which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Voter Registration Act of 1993 to require each State to ensure that each individual who provides identifying information to the State motor vehicle authority is automatically registered to vote in elections for Federal office held in the State unless the individual does not meet the eligibility requirements for registering to vote in such elections or declines to be registered to vote in such elections, and for other purposes.</official-title></form><legis-body id="H4ABD22A8BCBE4E9CB341439E81E0CBA9" style="OLC"><section id="HCB3C28BAD909487C9D0664DBCDE3C814" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Automatic Voter Registration Act</short-title></quote>.</text></section><section id="HCFE997F42AF349CD9B2B796461E48387"><enum>2.</enum><header>Automatic voter registration through State motor vehicle authorities</header><subsection id="H51D84484AAEA4C819EA8353EF931D540"><enum>(a)</enum><header>Automatic Voter Registration</header><text display-inline="yes-display-inline">Section 5 of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20504">52 U.S.C. 20504</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H6DBBBA2399E346D18319A07FFC70E4C9" style="OLC"><section id="HD12F87D6907F4CA4B1E6731C7DD2840A"><enum>5.</enum><header>Automatic voter registration through motor vehicle authority</header><subsection id="HB90DFDA385F74EA9BED8FCBCD4564147"><enum>(a)</enum><header>Transmission of Information to Election Officials</header><paragraph id="HB3BCA57B21E04C518E5C4C2277D200B7"><enum>(1)</enum><header>Transmission</header><text>Each State’s motor vehicle authority, upon receiving the identifying information described in paragraph (2) with respect to any individual who requests services from the authority, shall transmit the identifying information to the appropriate State election official.</text></paragraph><paragraph id="H3D69DD260E3F4829AE342160E46258F3"><enum>(2)</enum><header>Identifying information described</header><text>The identifying information described in this paragraph with respect to any individual is as follows:</text><subparagraph id="H018217190D0C4CD49DEB3BB0DEC39602"><enum>(A)</enum><text>The individual’s legal name.</text></subparagraph><subparagraph id="H19130872073D441CA911403785DACB47"><enum>(B)</enum><text>The individual’s age.</text></subparagraph><subparagraph id="HA0662413AB26448EA4860C7881B851B5"><enum>(C)</enum><text>The individual’s residence.</text></subparagraph><subparagraph id="H735FCDB0874F4F298CC7781D4B22AD7A"><enum>(D)</enum><text>The individual’s citizenship status.</text></subparagraph><subparagraph id="H00EA335F4CDF4A0696D65BFF53BEA6E9"><enum>(E)</enum><text>The individual’s electronic signature.</text></subparagraph></paragraph><paragraph id="H00CD3A16717D4528A242465C2EDD4532"><enum>(3)</enum><header>Restriction on use of information on citizenship status</header><text>A State may not use any identifying information regarding an individual’s citizenship status which is transmitted under this subsection for any purpose other than determining whether the individual is eligible to vote in elections for Federal office.</text></paragraph></subsection><subsection id="HBD1D660BF9AD406183D50906AC2A12C1"><enum>(b)</enum><header>Notification to Individuals</header><text>Upon receiving the identifying information with respect to an individual under subsection (a), the appropriate State election official shall issue a notification to the individual containing—</text><paragraph id="HFEDDBE0EEA4243899BD220C744EA84C7"><enum>(1)</enum><text>a statement that, unless the individual notifies the election official prior to the expiration of the 21-calendar day period which begins on the date the official issued the notification that the individual declines to be registered to vote in elections for Federal office held in the State, the individual shall be considered to have completed and submitted a voter registration application for purposes of this Act; and</text></paragraph><paragraph id="H377594D415C640C287129B1C82167BB8"><enum>(2)</enum><text>a description of the process by which the individual may decline to be registered to vote in elections for Federal office in the State.</text></paragraph></subsection><subsection id="H110291C755E048E49E3AF56706FBE947"><enum>(c)</enum><header>Automatic Registration of Eligible Individuals</header><text>Upon the expiration of the 21-calendar day period which begins on the date the appropriate State election official issues a notification to an individual under subsection (b)(1), the official shall ensure that the individual is registered to vote in elections for Federal office held in the State unless—</text><paragraph id="H6CE9DC7B612B4A45AF48110A7436BF5C"><enum>(1)</enum><text>the official determines that the individual does not meet the eligibility requirements for registering to vote in such elections;</text></paragraph><paragraph id="HD625F6A98A2343AFB4A6C6884ACC5600"><enum>(2)</enum><text>prior to the expiration of such 21-calendar day period, the individual notifies the official that the individual declines to be registered to vote in such elections; or</text></paragraph><paragraph id="H8B83544F9100408EA6F4AA66299D590A"><enum>(3)</enum><text>the individual is already registered to vote in such elections.</text></paragraph></subsection><subsection id="HE85BDFAF60714539BEDC75CEB16235EE"><enum>(d)</enum><header>Application to territories</header><text display-inline="yes-display-inline">This section shall apply with respect to the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands in the same manner as this section applies to a State.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H43027DC239A14DBBB85335356897D63C"><enum>(b)</enum><header>Conforming Amendment Relating to Timing of Registration Prior to Elections</header><text>Section 8(a)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20507">52 U.S.C. 20507(a)(1)(A)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HDD835B9FF14F401E8452D3551D282C54" style="OLC"><subparagraph id="H141D8ABD44A5488FAC5605F78ABB39D4"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of registration through a motor vehicle authority under section 5, if the identifying information with respect to the individual is transmitted by the authority to the appropriate State election official under section 5(a)(1) not later than the lesser of 30 days, or the period provided by State law, before the date of the election;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFC8C37B56A044426A2EEAEFC8E0BC822"><enum>(c)</enum><header>Other Conforming Amendment</header><text>Section 4(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20503">52 U.S.C. 20503(a)(1)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HCE84CAC6FD96414FAAF89D5F3CEEF4FC" style="OLC"><paragraph id="H3DCC36F70D264D67826AE7673DD407CB"><enum>(1)</enum><text display-inline="yes-display-inline">through the State motor vehicle authority pursuant to section 5;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2ABA603784954E00B49DCDC854DAA456"><enum>3.</enum><header>Effective date</header><subsection id="H0DE8F1DBDF6147DC98409F0C31B27094"><enum>(a)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect upon the expiration of the 180-day period which begins on the date of the enactment of this Act.</text></subsection><subsection id="H10689CB8C5A148F7857DB0D98CA76E4C"><enum>(b)</enum><header>Timing of Automatic Registration of Individuals Providing Identifying Information to Motor Vehicle Authority Prior to Effective Date</header><paragraph id="H01B769FCB76B4AD5B24CC9B8B5C3359A"><enum>(1)</enum><header>Retroactive automatic registration requirements</header><text>For purposes of section 5 of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20504">52 U.S.C. 20504</external-xref>), as amended by section 2(a), if an individual provided identifying information (as described in section 5(a)(2) of such Act) to a State motor vehicle authority at any time during the period described in paragraph (2), the authority shall transmit such information to the appropriate State election official pursuant to section 5(a)(1) of such Act not later than such effective date, unless the motor vehicle authority determines that the information is no longer valid with respect to the individual.</text></paragraph><paragraph id="H3563D02464AA410C9EAE6C9942413C8F"><enum>(2)</enum><header>Period described</header><text>The period described in this paragraph is the period which begins on the date which is 2 years prior to the date of the enactment of this Act and which ends on the effective date described in subsection (a).</text></paragraph></subsection></section></legis-body></bill>
