407C4223A983B65128C7C94A"><enum>(b)</enum><header>Change in status of Inspector General of designated Federal entities</header><text>Section 8G(e)(2) of the Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text><paragraph id="H5B58B26A88764C71BAD7060F4D2C78AB"><enum>(1)</enum><text>by inserting <quote>, is placed on paid or unpaid non-duty status,</quote> after <quote>office</quote>;</text></paragraph><paragraph id="H697794C62B594EFFBFBA001504417A29"><enum>(2)</enum><text>by inserting <quote>, change in status,</quote> after <quote>any such removal</quote>; and</text></paragraph><paragraph id="HC22DDE01F45C4E41B0032C234F2F2B51"><enum>(3)</enum><text>by inserting <quote>, change in status,</quote> after <quote>before the removal</quote>.</text></paragraph></subsection><subsection id="H11D0022493E04604853FD911EC1C202F"><enum>(c)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect 30 days after the date of the enactment of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HBF4C2E40ADFD401690735152AFE5ED10" section-type="subsequent-section"><enum>3.</enum><header>Presidential explanation of failure to nominate an Inspector General</header><subsection commented="no" id="HE6ACEF2951E5470AA5C3B0EF438818BD"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/3349d">section 3349d</external-xref> the following new section:</text><quoted-block display-inline="no-display-inline" id="H417BE91D68054528AD80295C898D108D" style="USC"><section commented="no" id="H4EF1913CA7264C68AD51B033E1E5544B"><enum>3349e.</enum><header>Presidential explanation of failure to nominate an Inspector General</header><text display-inline="no-display-inline">If the President fails to make a formal nomination for a vacant Inspector General position that requires a formal nomination by the President to be filled within the period beginning on the date on which the vacancy occurred and ending on the day that is 210 days after that date, the President shall communicate, within 30 days after the end of such period, to Congress in writing—</text><paragraph commented="no" id="H04A985A83ECD467DB4E7BBFD68814E7A"><enum>(1)</enum><text>the reasons why the President has not yet made a formal nomination; and</text></paragraph><paragraph commented="no" id="H1214D2DE0C39426F9A9328C350756472"><enum>(2)</enum><text>a target date for making a formal nomination.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HD128D1E4370645A0883188AB7B386E22"><enum>(b)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, is amended by inserting after the item relating to 3349d the following new item:</text><quoted-block display-inline="no-display-inline" id="H3D57F95C1AC640F4BC5B8FFFCCC1D541" style="OLC"><toc container-level="quoted-block-container" idref="H417BE91D68054528AD80295C898D108D" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="H4EF1913CA7264C68AD51B033E1E5544B" level="section">3349e. Presidential explanation of failure to nominate an Inspector General.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HB6BAB4518A4D4E52856A4F3052D0E72F"><enum>(c)</enum><header>Effective Date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to any vacancy first occurring on or after that date.</text></subsection></section><section id="H28FBD4FEF99146C99B918B5A91221639"><enum>4.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
