<official-title display="yes">To direct the Secretary of Health and Human Services to require long-term care facilities to report certain information relating to COVID-19 cases and deaths.</official-title>

<section id="H7496A262EBCF4A6F91DE2BFD9C7BE2FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nursing Facility Quality Reporting Act of 2021</short-title></quote>.</text></section> <section id="H705F29AB117049BB9C0469029257893F"><enum>2.</enum><header>Requiring long-term care facilities to report certain information relating to COVID-19 cases and deaths</header> <subsection id="HC3D855E913E84094A851A7331C24C5B2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall, as soon as practicable, require that the information described in paragraph (1) of section 483.80(g) of title 42, Code of Federal Regulations, or a successor regulation, be reported by a facility (as defined for purposes of such section).</text></subsection>
<subsection id="H179DCE3DA1D54371BE189995F0ACDCB8"><enum>(b)</enum><header>Demographic information</header><text>The Secretary shall post the following information with respect to skilled nursing facilities (as defined in section 1819(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(a)</external-xref>)) and nursing facilities (as defined in section 1919(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(a)</external-xref>)) on the Nursing Home Compare website (as described in section 1819(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(i)</external-xref>)), or a successor website, aggregated by State:</text> <paragraph id="HE5BC084474DB4930BCE99F5B732E623C"><enum>(1)</enum><text display-inline="yes-display-inline">The age, race/ethnicity, and preferred language of the residents of such skilled nursing facilities and nursing facilities with suspected or confirmed COVID-19 infections, including residents previously treated for COVID-19.</text></paragraph>
<paragraph id="H18B40111996D485A9A92476D10B924C7"><enum>(2)</enum><text display-inline="yes-display-inline">The age, race/ethnicity, and preferred language relating to total deaths and COVID-19 deaths among residents of such skilled nursing facilities and nursing facilities.</text></paragraph></subsection> <subsection id="H7B1CAEAE129143A8A88A63BD95CBDBF7"><enum>(c)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">Any information reported under this section that is made available to the public shall be made so available in a manner that protects the identity of residents of skilled nursing facilities and nursing facilities.</text></subsection>
<subsection id="HBDA06ADD0A994C5CB804620F4B811B37"><enum>(d)</enum><header>Implementation</header><text>The Secretary may implement the provisions of this section by program instruction or otherwise. </text></subsection></section> </legis-body> </bill>
