which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to require a Federal court to consider certain factors in imposing a sentence on a caretaker, and for other purposes.</official-title></form><legis-body id="H34B3F5B45B554B3E8A3572EA157677D6" style="OLC"><section id="H2A63325839064007BFB70DED7E042357" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community-Based Sentencing Alternatives for Caretakers Act of 2021</short-title></quote>. </text></section><section id="HFC592A1EA11941718815DA4F3A7683A1"><enum>2.</enum><header>Factors to be considered in imposing a sentence on a primary caretaker</header><subsection id="H6562D0332A8F4A639EF7CD995683801C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3553 of title 18, United States Code, is amended—</text><paragraph id="H89B4FC06394949EAB07393C005C7CBDA"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H950439431AAD4BC98B87A89E1EF692B8"><enum>(A)</enum><text>in paragraph (6), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H40C8E2C7A3464F118DA0661FB1B5BFF3"><enum>(B)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph><subparagraph id="H1BFFFB05D93E4AE4BA955AA535F8A1D1"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H262D909152DA4C37A594C5DBDF49384D" display-inline="no-display-inline"><paragraph id="HFFD6D63314BB4163940627054597AA8E"><enum>(8)</enum><text>a community-based alternative sentence for a defendant if—</text><subparagraph id="H5E2C606ADF9941EF8C071740821E495A"><enum>(A)</enum><text>such defendant is a caretaker; and</text></subparagraph><subparagraph id="HF3307B21155A49ADBACCC702F7E985FC"><enum>(B)</enum><text>the particular sentence to be imposed is for an offense that is not a violent offense under subsection (g). </text></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H09D5B3194DDC482B8638F08AD036EFC0"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HB48056F367DC47B091F46B6AECC7AEED" display-inline="no-display-inline"><subsection id="HF80C2800884E4906A6F8E8605BCA80F0"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section: </text><paragraph id="H66CDB4B0ADBF41D292F31483AFE03C8F"><enum>(1)</enum><header>Community-based alternative sentence</header><subparagraph id="H0F98CDBDECAF45CE960DE959D7573670"><enum>(A)</enum><header>In general</header><text>The term <term>community-based alternative sentence</term> means a sentence that may require the defendant to complete or participate in community-based programming, counseling, or other treatment or programming, as ordered by the court.</text></subparagraph><subparagraph id="H0FEED12CEB364C6A9B61BED953BEF8C9"><enum>(B)</enum><header>Types of treatment</header><text>Community-based programming, counseling, or other treatment, includes— </text><clause id="H23CB7668AB9E4DF7B27CAE265B08D871"><enum>(i)</enum><text display-inline="yes-display-inline">drug counseling, treatment, or rehabilitation programing; </text></clause><clause id="H96EA3717C59F453588DEE030114E8455"><enum>(ii)</enum><text>alcohol counseling, treatment, or rehabilitation programing;</text></clause><clause id="H63B4BD359B5546BBB997F13A808144BC"><enum>(iii)</enum><text>individual or family counseling; </text></clause><clause id="HCABC399F58084335838F3B98ED0CB1DB"><enum>(iv)</enum><text>family case management services; </text></clause><clause id="H0BBBEFF7F7CE4B968ACDBA0499210B55"><enum>(v)</enum><text>job training and job placement programing;</text></clause><clause id="H624A3A382C2B45119ACEEDB7F7FF8637"><enum>(vi)</enum><text>educational programming; or</text></clause><clause id="H27F256607C924021A9E9C7E93D164978"><enum>(vii)</enum><text>any other treatment or programming determined to be appropriate by the court. </text></clause></subparagraph></paragraph><paragraph id="H9E0AE19084E14AE78514B7D72B14A39C"><enum>(2)</enum><header>Caretaker</header><text>The term <term>caretaker</term> means an individual who has consistently assumed substantial responsibility for the housing, health, and safety of a child, parent, or other immediate family member, including an adult child or family member with a disability, of such defendant. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE22F5E100FA54FB6B03AAD0433E11F18"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date that is 90 days after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
