R. 2394</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210408">April 8, 2021</action-date><action-desc><sponsor name-id="C001067">Ms. Clarke of New York</sponsor> (for herself, <cosponsor name-id="V000081">Ms. Velázquez</cosponsor>, <cosponsor name-id="B001300">Ms. Barragán</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="M001160">Ms. Moore of Wisconsin</cosponsor>, <cosponsor name-id="B000574">Mr. Blumenauer</cosponsor>, <cosponsor name-id="G000551">Mr. Grijalva</cosponsor>, <cosponsor name-id="N000002">Mr. Nadler</cosponsor>, <cosponsor name-id="B001223">Mr. Bowman</cosponsor>, <cosponsor name-id="C001080">Ms. Chu</cosponsor>, <cosponsor name-id="E000297">Mr. Espaillat</cosponsor>, <cosponsor name-id="B001303">Ms. Blunt Rochester</cosponsor>, <cosponsor name-id="L000551">Ms. Lee of California</cosponsor>, <cosponsor name-id="M001163">Ms. Matsui</cosponsor>, and <cosponsor name-id="M001188">Ms. Meng</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the establishment of a Climate Justice Working Group to help guide the Nation’s just and equitable transition towards a clean, climate-resilient, zero-emission economy, and for other purposes.</official-title></form><legis-body id="HA17F4A128ACA474F823861E41738BDFB" style="OLC"><section id="H9B31315C952A4287AB27C8224C378C10" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Climate Justice Act of 2021</short-title></quote>. </text></section><section id="H5FDEF44643404EADA434C76D0DE1BE8C"><enum>2.</enum><header>Climate Justice Working Group</header><subsection id="HDDC9447943FC48BFA88DC7CADA127CFE"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the President shall establish an advisory committee, to be known as the Climate Justice Working Group, to advise on the Nation’s just and equitable transition towards a clean, climate-resilient, zero-emission economy.</text></subsection><subsection id="H304EC379222648FDBCBBA59DB7174D6F"><enum>(b)</enum><header>Membership</header><paragraph id="HF7E422B1510E439E9B84D7848C12D128"><enum>(1)</enum><header>Total number</header><text>The Working Group shall be comprised of no fewer than 22 members.</text></paragraph><paragraph id="HC1E2C1DEC31B4129A9FB7899436953F0"><enum>(2)</enum><header>Qualifications</header><text>The members of the Work Group shall have significant expertise or experience in matters relating to—</text><subparagraph id="HBEF3ABD8422842DBB6E8EC55A2780AAA"><enum>(A)</enum><text>climate change and environmental pollution; and</text></subparagraph><subparagraph id="HF846C7A32ECC458CB24A5BDC5880AD02"><enum>(B)</enum><text>the impacts of climate change and environmental pollution on frontline and disadvantaged communities.</text></subparagraph></paragraph><paragraph id="H998ABD99477D4C1FB25A460D7D1BD16C"><enum>(3)</enum><header>Appointment</header><text>The members of the Working Group shall be appointed by the President and shall include at a minimum the following representatives: </text><subparagraph id="H94DA0F722AF5473B88922B8695E93449"><enum>(A)</enum><text display-inline="yes-display-inline">Eight representatives from frontline community-based organizations with experience with, and a history of, advocacy regarding environmental justice or climate justice and equity issues. The representatives appointed pursuant to this subparagraph shall include at least one from each of a coastal community, a rural community, an urban community, and a Tribal community.</text></subparagraph><subparagraph id="HDE4419E6B1DD4D45A9AE3DCBB6BBF3A7"><enum>(B)</enum><text display-inline="yes-display-inline">One representative from the Environmental Protection Agency.</text></subparagraph><subparagraph id="HC6E519C93AD941F79CDF081BD63F4FEF"><enum>(C)</enum><text>One representative from the Department of Transportation.</text></subparagraph><subparagraph id="H1EC480DA86354061AD0585D0F068A4D0"><enum>(D)</enum><text display-inline="yes-display-inline">One representative from the Department of the Interior. </text></subparagraph><subparagraph id="H1C1C0733FC5B4BDAA8D32C12D8F93A47"><enum>(E)</enum><text>One representative from the Department of Energy.</text></subparagraph><subparagraph id="HEC9FBA704A4746C4888CD5363903301E"><enum>(F)</enum><text display-inline="yes-display-inline">One representative from the Department of Housing and Urban Development.</text></subparagraph><subparagraph id="H0325A869F36940B195A4908C1E241D7F"><enum>(G)</enum><text display-inline="yes-display-inline">One representative from the Federal Emergency Management Agency.</text></subparagraph><subparagraph id="H4AEF560ABB494B42994587A5958B93F7"><enum>(H)</enum><text display-inline="yes-display-inline">One public health representative from the Department of Health and Human Services.</text></subparagraph><subparagraph id="H9583D62CFAF14E39BC18C9B30C4382F3"><enum>(I)</enum><text>One representative from the Council on Environmental Quality.</text></subparagraph><subparagraph id="H6D6B3D3B84C047389C7D2492115E8ACC"><enum>(J)</enum><text>Two representatives from local government.</text></subparagraph><subparagraph id="H24ADFBA59B324A04AC112063C97B2744"><enum>(K)</enum><text>Two representatives from State government.</text></subparagraph><subparagraph id="H803277CAC62E4C949C6A4DA03583A659"><enum>(L)</enum><text>Two representatives from Tribal government.</text></subparagraph></paragraph></subsection><subsection id="H24AC9178A00D47668C370D8CF36A0F7A"><enum>(c)</enum><header>Duties</header><paragraph id="H418D7D5C026A4CFDA21D7CAE5712829D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Working Group shall advise and provide recommendations to the President and Federal agencies on or relating to the just and equitable creation and implementation of goals and initiatives to transition towards a clean, climate-resilient, zero-emission economy, including through reduction of greenhouse gas emissions and copollutants.</text></paragraph><paragraph id="HBDD0DB3D698047B88A60FA5A3C641EB1"><enum>(2)</enum><header>Core functions</header><subparagraph id="HE3638403C49D4027BEBD59E8730227DE"><enum>(A)</enum><header>Criteria and metrics</header><text display-inline="yes-display-inline">The Working Group, in consultation with relevant Federal agencies, interagency councils, White House offices, and advisory councils, shall establish a robust set of criteria and metrics to identify climate-burdened communities for the purposes of informing relevant Federal initiatives to geographically map the location of disadvantaged or vulnerable communities and of achieving a just and equitable transition towards a clean, climate-resilient, zero-emission economy. Such criteria and metrics shall be established based on geographic, public health, environmental hazard, and socioeconomic considerations, including such considerations as—</text><clause id="H4B7CFE00BB924F6693D80F50B4113800"><enum>(i)</enum><text display-inline="yes-display-inline">a disproportionate prevalence of negative health conditions;</text></clause><clause id="H93AB4FAC61AF4B91B2B5F2A4A132C1B0"><enum>(ii)</enum><text>cumulative environmental pollution and other hazards that can lead to negative public health effects;</text></clause><clause id="H18B91A833F114056869FF46F38332E13"><enum>(iii)</enum><text display-inline="yes-display-inline">proximity to existing environmental pollution and degradation, polluting facilities, waste sites, or natural resource extraction sites;</text></clause><clause id="H44405D441367458EBC5F9054DA47FB1D"><enum>(iv)</enum><text>vulnerability to the impacts of climate change such as flooding, drought, storm surges, and urban heat island effects;</text></clause><clause id="HBAD245B20C85426999B4015FB37648A5"><enum>(v)</enum><text display-inline="yes-display-inline">vulnerability to displacement due to the impacts of climate change or other socioeconomic forces;</text></clause><clause id="H3D2911071388421F92D1303541CC0292"><enum>(vi)</enum><text>access to green space;</text></clause><clause id="HD0495F9614A14E3D84A89FF42BB96BF3"><enum>(vii)</enum><text>historical and present-day discrimination on the basis of race, ethnicity, gender, national origin, immigration status, or other demographic factors;</text></clause><clause id="HC71D4D1117094350A508E87BCA2E5E3B"><enum>(viii)</enum><text display-inline="yes-display-inline">historical or present-day experience of economic transition, deindustrialization, or chronic underinvestment;</text></clause><clause id="H4D0771B8B81C4568972022BBD8FA32DD"><enum>(ix)</enum><text>income and wealth;</text></clause><clause id="H029B8234A0C942A9BE264F60FDF97FAB"><enum>(x)</enum><text>rent burden;</text></clause><clause id="H882117A093BC4BFC966EB0D5DFC3E82A"><enum>(xi)</enum><text>home ownership;</text></clause><clause id="H7D79E67CDC1F462FBC20EF62F2B71753"><enum>(xii)</enum><text>educational attainment;</text></clause><clause id="H54D4AEB39CAE41429BB1F15EF6B72F40"><enum>(xiii)</enum><text display-inline="yes-display-inline">linguistic isolation; and</text></clause><clause id="H5BFC1AC80E1A4DF999FCD91A1EF28981"><enum>(xiv)</enum><text display-inline="yes-display-inline">such other considerations as the Working Group considers appropriate.</text></clause></subparagraph><subparagraph id="H5DC3AE3E8F134269B1113EE012D34C4A"><enum>(B)</enum><header>Guiding principles</header><text display-inline="yes-display-inline">The Working Group, in consultation with relevant Federal agencies, interagency councils, White House offices, and advisory councils, shall establish guiding principles and recommendations for ensuring that, with respect to climate-burdened communities, all Federal goals and initiatives involving greenhouse gas emissions, copollutant reductions, and the allocation of Federal investments related to achieving a clean, climate-resilient, zero-emission economy—</text><clause id="HCF2F81D83F024E39BE123EF8E8E5BFA0"><enum>(i)</enum><text display-inline="yes-display-inline">prioritize and directly benefit such communities;</text></clause><clause id="H68C17890D33D4950AD5211958F120960"><enum>(ii)</enum><text display-inline="yes-display-inline">do not produce new or exacerbate existing disproportionate health, environmental, or socioeconomic burdens in such communities; and</text></clause><clause id="H8E2D7AD61CFA4F23926BEB2FFFFB63FE"><enum>(iii)</enum><text display-inline="yes-display-inline">include meaningful public consultation and engagement with members of such communities.</text></clause></subparagraph><subparagraph id="HFD4A4D3498554C6686E999D9741DB723"><enum>(C)</enum><header>Community engagement</header><text display-inline="yes-display-inline">In carrying out subparagraphs (A) and (B), the Working Group shall initiate and carry out public engagement, particularly with residents and stakeholders from disadvantaged and front-line communities, to ensure that the public has input into the criteria and metrics under subparagraph (A) and the guiding principles and recommendations under subparagraph (B).</text></subparagraph><subparagraph id="HEEF3CDE8FEEB4249AEDB90684D8EF43F"><enum>(D)</enum><header>Draft report</header><text display-inline="yes-display-inline">Before finalizing the criteria and metrics under subparagraph (A) and the guiding principles and recommendations under subparagraph (B), the Working Group shall—</text><clause id="HE0283F62668847BEAAFECAA8CC4D19CD"><enum>(i)</enum><text>publish a draft report containing a list of the proposed criteria and metrics and guiding principles and recommendations;</text></clause><clause id="H8A929FEDEC2C4827B36B76DFE6DFA864"><enum>(ii)</enum><text display-inline="yes-display-inline">make such draft report available on an easily accessible public website; and</text></clause><clause id="H2A12A863BBFB430C907FB849AF04B9C8"><enum>(iii)</enum><text display-inline="yes-display-inline">deliver such draft report to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate.</text></clause></subparagraph><subparagraph id="H6AFB42E076F84479B57BCCAA95596B44"><enum>(E)</enum><header>Public input</header><clause id="H67A81702319F495780828574D4842880"><enum>(i)</enum><header>Comment period</header><text>After publishing the draft report under subparagraph (D), the Working Group shall provide a period of at least 120 days for the submission of public comment on the draft report.</text></clause><clause id="H7E929B9CCFA8476883FE14E26D5539C5"><enum>(ii)</enum><header>Public hearings</header><text>During such 120-day period, the Working Group shall hold at least four public hearings on the draft report in different geographic regions of the United States.</text></clause><clause id="HC3B0E55F0014444698B57C30234EDB07"><enum>(iii)</enum><header>Meaningful opportunities</header><text display-inline="yes-display-inline">The Working Group shall ensure there are meaningful opportunities for public comment on the draft report from all segments of the population that might be impacted by the criteria and metrics under subparagraph (A) and the guiding principles and recommendations under subparagraph (B), including persons living in areas that may be identified as climate-burdened communities under such criteria and metrics.</text></clause></subparagraph><subparagraph id="H8A78B0C5890B45B2BD6EC5FD3AEE31A9"><enum>(F)</enum><header>Outreach</header><text display-inline="yes-display-inline">During the 120-day period for public comment under subparagraph (E)(i), and as soon as practicable, the Working Group, in coordination with relevant Federal entities, shall perform targeted outreach to all segments of the population that might be impacted by the criteria and metrics under subparagraph (A) and the guiding principles and recommendations under subparagraph (B) in order to inform such persons about the draft report and ways to provide meaningful input on the finalization of the report.</text></subparagraph><subparagraph id="H04C4FC6CD4AE49E8AE2301CF66BA6818"><enum>(G)</enum><header>Final report</header><text display-inline="yes-display-inline">Once public input has been sufficiently taken into account, and not later than 1 year after publication of the draft report under subparagraph (D), the Working Group shall—</text><clause id="HC726625BADFE40BD8610A1988012930C"><enum>(i)</enum><text display-inline="yes-display-inline">publish a final report containing the criteria and metrics under subparagraph (A) and the guiding principles and recommendations under subparagraph (B), including in a downloadable report made available on an easily accessible public website; and</text></clause><clause id="H61F37E31721D47CA947BFF66D27444DC"><enum>(ii)</enum><text display-inline="yes-display-inline">deliver such final report to the Committee on Energy and Commerce of the House of Representatives, the Committee on Environment and Public Works of the Senate, and the President.</text></clause></subparagraph></paragraph></subsection><subsection id="H89FE015C0FA84EF9A5684D8CE8AD2A31"><enum>(d)</enum><header>Federal experts</header><text display-inline="yes-display-inline">In carrying out this Act, the Working Group may call upon experts at Federal agencies and White House offices to provide testimony and advice.</text></subsection><subsection id="HFD1281FE8D534294A94F13D6E0286392"><enum>(e)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Working Group shall meet not less than annually to review and provide guidance on Federal goals and initiatives for the Nation’s just and equitable transition towards a clean, climate-resilient, zero-emission economy, including to review and modify as necessary any of the criteria and metrics established pursuant to subsection (c)(2)(A), or the guiding principles and recommendations established pursuant to subsection (c)(2)(B).</text></subsection><subsection id="H43CD1B521947423EB31ED1EE2F294C42"><enum>(f)</enum><header>Compensation and expenses</header><text>Any nonfederally employed member of the Working Group, when attending meetings of the Working Group or when otherwise engaged in the business of the Working Group, shall receive—</text><paragraph id="H3571FBDC76974A93B5C785CCD291D7E9"><enum>(1)</enum><text>compensation at a rate fixed by the Secretary, not exceeding the daily equivalent of the current rate of basic pay in effect for GS–15 of the General Schedule under section 5332 of title 5, United States Code, including travel time; and</text></paragraph><paragraph id="H3465993B43E14DDA8A7385B3F5FE67E9"><enum>(2)</enum><text>travel or transportation expenses under section 5703 of title 5, United States Code.</text></paragraph></subsection><subsection id="HFD4114B8B2B842098077335D4E427113"><enum>(g)</enum><header>Applicability of Federal Advisory Committee Act</header><paragraph id="HC0CE82B84721487F8316EA9992575B08"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the Working Group.</text></paragraph><paragraph id="HC29C3CAA9282451BA88BAD82D3B19317"><enum>(2)</enum><header>Termination</header><text display-inline="yes-display-inline">The termination requirements under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /14">section 14</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Working Group.</text></paragraph></subsection><subsection id="H51D10F42A6BC4E44ADD2420B397A3A7F"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H517D7C8C5D594AB6ACDDBFD371A48789"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>frontline community-based organization</term> means a local nonprofit advocacy organization that represents frontline communities that are most vulnerable to the impacts of climate change or burdened by environmental pollution.</text></paragraph><paragraph id="HEA9AA13D384D442ABD87ABE01DF946B9"><enum>(2)</enum><text>The term <term>Working Group</term> means the Climate Justice Working Group established pursuant to subsection (a).</text></paragraph></subsection></section><section id="H982A9EBEEB384CA89149DD2FF0BE85ED"><enum>3.</enum><header>Implementation by Federal agencies of criteria, metrics, guiding principles, and recommendations</header><text display-inline="no-display-inline">No later than 90 days after the completion of the final report under section 2(c)(2)(G), the President shall—</text><paragraph id="HAB3A9EEF0FCD40A0ADCEA56777428832" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">direct all relevant Federal agencies, White House offices, Federal interagency councils, and other relevant Federal entities—</text><subparagraph id="HDD78726F6C0A42CAA6E4A461D9A8EABE" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">to incorporate the criteria and metrics under subsection (c)(2)(A) to identify climate-burdened communities, including for the purpose of informing any relevant initiatives to geographically map the location of disadvantaged or vulnerable communities, including the Environmental Protection Agency's EJScreen tool; and</text></subparagraph><subparagraph id="HDF1619A1ADFA4F01995BF43278C7A835" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">to incorporate the guiding principles and recommendations under section 2(c)(2)(B) into plans, strategies, and programs to the maximum extent possible, including for the purpose of prioritizing investment and directing programmatic resources towards climate-burdened communities, including through the Justice40 Initiative; and</text></subparagraph></paragraph><paragraph id="H16EB201F9EA2453DBBC56397D4544F06"><enum>(2)</enum><text display-inline="yes-display-inline">issue to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate, and make available to the public, a report specifying—</text><subparagraph id="HF9A32520482846F08F77780B4141B45E"><enum>(A)</enum><text>the steps taken to comply with paragraphs (1) and (2); and</text></subparagraph><subparagraph id="HEEF1A39DCD964012B7E7014517C64107"><enum>(B)</enum><text display-inline="yes-display-inline">how the Climate Justice Working Group will continue to be utilized and involved in upcoming Federal planning and initiatives related to supporting a just and equitable transition towards a clean, climate-resilient, zero-emission economy.</text></subparagraph></paragraph></section></legis-body></bill>
