which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish an innovative mobility and technology deployment grants program, and for other purposes.</official-title></form><legis-body id="HCC404398D0254878BED6144DA5D2AFC7" style="OLC"><section id="HC26DD7E9FCCC4D14AC2E74AE2679F06C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinvesting in Essential Partnerships And Infrastructure for Rural America Act</short-title></quote> or the <quote><short-title>REPAIR Act</short-title></quote>. </text></section><section id="H62713D2959FF462C84412168C63135E0" section-type="subsequent-section"><enum>2.</enum><header>Fixed guideway capital investment grants</header><text display-inline="no-display-inline">Section 5309 of title 49, United States Code, is amended—</text><paragraph id="HD9B50ADFDAD649B899B3F3EC35C2B966"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="H2EE12A8827BA40BC8818605C9CBA6371"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (7)—</text><clause id="H0851BE7FB3A84A0D84C43F0B20863B0F"><enum>(i)</enum><text>in subparagraph (A) by striking <quote>$100,000,000</quote> and inserting <quote>$200,000,000</quote>; and</text></clause><clause id="H7159B5C8F8A9494B8873D72B1595C39E"><enum>(ii)</enum><text>in subparagraph (B) by striking <quote>$300,000,000</quote> and inserting <quote>$400,000,000</quote>; and </text></clause></subparagraph><subparagraph id="HF36F78B453B24D6AB354814B810C8DB6"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H5325CA9A70AF4D5B8EBE82B0F271D4CE" display-inline="no-display-inline"><paragraph id="H9B37A9F173D5496992A2D808122E5EC6"><enum>(8)</enum><header>Rural start project</header><text display-inline="yes-display-inline">The term <quote>rural start project</quote> means a new transit capital project that is not in an urbanized area for which—</text><subparagraph id="HE910E1AE8EA54A63A3BB2B280A55A804"><enum>(A)</enum><text>the Federal assistance provided or to be provided under this section is less than $80,000,000; and</text></subparagraph><subparagraph id="H9FE534E8435142BB8C99EE1CB6C364BC"><enum>(B)</enum><text>the total estimated net capital cost is less than $150,000,000.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H21FD25916C2748C6B994ABD11EBB5D2F" commented="no"><enum>(2)</enum><text>in subsection (b)(1) by striking <quote>or small start projects</quote> and inserting <quote>, small start projects, or rural start projects</quote>; </text></paragraph><paragraph id="H791B9ED42A314DBAA69600621ABFE843" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)(1) by striking <quote>small start projects</quote> and inserting <quote>, small start projects, rural start projects</quote>; and </text></paragraph><paragraph id="HE967240480FE4AE69931DFF50A649897"><enum>(4)</enum><text>in subsection (h)—</text><subparagraph id="H19D51AEC338749B8822974AB99F23974" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading by striking <quote><header-in-text level="subsection" style="USC">Small start projects</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Small start projects and rural start projects</header-in-text></quote>;</text></subparagraph><subparagraph id="H9111AB0EF3304C1F8FE06A37BF1B29DC"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1) by striking <quote>small start project</quote> and inserting <quote>small start project or rural start project</quote>;</text></subparagraph><subparagraph id="H444D61730B94464F9EFC0805A189EA39"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2)(A) by striking <quote>small starts project</quote> and inserting <quote>small start project or rural start project</quote>;</text></subparagraph><subparagraph id="HD7C8B7F098A7426B86A8BF57EDA31273"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (3) by striking <quote>small start project</quote> and inserting <quote>small start project or rural start project</quote>; and </text></subparagraph><subparagraph id="HC49699636CA74409880D03F4E0383975"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (6)(A) by striking <quote>small start project</quote> and inserting <quote>small start project or rural start project</quote>. </text></subparagraph></paragraph></section><section id="H17A5AE2D56554981B613CEA98765773C"><enum>3.</enum><header>Enhanced mobility of seniors and individuals with disabilities</header><text display-inline="no-display-inline">Section 5310 of title 49, United States Code, is amended—</text><paragraph id="HFF18A16BBD174190908BDE472DD1631E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2) by striking <quote>(A) <header-in-text level="subparagraph" style="USC">Amount available</header-in-text></quote> and all that follows through <quote>A recipient of a grant under</quote> and inserting <quote>A recipient of a grant under</quote>;</text></paragraph><paragraph id="HF56B210A300C470F82B6488F9B64CB6B" commented="no"><enum>(2)</enum><text>in subsection (c)(2) by adding at the end the following:</text><quoted-block style="USC" id="HAD06751C6FF84A4C8CF3E05B1F1051F2" display-inline="no-display-inline"><subparagraph id="HAB88442F53FA40A2BFD8C23135F0F61D" commented="no"><enum>(E)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Amounts apportioned under section 5310(c)(1)(A) may be reallocated to projects in areas other than urbanized areas.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HAEB354DD39324E9CB5875F3AE8264F76"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraphs (1) and (2) of subsection (d) and inserting the following:</text><quoted-block style="OLC" id="H4F97F2B349FE40189DC9C8314AAE096B" display-inline="no-display-inline"><paragraph id="HED6532CAB60C49C98F328018B645F48B"><enum>(1)</enum><header>Capital projects</header><subparagraph id="H38DBBAE346424A68A4E18E5777A3911E"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a grant awarded under this section for a capital project shall be 80 percent of the net costs of the project, as determined by the Secretary.</text></subparagraph><subparagraph id="HDB7EB2BC38414E298F684485F7AC96FF"><enum>(B)</enum><header>Exception</header><text>A State described in section 120(b) of title 23 shall receive a Government share of the net costs in accordance with the formula under such section.</text></subparagraph></paragraph><paragraph id="HACBD51706A994DD7B37EFEBA9ACC6640"><enum>(2)</enum><header>Operating Assistance</header><subparagraph id="HAA28C9F8EC4B428FA7C224A3B89E3C74"><enum>(A)</enum><header>In general</header><text>Except as provided by subparagraph (B), a grant awarded under this section for a operating assistance may not exceed an amount equal to 50 percent of the net operating costs of the project, as determined by the Secretary.</text></subparagraph><subparagraph id="H6689426BD41A446687A9E40501F36167"><enum>(B)</enum><header>Exception</header><text>A State described in section 120(b) of title 23 shall receive a Government share of the net costs that is equal to 62.5 percent of the Government share provided for under paragraph (1)(B).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H19A49B1744794C9E9EA786BB4B24BFE0"><enum>(4)</enum><text>by striking subsection (e)(1) and inserting the following:</text><quoted-block style="OLC" id="H86BBF85E4D24411AB7F80508D5D55FA1" display-inline="no-display-inline"><paragraph id="H5DE67A6838ED4BDEA53C9BCA5C5048F7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent the Secretary determines appropriate, the requirements of—</text><subparagraph id="HA1C3B32E0A124FD39F73A67DB7F65DD9"><enum>(A)</enum><text>section 5307 shall apply to recipients of grants made in urbanized areas under this subsection; and</text></subparagraph><subparagraph id="H08820E64DA204706850121ED38B66FB4"><enum>(B)</enum><text>section 5311 shall apply to recipients of grants made in rural areas under this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE092BFE40B48464483A7F8B38FE8C335"><enum>4.</enum><header>Formula grants for rural areas</header><text display-inline="no-display-inline">Section 5311(g) of title 49, United States Code, is amended—</text><paragraph id="HDACD5AF3CC5249E6A4219820BF4BCEB3"><enum>(1)</enum><text>in paragraph (1) by adding at the end the following:</text><quoted-block style="OLC" id="H96ECFEEDA4274FA3928E02DCF6C738BD" display-inline="no-display-inline"><subparagraph id="H1772D33492E847DCB8E86E94F3D92815"><enum>(C)</enum><header>Projects in qualified opportunity zones, medically underserved areas, or areas with a medically underserved population</header><text display-inline="yes-display-inline">A grant awarded under this section for a capital project in a qualified opportunity zone, a medically underserved area, or areas with a medically underserved population shall be for 90 percent of the net costs of the project, as determined by the Secretary. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H1AD7252AFC6848E4BB456BA056BB26F0"><enum>(2)</enum><text>in paragraph (2) by adding at the end the following:</text><quoted-block style="OLC" id="HEB26B06730824BA487BA8404DCDA7AAA" display-inline="no-display-inline"><subparagraph id="H02A60F329A8B416BA6E84BDA0D0EBD48"><enum>(C)</enum><header>Projects in qualified opportunity zones, medically underserved areas, or areas with a medically underserved population</header><text display-inline="yes-display-inline">A grant awarded under this section for a capital project in a qualified opportunity zone, a medically underserved area, or an area with a medically underserved population shall be for 62.5 percent of the Government share provided for under paragraph (1)(B).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA0DDAA9C8F674E42A60C0D223C68C3A3"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H345ABE995D834D5F932EF2B8E3F3AC4B" display-inline="no-display-inline"><paragraph id="HBD3054883A024099925E6ED67B9E7CC1"><enum>(6)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="H882C6ADE8A834413B04FC89D7CE19F4F"><enum>(A)</enum><header>Qualified opportunity zone</header><text display-inline="yes-display-inline">The term <quote>qualified opportunity zone</quote> has the meaning given such term <external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">section 1400Z–1</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph><subparagraph id="H10EBD3A022C34BF882CC842D8CB9FADB"><enum>(B)</enum><header>Medically underserved areas; an area with a medically underserved population</header><text>The term <quote>medically underserved areas</quote> or <quote>an area with a medically underserved population</quote> means an area or populations that are designated as medically underserved by the Secretary of Health and Human Services pursuant to section 330(b)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(b)(3)</external-xref>). </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4F850BAA8BAC4ACAB561107F599DA071"><enum>5.</enum><header>Non-emergency medical transportation</header><subsection id="HEE4B0F00B1C54EE3B6D7909855F0A68A"><enum>(a)</enum><header>Research project eligibility</header><text display-inline="yes-display-inline">Section 5312(c)(2) of title 49, United States Code, is amended—</text><paragraph id="H25976965AE624E3F930312850AADF218"><enum>(1)</enum><text>in subparagraph (M), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H8DFB0AB9C16C4C8993DE5ACEEA82AD94"><enum>(2)</enum><text>by redesignating subparagraph (N) as subparagraph (O); and </text></paragraph><paragraph id="H4E3BF51233E64288914612E9027FC70C"><enum>(3)</enum><text>by inserting after subparagraph (M) the following:</text><quoted-block style="OLC" id="H0AE6BDA90E8E4948BC0DD93618DBEC54" display-inline="no-display-inline"><subparagraph id="H2656AA2BA7774AA687472EED701668C5"><enum>(N)</enum><text display-inline="yes-display-inline">access to hospitals and healthcare providers in areas underserved by transit or with limited public transportation options, as determined by the Secretary; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H87A4B1BF67F44FB39316DEF4B026CE4A"><enum>(b)</enum><header>Innovation and development project eligibility</header><text display-inline="yes-display-inline">Section 5312(d)(2) of title 49, United States Code, is amended—</text><paragraph id="HFBD091A03EF7465799D4371C94CB4342"><enum>(1)</enum><text>in subparagraph (G), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H28B8A5DB87FC40918F05BFDF5E4BF66E"><enum>(2)</enum><text>by redesignating subparagraph (H) as subparagraph (I); and</text></paragraph><paragraph id="HB9B6E9B44F44457498AB3A7ADAA2C7BF"><enum>(3)</enum><text>by inserting after subparagraph (G) the following:</text><quoted-block style="OLC" id="H164981696340421BBCAABE63017DCF52" display-inline="no-display-inline"><subparagraph id="H82B8A669C72B469691F2A517B7B83DCF"><enum>(H)</enum><text display-inline="yes-display-inline">public transportation projects that improve health care access and outcomes; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8EDF8BA86A624A1BBB6980A5369BA208"><enum>(c)</enum><header>Demonstration, deployment, and evaluation project eligibility</header><text display-inline="yes-display-inline">Section 5312(e)(3) of title 49, United States Code, is amended—</text><paragraph id="H729DB56FD23542FEB291B12966A908B8"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H10628A8FC4A849159EEB21F4B955467A"><enum>(2)</enum><text>in subparagraph (C), by striking the period and inserting <quote>; or</quote>; and </text></paragraph><paragraph id="H7FE300A96C67463A9D7E9A439233ECD5"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H54ABA0EFF5514F02AA567BCFF63AB44C" display-inline="no-display-inline"><subparagraph id="H2A4585F3839345AEA32D11EBA031B698"><enum>(D)</enum><text display-inline="yes-display-inline">the deployment of public transportation projects or practices that—</text><clause id="H47983059B9B94AFB822ACDD0D806554C"><enum>(i)</enum><text>achieve measurable improvements in transportation access to health care for medically underserved areas or populations, as designated by the Health Resources and Services Administration pursuant to section 330(b)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(b)(3)</external-xref>); </text></clause><clause id="H7F44B1C81831407AB59D69A3F969160C"><enum>(ii)</enum><text>implement transportation strategies for addressing significant health needs as identified by a community health needs assessment pursuant to the requirements of <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(r)(3)(A)</external-xref> of the Internal Revenue Code of 1986; or</text></clause><clause id="H2E3F7D0920DC4DB6B1E71AAD311230C7" commented="no"><enum>(iii)</enum><text>eliminate or reduce transportation barriers to accessing health care that are identified and prioritized in the coordinated public transit-human services transportation plan described in section 5310(e)(2)(A). </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HBA82D1BE73254060B0079379E1513700"><enum>6.</enum><header>Innovative mobility and technology deployment grants</header><subsection id="H266BEAA5B855453699A60758E9C1B905"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/5312">section 5312</external-xref> the following:</text><quoted-block style="USC" id="H5269DE0B13804E5094606C3CA7F2BDF9" display-inline="no-display-inline"><section id="H8A7AC7F387904114A3D1C938D64A1696"><enum>5313.</enum><header>Innovative mobility and technology deployment grants</header><subsection id="HEE9B7E6B2EBB4988A2F3B654B27F8698"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary shall establish an innovative mobility and technology deployment grants program to award grants to entities described in subsection (b) to assist in financing of public transportation projects that—</text><paragraph id="H8012754A47354E01B1590446EDDBA8E8"><enum>(1)</enum><text>allow for the integration of mobility services or technologies in public transportation services, including traveler information, trip planning information, new or expanded reservation capabilities, integrated payment solutions, fare automation, or delivery designs to improve options in public transportation;</text></paragraph><paragraph id="H49D6542B05374696A215BB6870FBD1FA"><enum>(2)</enum><text>advance first-mile, last-mile, late night, or low density services that connect riders to public transportation, including—</text><subparagraph id="H7BE527F9DF51412E990A2745B8656707"><enum>(A)</enum><text>microtransit;</text></subparagraph><subparagraph id="HCCBAC4250E454033BB1E30263AEA94DA"><enum>(B)</enum><text>commuter busing; or</text></subparagraph><subparagraph id="HC57FBCA3AD054ABF8E1F283491497FC4"><enum>(C)</enum><text>commuter highway vehicles;</text></subparagraph></paragraph><paragraph id="H69A8BB37D1464DB9968FC2A7A2EDF814"><enum>(3)</enum><text>advance on demand complementary paratransit services;</text></paragraph><paragraph id="H96DC3747B62D4CAC9E347FE9BA858E6A"><enum>(4)</enum><text>provide accessibility and connectivity for rural areas not being adequately served by public transportation, as determined by the Secretary; </text></paragraph><paragraph id="HD91629EF9FFD412B99581C9F96211EDD"><enum>(5)</enum><text>expand high-performing public transportation business models that increase access to public transportation; or</text></paragraph><paragraph id="HE75F4F4ABA0842B392E26D4171766484"><enum>(6)</enum><text>provide any other transit service that the Secretary determines appropriate to meet the purposes of this section. </text></paragraph></subsection><subsection id="HCB47E409C4A144679AC19FBBFA3D673E"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible for a grant under this section, an entity shall be—</text><paragraph id="H653AAC2A744746CF9EA634E86CF9ADB3"><enum>(1)</enum><text>a State or local government; or</text></paragraph><paragraph id="H04AFD8BB89634737B3E33C68FFE1A967"><enum>(2)</enum><text>a publicly owned operator of public transportation.</text></paragraph></subsection><subsection id="H209B6CF86F5448009F13C15D27B0F46A"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, an entity described in subsection (b) shall submit to the Secretary an application in such form and contain such information as the Secretary may require.</text></subsection><subsection id="HC3659B8279624AA2B8893E028FA714B5"><enum>(d)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">The Secretary shall—</text><paragraph id="HD9D5DD4F5D29491F85EAD0C41249123B"><enum>(1)</enum><text>issue such regulations as are necessary to carry out this section, and publish such regulations in the Federal Register, not later than 270 days after the date of enactment of this section; and</text></paragraph><paragraph id="H4242336A16AB49F09DE258DDF7F83032"><enum>(2)</enum><text>in issuing such regulations, solicit and receive comments from stakeholders not later than 180 days after the date of enactment of this section.</text></paragraph></subsection><subsection id="HB01977C72ED049FB8CAD9C3F28DA3882"><enum>(e)</enum><header>Grant requirements</header><text>The Secretary may approve modified grant requirements for projects carried out using a grant under this section.</text></subsection><subsection id="HFFC0C15A905D4D53827670431CA4A3F8"><enum>(f)</enum><header>Limitations</header><paragraph id="HABA93620A0C74F63A16FFF52B6050679"><enum>(1)</enum><header>Period of grant</header><text display-inline="yes-display-inline">A grant under this section shall be for a 3-year period beginning on the date on which the first payment of any amount under the grant is provided to an eligible entity.</text></paragraph><paragraph id="HEF56C8A80D5E498A9B5DD9301DCA2EA5"><enum>(2)</enum><header>Rural grant minimum</header><text>The Secretary shall award not less than 20 percent of the total amounts made available to carry out this section to support activities described under subsection (a) in rural areas.</text></paragraph><paragraph id="HB90A744BD1054AC592037148D1FF0B5C"><enum>(3)</enum><header>Government share of costs</header><text>The Federal share of the total project cost of a project carried out under this section may not exceed 80 percent.</text></paragraph><paragraph id="HD1A1A9DA43E545F8ACA3392FC172837B"><enum>(4)</enum><header>Allocation</header><text>Of the amounts authorized to be appropriated to carry out this section for each fiscal year, not more than 20 percent may be awarded under subsection (a) to a single entity. </text></paragraph></subsection><subsection id="HEEB65A9721D54A25AB2DDC7D598A4C8B"><enum>(g)</enum><header>Best practices</header><text>The Secretary shall annually collect from, review, and disseminate to public transportation agencies findings or best practices from projects funded under this section.</text></subsection><subsection id="H9741E5BDF13B43169584A141ACA7561E"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD463C5BBA1964507BB481C5C0F530B4F"><enum>(1)</enum><header>Commuter highway vehicle</header><text>The term <quote>commuter highway vehicle</quote> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/132">section 132(f)(5)(B)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="H17F34CF1A9104660A406C6B767E2DD28"><enum>(2)</enum><header>High-performing public transportation</header><text>The term <quote>high-performing public transportation</quote> means a public transportation service, whether provided by a public agency, private nonprofit, or for-profit organization, that is able to collect all operating costs through fare-box revenue or other dedicated sources for an activity and increases access to public transportation.</text></paragraph><paragraph id="HE8F962DC413B4BBEB26BDECAE0A2DF15"><enum>(3)</enum><header>Micro-transit</header><text display-inline="yes-display-inline">The term <quote>micro-transit</quote> means internet-enabled, public transportation services that use dynamically generated routes calculated by algorithms developed to increase the occupancy of vehicles.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0244CB97857F445EBF175EFB019F8A75"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/5312">section 5312</external-xref> the following: </text><quoted-block style="USC" id="H33194509F5C34704A23D0556BBED36BC" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">5313.
