<section id="H7E7E2ABAE21E43529493C939D928C5C6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Efficient Qualified Improvement Property Act of 2021</short-title></quote> or the <quote><short-title>E–QUIP Act</short-title></quote>. </text></section> <section id="HD2558E45C0164D66802F4D584459FD51"><enum>2.</enum><header>Depreciation of energy efficient qualified improvement property</header> <subsection id="HDA8B68E42C98460EA9DD8B0E365E9881"><enum>(a)</enum><header>10-Year property</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/168">Section 168(e)(3)(D)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and</quote> at the end of clause (iii), by striking the period at the end of clause (iv) and inserting <quote>, and</quote>, and by adding at the end the following new clause:</text>

<clause id="HC10CB302FF82412E82BEC25BB43B55ED"><enum>(vi)</enum><text display-inline="yes-display-inline">energy efficient qualified improvement property.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDE5F9F575E214A87A3F213DDE637251D"><enum>(b)</enum><header>Straight line method</header><text>Section 168(b)(3) of such Code is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H1EC53ADA683849CE985C3805DC38F8EE"><enum>(H)</enum><text display-inline="yes-display-inline">Energy efficient qualified improvement property described in subsection (e)(7).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H4A921564408A4D2AA17C97F8678B1452"><enum>(c)</enum><header>Energy efficient qualified improvement property defined</header><text>Section 168(e) of such Code is amended by adding at the end the following new paragraph:</text>

<paragraph id="H844F55A2E96A42B089457AF1E80116B3"><enum>(7)</enum><header>Energy efficient qualified improvement property</header>
<subparagraph id="H103C2DF6E8BD446F8097A6BFB3616820"><enum>(A)</enum><header>In general</header><text>The term <term>energy efficient qualified improvement property</term> means any improvement—</text> <clause id="HA8C40CA696204ED9A922774EE31209C8"><enum>(i)</enum><text>to a building which is nonresidential real property, or multifamily residential rental property, first placed in service more than 10 years before the date of the enactment of this subparagraph,</text></clause>
<clause id="H99BD4D9C2CA549C0AAC1FEEC4D4F2B08"><enum>(ii)</enum><text>which is installed as part of—</text> <subclause id="H0BB6D4E22D7E4F118931618A3F93C678"><enum>(I)</enum><text>the lighting system,</text></subclause>
<subclause id="H04114A700DC6454CAFF7CA9A2DD5E4B3"><enum>(II)</enum><text>the heating, cooling, ventilation, or hot water systems, or</text></subclause> <subclause id="HB0A1227F95814E03AC5B300294CB1FE2"><enum>(III)</enum><text>the building envelope,</text></subclause></clause>
<clause id="HBDBEC56D8C494FE09A709BC2D9CDF0EF"><enum>(iii)</enum><text>which meets the performance requirements of subparagraph (B),</text></clause> <clause id="H11E8743E2BEC482680580DBE34CCA0F5"><enum>(iv)</enum><text display-inline="yes-display-inline">which, in the case of an improvement described in subclause (I) or (II) of clause (ii)—</text>
<subclause id="HBD9BE58D0CA04F1D86BEDFE7266F6EA2"><enum>(I)</enum><text display-inline="yes-display-inline">is audited, commissioned, or managed by a professional with a credential that is recognized by the Department of Energy through its Better Buildings Workforce Guidelines, or such other credential programs identified by the Secretary of Energy (following an opportunity for, and consideration of, public input), and</text></subclause> <subclause id="H65F9763A1BC34CEDB044DB88AB375DE8"><enum>(II)</enum><text>is subject to an ongoing operations and maintenance plan under such certification during the applicable recovery period,</text></subclause></clause>
<clause id="HB306A71CB8BF4192A25324715C6EAA58"><enum>(v)</enum><text display-inline="yes-display-inline">which, in the case of an improvement described in clause (ii)(III), the design and installation has been completed, observed, or approved by an individual qualified by industry-recognized professional credential programs in building envelope quality assurance, as identified by the Secretary of Energy (following an opportunity for, and consideration of, public input),</text></clause> <clause id="H858535CA47084000AE335CF0116106CC"><enum>(vi)</enum><text>which is placed in service before January 1, 2026, and</text></clause>
<clause id="HEFC86E4739C043B1AA72960C62B395FC"><enum>(vii)</enum><text>with respect to which the taxpayer elects the application of this subparagraph.</text></clause></subparagraph> <subparagraph id="HC2A9B20AE93146C88024C184B7CCE31E"><enum>(B)</enum><header>Performance requirements</header><text>An improvement meets the performance requirements of this subparagraph if—</text>
<clause id="HA9A709FB2C65458C8AD7A0F7F9A9E8C0"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of lighting, it meets the lighting power allowances, densities, and control specifications in the prescriptive option of the International Green Construction Code (2018),</text></clause> <clause id="HDD5CDC48A09648B88C775C0EF7370371"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a unitary air-cooled air conditioner, it meets or exceeds Consortium for Energy Efficiency Tier 2, as in effect on January 1, 2019,</text></clause>
<clause id="HD5D8714BA94F422C8049530C938D9AF9"><enum>(iii)</enum><text>in the case of a unitary water-cooled and evaporatively cooled air conditioner, it meets or exceeds Consortium for Energy Efficiency Tier 1, as in effect on January 1, 2019, </text></clause> <clause id="H104C062A919B4B0EA0F260E0CC80DB4E"><enum>(iv)</enum><text>in the case of a unitary heat pump—</text>
<subclause id="HD8FBDFEF02824A7782B5E0E6C65555E0"><enum>(I)</enum><text>with a capacity of less than 65,000 Btu per hour, it meets or exceeds Consortium for Energy Efficiency Tier 2, as in effect on January 1, 2019, or</text></subclause> <subclause id="H7AD19285340749599739C183A0010654"><enum>(II)</enum><text>with a capacity of 65,000 Btu per hour or greater, it meets or exceeds Consortium of Energy Efficiency Tier 1, as in effect on January 1, 2019,</text></subclause></clause>
<clause id="H6E141B073EFA4865AC51322CE7E5CFFA"><enum>(v)</enum><text>in the case of a variable refrigerant flow multisplit air conditioner or variable refrigerant flow multisplit heat pump—</text> <subclause id="HF936DB71CBDF48C0B8D1C4794459B203"><enum>(I)</enum><text>with a capacity of less than 65,000 Btu per hour, it meets or exceeds Consortium for Energy Efficiency Tier 2, as in effect on January 12, 2016, or</text></subclause>
<subclause id="H56338AD0CE4B4470A0DF82A827F80B0E"><enum>(II)</enum><text>with a capacity of 65,000 Btu per hour or greater, it meets or exceeds Consortium of Energy Efficiency Tier 1, as in effect on January 12, 2016,</text></subclause></clause> <clause id="HBBE4DFCA54E541F6B3BA821812EC4D50"><enum>(vi)</enum><text>in the case of a boiler, it meets or exceeds Consortium for Energy Efficiency Tier 1, as in effect on September 1, 2015, </text></clause>
<clause id="HD548EF8103B44F01BA7E2283BED5AE96"><enum>(vii)</enum><text>in the case of a hot water heater—</text> <subclause id="H08D4208A057248F5B05E42DBDBF010DB"><enum>(I)</enum><text>that is gas-fired, it meets or exceeds Consortium of Energy Efficiency Tier 1, as in effect on June 5, 2012, or</text></subclause>
<subclause id="HC4E3F15E02254F2DA6512EEC0E6E77A9"><enum>(II)</enum><text>that runs on electricity, it has a Coefficient of Performance of 3 or more,</text></subclause></clause> <clause id="H11BF171A015E400F9F6530FF856DA74C"><enum>(viii)</enum><text>in the case of a water-cooled centrifugal chiller package, it meets the prescriptive option of the International Green Construction Code (2018),</text></clause>
<clause id="H2FC0296D407A4D35AAE5524DF66AFC22"><enum>(ix)</enum><text display-inline="yes-display-inline">in the case of insulation for heating and cooling supply and return ducts, it meets the prescriptive option for duct insulation of the International Green Construction Code (2018) and its applicable Normative Appendix,</text></clause> <clause id="H8A73A68D3CE84245987C5CE379007705"><enum>(x)</enum><text display-inline="yes-display-inline">in the case of roofing, walls, and associated insulation, it meets the prescriptive option for building envelope opaque elements of the International Green Construction Code (2018) and its applicable Normative Appendix,</text></clause>
<clause id="H46ECEF323D6442E693C8DF3E6C4E485E"><enum>(xi)</enum><text display-inline="yes-display-inline">in the case of piping insulation, it meets the prescriptive option for piping insulation of ANSI/ASHRAE/IES Standard 90.1–2019,</text></clause> <clause id="HAC0F709A19054B7FB5D0B7CE9E901B4A"><enum>(xii)</enum><text display-inline="yes-display-inline">in the case of windows, doors, and skylights, they meet the prescriptive option for building envelope fenestration and skylights of the International Green Construction Code (2018) and its applicable Informative Appendix,</text></clause>
<clause id="H0F4AF5C057EB4E4AB325C2CDDF70DE8B"><enum>(xiii)</enum><text display-inline="yes-display-inline">in the case of sensors and controls, it is a device that automatically controls the operation of other qualified equipment without manual operation of a switch, using technology such as motion or occupancy detection, infrared, ultrasonic, microwave, audio-based, image-processing, temperature, humidity, time-scheduling, bi-level, or demand-response, and</text></clause> <clause id="HB7F5B5F9E5ED449E99F18367CD364BF9"><enum>(xiv)</enum><text display-inline="yes-display-inline">in the case of a variable speed or frequency drive, it is a drive—</text>
<subclause id="HB7934370CBD04065BEDAE865022A3E78"><enum>(I)</enum><text>added to adjust the speed and torque of an operational motor that powers pump, fan, exhaust, ventilation, air-handling, or compressor equipment, and</text></subclause> <subclause id="H15A6DA1E54AE4DD9BD03F2FA53AFBCBA"><enum>(II)</enum><text>controlled automatically by a building automation system, process control system, or local controller driven by differential pressure flow, temperature or another variable signal.</text></subclause></clause></subparagraph>
<subparagraph id="HC776DCA8A8F040888F8F51C47ECB7A42"><enum>(C)</enum><header>Updating of performance standards</header><text display-inline="yes-display-inline">The most recent version of each performance standard described in subparagraph (B) shall be affirmed by the Secretary (after consultation with the Secretary of Energy) and shall apply with respect to any property for purposes of this paragraph not later than the date that is 2 years before the date that the improvement to such property begins.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HB59E12544A2C4A01B7FC18AB13B20938"><enum>(d)</enum><header>Alternative depreciation system</header><text>The table in section 168(g)(3)(B) of such Code is amended by inserting after the item relating to subparagraph (D)(v) the following new item:</text>

<subsection id="HE940FEBCBFCB485C8CCD804BFF0D8A8D"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after December 31, 2020.</text></subsection></section> <section id="H540713BA33F04F53B6783032A80A61AA"><enum>3.</enum><header>Report relating to depreciation of energy efficient qualified improvement property</header> <subsection id="H62C45B46CF5A45DCB0CDBF079A282379"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date that is 3 years after the date of the enactment of this Act, the Secretary of the Treasury, in consultation with the Secretary of Energy, shall submit to Congress a report on energy efficient qualified improvement property (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/168">section 168(e)(7)</external-xref> of the Internal Revenue Code of 1986).</text></subsection>
<subsection id="HDD5B5170231D40BB81644B7F6D171A53"><enum>(b)</enum><header>Contents</header><text>Such report shall include the following:</text> <paragraph id="H0E970073B8F84804A714F00F5EE999CA"><enum>(1)</enum><text>The number of times over such 3-year period energy efficient qualified improvement property was placed in service and treated as 10-year property under section 168(e)(3)(D) of such Code.</text></paragraph>
<paragraph id="H5356F1F79AC14A53A570C357F5670C32"><enum>(2)</enum><text>A summary of the types of such energy efficient qualified improvement property placed in service during such period.</text></paragraph> <paragraph id="HED90AC900FD2401A89EA85818DDFE1AC"><enum>(3)</enum><text>An estimate of the energy use savings, and reduction in greenhouse gas emissions, attributable to such property.</text></paragraph>
<paragraph id="H13989522C1FD49D6A6D59537C875D945"><enum>(4)</enum><text display-inline="yes-display-inline">An estimate of the number of jobs created which are attributable to the enactment of the Energy Efficient Qualified Improvement Property Act of 2020.</text></paragraph> <paragraph id="H762D0237076C42CA87A8239C5B5B50C6"><enum>(5)</enum><text>Any recommendations for updated efficiency requirements for energy efficient qualified improvement property or rules for the depreciation thereof.</text></paragraph></subsection></section>
