findings</header><subsection id="H8C6DE5C167174DD7A96E833C811DB1D5"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Public Service Spending Integrity Act</short-title></quote>.</text></subsection><subsection id="H90296BCB0DD740D3B772B4F03BB86B6A"><enum>(b)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="H5617527827904DE3807A6AAF524D846F"><enum>(1)</enum><text display-inline="yes-display-inline">Americans’ trust in government is essential to our democracy.</text></paragraph><paragraph id="HBB26F172EEE5490191B4B9F6EB6C632A"><enum>(2)</enum><text display-inline="yes-display-inline">Allowing public service by an elected official to seemingly converge with their own personal gain is corrosive to Americans’ faith in government.</text></paragraph><paragraph id="H29D4D10988A04A9193FE24647F3BD7D5"><enum>(3)</enum><text display-inline="yes-display-inline">Members of Congress and the executive branch have substantial power and discretion over the disbursement of public funds, and with that comes the obligation to create a barrier between public service and personal gain.</text></paragraph></subsection></section><section id="H741E60D90D87431CB41BB018E673746C"><enum>2.</enum><header>Limitation on use of Federal funds and contracting at businesses owned by certain Government officers and employees</header><subsection id="H791E4AB71FE94F1D84A21EE95CC8936D"><enum>(a)</enum><header>Limitation on Federal funds</header><text display-inline="yes-display-inline">Beginning in fiscal year 2021 and in each fiscal year thereafter, no Federal funds may be obligated or expended for purposes of procuring goods or services at any business owned or controlled by a covered individual or any family member of such an individual, unless such obligation or expenditure of funds is authorized under the Presidential Protection Assistance Act of 1976 (<external-xref legal-doc="public-law" parsable-cite="pl/94/524">Public Law 94–524</external-xref>).</text></subsection><subsection id="H4FA6AB000FA540C58EFCB55D04D3DC96"><enum>(b)</enum><header>Prohibition on contracts</header><text display-inline="yes-display-inline">No Executive agency may enter into or hold a contract with a business owned or controlled by a covered individual or any family member of such an individual.</text></subsection><subsection id="H90E590D3818F4A51AE621877BCD470CB"><enum>(c)</enum><header>Determination of ownership</header><text display-inline="yes-display-inline">For purposes of this section, a business shall be deemed to be owned or controlled by a covered individual or any family member of such an individual if the covered individual or member of family (as the case may be)—</text><paragraph id="H7ED2F73FE8BE4300B7EE9F682D5B4C0F"><enum>(1)</enum><text display-inline="yes-display-inline">is a member of the board of directors or similar governing body of the business;</text></paragraph><paragraph id="H58F1A28C6E44495792788DC036BE0595"><enum>(2)</enum><text display-inline="yes-display-inline">directly or indirectly owns or controls more than 50 percent of the voting shares of the business; or</text></paragraph><paragraph id="H587606C2312A4A4BB7B651362F4B2B9F"><enum>(3)</enum><text display-inline="yes-display-inline">is the beneficiary of a trust which owns or controls more than 50 percent of the business and can direct distributions under the terms of the trust.</text></paragraph></subsection><subsection id="H6D2EE104CCB24138B8CF408ABB2579B0"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H0C38997FF2104049810555B2EC00228E"><enum>(1)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means—</text><subparagraph id="H9441F78633D140598CDC7E737F2D4E00"><enum>(A)</enum><text>the President;</text></subparagraph><subparagraph id="HD18340A5A75A4B5FB5B1B062D2F938AE"><enum>(B)</enum><text>the Vice President;</text></subparagraph><subparagraph id="HAC5687EC4E454D10A6A3BFD2FD887A41"><enum>(C)</enum><text>the head of any Executive department (as that term is defined in section 101 of title 5, United States Code); and</text></subparagraph><subparagraph id="HCD137734029F4B729A82424251E52840"><enum>(D)</enum><text>any individual occupying a position designated by the President as a Cabinet-level position.</text></subparagraph></paragraph><paragraph id="HF768694C8C3D4C51AF8CC8AA4B0B0E00"><enum>(2)</enum><header>Family member</header><text display-inline="yes-display-inline">The term <term>family member</term> means an individual with any of the following relationships to a covered individual:</text><subparagraph id="H3846C36B329542B4BAE71297DDED3E28"><enum>(A)</enum><text display-inline="yes-display-inline">Spouse, and parents thereof.</text></subparagraph><subparagraph id="H2F449B0BB54240E2993F4DAC1F3CC702"><enum>(B)</enum><text display-inline="yes-display-inline">Sons and daughters, and spouses thereof.</text></subparagraph><subparagraph id="HBE59C73B193A46CCBCBFAB57A60741E6"><enum>(C)</enum><text display-inline="yes-display-inline">Parents, and spouses thereof.</text></subparagraph><subparagraph id="H92D99372A6C34F97A02FD187F9F7FCBE"><enum>(D)</enum><text display-inline="yes-display-inline">Brothers and sisters, and spouses thereof.</text></subparagraph><subparagraph id="H1E03B61F962D40989481BA6D09DFA454"><enum>(E)</enum><text display-inline="yes-display-inline">Grandparents and grandchildren, and spouses thereof.</text></subparagraph><subparagraph id="HF07ED222511C475999E4FFD33EAFAECE"><enum>(F)</enum><text display-inline="yes-display-inline">Domestic partner and parents thereof, including domestic partners of any individual in paragraphs (2) through (5).</text></subparagraph></paragraph><paragraph id="H4125ECBE27B347D8BA04536B93957E9C"><enum>(3)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given that term in section 105 of title 5, United States Code.</text></paragraph></subsection></section></legis-body></bill>
