<official-title display="yes">To prohibit airlines and Amtrak from conditioning the provision of transportation services to any individual on such individual having been vaccinated against COVID–19, and for other purposes.</official-title>

<section id="HC57C7CFBF13F4100A1F907AE946C7D20" section-type="section-one"><enum>1.</enum><header>Certain COVID vaccination requirements prohibited</header>
<subsection id="H98CD29685E7C476B9EBE3C2ABFF523B5"><enum>(a)</enum><header>Airlines</header><text display-inline="yes-display-inline">The Secretary of Transportation, acting through the Administrator of the Federal Aviation Administration, shall prohibit air carriers (as such term is defined in section 40102(a) of title 49, United States Code) from denying an individual air transportation solely because such individual has not been vaccinated against COVID–19.</text></subsection> <subsection id="H4B3863B2AC234A29B2890375C7D3203C"><enum>(b)</enum><header>Amtrak</header><text display-inline="yes-display-inline">Amtrak may not deny an individual passenger rail transportation solely because such individual has not been vaccinated against COVID–19.</text></subsection>
<subsection id="H268CB1ACCE814F78B6F4EFFBBFC90F34"><enum>(c)</enum><header>Funding prohibitions</header><text>No Federal funds may be obligated or expended—</text> <paragraph id="HA229F198EE3C49DBAAA2FCDEE7290FC7"><enum>(1)</enum><text display-inline="yes-display-inline">to create, administer, or mandate the creation of a database of individuals who have been vaccinated against COVID–19; and</text></paragraph>
<paragraph id="HFFC1D53A252B4FD2B4F4089E0E27DFE1"><enum>(2)</enum><text display-inline="yes-display-inline">by any Federal agency (as defined in section 105 of title 5, United States Code) to develop, implement, or enforce any Federal law, rule, regulation, guidance, or policy denying any individual access to transportation or otherwise restricting or preventing any individual from traveling solely because such individual has not been vaccinated against COVID–19.</text></paragraph></subsection></section> </legis-body> </bill>
