R. 2329</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210401">April 1, 2021</action-date><action-desc><sponsor name-id="M001157">Mr. McCaul</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize appropriations to counter the malign influence of the Chinese Communist Party, and for other purposes.</official-title></form><legis-body id="H0E8351FF9A6D4B1098C809C37ED3A9AA" style="OLC"><section id="HB60397B5838045A1A247F5AAB04EE2F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Countering Chinese Communist Party Malign Influence Act</short-title></quote>.</text></section><section id="H42EFB6B9D2D74F7789A0F221BBB5A827"><enum>2.</enum><header>Authorization</header><subsection id="HF3801ACD866B4B33ADBB31B7CC738EA2"><enum>(a)</enum><header>Countering Chinese influence fund</header><text display-inline="yes-display-inline">There is authorized to be appropriated $300,000,000 for each of fiscal years 2021 through 2025 for the Countering Chinese Influence Fund to counter the malign influence of the Chinese Communist Party globally. Amounts appropriated pursuant to this authorization are authorized to remain available until expended and shall supplement, not supplant, amounts otherwise authorized to be appropriated to counter such influence.</text></subsection><subsection id="HA859E6A6AEF44B40B30E3AC415E53E17"><enum>(b)</enum><header>Consultation required</header><text display-inline="yes-display-inline">Amounts appropriated or otherwise made available to counter the malign influence of the Chinese Communist Party globally, including pursuant to the authorization under subsection (a) or before the date of the enactment of this Act, shall be subject to prior consultation with, and the regular notification procedures of—</text><paragraph id="HE559D80C3272471B9E3A4507A24760C2"><enum>(1)</enum><text>the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives; and</text></paragraph><paragraph id="HD8D140E062934183AA58359E497FF496"><enum>(2)</enum><text>the Committee on Foreign Relations and the Committee on Appropriations of the Senate.</text></paragraph></subsection><subsection id="HC2ACB29DB8FE4BE3BBC53019AE1B7CD6"><enum>(c)</enum><header>Policy Guidance, Coordination, and Approval</header><paragraph id="H48062F4E5BF7412CB9DBEF15369CE8D5"><enum>(1)</enum><header>Coordinator</header><text display-inline="yes-display-inline">The Secretary of State shall designate a senior official of the Department at the rank of Assistant Secretary or above to provide policy guidance, coordination, and approval for the obligation of funds authorized pursuant to subsection (a).</text></paragraph><paragraph id="HB2A94B4B72ED4E198B486F2ED9734EDD"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The senior official designated pursuant to paragraph (1) shall be responsible for the coordination and approval of all programming conducted using the funds authorized to be appropriated by subsection (a), based on a determination that such programming counters the malign influence and activities of the Chinese Communist Party pursuant to the strategic objectives of the United States, as established in the 2017 National Security Strategy, the 2018 National Defense Strategy, and other relevant national and regional strategies as appropriate.</text></paragraph><paragraph id="HFF50D1989A7E46E49E702451DCB54793"><enum>(3)</enum><header>Interagency coordination</header><text>The senior official designated pursuant to paragraph (1) shall, in coordinating and approving programming pursuant to paragraph (2), seek to—</text><subparagraph id="HB3D3BE2E5F7C4F8B84090FB384850BC6"><enum>(A)</enum><text>conduct appropriate interagency consultation; and</text></subparagraph><subparagraph id="HB4333C16C473428F891E176A25BDFAC1"><enum>(B)</enum><text display-inline="yes-display-inline">ensure, to the maximum extent practicable, that all approved programming functions in concert with other Federal activities to counter the malign influence and activities of the Chinese Communist Party.</text></subparagraph></paragraph><paragraph id="H8A0F1478F7AD4EE681B28397859FD52C"><enum>(4)</enum><header>Assistant coordinator</header><text display-inline="yes-display-inline">The Administrator of the United States Agency for International Development shall designate a senior official at the rank of Assistant Administrator or above to assist and consult the senior official designated pursuant to paragraph (1).</text></paragraph></subsection><subsection id="HAA3A858D8FD84E00861FF1C6E5E8272D"><enum>(d)</enum><header>Malign influence</header><text>In this section, the term <term>malign influence</term> with respect to the Chinese Communist Party should be construed to include acts conducted by the Chinese Communist Party or entities acting on its behalf that—</text><paragraph id="H9D42330F8A3549A0B4AC3516BA3F2EC6"><enum>(1)</enum><text display-inline="yes-display-inline">undermine a free and open international order;</text></paragraph><paragraph id="H08533BC84DAB41A9B0C0E46805FADC68"><enum>(2)</enum><text>advance an alternative, repressive international order that bolsters the Chinese Communist Party’s hegemonic ambitions and is characterized by coercion and dependency;</text></paragraph><paragraph id="HCF514BFBD4DC4C2A884ACA1FA558D3E3"><enum>(3)</enum><text display-inline="yes-display-inline">undermine the national security or sovereignty of the United States or other countries; or</text></paragraph><paragraph id="HC07CF0611352450196F566E79086F308"><enum>(4)</enum><text display-inline="yes-display-inline">undermine the economic security of the United States or other countries, including by promoting corruption.</text></paragraph></subsection></section></legis-body></bill>
