which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for equal protection of the law and to prohibit discrimination and preferential treatment on the basis of race, color, national origin, or sex in the administration of programs of the Department of Agriculture, and for other purposes.</official-title></form><legis-body id="H7B0AFAA4E8CF4D748D295D13D3215EA7" style="OLC"><section id="HA2A48AD6CC7849B5B7F925765361A246" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agriculture Civil Rights and Equality Act</short-title></quote> or the <quote><short-title>ACRE Act</short-title></quote>. </text></section><section id="HE71FDEE5059E4331AE60CAFB4D173DC2"><enum>2.</enum><header>Anti-discrimination policies</header><subsection id="H35308537FB844BE98AB244DF8D3B599D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Agriculture (or any officer, employee, or other designee of the Secretary) (referred to in this Act as the <quote>Secretary</quote>) shall not—</text><paragraph id="H02CBC9DBD74B4A6F841D90F4C9A39887"><enum>(1)</enum><text>intentionally discriminate against, or grant a preference to, any person or group based in whole or in part on race, color, national origin, or sex, in connection with any contract or subcontract entered into by the Secretary, award made by the Secretary, employment with the Department of Agriculture, or any other program or activity carried out by the Secretary; or</text></paragraph><paragraph id="HF90F907EEB8C413D91FDD2DB0D729F89"><enum>(2)</enum><text>require, direct, or encourage any entity under a contract or subcontract withe Secretary, or the recipient of a license issued by the Secretary or financial assistance provided under a program administered by the Secretary, to discriminate intentionally against, or grant a preference to, any person or group based in whole or in part on race, color, national origin, or sex, in connection with such a contract, subcontract, license, or financial assistance.</text></paragraph></subsection><subsection id="H2301039716584174A30FCA25869560CB"><enum>(b)</enum><header>States, territories, and private entities</header><text display-inline="yes-display-inline">A State, territory, or private entity (including institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that receives financial assistance through a program administered by the Secretary shall not, as a condition of receiving such funding, discriminate against, or grant a preference to, any person or group based in whole or in part on race, color, national origin, or sex—</text><paragraph id="H53691909F21D44C48D70B28AC30E2A09"><enum>(1)</enum><text>in connection with any grant, activity, project, contract (or subcontract) carried out using such funds, including the salaries and expenses of any employees paid using such funds; or</text></paragraph><paragraph id="H82A45AA4FBF94CB7AEF01CB32E78DA5D"><enum>(2)</enum><text>with respect to determining admission to any such institution of higher education.</text></paragraph></subsection><subsection id="H292E4B2FDDDC45E381B6D8A386EFC44F"><enum>(c)</enum><header>Certain sex-Based classifications</header><text display-inline="yes-display-inline">Nothing in subsection (a) or (b) shall be construed as prohibiting or limiting any classification based on sex if—</text><paragraph id="HB64980751AD64FA189C8691CA86C155E"><enum>(1)</enum><text>the classification is applied with respect to employment; and</text></paragraph><paragraph id="H2EBBCFFD83CE4F239A9DC56E0E186235"><enum>(2)</enum><text display-inline="yes-display-inline">the classification would be exempt from the prohibitions of title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a</external-xref> et seq.) by reason of section 703(e)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2(e)(1)</external-xref>).</text></paragraph></subsection><subsection id="HA80944F8D94D424F8229F82CD3E4A909"><enum>(d)</enum><header>Civil action</header><paragraph id="H1429E33CFABD4F3EBDE9F9748C7A972E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who is aggrieved by conduct prohibited by subsection (a) or (b), may commence a civil action in the appropriate district court of the United States to obtain appropriate relief (which may include back pay), against Secretary or a State, territory, or private entity referred to in subsection (b). </text></paragraph><paragraph id="H7306CFAAB6914FE0A83AD15F879D5B30"><enum>(2)</enum><header>Damages</header><text>A prevailing plaintiff in a civil action under paragraph (1) may recover reasonable attorney’s fees.</text></paragraph><paragraph id="H40071FD738B44F29802ED89AF3F96102"><enum>(3)</enum><header>Effect on other law</header><text>The remedies available to a plaintiff pursuant to a civil action under paragraph (1) shall not affect any remedy available to such a plaintiff under any other State or Federal law.</text></paragraph></subsection></section></legis-body></bill>
