<section id="HD1246C2D3A8A4689886A6CD185318B59" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conceding Our Veterans’ Exposures Now And Necessitating Training Act of 2021</short-title></quote> or the <quote><short-title>COVENANT Act of 2021</short-title></quote>.</text></section> <section id="H5ACBF4F9CCFE4100A671CBB3AA0A7208"><enum>2.</enum><header>Presumptions of service connection for illnesses associated with exposure to certain airborne hazards</header> <subsection id="H9A287788E43C4748900F7D7A531A4B67"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> 
<paragraph id="H80D6DE2A0C8D421FBF9BF9E213E2901C"><enum>(1)</enum><text>as in past theaters of operation, Southwest Asia and its supporting theaters of operation pose numerous natural and manmade hazards that negatively affect the health outcomes of individuals serving in these foreign environments;</text></paragraph> <paragraph id="H2E0B6349441A479E9B396B6D7EB6ED3B"><enum>(2)</enum><text>toxic exposures from burn pits, oil well fires, and other regional airborne hazards increase the potential for immediate and long-term illnesses to emerge among members of the Armed Forces; and</text></paragraph> 
<paragraph id="H0B2B4E5D0D2C4C1B8C0D0EB1C0D32B2B"><enum>(3)</enum><text display-inline="yes-display-inline">legislation is necessary—</text> <subparagraph id="HBDAA0088889A4D21AED40AC363DC8D79"><enum>(A)</enum><text>to confront the scientific challenge of producing clear associations between in-theater toxic exposures and the illnesses confronting veterans who served in Southwest Asia and beyond;</text></subparagraph> 
<subparagraph id="HBF703611D4674AEA9228BA3790848FDF"><enum>(B)</enum><text>to address the insufficient data hindering the Secretary of Veterans Affairs, the Secretary of Defense, and relevant partners from reaching proactive determinations regarding such associations; and</text></subparagraph> <subparagraph id="H2094134E5A5148E2BD61DC1572A5DA99"><enum>(C)</enum><text>to improve evaluations associated with claims for disability compensation that relate to toxic exposure.</text></subparagraph></paragraph></subsection> 
<subsection id="HD7127C6CE6DD461D9B79DD84420D5201"><enum>(b)</enum><header>Presumptions of service connection</header> 
<paragraph id="H2E030BACD2BF4B30810612548B7183E6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text> <quoted-block style="USC" id="HA43657D26E124F8EAA07B598819B0669" display-inline="no-display-inline"> <section id="H1C24A38437914A0ABD47472D291A9BF9"><enum>1119.</enum><header>Presumptions of service connection for illnesses associated with exposure to certain airborne hazards</header> <subsection id="H1C264346F7714D62B7F2E5413CB02BDC"><enum>(a)</enum><header>Presumptions</header> <paragraph commented="no" display-inline="yes-display-inline" id="H19CA5709582E49AF8915D075F58392C9"><enum>(1)</enum><text>For the purposes of section 1110 of this title, and subject to section 1113 of this title, an illness specified in subsection (d) becoming manifest in a covered veteran to a degree of 10 percent or more shall be considered to have been incurred in or aggravated during active military, naval, or air service, notwithstanding that there is no record of evidence of such illness during a period of such service.</text></paragraph> 
<paragraph id="HF6171033F43A4144825473BE6343448C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A covered veteran shall be presumed to have been exposed to an airborne hazard specified in subsection (e) during service of the covered veteran specified in subsection (f)(1) unless there is affirmative evidence to establish that the covered veteran was not exposed to any such airborne hazard during such service.</text></paragraph></subsection> <subsection id="H92AA12AD3047438482EFDB89C5B41240"><enum>(b)</enum><header>Medical examinations and opinions</header> <paragraph commented="no" display-inline="yes-display-inline" id="HB6DD05BDB36F4AF69DA3A96AB7B63AEF"><enum>(1)</enum><text display-inline="yes-display-inline">If a covered veteran submits to the Secretary a claim for disability compensation for a diagnosed illness not specified in subsection (d) that includes an assertion that the illness is related to airborne hazard exposure (regardless of whether such assertion identifies a particular airborne hazard specified in subsection (e)) or open burn pit exposure, and the evidence of record is insufficient to establish service connection for the illness, the Secretary shall provide to the covered veteran a medical examination and obtain a medical opinion under section 5103A of this title to determine whether the illness is at least as likely as not caused by an airborne hazard specified in subsection (e).</text></paragraph> 
<paragraph id="HFC62CF1BA28944119539616401CC6854" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">In carrying out paragraph (1), if the diagnosed illness for which a claim is submitted involves a sign or symptom specified in section 1117(g) of this title, the Secretary shall ensure that—</text> <subparagraph id="HAADBCC28AAF64A3E81B8B6C07E8725FF" commented="no"><enum>(A)</enum><text>the medical examination provided pursuant to such paragraph includes an evaluation of each corresponding body part or system that relates to the sign or symptom; and</text></subparagraph> 
<subparagraph id="H3D10C59458D844F2A9DC3FCC8969DB76" commented="no"><enum>(B)</enum><text>the sign or symptom is considered in making the determination under such paragraph.</text></subparagraph></paragraph> <paragraph id="HE78EB237119A43FD9299E4EA8946C51D" indent="up1"><enum>(3)</enum><text>In providing the Secretary with a medical opinion pursuant to paragraph (1), a medical provider shall consider—</text> 
<subparagraph id="H7F4F5132859F44B1ACCB6E4CCBD491A1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the total potential exposure to airborne hazards through any service of the covered veteran specified in subsection (f)(1) and the synergistic effect of combined airborne hazards, including airborne hazards that involve exposure through inhalation, dermal exposure, or ingestion; and</text></subparagraph> <subparagraph id="H1443BF46516140458BDABC85D2B4C152" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the medical evidence and scientific reporting available at the time of the determination under paragraph (1).</text></subparagraph></paragraph></subsection> 
<subsection id="HABE89A3C8677478A962F3ADFF3BD7303" commented="no"><enum>(c)</enum><header>Relationship to presumptions for illnesses associated with service in Persian Gulf</header><text display-inline="yes-display-inline">A determination that a presumption of service connection is not warranted pursuant to this section shall not preclude the Secretary from—</text> <paragraph id="H885D72F4438C4E9E88F49D10B202646E" commented="no"><enum>(1)</enum><text>determining that a presumption of service connection is warranted pursuant to section 1118 of this title; or</text></paragraph> 
<paragraph id="H5DD99100743143FD8C65B5ACC6FE69D8" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">paying compensation to the veteran (or dependency and indemnity compensation to a survivor of the veteran) pursuant to section 1117 of this title.</text></paragraph></subsection> <subsection id="HBB4B67738E4043059A09DEC8A4A1CE65"><enum>(d)</enum><header>Illnesses</header><text>The illnesses specified in this subsection are the following:</text> 
<paragraph id="H1E12CFA220E142F39FEECADD7BD09BFA" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Asthma that was diagnosed after a period of service specified in subsection (f)(1).</text></paragraph> <paragraph id="H004B7B9BF3C24FD899C11D7BAE9219D1"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H23CC027A502D49819A301ABB3BFE093D"><enum>(A)</enum><text display-inline="yes-display-inline">Head cancer of any type.</text></subparagraph> 
<subparagraph id="H75E4267E934A488486B936D0225B96A5" indent="up1"><enum>(B)</enum><text>Neck cancer of any type.</text></subparagraph> <subparagraph id="HCE2C11095B4341298B1712346FED74A6" indent="up1"><enum>(C)</enum><text>Respiratory cancer of any type.</text></subparagraph> 
<subparagraph id="H10431555663F4C19AF3183734C07A6F2" indent="up1"><enum>(D)</enum><text>Gastrointestinal cancer of any type.</text></subparagraph> <subparagraph id="H3AF6C2FA54E54942B73F4F578A90E279" indent="up1"><enum>(E)</enum><text>Reproductive cancer of any type.</text></subparagraph> 
<subparagraph id="H8E5603A31326470F9F87B3D19B5C1FCF" commented="no" indent="up1"><enum>(F)</enum><text>Lymphoma cancer of any type.</text></subparagraph> <subparagraph id="H3A766C64F0F945C8985CFCB437EBB9EC" commented="no" indent="up1"><enum>(G)</enum><text>Lymphomatic cancer of any type.</text></subparagraph>

<subsection id="H48F1C45E0F3741ABB173B33B3638B1B4"><enum>(e)</enum><header>Airborne Hazards</header><text display-inline="yes-display-inline">The airborne hazards specified in this subsection are the following:</text> <paragraph id="HB2EA0DC44F4E40C9BFA9A41724A7BA37"><enum>(1)</enum><text>Particulate matter, including the following:</text> 
<subparagraph id="HF3129F0817894A6E9C46C13F3D07EE33"><enum>(A)</enum><text display-inline="yes-display-inline">PM-10.</text></subparagraph> <subparagraph id="H13A5E537819842F59C6FBB34827D689E"><enum>(B)</enum><text display-inline="yes-display-inline">PM-2.5.</text></subparagraph></paragraph>

<subsection id="HA383E3AE6C144B16B5907E554F42B844"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HE91DC891DE974403865C60D2AF99CFDD"><enum>(1)</enum><text>The term <quote>covered veteran</quote> means any veteran who—</text> 
<subparagraph id="H4E695624E75F43BE880AE2EF9710B451"><enum>(A)</enum><text display-inline="yes-display-inline">on or after August 2, 1990, performed active military, naval, or air service while assigned to a duty station in—</text> <clause id="HAB2DB2A2143B44518FF6D57E5D48D500"><enum>(i)</enum><text>Bahrain;</text></clause> 
<clause id="HA5DB4E0F629442D8A9E4D777B6E48E44"><enum>(ii)</enum><text>Iraq;</text></clause> <clause id="H305134D0D3C64BCBBF4AA4F8B42ED51D"><enum>(iii)</enum><text>Kuwait;</text></clause> 
<clause id="H306AFBAFEA164C3DA8706BD921F78011"><enum>(iv)</enum><text>Oman;</text></clause> <clause id="HAB1BF3462C4C44A28B5407C118B7324B"><enum>(v)</enum><text>Qatar;</text></clause> 
<clause id="H4B5DEBD223D04649B47BA768B2C3C6BA"><enum>(vi)</enum><text>Saudi Arabia; </text></clause> <clause id="H4AE621F055374305B74AEE13291C2D11"><enum>(vii)</enum><text>Somalia; or</text></clause> 
<clause id="HE2A6E044DEC04E8EB1B50A1FBA9006E9"><enum>(viii)</enum><text>United Arab Emirates; or</text></clause></subparagraph> <subparagraph id="HDCA9853727424734B5B0BC5B3B424352"><enum>(B)</enum><text display-inline="yes-display-inline">on or after September 11, 2001, performed active military, naval, or air service while assigned to a duty station in—</text>

<clause id="H6CAE25F80FEC4E0EAAA4FFE6156287E9"><enum>(iii)</enum><text>Egypt;</text></clause> <clause id="H949D7F23E5A74A76ABF136947F24DBB3"><enum>(iv)</enum><text>Jordan;</text></clause> 
<clause id="H74620F534E2148479AAA59211235D355"><enum>(v)</enum><text>Lebanon;</text></clause> <clause id="H6CF73CFED25846509B7655EB0F6014EF"><enum>(vi)</enum><text>Syria;</text></clause> 
<clause id="HFE0BE3A10FFD4CFE9ECF29E5B083340F"><enum>(vii)</enum><text>Yemen;</text></clause> <clause id="H116E2649F0A4492DAD70EA382865F418"><enum>(viii)</enum><text>Uzbekistan;</text></clause> 
<clause id="H948D5B79D2204EC1B9BD2E3FF6D08E94"><enum>(ix)</enum><text>the Philippines; or</text></clause> <clause id="H1C34EE081B144D999C650DE3864761A0"><enum>(x)</enum><text>any other country determined relevant by the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="HE24A1E8004104922AD3C9D0548DB0A17"><enum>(2)</enum><text>The term <quote>illness</quote> means a disease or other condition that affects the health of an individual on a basis other than an acute or transient basis.</text></paragraph> <paragraph id="HFD4D8B41063F469C9D0EE4FA6F83FFFB" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>open burn pit</quote> has the meaning given such term in section 201(c) of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note), except that the area of land may be located in any country specified in paragraph (1) or determined relevant by the Secretary pursuant to such paragraph.</text></paragraph></subsection> 
<subsection id="H24F544C1FF424ABC88637EC8AAF68209" commented="no"><enum>(g)</enum><header>Effective date of award</header><text display-inline="yes-display-inline">The effective date of an award under this section shall be determined in accordance with section 5110 of this title, except that such date may not be earlier than the date of the enactment of this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HC5BFE65C760B4821AC0659F45719FE93"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/38/1118">section 1118</external-xref> the following new item:</text>

<toc-entry level="section">1119. Presumptions of service connection for illnesses associated with exposure to certain airborne hazards.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2499E8834BCE40CE869ACAA37D69FD21"><enum>(3)</enum><header>Implementation deadline</header><text>The Secretary of Veterans Affairs shall implement the amendments made by this subsection by not later than 18 months after the date of the enactment of this Act.</text></paragraph></subsection> <subsection id="H8A97A0CBE843402EA22C83CDF6C561F8" commented="no"><enum>(c)</enum><header>Relationship to presumptions for illnesses associated with service in the Persian Gulf</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, is further amended—</text> 
<paragraph id="H28DC27912E844C44B563745BC2913693" commented="no"><enum>(1)</enum><text>in section 1117, by adding at the end the following new subsection:</text> <quoted-block style="USC" id="H644AD91BBDB947AF916A4D7F5E29FC26" display-inline="no-display-inline"> <subsection id="HA0D1AE2D28CD440AB9CD965210E41100" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">A denial or termination of compensation paid to a veteran pursuant to this section shall not preclude the Secretary from determining that a presumption of service connection is warranted pursuant to section 1119 of this title.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HDED869B8412147C9A010A38C68F33796" commented="no"><enum>(2)</enum><text>in section 1118, by adding at the end the following new subsection:</text> <quoted-block style="USC" id="HE7324D5A584C407AA1FF50AE28E3E07D" display-inline="no-display-inline"> <subsection id="H78B29DC6D33E4439AA11B04DB2D48325" commented="no"><enum>(f)</enum><text display-inline="yes-display-inline">A determination that a presumption of service connection is not warranted pursuant to this section shall not preclude the Secretary from determining that a presumption of service connection is warranted pursuant to section 1119 of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H788D12CE86EF46BCB208191F89FEA4D9"><enum>(d)</enum><header>Pending cases</header> 
<paragraph id="H6832CF60930541F697CF19DA97F90F9E"><enum>(1)</enum><header>Authority to stay</header><text display-inline="yes-display-inline">The Secretary may stay a claim described in paragraph (2) until the date on which the Secretary commences the implementation of section 1119 of title 38, United States Code (as added by subsection (b)).</text></paragraph> <paragraph id="H12E9B84736564F4D907B86F3F8D981D9"><enum>(2)</enum><header>Claims described</header><text display-inline="yes-display-inline">A claim described in this subparagraph is a claim for disability compensation that is pending at the Veterans Benefits Administration, the Board of Veterans' Appeals, the Court of Appeals for Veterans Claims, or the Court of Appeals for the Federal Circuit, on or after the date of the enactment of this Act and before the date on which the Secretary commences the implementation of such section 1119 and that relates to—</text> 
<subparagraph id="H1955CC5B5DA04493827E3622CA6037F3" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the service and illnesses covered by such section 1119; or</text></subparagraph> <subparagraph id="H79E264F5789547C2A76714559280D821"><enum>(B)</enum><text display-inline="yes-display-inline">the service covered by such section 1119 and a diagnosed illness asserted in the claim to be related to airborne hazard exposure, regardless of whether such assertion identifies a particular airborne hazard, or open burn pit exposure.</text></subparagraph></paragraph></subsection> 
<subsection id="HE831999CBF754CD98CB5E9ED701B4BD8"><enum>(e)</enum><header>Standard medical training curriculum</header> 
<paragraph id="H384F8AAB6219493E89B75787BFF57DCC"><enum>(1)</enum><header>Curriculum</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall establish a standard medical training curriculum for all medical providers conducting examinations and providing opinions under section 1119(b) of title 38, United States Code (as added by subsection (b)), that provides a standardized approach to conducting and providing examinations and opinions in accordance with such section.</text></paragraph> <paragraph id="H23BC889ACAF34928836242A5334BB93F" commented="no"><enum>(2)</enum><header>Elements</header><text>The Secretary shall include in the curriculum under paragraph (1) an instruction for each medical provider conducting an examination or providing an opinion to consider the following:</text> 
<subparagraph id="H0C345183C1444E46AB158B2B24113B2E" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Relevant medical and scientific literature.</text></subparagraph> <subparagraph id="H7B1644A44294470CB78759CD87EB73EC" commented="no"><enum>(B)</enum><text>Available information on the proximity, intensity, and frequency of exposure of the individual to airborne hazards.</text></subparagraph> 
<subparagraph id="HCD0CC11CDEF64F5DA4B466043B34D892" commented="no"><enum>(C)</enum><text>Medically unexplained chronic multisymptom illnesses.</text></subparagraph> <subparagraph id="H447AA2EBC91F4374BFDC6D0A5BD0B8E2" commented="no"><enum>(D)</enum><text>All competent and credible evidence of record.</text></subparagraph></paragraph> 
<paragraph id="H39E829251B8840169B7279E4058AE999"><enum>(3)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">Prior to implementation of the curriculum under paragraph (1), the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate such curriculum.</text></paragraph></subsection> <subsection id="H2E83C9E684B5431FA60C704E4B8CB088"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H21ED7FF1E61E4157986981F2A58AB513"><enum>(1)</enum><text>The terms <quote>illness</quote> and <quote>open burn pit</quote> have the meaning given such terms in section 1119 of title 38, United States Code (as added by subsection (b)).</text></paragraph> <paragraph id="H39435C8E42244B0CAB453BD74407E85B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>medically unexplained chronic multisymptom illness</quote> has the meaning given such term in section 1117(a)(2)(B) of title 38, United States Code.</text></paragraph></subsection></section> 
<section id="H70B9FB6A292B426C8E71930D687614EF"><enum>3.</enum><header>Eligibility for care and services based on potential exposure to certain airborne hazards</header> 
<subsection id="HE9B32902B7E64723922BF2576CA49B33" commented="no"><enum>(a)</enum><header>Eligibility for care and services</header><text display-inline="yes-display-inline">Section 1710(e) of title 38, United States Code, is amended—</text> <paragraph id="H62A509FFAECE4B27BCD3073D73154C75" commented="no"><enum>(1)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text> 
<quoted-block style="USC" id="H89EFCF13AB2340A0A73C4C885975CE08" display-inline="no-display-inline"> 
<subparagraph id="H6C35EAA9A08144A3816E243724BAB411" indent="up1" commented="no"><enum>(G)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H838D931A0F2F4542AE8AC31C8FB146E8"><enum>(i)</enum><text>Subject to paragraph (2), a covered veteran is eligible for hospital care, medical services, and nursing home care under subsection (a)(2)(F) for any diagnosed illness, notwithstanding that there is insufficient medical evidence to conclude that such illness is attributable to the service specified in section 1119(f)(1) of this title.</text></clause> <clause id="H07232B08DD2149A7A5CF45BB8B161BEB" indent="up1" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">In this subparagraph, the term <quote>covered veteran</quote> has the meaning given such term in section 1119 of this title.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5115C1B15A15455E91E53850E7DBCE28" commented="no"><enum>(2)</enum><text>in paragraph (2)(B), by striking <quote>or (F)</quote> and inserting <quote>(F), or (G)</quote>.</text></paragraph></subsection> <subsection id="HEF36BEC5AA3B4B3B847855ED2AC7434E"><enum>(b)</enum><header>Resource assessment and report</header> <paragraph id="H1057C14B07DC4199A02A37EDA9158020"><enum>(1)</enum><header>Initial assessment and report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall—</text> 
<subparagraph id="H9CB64670A17C4ECCBB1CA0AFF33E63F4"><enum>(A)</enum><text display-inline="yes-display-inline">complete an assessment to determine—</text> <clause id="H9EBCEDB13C41409CA38B12A4D410B6C0"><enum>(i)</enum><text>the personnel and material resources necessary to implement the amendments made by subsection (a); and</text></clause> 
<clause id="HF19E1A17EDF745A08D54BB40AA741C70"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of covered veterans, as such term is defined in section 1119 of title 38, United States Code (as added by section 2(b)), who receive hospital care or medical services furnished by the Secretary under chapter 17 of such title, disaggregated by priority group specified in section 1705(a) of such title; and</text></clause></subparagraph> <subparagraph id="HC691A7F254644B848E6822AECA89FDDE"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate an initial report containing the findings of the assessment completed under subparagraph (A), including a specific determination as to whether the Department has the personnel and material resources necessary to implement the amendments made by subsection (a).</text></subparagraph></paragraph> 
<paragraph id="H2E70927AAD1344FB97790AA56C345905"><enum>(2)</enum><header>Subsequent reports</header><text display-inline="yes-display-inline">If the initial report submitted under paragraph (1)(B) contains a determination that the Department does not have the personnel or material resources necessary to implement the amendments made by subsection (a), beginning not later than 90 days after the submission of such initial report and every 90 days thereafter until the effective date specified in subsection (c), the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a subsequent report containing an update to such determination.</text></paragraph></subsection> <subsection id="HCC1A0455915D4C9AAA8982E010405B3A"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect on the date that is the earlier of the following:</text> 
<paragraph id="H97CF161FBC034404AEE5A36F41AC97C9"><enum>(1)</enum><text>The date on which the Secretary submits a report under subsection (b) containing a determination that the Department has the personnel and material resources necessary to implement such amendments.</text></paragraph> <paragraph id="H85B003E5EBEE4CCF880D12440423E18C"><enum>(2)</enum><text>The date that is 18 months after the date of the enactment of this Act.</text></paragraph></subsection></section>
