which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to combat straw purchases of firearms and deter firearms trafficking.</official-title></form><legis-body id="H365385EB9CFE4F1EB48B918D4FA086FE" style="OLC"><section id="H6A16A89C4D6A4E248A9BFD9BFAF1CF05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Gun Trafficking Act</short-title></quote>.</text></section><section id="H9EEEEDCCE4D3455BB4A027FEFA261FB0"><enum>2.</enum><header>Prohibition on straw purchases of firearms; prohibition on gun trafficking</header><subsection id="H2BCB43267F0445D8A59D899DA6241A3A"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H1014E88D840644E48A65DCCD279337AE"><enum>(1)</enum><text>in section 921(a), by adding at the end the following:</text><quoted-block id="HD65C9BC8BA604B9584A7F049C189BDC1" style="OLC"><paragraph id="H659BCAD114B441769662D6F9C7BDFE83" indent="up1"><enum>(36)</enum><text>The term <term>family members</term> means spouses, domestic partners, parents and their children, including step-parents and their step-children, siblings, aunts or uncles and their nieces or nephews, or grandparents and their grandchildren.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H031E779AA9A84A55BA3F28B386EE0416"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HD522A1A5E20D4CE0A9DB95BAFB7CEB3F" style="USC"><section id="H54E4E3DCE6D446FBBF8AFE1C5F0D5BF6"><enum>932.</enum><header>Gun trafficking</header><subsection id="HE5AE24D8E9554FC9B1AAB33AD9D0F8CE"><enum>(a)</enum><text>It shall be unlawful for any person (other than a licensee under this chapter), in or otherwise affecting interstate or foreign commerce, to knowingly purchase or acquire, or attempt to purchase or acquire, a firearm from or through such a licensee for the possession of a third party.</text></subsection><subsection id="H831E75360F5C4F8890E4A8E0A0B9A608"><enum>(b)</enum><text>It shall be unlawful for any person (other than a licensee under this chapter), in or otherwise affecting interstate or foreign commerce, to solicit, hire, demand, or order another person to purchase, or attempt to purchase, any firearm for the purpose of obtaining the firearm for the person or selling or transferring the firearm to a third party.</text></subsection><subsection id="H22E1D597AADC42EC98DB0E3076E320A1"><enum>(c)</enum><text>The Attorney General shall ensure that the firearm transaction record form required to be completed in connection with a firearm transaction includes a statement outlining the penalties that may be imposed for violating subsection (a).</text></subsection><subsection id="H5616971774A0491EA5ED9B6F140BD8CA"><enum>(d)</enum><text>This section shall not apply to any firearm—</text><paragraph id="H8FA739E7D84E4AC98992A7B8E84F14AC"><enum>(1)</enum><text>that is purchased or acquired by any person, or that any person attempts to purchase or acquire, as a bona fide gift between family members; or</text></paragraph><paragraph id="H655C7D7B3094454BA07F4BFA19E29DCC"><enum>(2)</enum><text>that is purchased or acquired by an agent of a lawful business, or that an agent of a lawful business attempts to purchase or acquire, for the purpose of transferring to another agent of the business, for lawful use in the business,</text></paragraph><continuation-text continuation-text-level="subsection">if the purchaser or person acquiring the firearm has no reason to believe that the recipient of the firearm will use or intends to use the firearm in a crime or is prohibited from purchasing or possessing firearms under State or Federal law. </continuation-text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HCE7B548DB6AA4318A1B488552B5E3E37"><enum>(b)</enum><header>Forfeiture</header><text>Section 982(a)(5) of such title is amended—</text><paragraph id="H05DDCCA6F0FB4217AEC6DE9F7FF8790B"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>or</quote> at the end; and</text></paragraph><paragraph id="H2E319C9E1F044CA99846072895E57B42"><enum>(2)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block id="H6F27CE23A2FC48F2B7F1B6034673F605" style="OLC"><subparagraph id="HFE1F79B618A2468B84E2722203951843" indent="up1"><enum>(F)</enum><text>section 922(a)(1)(A) (related to unlicensed firearms sales);</text></subparagraph><subparagraph id="H41FE2057867546C1B8E0AF9C1556BBA6" indent="up1"><enum>(G)</enum><text>section 922(d) (relating to illegal gun transfers); or</text></subparagraph><subparagraph id="H3DE916D3F0114C1C88504E1BBCE6851B" indent="up1"><enum>(H)</enum><text>section 932 (relating to gun trafficking),</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAA52933762524EB7A3A8DEBCDDF11BB0"><enum>(c)</enum><header>Money laundering amendment</header><text>Section 1956(c)(7)(D) of such title is amended by striking <quote>section 924(n)</quote> and inserting <quote>section 922(a)(1)(A), 922(d), 924(n), or 932</quote>.</text></subsection><subsection id="HE9999DDB6FCE431B8F0595A30290D237"><enum>(d)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by adding at the end the following:</text><quoted-block style="USC" id="H34CA2E8322AF42588D3A8CFB79190140" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="HD522A1A5E20D4CE0A9DB95BAFB7CEB3F" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H54E4E3DCE6D446FBBF8AFE1C5F0D5BF6" level="section">932. Gun trafficking.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HD3CE3A1BCE4746488A3C443AF8E18CDE"><enum>3.</enum><header>Prohibition on disposition of firearm to person intending unlawful further disposition</header><text display-inline="no-display-inline">Section 922(d) of title 18, United States Code, is amended in the 1st sentence—</text><paragraph id="H22A27EDE5F384BB098D4532F33634C66"><enum>(1)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HFC2BD2A3928547949473E1EDDD739859"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HE32A17F5FA4D4AE9B137E37AB8D3A75E"><enum>(3)</enum><text>by inserting after and below paragraph (9) the following:</text><quoted-block id="H2EB4F2E2232142FB8039DA9B2D325CBF" style="OLC"><paragraph id="HB6A5C8DCA1444A6193A9E434A8A2DF06"><enum>(10)</enum><text>intends to sell or otherwise dispose of the firearm or ammunition in violation of a Federal law, or to sell or otherwise dispose of the firearm or ammunition to a person in another State in violation of a law of that State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H81F89DD3E45E4B988C7204F894F2B65A"><enum>4.</enum><header>Penalties</header><text display-inline="no-display-inline">Section 924(a) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block id="H2643E275AB3440FC9563F4EEB4F9DBF7" style="OLC"><paragraph id="H77FAE3BF24FD485BB65593731C9A63E1" indent="up1"><enum>(8)</enum><text>Whoever knowingly violates section 922(a)(1)(A) or 932 shall be fined under this title, imprisoned not more than 10 years, or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5E3005BAE4FA42748C8DA89A935BD779"><enum>5.</enum><header>Firearms subject to forfeiture</header><text display-inline="no-display-inline">Section 924(d) of title 18, United States Code, is amended—</text><paragraph id="H6A47EE56CF68414DBB7CC92BA394E6F4"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>or 932</quote> after <quote>section 924</quote>; and</text></paragraph><paragraph id="H4F3131DC7FBD415EB95FAA1DD0E4F37A"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="H2427C4AD6588472B8C6ACDB878E828E9"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H1E4A51A444844959BF7E0C460A94BC5C"><enum>(B)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H04AAB21C030E4DF1A6F60A0CBBE2735A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H64B02FCE51544092BE03FB33F5D7CBD8" style="OLC"><subparagraph id="H40253FADB8AF40B1AE6DB6AB093CB6E8" indent="up1"><enum>(G)</enum><text>any offense under section 932.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
