<official-title display="yes">To amend title XIX of the Social Security Act to ensure adequate access to vaccines under the Medicaid program and the Vaccines for Children program, and for other purposes.</official-title>

<section id="H12315783241B45A6A6405ACD967F87C6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening the Vaccines for Children Program Act of 2021</short-title></quote>.</text></section> <section id="H0423AB043159449FA54540852B1FA712"><enum>2.</enum><header>Ensuring adequate access to vaccines under the Medicaid program and the Vaccines for Children program</header> <subsection id="HFE5254542BAD447598CF29EE387B5F95"><enum>(a)</enum><header>Encouraging involvement of providers</header><text>Paragraph (3) of section 1928(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396s">42 U.S.C. 1396s(c)</external-xref>) is amended—</text>
<paragraph id="H4BFACBD9D0954EB9911DC5F0C1407CA0"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and moving the margins of each such clause, as so redesignated, 2 ems to the right;</text></paragraph> <paragraph id="HA71E06CF69F143C8B5C95292C2B52A58"><enum>(2)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">providers</header-in-text></quote> and all that follows through <quote>Each program</quote> and inserting </text>
<quoted-block style="OLC" id="HE11393C57785485F8585F15D5CF2D772" display-inline="yes-display-inline"><text><header-in-text level="paragraph" style="OLC">providers.—</header-in-text></text> <subparagraph id="H97C4C4F9A37943109D7797282A4B45E2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each program</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H2893ED911B5745E59D47EEC781463B73"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H690562D585724391BE80A8F37EA6F1A1" display-inline="no-display-inline"> <subparagraph id="HC2AA8FCB3986493FAE951DC70148F901"><enum>(B)</enum><header>Incentive payments</header> <clause id="H71B5573A789E4AC18334D287A643DB52"><enum>(i)</enum><header>In general</header><text>The Secretary shall pay to each provider that requests payment under this subparagraph and that is a program-registered provider under this section for the duration of the period beginning on the date of the enactment of this subparagraph, and ending on December 31, 2022—</text>
<subclause id="HFEF9F190058F4132B8598E9CB3CE384D"><enum>(I)</enum><text>an amount equal to $5,000, to be paid as soon as practicable after the date of the enactment of this subparagraph;</text></subclause> <subclause id="H2CA06EB26217459D9D22082964FEB82F"><enum>(II)</enum><text>an amount equal to $2,500, to be paid as soon as practicable after January 1, 2022; and</text></subclause>
<subclause id="H90EB5B20530A413386B959B244B1F914"><enum>(III)</enum><text>an amount equal to $2,500, to be paid as soon as practicable after January 1, 2023.</text></subclause></clause> <clause id="HF3842D95EC6D4CF3A8A3F65BB7006811"><enum>(ii)</enum><header>Use of funds</header><text>Payments made under clause (i) may only be used by a provider for purposes of carrying out the program under this section (including any operational expenses associated with the furnishing of vaccines under such program, as specified by the Secretary).</text></clause>
<clause id="H6DB2BE1352304F73B37FAF519D5584F7"><enum>(iii)</enum><header>Recoupment of payments</header><text>The Secretary may conduct reviews of providers receiving payments under this subparagraph to ensure that such payments are used in accordance with clause (ii) and recoup from such providers any such payments not so used in accordance with such clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HBAE7AC9FA4BE491AB204BD38979CB27D"><enum>(b)</enum><header>Expansion of definition of federally vaccine-Eligible child</header><text display-inline="yes-display-inline">Paragraph (2) of section 1928(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396s">42 U.S.C. 1396s(b)</external-xref>) is amended—</text>
<paragraph id="HC6288DE095D34C62AEC4B4B2FA9F5460"><enum>(1)</enum><text>in subparagraph (A)—</text> <subparagraph id="HB5AD88A8AB6543C5AD9915734B996BC4"><enum>(A)</enum><text>in clause (iii), by striking <quote>A child who</quote> and all that follows through the period at the end and inserting <quote>A child who is administered a qualified pediatric vaccine and is not insured with respect to such vaccine.</quote>; and</text></subparagraph>
<subparagraph id="H95911C90B9E74EDD9908B90918FEED1F"><enum>(B)</enum><text>by adding at the end the following new clause:</text> <quoted-block style="OLC" id="H262AAFF32DEA47DC87C234864F0DB9F6" display-inline="no-display-inline"> <clause id="H8641DF05920246019921735360DA16FA"><enum>(v)</enum><text display-inline="yes-display-inline">A child who is enrolled for child health assistance under a State child health plan approved under title XXI.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HF2ABEA3DBDCF4C29A74BC8E0ADF43F53"><enum>(2)</enum><text>in subparagraph (B)(ii)(II), by striking <quote>for purposes of subparagraph (A)(iii)(II)</quote> and inserting <quote>for purposes of subparagraph (A)(iii)</quote>.</text></paragraph></subsection> <subsection id="HB78C1DFF266D4B7B978ED79BF16A5741" commented="no"><enum>(c)</enum><header>Minimum payment requirement for vaccine administration services</header> <paragraph id="HDEE3EDD6E1CE49AA99445EA81121BD38" commented="no"><enum>(1)</enum><header>In general</header><text>Section 1902(a)(13) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(13)</external-xref>) is amended—</text>
<subparagraph id="HDE364B54656E42CEB3DF97CB890A04DF" commented="no"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H8720B04E079C46449F7F6B11272ABDE6" commented="no"><enum>(B)</enum><text>in subparagraph (C), by striking the semicolon and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="HA14C671FFDF24027A2433F8CC6C49DAA" commented="no"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="HA68CE0A0DA0047598C0389E6654E3B4C" display-inline="no-display-inline"> <subparagraph id="HE12884F189A44AD0BA250F372759D5E4" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">for payment for vaccine administration services (including vaccine counseling and educational services) furnished by a provider during the period beginning on the date of the enactment of this subparagraph, and ending on December 31, 2022 (including, notwithstanding subsection (c)(2)(C)(ii) of section 1928, any such services furnished with respect to a vaccine furnished under the program established by the State pursuant to such section to a medicaid-eligible child (as defined in subsection (b)(2)(B)(i) of such section)), at a rate not less than 100 percent of the payment rate that applies to such services and provider under part B of title XVIII;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HFDD7475C706440CAAB8D5185254FDA5F" commented="no"><enum>(2)</enum><header>Managed care plans</header><text display-inline="yes-display-inline">Section 1932(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-2">42 U.S.C. 1396u–2(f)</external-xref>) is amended—</text> <subparagraph id="H702D421E3CB649AF9D861FEAEA1DCC30" commented="no"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text level="subsection" style="OLC">payment for primary care services</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">payments</header-in-text></quote>; </text></subparagraph>
<subparagraph id="HF1ED1328666E43AFBF4CF01094AD36DC" commented="no"><enum>(B)</enum><text>by striking <quote>section 1902(a)(13)(C)</quote> and inserting <quote>subparagraph (C) of section 1902(a)(13) and vaccine administration services described in subparagraph (D) of such section</quote>; </text></subparagraph> <subparagraph id="HB6CB99B38BE949458ECA5110EBF04399" commented="no"><enum>(C)</enum><text>by striking <quote>such section</quote> and inserting <quote>such subparagraph (C) or (D), respectively</quote>; and</text></subparagraph>
<subparagraph id="H28CD7DEAD3A24C299A91E1DB43E2010D"><enum>(D)</enum><text>by adding at the end the following new sentence: <quote>The provisions of the preceding sentence shall apply to contracts entered into with, and payments made by, other specified entities (as defined in section 1903(m)(9)(D)(iii)) in the same manner as such provisions apply with respect to contracts entered into with, and payments made by, medicaid managed care organizations.</quote>. </text></subparagraph></paragraph> <paragraph id="H3FD40842A5204F07A90AA22F3219829B"><enum>(3)</enum><header>CHIP</header><text>Section 2103(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)</external-xref>) is amended by adding at the end the following new paragraph:</text>
<quoted-block style="OLC" id="HDD69439AA9DC416798F6EB83A1FA0ACD" display-inline="no-display-inline">
<paragraph id="HFC198BB7AC1446EEA041836FF329BED0"><enum>(11)</enum><header>Vaccine administration services</header><text display-inline="yes-display-inline">The child health assistance provided to a targeted low-income child shall include payment for vaccine administration services (including vaccine counseling and educational services) furnished by a provider during the period beginning on the date of the enactment of this paragraph, and ending on December 31, 2022 (including, notwithstanding subsection (c)(2)(C)(ii) of section 1928, any such services furnished to such child with respect to a vaccine furnished under the program established by the State pursuant to such section), at a rate not less than 100 percent of the payment rate that applies to such services and provider under part B of title XVIII.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HBE12EC868451446E984B0405C73D5863" commented="no"><enum>(d)</enum><header>Coverage of vaccine counseling and educational services under Medicaid</header> <paragraph id="H98EA78A396734B26A80881585519F4DF" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text>
<subparagraph id="H84E98C5BA6A64A5DA682A16EB413CD74" commented="no"><enum>(A)</enum><text>in paragraph (29), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="HAD8883E5115240F3928C918675D46175" commented="no"><enum>(B)</enum><text>by redesignating paragraph (30) as paragraph (31); and</text></subparagraph>
<subparagraph id="HDD0920F5E6784A04895AB7DB350FAFE9" commented="no"><enum>(C)</enum><text>by inserting after paragraph (29) the following new paragraph:</text> <quoted-block style="OLC" id="HED2EC4FFCDD84A29B5664F46432574BE" display-inline="no-display-inline"> <paragraph id="HC15016DC954B43FC80C82DC76CE84D09" commented="no"><enum>(30)</enum><text display-inline="yes-display-inline">vaccine counseling and educational services furnished to children under the age of 19 on or after the date of the enactment of this paragraph, including any such services furnished as part of a multiple component vaccine (identified as of October 1, 2020, by CPT code 90461) and including any such services furnished under the program established by the State pursuant to section 1928 to a medicaid-eligible child (as defined in subsection (b) of such section),</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HEAD4703DF3784440B467E25920ABFB72" commented="no"><enum>(2)</enum><header>Mandatory benefit</header><text>Section 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended by striking <quote>and (29)</quote> and inserting <quote>(29), and (30)</quote>.</text></paragraph></subsection> <subsection id="HF50BBC7F5734485BB3F41FB16869D96E"><enum>(e)</enum><header>Clarification of coverage of pediatric vaccines and vaccine counseling and educational services under the Vaccines for Children program</header><text display-inline="yes-display-inline">Section 1928(c)(2)(C)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396s">42 U.S.C. 1396s(c)(2)(C)(ii)</external-xref>) is amended to read as follows:</text>
<quoted-block style="OLC" id="HE7D1AF0F849E45C88EB7324DD654405B" display-inline="no-display-inline">
<clause id="H7FFC59CA571D4754AD36998693043AE9" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The provider may impose—</text> <subclause id="H1799176373894CCAABCA22C8DDA36FE6"><enum>(I)</enum><text display-inline="yes-display-inline">in the case of a qualified pediatric vaccine not described in subclause (II), a fee for the administration of and counseling for such vaccine so long as the fee in the case of a federally vaccine-eligible child does not exceed the costs of such administration and counseling (as determined by the Secretary based on actual regional costs for such administration and counseling); and</text></subclause>
<subclause id="H54E3D803F3884A8A87F4388A26A8FC49"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of a qualified pediatric vaccine that is a multiple component vaccine, a separate charge for the administration of and counseling for each component of such vaccine so long as the charge in the case of a federally vaccine-eligible child does not exceed—</text> <item id="H34CB53D8296745F9B165EF81E9111A6D"><enum>(aa)</enum><text>with respect to the first component of such vaccine, the costs of such administration and counseling for such component (as determined by the Secretary based on actual regional costs for such administration and counseling for such first component); and</text></item>
<item id="HC3D6717619B946F283F3DA345ABD7177"><enum>(bb)</enum><text display-inline="yes-display-inline">with respect to a subsequent component of such vaccine, the payment rate that applies to such administration and counseling for such component and provider under part B of title XVIII.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2FE99F5B963C440E87F929EC46E36B4D"><enum>(f)</enum><header>Increase in Federal medical assistance percentage</header> <paragraph id="H2A68C9C1AE4448A49D7C9E01EBCD1A9B"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), for each calendar quarter occurring during the period beginning on January 1, 2021, and ending on December 31, 2022, the Federal medical assistance percentage determined for each State, including the District of Columbia, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, Puerto Rico, and the United States Virgin Islands, under section 1905(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)</external-xref>), after application of section 6008 of the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>) (if applicable), shall be increased by 1 percentage point.</text></paragraph>
<paragraph id="H2966275CD58A48C0ACB42ABD8BD67E82"><enum>(2)</enum><header>Requirements</header>
<subparagraph id="HA8F5EA77F01F42779B2D79E4FF81BBC2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State described in paragraph (1) may not receive the increase described in such paragraph in the Federal medical assistance percentage for such State, with respect to a quarter, if such State does not ensure culturally competent and effective messages for vaccination outreach to child populations, which may include the dissemination of information highlighting—</text> <clause id="H38178423A00747ABB1FAC9C6320720A3"><enum>(i)</enum><text display-inline="yes-display-inline">advancements in research and vaccine development that have saved millions of individuals from death and disability from now-preventable diseases;</text></clause>
<clause id="H4669FBD8EDEA44D2A2D5652E8A35E6F2"><enum>(ii)</enum><text display-inline="yes-display-inline">information on how individuals across the lifespan benefit from immunizations, including those who cannot be vaccinated and rely on community immunity;</text></clause> <clause id="H3C6ACF865162489DA75918B2A02FAC92"><enum>(iii)</enum><text display-inline="yes-display-inline">information on the dangers of not being vaccinated, including the potential for infectious disease outbreaks within communities; and</text></clause>
<clause id="HCEACACF6F81F4F08921BC7C76BAE6D37"><enum>(iv)</enum><text display-inline="yes-display-inline">information on vaccine safety and the systems in place to monitor vaccine safety.</text></clause></subparagraph> <subparagraph id="H9333031996704EAC907449554AA87A00"><enum>(B)</enum><header>Requirement for certain States</header><text display-inline="yes-display-inline">Section 1905(cc) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(cc)</external-xref>) is amended—</text>
<clause id="H28F52835D7254BAB88B4E57F786D9FA0"><enum>(i)</enum><text>by inserting <quote>and section 2(e) of the Strengthening the Vaccines for Children Program Act of 2021</quote> before <quote>, except that in applying</quote>; and</text></clause> <clause id="H07EB981FF6F44440A9EB2C52499A03D5"><enum>(ii)</enum><text>by inserting <quote>, and in applying such treatments to the increases in the Federal medical assistance percentage under section 2(e) of the Strengthening the Vaccines for Children Program Act of 2021, the reference to <quote>December 31, 2009</quote> shall be deemed to be a reference to <quote>December 31, 2020</quote></quote> before the period at the end.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H74BEB4A62941441D8075BC1A4FD9AFC4"><enum>(g)</enum><header>Tribal epidemiology center data access</header><text display-inline="yes-display-inline">With respect to data access for tribal epidemiology centers established under section 214 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1621m">25 U.S.C. 1621m</external-xref>), the Director of the Centers for Disease control and Prevention may create a data sharing strategy that ensures such centers have access to data, data sets, monitoring systems, delivery systems, and other protected health information with respect to health care and public health surveillance systems of child and adolescent health necessary to accomplish such centers’ public health authority responsibilities described in such section or section 164.501 of title 45, Code of Federal Regulations.</text></subsection> <subsection id="H6CFCD2AE33B848349531213975C12EAD"><enum>(h)</enum><header>Reports</header> <paragraph id="HC5ED9E0B37C04953826ECBD5F7CF0247"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each of fiscal years 2021 and 2022, the Director of the Centers for Disease Control and Prevention, in coordination with each State that has established a pediatric vaccine distribution program under section 1928 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396s">42 U.S.C. 1396s</external-xref>), shall publish on the public internet website of the Centers for Disease Control and Prevention, in such manner as determined appropriate by the Director, information on vaccination rates under each such program during such year, including such rates disaggregated by region, age, sex, race, ethnicity, and other demographic factors determined appropriate by the Director.</text></paragraph>
<paragraph id="H23BC31318FA24A8DB3E5E960C9008DC4" commented="no"><enum>(2)</enum><header>Effects on vaccination rates and program participation</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report containing an analysis of the effects of the provisions of, and the amendments made by, this Act on—</text> <subparagraph id="HB03A0EC2F3FE442F836A2276BE36C641" commented="no"><enum>(A)</enum><text>vaccination rates under the pediatric vaccine distribution program under section 1928 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396s">42 U.S.C. 1396s</external-xref>); and</text></subparagraph>
<subparagraph id="H99AF4508B44A4276B4A5CD0E89F4F0AF" commented="no"><enum>(B)</enum><text>provider participation in such program.</text></subparagraph></paragraph></subsection></section> </legis-body> </bill>
