which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To repeal certain impediments to the administration of the firearms laws.</official-title></form><legis-body id="HC5E9E351366D4119B45A9CD295AA1309" style="OLC"><section id="HFD84F4941BD44684B8DD005F67C7CEE6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gun Records Restoration and Preservation Act</short-title></quote>.</text></section><section id="H9ACA0EC3027C45D4AD42B8D694947C9F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text><paragraph id="HD7708B6C3693439BBFB111C82796589B"><enum>(1)</enum><text>The Tiahrt Amendments prevent the collection of valuable information, and the establishment of effective policies to prevent illegal guns from being used in crimes.</text></paragraph><paragraph id="H45C19C5F902E471FB40811EE6F5C5BE9"><enum>(2)</enum><text display-inline="yes-display-inline">The Tiahrt Amendments impede enforcement of the gun laws by requiring most background check records to be destroyed within 24 hours, and by barring the Federal Government from requiring annual inventory audits by owners of gun shops.</text></paragraph><paragraph id="HEF89EE341CB04C29BB3BC68ECA68D2E1"><enum>(3)</enum><text display-inline="yes-display-inline">A 2012 study by researchers at Johns Hopkins Bloomberg School of Public Health found that the Tiahrt Amendments dramatically increased gun trafficking to the criminal market.</text></paragraph><paragraph id="H74DEF8351522499A8F1D8F246FDB6D2B"><enum>(4)</enum><text display-inline="yes-display-inline">A 2016 study from the University of Pittsburgh Graduate School of Public Health found that in 2008, 79 percent of all guns recovered by police from crime scenes belonged to someone other than the perpetrator—30 percent had been stolen.</text></paragraph><paragraph id="HABFBFA139C5D418D86CB684E025178DE"><enum>(5)</enum><text display-inline="yes-display-inline">Every year, more than 123,000 Americans are shot.</text></paragraph><paragraph id="H845E5603BAA64B98B5DF65B593B65A9C"><enum>(6)</enum><text display-inline="yes-display-inline">2020 was one of the deadliest years on record for the United States, with an estimated 19,300 people killed in firearm homicides or non-suicide related shootings, which is a 25-percent increase over 2019.</text></paragraph><paragraph id="H8C0194F28DCE431AB60AD942ACCA0654"><enum>(7)</enum><text display-inline="yes-display-inline">In 2019, 58.9 percent of firearm homicide victims were Black and 15.9 percent of firearm homicide victims were Hispanic.</text></paragraph><paragraph id="H3C814B2C1BFE4011AFF5A837911915C5"><enum>(8)</enum><text display-inline="yes-display-inline">In 2019, the National Tracing Center at the Bureau of Alcohol, Tobacco, Firearms, and Explosives processed 450,000 trace requests on firearms from Federal, State, and local law enforcement.</text></paragraph><paragraph id="H78FA310685FE4999824FA9919A938878"><enum>(9)</enum><text>Having effective policies to prevent illegal gun trafficking makes our families and communities safer.</text></paragraph><paragraph id="H0A18D0FDA2A44BA3A75D28266C1DC2D2"><enum>(10)</enum><text>Repealing the Tiahrt Amendments would support law enforcement efforts and give the public vital information needed to craft the most effective policies against illegal guns.</text></paragraph></section><section id="H77D2EB8BF62246178BABAF38C0FCFAF5"><enum>3.</enum><header>Repeal of certain limitations on the use of database information of the Bureau of Alcohol, Tobacco, Firearms and Explosives</header><subsection id="H99D153CED983475382DC369EB3E2BE63"><enum>(a)</enum><text display-inline="yes-display-inline">The matter under the heading <quote>Bureau of Alcohol, Tobacco, Firearms and Explosives—Salaries and Expenses</quote> in title II of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 609–610) is amended by striking the 6th proviso.</text></subsection><subsection id="HEC41977EC85B4E7FAEB0A368B00222BF"><enum>(b)</enum><text display-inline="yes-display-inline">The 6th proviso under the heading <quote>Bureau of Alcohol, Tobacco, Firearms and Explosives—Salaries and Expenses</quote> in title II of division B of the Consolidated Appropriations Act, 2010 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/117">Public Law 111–117</external-xref>; 123 Stat. 3128–3129) is amended by striking <quote>beginning in fiscal year 2010 and thereafter</quote> and inserting <quote>in fiscal year 2010</quote>.</text></subsection><subsection display-inline="no-display-inline" id="H96A941679B124A25B86E9CB37FCD3A1F"><enum>(c)</enum><text display-inline="yes-display-inline">The 6th proviso under the heading <quote>Bureau of Alcohol, Tobacco, Firearms and Explosives—Salaries and Expenses</quote> in title II of division B of the Omnibus Appropriations Act, 2009 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/8">Public Law 111–8</external-xref>; 123 Stat. 574–576) is amended by striking <quote>beginning in fiscal year 2009 and thereafter</quote> and inserting <quote>in fiscal year 2009</quote>.</text></subsection><subsection id="HDA430A515ACC43DCB5FBCEF9154C3065"><enum>(d)</enum><text display-inline="yes-display-inline">The 6th proviso under the heading <quote>Bureau of Alcohol, Tobacco, Firearms and Explosives—Salaries and Expenses</quote> in title II of division B of the Consolidated Appropriations Act, 2008 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>; 121 Stat. 1903–1904) is amended by striking <quote>beginning in fiscal year 2008 and thereafter</quote> and inserting <quote>in fiscal year 2008</quote>.</text></subsection><subsection id="HAD7A921634D94370A7C35FC00EC4CC9A"><enum>(e)</enum><text display-inline="yes-display-inline">The 6th proviso under the heading <quote>Bureau of Alcohol, Tobacco, Firearms and Explosives—Salaries and Expenses</quote> in title I of the Science, State, Justice, Commerce, and Related Agencies Appropriations Act, 2006 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref>; 118 Stat. 2859–2860) is amended by striking <quote>under this or any other Act with respect to any fiscal year</quote>.</text></subsection></section><section id="H15F38F6E1B7940DCBD5D4E60D86A2ED4"><enum>4.</enum><header>Elimination of prohibition on processing of Freedom of Information Act requests about arson or explosives incidents or firearm traces</header><text display-inline="no-display-inline">Section 644 of division J of the Consolidated Appropriations Resolution, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/5/552">5 U.S.C. 552</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law 108–7</external-xref>; 117 Stat. 473) is repealed.</text></section><section display-inline="no-display-inline" id="HA13FD27F91E44B46AC12F3918C5BDE0F"><enum>5.</enum><header>Repeal of limitations on imposition of requirement that firearms dealers conduct physical check of firearms inventory</header><text display-inline="no-display-inline">The 5th proviso under the heading <quote>Bureau of Alcohol, Tobacco, Firearms and Explosives—Salaries and Expenses</quote> in title II of division B of the Consolidated and Further Continuing Appropriations Act, 2013 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/113/6">Public Law 113–6</external-xref>; 127 Stat. 248) is amended by striking <quote>and any fiscal year thereafter</quote>.</text></section><section id="H4B4FB7907A7B44E4A90BB0FF201F06E6"><enum>6.</enum><header>Elimination of prohibition on consolidation or centralization in the Department of Justice of firearms acquisition and disposition records maintained by Federal firearms licensees</header><text display-inline="no-display-inline">The matter under the heading <quote>Bureau of Alcohol, Tobacco, Firearms and Explosives—Salaries and Expenses</quote> in title II of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 609) is amended by striking the 1st proviso.</text></section><section id="H05C4A1B9D27B4BC6BB71B5CA212B165B"><enum>7.</enum><header>Repeal of requirement to destroy instant criminal background check records within 24 hours</header><text display-inline="no-display-inline">Section 511 of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 632) is amended—</text><paragraph id="HA9819F4E2E094B25901126C0D2414533"><enum>(1)</enum><text>by striking <quote>—</quote> and all that follows through <quote>(1)</quote>; and</text></paragraph><paragraph id="H06A99F3D9A4B40EB8A5A59F47AE65C1C"><enum>(2)</enum><text>by striking the semicolon and all that follows and inserting a period.</text></paragraph></section></legis-body></bill>
