<official-title display="yes">To direct the Secretary of Homeland Security to establish a plan to respond to irregular migration surges at the border, to establish an irregular migration surge border response fund, and for other purposes.</official-title>

<section id="H2EA23E288BBB4D778DBD2D77CDF08883" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Surge Response and Resilience Act</short-title></quote>.</text></section> <section id="HA23B7E328DF449DCB06833A4CC226DBC"><enum>2.</enum><header>Irregular migration surge border response plan and fund</header> <subsection id="HE367B0B5FB1C4CBCB21FB0E40633B105"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle C of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/231">6 U.S.C. 231</external-xref> et seq.) is amended by adding at the end the following new section: </text>

<section id="H45EF8BF3802B4753BF511C07FB10FD6C" commented="no"><enum>437.</enum><header>Irregular migration surge border response plan and fund</header>
<subsection id="H3BC376D3CAB94031BE6AB8065DD0B0F4" commented="no"><enum>(a)</enum><header>Response plan</header>
<paragraph id="HB9CFF89655C245DDAA49EF83FB8A5FDD" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in coordination with the heads of appropriate Federal agencies, shall develop a plan to respond to irregular migration surges at the border that present risks to border security (referred to in this section as the <quote>Response Plan</quote>).</text></paragraph> <paragraph id="H5A8347A032A447B2A265BD9BA0CAC3A7" commented="no"><enum>(2)</enum><header>Elements</header><text>The Response Plan shall include the following:</text>
<subparagraph id="HE205A219DA634EF996BEB05E1E9B39FB" commented="no"><enum>(A)</enum><text>The identification of—</text> <clause id="HAB69278576C144FF9ADA26CE600ED845" commented="no"><enum>(i)</enum><text>each agency, component, and office participating in the Response Plan; and </text></clause>
<clause id="HFE0478AA2D724FBAAB63FA51961514A7" commented="no"><enum>(ii)</enum><text>the role, chain of command, and responsibilities, including minimum acceptable response times, of each such entity identified pursuant to clause (i). </text></clause></subparagraph> <subparagraph id="H0EE0485641EA4417B2FDAC1C50C2F585" commented="no"><enum>(B)</enum><text>A strategy to—</text>
<clause id="H1AD7B890D18C4C5A944C909AB4961489" commented="no"><enum>(i)</enum><text>enhance security and reinforce infrastructure of the Department along the border; </text></clause> <clause id="H04D10062C06643E6867F61F5CAE5C945" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">maximize the use of Border Patrol Processing Coordinators to assist with processing individuals in the custody of the Department at the border; and </text></clause>
<clause id="HBDA96AC208FC4FDDB81A99E49C7A3BF4"><enum>(iii)</enum><text display-inline="yes-display-inline">conduct streamlined screening and processing procedures of individuals in the custody of the Department at the border without diminishing security measures or normally conducted checks during such procedures. </text></clause></subparagraph> <subparagraph id="H8628B20F35914564B4594AA8EF53A0E4" commented="no"><enum>(C)</enum><text>A process to—</text>
<clause id="H5685163FC17E40E495D78EC0F797281D" commented="no"><enum>(i)</enum><text>identify needed personnel and detail such personnel to the border;</text></clause> <clause id="HF20106507D9C4D1CA928FC286B532ACC" commented="no"><enum>(ii)</enum><text>request interagency assistance for the border; </text></clause>
<clause id="HAD172DF83023402FB6500C621399E099" commented="no"><enum>(iii)</enum><text>quickly expand temporary processing and holding capacity to respond to an irregular migration surge at the border; and</text></clause> <clause id="H45C7AFD185044A1EAC7261AD9D443CA0"><enum>(iv)</enum><text>track and keep the Secretary informed of the metrics identified in subsection (c).</text></clause></subparagraph>
<subparagraph id="H7E6BA9F286274ED39EA1E52292C1C27C" commented="no"><enum>(D)</enum><text>Policies and procedures to ensure timely communication and coordination between relevant agencies relating to—</text> <clause id="H55E6AB6EF50C4E898A48186A960A7C35" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the capacity of Department border facilities; and</text></clause>
<clause id="H3250B8F32C6B4F35921472190404B16E" commented="no"><enum>(ii)</enum><text>transferring individuals at the border in the custody of the Department within the Department or to other agencies.</text></clause></subparagraph> <subparagraph id="H0C51F8BF40D54CA1919E6AAD4A159AFE" commented="no"><enum>(E)</enum><text>A process to initiate and conduct an after-action review of the efforts of the Department in response to an irregular migration surge at the border.</text></subparagraph>
<subparagraph id="H9C83886A05A248A99DCE77994E4F544C" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">A strategy to ensure any individual at the border in the custody of the Department is not released into the United States during a public health emergency, if any such individual has a communicable disease relating to the public health emergency.</text></subparagraph> <subparagraph id="H76A9341F8AAA46A886D61751E87F21C9"><enum>(G)</enum><text display-inline="yes-display-inline">A strategy to inform and coordinate, for the purposes of public safety, any release of individuals at the border from the custody of the Department with the appropriate State, Tribal, and local governments, non-governmental organizations, and relevant transportation companies. </text></subparagraph>
<subparagraph id="HB26215844F454836A18DEDBA0D1B7BB7" commented="no"><enum>(H)</enum><text>A regularly updated intelligence driven analysis that includes—</text> <clause id="HB2FE8F612D7E4D168D662EF1F3E4A7E8" commented="no"><enum>(i)</enum><text>trends at the border with respect to demographics and group size that could contribute to overcrowding of CBP border facilities;</text></clause>
<clause id="HE0CD7CF9AF4341E8BE2E4C18C515E696" commented="no"><enum>(ii)</enum><text>migrant perceptions of United States law and policy at the border, including human smuggling organization messaging and propaganda;</text></clause> <clause id="H4011E1BBC21E40A1B98D010CB8E65DC2" commented="no"><enum>(iii)</enum><text>tactics, techniques, and procedures used by human smuggling organizations to exploit border security vulnerabilities to facilitate such smuggling activities across the border;</text></clause>
<clause id="HD07BE3A34B5244859DEF599CB2A3ED9D" commented="no"><enum>(iv)</enum><text>a consideration of historical apprehension recidivism rates and any fluctuation with respect to such rates;</text></clause> <clause id="HE663811ACD6041088E94DCA588EA7B79" commented="no"><enum>(v)</enum><text>the methods and use of technology to organize and encourage irregular migration and undermine border security; and</text></clause>
<clause id="H072FD7E82FE7409983468A3A3DD3B4D0" commented="no"><enum>(vi)</enum><text>any other information the Secretary determines appropriate.</text></clause></subparagraph></paragraph></subsection> <subsection id="H66477754F2324A8C8A4477437EDE635A" commented="no"><enum>(b)</enum><header>Department coordination</header> <paragraph id="H16948F40DE9A4BF4A263A5E4D08A2749" commented="no"><enum>(1)</enum><header>Partnerships</header><text>The Secretary shall direct the participants in the Response Plan of the Department to enter into necessary and appropriate memoranda of understanding or other appropriate agreements, to be periodically updated, to carry out the requirements of this section.</text></paragraph>
<paragraph id="H4C484565219F45D9849D00F27A1E515A" commented="no"><enum>(2)</enum><header>Ongoing intelligence analysis</header><text display-inline="yes-display-inline">The Secretary shall identify and implement the appropriate process to coordinate information sharing between the Office of Intelligence and Analysis, CBP, ICE, and any other appropriate agency in preparation for or during an irregular migration surge at the border to assess the estimated number of individuals traveling to the United States border outside of standard trade and travel routes.</text></paragraph> <paragraph id="H771AF2DE77634257BEF56A52ADF5308E" commented="no"><enum>(3)</enum><header>Communication</header><text>The Secretary shall identify the most appropriate communication structure to ensure immediate and continued success of the Response Plan.</text></paragraph></subsection>
<subsection id="H28E5141ECE9A482D81169A5E8FC080CB" commented="no"><enum>(c)</enum><header>Response Plan activation</header>
<paragraph id="HDB752F8B8B424CEAAF7B9A8CB04568BB" commented="no"><enum>(1)</enum><header>Threshold identification and activation</header><text>The Secretary shall—</text> <subparagraph id="H04C0597C7E374097B35070644DAA6969" commented="no"><enum>(A)</enum><text>identify metric thresholds required to activate the Response Plan; and</text></subparagraph>
<subparagraph id="HB9D8991341604EA8B90BA51605CF9C86" commented="no"><enum>(B)</enum><text>activate the Response Plan when such thresholds are satisfied.</text></subparagraph></paragraph> <paragraph id="H7D1985FF9C4C4DC8B66AA1E813464E0E" commented="no"><enum>(2)</enum><header>Elements</header><text>The metric thresholds to be considered by the Secretary pursuant to paragraph (1) include the following:</text>
<subparagraph id="H656AB19D72744CF3A9E6315929E3037C" commented="no"><enum>(A)</enum><text>The average amount of time an individual at the border is in the custody of CBP, disaggregated by whether such individual is a single adult, a member of a family unit, or an unaccompanied alien child.</text></subparagraph> <subparagraph id="H8A8723F8E17E431CB8C48FA72C27231C" commented="no"><enum>(B)</enum><text>The total percentage of individuals at the border in the custody of the Department with respect to capacity, disaggregated by—</text>
<clause id="HAB338B3D43504ADABD9E07266B79698C" commented="no"><enum>(i)</enum><text>field office or sector; and</text></clause> <clause id="H6388022C692F47AE9C55E81972F2DFC2" commented="no"><enum>(ii)</enum><text>whether such an individual in the custody of the Department is a single adult, a member of a family unit, or an unaccompanied alien child.</text></clause></subparagraph>
<subparagraph id="H16C58DA8CBFF4EBBAE1FB9BADAC9A4D0" commented="no"><enum>(C)</enum><text>The total percentage of individuals in the custody of a partner agency with respect to capacity, disaggregated by each facility holding such individuals.</text></subparagraph> <subparagraph id="H4D32FAAA9443429D95856192A499F8FC" commented="no"><enum>(D)</enum><text>The estimated number of individuals traveling to the United States border outside of standard trade and travel routes as determined by intelligence and other sources.</text></subparagraph>
<subparagraph id="H678E43F0711443DB82538BC61753714E" commented="no"><enum>(E)</enum><text>Any other such threshold the Secretary determines appropriate.</text></subparagraph></paragraph> <paragraph id="H161A51807E164DC5A6CD9643E1371A13" commented="no"><enum>(3)</enum><header>Notifications to Congress</header> <subparagraph id="HBEC61F89C20C4E028475F50B0513577D" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 45 days after the date of the enactment of this Act, the Secretary shall notify the appropriate congressional committees of the finalization of the metric thresholds required under paragraph (1)(A).</text></subparagraph>
<subparagraph id="H452891EB119A4E6893CCA5516CEFE8D7" commented="no"><enum>(B)</enum><header>Updating metric thresholds</header><text>Not later than 14 days after the Secretary updates such metric thresholds, the Secretary shall notify the appropriate congressional committees of such update.</text></subparagraph></paragraph></subsection> <subsection id="HDCD3415043454A0DB60602092E9B4434" commented="no"><enum>(d)</enum><header>After-Action review</header><text display-inline="yes-display-inline">The Secretary shall develop a process, including policies and procedures, to initiate and conduct an after-action review of the efforts of the Department in response to an irregular migration surge at the border that presents risks to border security. The review shall—</text>
<paragraph id="HB81E3CEF924A45B9A90FE4634D5A47EC" commented="no"><enum>(1)</enum><text>be conducted at the conclusion of such a surge in which the Response Plan has been activated by the Secretary; and</text></paragraph> <paragraph id="HB539792AD4C2400AB916EF13F9CD22E1" commented="no"><enum>(2)</enum><text>include a consideration of any necessary changes, including allocation of resources and changes in authority, law, or policy to improve the ability of the Department to respond to future irregular migration surges at the border and mititgate the risks to border security from such surges.</text></paragraph></subsection>
<subsection id="H84470DD849644DB3A7C98D5658BECDBD" commented="no"><enum>(e)</enum><header>Updating response plan</header><text>The Secretary shall—</text> <paragraph id="H16A291433BF44E0CA3136B12D1F1FBEC" commented="no"><enum>(1)</enum><text>periodically update the Response Plan and the appropriate metric thresholds to activate the Response Plan; and</text></paragraph>
<paragraph id="H7197A11C6A864C61A66EF9D1B1CF70E8" commented="no"><enum>(2)</enum><text>consider the most recent action-after review required under subsection (d) for such an update. </text></paragraph></subsection> <subsection id="H3565F6A8DBCE423EA3963CBFB235F72E" commented="no"><enum>(f)</enum><header>Briefing to Congress</header><text>If the Secretary activates the Response Plan pursuant to subsection (c)(1)(B), not later than 14 days after such activation, the Secretary shall—</text>
<paragraph id="HA06CC379D80D47979C609ADA5119FE89" commented="no"><enum>(1)</enum><text>brief the appropriate congressional committees with respect to such activation; and</text></paragraph> <paragraph id="H8A5039C42B574511BE5062EE4E195050" commented="no"><enum>(2)</enum><text>include with such briefing an assessment with respect to whether there is a need to obligate and expend amounts available from the Irregular Migration Surge Border Response Fund, established pursuant to subsection (g).</text></paragraph></subsection>
<subsection id="HA1BB8AB5A31F42309552D86DC7A9E03E" commented="no"><enum>(g)</enum><header>Irregular migration surge border response fund</header>
<paragraph id="H40104F0E5B96419282D1F929B0E5E59F" commented="no"><enum>(1)</enum><header>Creation of fund</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Irregular Migration Surge Border Response Fund</quote> (referred to in this section referred to as the <quote>Fund</quote>), consisting of amounts appropriated pursuant to the authorization of appropriations in paragraph (4).</text></paragraph> <paragraph id="H6FD4955463994AB39EEB0C7E584E6748"><enum>(2)</enum><header>Investment of amounts</header> <subparagraph id="HD0332663A3E84435A7070598A2ADB854"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall invest such portion of the Fund as is not required to meet current withdrawals in interest-bearing obligations of the United States or in obligations guaranteed as to both principal and interest by the United States.</text></subparagraph>
<subparagraph id="H0D688C87D07246359BE64536B816607E"><enum>(B)</enum><header>Interest and proceeds</header><text display-inline="yes-display-inline">The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></subparagraph></paragraph> <paragraph id="H568CD04A4BA1448A9CC94F4CE34CB3C7" commented="no"><enum>(3)</enum><header>Use of funds</header> <subparagraph id="H0CEECFAD197C4AF2A2CD38FCCB76097E" commented="no"><enum>(A)</enum><header>In general</header><text>The Secretary may only obligate and expend amounts available in the Fund—</text>
<clause id="H311B3BA65D7B4F3ABDFF12D12FB07B14" commented="no"><enum>(i)</enum><text>if the Secretary activates the Response Plan pursuant to subsection (a)(4)(A); and</text></clause> <clause id="H1C25C7FB3DB14FE2B7E27A155DE90481" commented="no"><enum>(ii)</enum><text>for the purposes described in subparagraph (B).</text></clause></subparagraph>
<subparagraph id="H530F4C50B7244A08863A56D023908D7C" commented="no"><enum>(B)</enum><header>Purposes</header><text>The purposes described in this subparagraph are the following:</text> <clause id="HF2DCCFB649EC4802B07144058E9B4499" commented="no"><enum>(i)</enum><text>Replenishing the depletion of consumables, personal protective equipment, medical supplies and equipment, transportation equipment, and personnel overtime funds.</text></clause>
<clause id="HA7E99FC046054A58A6592B754B37DA5F" commented="no"><enum>(ii)</enum><text>Expanding temporary Department processing capacity, long-term holding capacity, and transportation services for individuals at the border in the custody of the Department or partner agencies.</text></clause> <clause id="H7D647B0FD6E347D480F884C772579FBB" commented="no"><enum>(iii)</enum><text>Ensuring timely communication and transportation between the agencies of the Department, or with partner agencies, with respect to the transfer of individuals at the border in the custody of the Department.</text></clause>
<clause id="HF60B4536566E44D7BD962ED458A5B9AE" commented="no"><enum>(iv)</enum><text>Requesting interagency assistance and detailing Department personnel in order to respond to an irregular migration surge.</text></clause></subparagraph></paragraph> <paragraph id="H47E304D06D9F4BEB8BB4356C0ABA6296"><enum>(4)</enum><header>Remaining amounts</header> <subparagraph id="H43C781EF97764C8C96D879048D6AEAEE"><enum>(A)</enum><header>In general</header><text>Amounts in the Fund shall remain available until expended.</text></subparagraph>
<subparagraph id="HA34F3BE0B1954041BCB93774443CFCCD"><enum>(B)</enum><header>Exception</header><text>Amounts remaining in the Fund at the end of fiscal year 2025 shall be returned to the general fund of the Treasury. </text></subparagraph></paragraph> <paragraph id="H757789A17B5F40EAB8870841EFAAF450" commented="no"><enum>(5)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Irregular Migration Surge Border Response Fund $1,000,000,000 in fiscal year 2022 and such sums as are necessary to maintain a balance of $1,000,000,000 for each fiscal year from 2022 through 2025.</text></paragraph></subsection>
<subsection id="H6298988B6B234BDB9891D76ACDF88B4A" commented="no"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H7EF571A013564F11B12B3C319FC1B1D5" commented="no"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text>
<subparagraph id="HE7F357E729E14B1B8F0CD7006440E81A" commented="no"><enum>(A)</enum><text>the Committee on Homeland Security of the House of Representatives; and</text></subparagraph> <subparagraph id="H6A3142B9F73E4007B1E3CA737DE392D6" commented="no"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph>
<paragraph id="HD11567DCEB0B4576B6C1BE804D2FBBEA" commented="no"><enum>(2)</enum><header>Border</header><text>The term <term>border</term> means the international land borders of the United States.</text></paragraph> <paragraph id="H42521657B65745298AAD4D8434C87FC2"><enum>(3)</enum><header>CBP</header><text display-inline="yes-display-inline">The term <quote>CBP</quote> means U.S. Customs and Border Protection.</text></paragraph>
<paragraph id="HEE33AEF4DC0F4C34B297E7F92550AC03"><enum>(4)</enum><header>ICE</header><text display-inline="yes-display-inline">The term <quote>ICE</quote> means U.S. Immigration and Customs Enforcement.</text></paragraph> <paragraph id="H4ACB51B3FAC64CB683CB395D02A08866" commented="no"><enum>(5)</enum><header>Irregular migration surge</header><text>The term <term>irregular migration surge</term> means a significant increase or a sustained large number of Department encounters with individuals at the border that—</text>
<subparagraph id="H490CD2849C9F4F4B8639FD1A80C076A7" commented="no"><enum>(A)</enum><text>do not use the formal immigration system of countries they are traveling through; and</text></subparagraph> <subparagraph id="HA385C1177EB9481799F90769D76A0688" commented="no"><enum>(B)</enum><text>are traveling to, or attempting to enter, the United States illegally.</text></subparagraph></paragraph>
<paragraph id="HCC63AD869C5440AB98BFE2597AB278F0" commented="no"><enum>(6)</enum><header>Public health emergency</header><text>The term <term>public health emergency</term> means a public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HAD5810A3AAC545C5B1375F19663BF272"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 436 the following new item: </text>
