which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a commission to study the relocation of select executive agencies or divisions of such agencies outside the Washington metropolitan area, to make recommendations to Congress on appropriate findings, and for other purposes.</official-title></form><legis-body id="H2BCE1A3AD0044A61AB718D1780F4A21C" style="OLC"><section id="H425F20DD0B9345418847274360C280AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Government Decentralization Commission Act</short-title></quote>.</text></section><section id="HE7026E2C909240F793E82BA29C542D45"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established in the General Services Administration a commission to be known as the <quote>Federal Government Decentralization Commission</quote> (in this Act referred to as the <quote>Commission</quote>).</text></section><section id="H392DC4DA307F4ADF80AAC3CBF65B29B6"><enum>3.</enum><header>Duties of Commission</header><text display-inline="no-display-inline">The Commission shall—</text><paragraph id="H48C8C402285349A881CF851F86EF289E"><enum>(1)</enum><text>study the relocation of executive agencies or divisions of executive agencies outside the Washington metropolitan area; and</text></paragraph><paragraph id="H2E58A7F6C3B8479A8AFFD46CEF0EC6C6"><enum>(2)</enum><text>submit to Congress a plan for the relocation of recommended agencies or divisions.</text></paragraph></section><section id="H89509E0FD44E4C8D8783C511D76F6063"><enum>4.</enum><header>Membership</header><subsection id="HB149E3EE035848C6A93F90D83FCFE0F5"><enum>(a)</enum><header>Number and appointment</header><text>The Commission shall be composed of the Administrator of General Services (or a designee) and 10 other members, appointed as follows:</text><paragraph id="HB0DFE141BB424C12B8BDF5F1BC1E5935"><enum>(1)</enum><text>Two members shall be appointed by the majority leader of the Senate.</text></paragraph><paragraph id="H5907B051CB2E4F9C8731DCA87F4EB778"><enum>(2)</enum><text>Two members shall be appointed by the Speaker of the House of Representatives.</text></paragraph><paragraph id="H4BABFFC68D1849A793A16457D263751A"><enum>(3)</enum><text>Two members shall be appointed by the minority leader of the Senate.</text></paragraph><paragraph id="H5C7367A126F4487E819329654966E902"><enum>(4)</enum><text>Two members shall be appointed by the minority leader of the House of Representatives.</text></paragraph><paragraph id="HACFFC4DED52D4A43847A4E035CAB46ED"><enum>(5)</enum><text>Two members shall be appointed by the Administrator of the General Service Administration.</text></paragraph></subsection><subsection id="H02FB8D1FC377468CADE2AACA399DF9FC"><enum>(b)</enum><header>Deadline for initial appointment</header><text>The initial members of the Commission shall be appointed not later than 90 days after the date of the enactment of this Act.</text></subsection><subsection id="H9042981CA2E649ED9BAF507F0D5DF8E4"><enum>(c)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text><paragraph id="H2041058B755149579104CC3BB35527D5"><enum>(1)</enum><text>shall not affect the powers of the Commission; and</text></paragraph><paragraph id="H85F91A05144E4C7A8DDEE4BF72B50F78"><enum>(2)</enum><text>shall be filled in the same manner as the original appointment was made.</text></paragraph></subsection><subsection id="HCC58933860F94C52A5AC69E3650FBEED"><enum>(d)</enum><header>Compensation</header><text display-inline="yes-display-inline">Each member of the Commission shall serve without pay.</text></subsection><subsection id="HE6D712EC02614C4FB10D05AB64E9B891"><enum>(e)</enum><header>Travel expenses</header><text>Each member of the Commission shall be allowed a per diem allowance for travel expenses, at rates consistent with those authorized under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection><subsection id="H287697D0C67047BCBE2EA6CAE614E6ED"><enum>(f)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Chairperson of the Commission shall be the Administrator of General Services (or a designee).</text></subsection></section><section commented="no" id="H27D5AE78C49C4A51B637757C6D751261"><enum>5.</enum><header>Administrative support and staff provided by the General Services Administration</header><text display-inline="no-display-inline">Administrative and support staff for the Commission shall be provided by the General Services Administration.</text></section><section id="H4A48CA856B9C4CB69428212189DFE522"><enum>6.</enum><header>Submission of plan to Congress</header><subsection id="HB9C00E9EBB2149C2A6145C292E02B83D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Commission shall develop and submit to Congress a plan for the relocation of executive agencies or divisions of executive agencies outside the Washington metropolitan area.</text></subsection><subsection commented="no" id="HA1EEB1D2A22949949EAFBCDB78BA8A6A"><enum>(b)</enum><header>Requirements for plan</header><text display-inline="yes-display-inline">The plan shall include the following:</text><paragraph commented="no" id="H79FB2E8EC1F341A2BC46D2BFA38FE90B"><enum>(1)</enum><text display-inline="yes-display-inline">An identification of new locations for executive agencies or divisions of executive agencies outside the Washington metropolitan area, which shall be prioritized—</text><subparagraph commented="no" id="HD0F8DB0C4B1848A5AFB34A1D473B5DA5"><enum>(A)</enum><text>by relocation to a low-income community; or</text></subparagraph><subparagraph commented="no" id="H92AB9624F4B44E22AB6EC6A443503619"><enum>(B)</enum><text>by relocation to areas with expertise in the mission and goal of the executive agency or division.</text></subparagraph></paragraph><paragraph commented="no" id="H4FFDEBFF1EAD4DA2BB00F3B61DC5A68A"><enum>(2)</enum><text>A consideration of national security implications of the relocation.</text></paragraph><paragraph commented="no" id="HC9CFB7D6AF484C3CB8CBF25C2B0E2614"><enum>(3)</enum><text display-inline="yes-display-inline">An economic and workforce development study on how the relocation of an executive agency or division would impact the new location.</text></paragraph><paragraph commented="no" id="H5F6A75F503F54F188E82735B5D124B7A"><enum>(4)</enum><text display-inline="yes-display-inline">A list of potential site acquisitions and partial prospectus for executive agencies or divisions of executive agencies, which shall include—</text><subparagraph commented="no" id="H33229695000541E298325192DC4938FA"><enum>(A)</enum><text>a brief description of the building to be constructed, altered, or leased;</text></subparagraph><subparagraph commented="no" id="HB08035F1FFAF4926BB61F106DD2482F5"><enum>(B)</enum><text>the location of the building; and</text></subparagraph><subparagraph commented="no" id="HF2BB3B7209464EC2B98EF34AFCD3BEF6"><enum>(C)</enum><text>an estimate of the maximum cost of the acquisition and the relocation.</text></subparagraph></paragraph></subsection></section><section id="H642B410B47534492945B8632F6D61865"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H5F96C6D0365B451C9B4B985FE0ACFD48"><enum>(1)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term <term>Executive agency</term> in section 105 of title 5, United States Code, except that the term does not include the Executive Office of the President.</text></paragraph><paragraph commented="no" id="HFC813F1F92804E7DAEBAE8C4203358DD"><enum>(2)</enum><header>Low-income community</header><text display-inline="yes-display-inline">The term <term>low-income community</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/45D">26 U.S.C. 45D(e)</external-xref>).</text></paragraph><paragraph id="HE3E761F9B6EB4B1994D54F3CCD0E2FE4"><enum>(3)</enum><header>Washington metropolitan area</header><text>The term <term>Washington metropolitan area</term> means the geographic area located within the boundaries of—</text><subparagraph id="H851A525DC615420DB4837484B1B842A6"><enum>(A)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="H17FE050A63E14976BE54D1E3D68A90FE"><enum>(B)</enum><text>Montgomery and Prince George’s Counties in the State of Maryland; and</text></subparagraph><subparagraph id="H71FEAE6C1B87447CB36AC583FD1C806B"><enum>(C)</enum><text>Arlington, Fairfax, Loudon, and Prince William Counties and the City of Alexandria in the Commonwealth of Virginia.</text></subparagraph></paragraph></section><section id="HF116EF908A02486E8A51C7D3749F9FB6"><enum>8.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall terminate 30 days after the submission of the plan under section 6.</text></section><section commented="no" id="HD461DAA5BF7A4D7EA32BEE4A91AFDF7D"><enum>9.</enum><header>Funding</header><text display-inline="no-display-inline">No new appropriations may be obligated to carry out this Act.</text></section></legis-body></bill>
