which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for a presumption of service connection for certain diseases in veterans who were exposed to burn pits.</official-title></form><legis-body id="HAD31DC9302C0414583B277C057F16A44" style="OLC"><section id="HE1D2A4851DCC4E269885814D35A97785" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Right to Breathe Act</short-title></quote>. </text></section><section id="HAAE8997BC22541CA89D2AE6EF0CF5F94"><enum>2.</enum><header>Presumption of service connection for certain diseases in veterans who were exposed to burn pits</header><subsection id="HAC62BB1228AB40408B7BBB30A610B8BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1112 of title 38, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="H894DACFB36BB4B46BEC9F1CFDDD52278" display-inline="no-display-inline"><subsection id="H1B7D12D152A54783B49549E5A1536CDD"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H259D94550784446980DF823CD9D2F6E6"><enum>(1)</enum><text display-inline="yes-display-inline">For the purposes of section 1110 of this title, and subject to the provisions of section 1113 of this title, a disease specified in paragraph (2) of this subsection becoming manifest in a burn pit-exposed veteran shall be considered to have been incurred in or aggravated during active military, naval, or air service, notwithstanding that there is no record of evidence of such disease during a period of such service.</text></paragraph><paragraph id="HC82EA4625758469C841C37462BECE79B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The diseases referred to in paragraph (1) of this subsection are the following:</text><subparagraph id="HED0869FD22D644ABAA2281850472E5FD"><enum>(A)</enum><text display-inline="yes-display-inline">Asthma.</text></subparagraph><subparagraph id="HFECA8702B59C4F77B0C484276B640E4B"><enum>(B)</enum><text>Chronic bronchitis.</text></subparagraph><subparagraph id="H1A3F2FD22DF34BB8B32BCFA6D95F48A9"><enum>(C)</enum><text display-inline="yes-display-inline">Chronic obstructive pulmonary disease.</text></subparagraph><subparagraph id="HBC42F4F68CBD42488479A1321D4B67AC"><enum>(D)</enum><text>Constrictive bronchiolitis.</text></subparagraph><subparagraph id="H9DC08AD4664641BA96FCC5E78412C395"><enum>(E)</enum><text>Emphysema.</text></subparagraph><subparagraph id="H90F44EA2E3A74728BE95812C05D3FCD5"><enum>(F)</enum><text>Granulomatous disease.</text></subparagraph><subparagraph id="H23DD0B8AEF5C4027AE2710094460F52E"><enum>(G)</enum><text>Interstitial lung disease.</text></subparagraph><subparagraph id="HBCE1C9B42AEF41FB89ACE3979AF08E5E"><enum>(H)</enum><text>Lung cancer.</text></subparagraph><subparagraph id="HCB26AE74AC714390A636F1A32C1864B5"><enum>(I)</enum><text>Pneumonia.</text></subparagraph></paragraph><paragraph id="H848AC55E04684AFB95427E1CADDB7EE3" indent="up1"><enum>(3)</enum><text>For purposes of this subsection:</text><subparagraph id="H4B26561729054ED0BCD91503AD1606E0"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>burn pit-exposed veteran</quote> means a veteran who, on or after January 1, 1990, served as a member of the Armed Forces in support of a contingency operation and was based or stationed at a location where an open air burn pit was in use.</text></subparagraph><subparagraph id="H43A871CF1EA848588D989D3B95E2C751"><enum>(B)</enum><text>The term <quote>open burn pit</quote> means an area of land located that—</text><clause id="H5057B6E96604409EA558A97D2DB44B90"><enum>(i)</enum><text>is designated by the Secretary of Defense to be used for disposing solid waste by burning in the outdoor air; and</text></clause><clause id="HB0C2F61DB8CF4850B2A4B1D6D93AFECE"><enum>(ii)</enum><text>does not contain a commercially manufactured incinerator or other equipment specifically designed and manufactured for the burning of solid waste.</text></clause></subparagraph><subparagraph id="HD4794D88356D40C988EF5E9CE26CC2B9"><enum>(C)</enum><text>The term <quote>contingency operation</quote> has the meaning given that term in section 101(a)(13) of title 10.</text></subparagraph><subparagraph id="HCAEC9EA4A7384F2F8D5A4E41DE647A2C"><enum>(D)</enum><text display-inline="yes-display-inline">The term <quote>solid waste</quote> has the meaning given such term in section 1004(27) of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903(27)</external-xref>). </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H041B6126695F447FA271EC458259E327"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
