R. 229</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210106">January 6, 2021</action-date><action-desc><sponsor name-id="R000599">Mr. Ruiz</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to prohibit a candidate for election for Federal office from using amounts contributed to the candidate’s campaign to make payments to vendors owned or controlled by the candidate or by an immediate family member of the candidate.</official-title></form><legis-body id="HF4FC3464C2BA4FBC952399058CA838BE" style="OLC"><section id="H2DB4B0B3C00D466EAFDD10AB17185DC6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Campaign Spending Integrity Act</short-title></quote>. </text></section><section id="HD665EDE9E61448B287E3EF24070945D6"><enum>2.</enum><header>Prohibiting use of campaign funds for payments to vendors owned or controlled by candidate or immediate family member</header><subsection id="H78719CFBD83A4674BDDB098C158F2558"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 313(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H67D86D10440E4A1DB345647C042AFE3D" display-inline="no-display-inline"><paragraph id="H1C8FFFF7CDAD405DB5DF0A68DABD5B23"><enum>(3)</enum><header>Treatment of payments to vendors owned or controlled by candidate or immediate family member as conversion</header><subparagraph id="H817E3123194B47D6BF2BBE92ACFB6B02"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of paragraph (1), a contribution to an authorized committee of a candidate shall be considered to be converted to the personal use of the candidate if the contribution is used to make a payment to a vendor which is owned or controlled by the candidate or by an immediate family member of the candidate.</text></subparagraph><subparagraph id="H8AB2AAC188D6481E89D5CA0E55C15A3D"><enum>(B)</enum><header>Determination of ownership and control</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), a vendor shall be considered to be owned or controlled by a candidate or by an immediate family member of the candidate if the candidate or the immediate family member—</text><clause id="HA1556702B4704D3A8DE23CA7B42926C8"><enum>(i)</enum><text>is a member of the board of directors or similar governing body of the vendor;</text></clause><clause id="HF4C93F51AC6E443294D2C640A70FB380"><enum>(ii)</enum><text>directly or indirectly owns or controls more than 50 percent of the voting shares of the vendor; or</text></clause><clause id="H5415DC04195F40B68AC5BE6AE5FD8466"><enum>(iii)</enum><text>is the beneficiary of a trust which owns or controls more than 50 percent of the voting shares of the vendor and, under the terms of the trust, can direct distributions from the trust.</text></clause></subparagraph><subparagraph id="H6530B5684E934FD09E66170F6E1E0FD4"><enum>(C)</enum><header>Immediate family member defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>immediate family member</term> means, with respect to a candidate, any of the following:</text><clause id="H52801E0BAD1841FBAA6CF0795D33683C"><enum>(i)</enum><text>Spouse, and parents thereof.</text></clause><clause id="HBDC78DF49B1D4DCFAA0771F66BEAFA42"><enum>(ii)</enum><text>Sons and daughters, and spouses thereof.</text></clause><clause id="H8E056D8DA47544248A56F1FD814C2EFA"><enum>(iii)</enum><text>Parents, and spouses thereof.</text></clause><clause id="H4D3DB6FFBFE44ED0817A58597ADBFDDD"><enum>(iv)</enum><text>Brothers and sisters, and spouses thereof.</text></clause><clause id="HA715F75DF1E2444FB43EFF24AFEC207F"><enum>(v)</enum><text>Grandparents and grandchildren, and spouses thereof.</text></clause><clause id="H6344752D91444CA9B73F71EAA259FEC3"><enum>(vi)</enum><text display-inline="yes-display-inline">Domestic partner and parents thereof, including domestic partners of any individual in clauses (i) through (v).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC5BEC1946BD84C1E81192E140AABC62A"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to payments made on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
