committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that United States citizens may not be discriminated against based on their COVID–19 vaccination status, and for other purposes.</official-title></form><legis-body id="H79CB966150A84352B90BF0317C09C557" style="OLC"><section id="H8D4588091FB0451C861367CEFABEB192" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>We Will Not Comply Act</short-title></quote>.</text></section><section id="H1522DCEC945D44ADB7CD93FB6E09B96C"><enum>2.</enum><header>Interstate commerce</header><text display-inline="no-display-inline">No entity that is subject to title II of the Civil Rights Act of 1964 may discriminate against any person because such person has or has not received a COVID–19 vaccine. </text></section><section id="HB913022103F54BB1A9490CA060FFBCB3"><enum>3.</enum><header>Funding riders</header><subsection id="H15159522DE524880B1B8DEA75D7AD1A3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No Federal funds may be used to require any individual to receive a COVID–19 vaccine, or to enforce any such requirement. </text></subsection><subsection id="HD834B8BE5EC7440B93D6850E5380FBD9"><enum>(b)</enum><header>No conditions for educational institutions</header><paragraph id="H7339773D3D994D48BBFE7B4E58150F09"><enum>(1)</enum><header>In general</header><text>No Federal funds may be made available to any elementary school, secondary school, or institution of higher education if such school or institution requires an individual to receive a COVID–19 vaccine as a condition for attendance or participation in any academic or extra-curricular activity, including sports teams, athletic clubs, or any other voluntary organization.</text></paragraph><paragraph id="H8F2E5557F3D94639911CADC0174C0821"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H2ACF502198DC44118B0A44C000385BAC"><enum>(A)</enum><text>The terms <term>elementary school</term> and <term>secondary school</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></subparagraph><subparagraph id="H7911F775D64E46A69A9DE6589F856E92"><enum>(B)</enum><text>The term <term>institution of higher education</term> has the meaning given that term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="H75D5053FE6E84B2E81002F96A32E307B"><enum>(c)</enum><header>Clarification</header><text>No Federal funds may be used to compel an individual who has a religious objection to a vaccine or to vaccination to receive such vaccine or vaccination.</text></subsection></section><section id="H14B8BADD95614B87A7DD0E50D8C72DAB"><enum>4.</enum><header>Private right of action</header><text display-inline="no-display-inline">An individual who has been discriminated against on the basis of the individual’s COVID–19 vaccine status, or the individual’s failure to comply with a requirement to wear a face covering, may bring an action in the appropriate United States district court seeking damages.</text></section><section id="H90798C4195E54C67B591E8B5A933CFEB"><enum>5.</enum><header>Prohibition on Vaccine Requirements to Obtain Government Documents</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, an individual may not be required to have received a COVID–19 vaccine as a condition for obtaining a United States passport. </text></section><section id="H894DCD90A92E4C958A96B6B364C112BC"><enum>6.</enum><header>Interstate Travel Under the Privileges and Immunities Clause</header><subsection id="HBF974C2465F247CF886DB42309DAF1BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation, acting through the Administrator of the Federal Aviation Administration, shall prohibit air carriers and foreign air carriers (as such terms are defined in section 40102(a) of title 49, United States Code) from denying an individual air transportation solely because such individual has not been vaccinated against COVID–19.</text></subsection><subsection id="H7EF05B1836D54E5D9C6521C95DEF8504"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">This section does not prohibit the United States Government from requiring that aliens receive a COVID–19 vaccine before entering the United States. </text></subsection></section><section id="HEE9FEFCB3D1B4308972440076A2BE6B0"><enum>7.</enum><header>Civil rights and educational opportunities</header><subsection id="H9844832F9459404CB9E75808D208D1BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No public school or public college (as such terms are defined in section 401 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000c">42 U.S.C. 2000c</external-xref>) may deny an individual access to the school or college based on whether the individual has received a vaccine, including a vaccine for COVID–19.</text></subsection><subsection id="H65439A9C0DEA4835983F56112B4F1BD2"><enum>(b)</enum><header>Enforcement by the Attorney General</header><text display-inline="yes-display-inline">The Attorney General may enforce this section in the same manner as title IV of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000c">42 U.S.C. 2000c</external-xref> et seq.). </text></subsection></section><section id="HDBC2B48D24B5494285B2AF4BAB87DB02"><enum>8.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that Jacobson v. Massachusetts (197 U.S. 11; 1905) should be overturned. </text></section></legis-body></bill>
