<official-title display="yes">To prohibit consumer reporting agencies from furnishing a consumer report containing any adverse item of information about a consumer if such consumer is a victim of trafficking, and for other purposes.</official-title>

<section id="H6F5DA12C692F40F0BC5C726B90A10D5F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debt Bondage Repair Act</short-title></quote>. </text></section> <section id="H66AF46CB5F264FDBBA7E3718D6CF004D"><enum>2.</enum><header>Adverse information in cases of trafficking</header> <subsection id="H7C4DCECD47204B3899AF9F2CC1973E33"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.) is amended by inserting after section 605B the following:</text>

<section id="HD6452F4118C5436DAF617C3EAC3D5E96"><enum>605C</enum><header>Adverse information in cases of trafficking</header>
<subsection id="H2B0AB2C4E8F14EB88A14340B62762669"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A consumer reporting agency may not furnish a consumer report containing any adverse item of information about a consumer that resulted from a severe form of trafficking in persons or sex trafficking if a court of competent jurisdiction, in a lawsuit that is not a class action lawsuit, has determined that the consumer is a victim of trafficking.</text></subsection> <subsection id="HC1B62515189342CF85FD32458B354E9A"><enum>(b)</enum><header>Rulemaking</header> <paragraph id="HEB6724510CFF461D8F3271F62B50E960"><enum>(1)</enum><header>In general</header><text>The Director shall, not later than 180 days after the date of the enactment of this section, issue a rule to implement subsection (a).</text></paragraph>
<paragraph id="HBED8741DCDC1441588439F69ACDFC725"><enum>(2)</enum><header>Contents</header><text>The rule issued pursuant to paragraph (1) shall establish a method by which consumers may submit documentation to consumer reporting agencies, including—</text> <subparagraph id="H72D245A19E634DC188A2A2D8DE364D87"><enum>(A)</enum><text display-inline="yes-display-inline">documentation of a determination by a court of competent jurisdiction that such consumer is a victim of trafficking; and</text></subparagraph>
<subparagraph id="H4EE039DBE0B4489AA28090F8F989550C"><enum>(B)</enum><text>documentation that identifies items of adverse information that should not be furnished by the consumer reporting agency because the items resulted from the severe form of trafficking in persons or sex trafficking of which the consumer is a victim.</text></subparagraph></paragraph></subsection> <subsection id="H8FF3591164EB402B80E82A459D735CFB"><enum>(c)</enum><header>Victim of trafficking defined</header><text display-inline="yes-display-inline">For the purposes of this section, the term “victim of trafficking” means a person who—</text>
<paragraph id="H2739904860FA4940A251EF7DA3A1EF94"><enum>(1)</enum><text>is a victim of a severe form of trafficking in persons or sex trafficking, as such terms are defined in section 103 of the Trafficking Victims Protection Act of 2000; and</text></paragraph> <paragraph id="H517965E64902451BB0CFDE7571B820A3"><enum>(2)</enum><text>has been listed as a victim in a criminal case against a person who has been found guilty of a severe form of trafficking in persons or sex trafficking.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H6BAC63AFA8D840E1BB711EEAF5D64A42"><enum>(b)</enum><header>Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents of the Fair Credit Reporting Act is amended by inserting after the item relating to section 605B the following new item:</text> <quoted-block style="OLC" id="H3A4D75EA3E3D44679A22FD6A6B57D9D2" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">605C. Adverse information in cases of trafficking.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H4C73544D0FF646EA9EC7948EEA1F30A3"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply on the sooner of—</text>
<paragraph id="HF7A6E470DD4C4ADAADFB5EF3326DA269"><enum>(1)</enum><text>the date that is 30 days after the date on which the Director of the Bureau of Consumer Financial Protection issues a rule pursuant to section 605C(b) of the Fair Credit Reporting Act; or</text></paragraph> <paragraph id="HA9AD745FA57048D5A1DC31A576128C20"><enum>(2)</enum><text display-inline="yes-display-inline">the date that is 2 years after the date of the enactment of section 605C of the Fair Credit Reporting Act.</text></paragraph></subsection></section>
