which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Energy Policy and Conservation Act to provide Federal financial assistance to States to implement expanded energy savings performance contracting programs, and for other purposes.</official-title></form><legis-body id="HD1E54C15EFEA4FC1A63F2B6C13E2DB7B" style="OLC"><section id="HC7B907CDA5264B508903DE00B0AF0C02" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Improving State and Local Government Access to Performance Contracting Act</short-title></quote>.</text></section><section id="HE4A53CAA56A04179BFF8BD83FFBE376C"><enum>2.</enum><header>State energy savings performance contracting program expansion</header><subsection id="H601EA84E9BD14482A06BA5B6934D5506"><enum>(a)</enum><header>Program expansion</header><paragraph id="H232A689655C8440F93B626E2426CC2DF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Part D of title III of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block id="HF88468C04E8245659AF2091DA3F29728" style="OLC"><section id="H963FD849D5004F7D8018EA7F4793073A"><enum>367.</enum><header>State energy savings performance contracting program expansion</header><subsection id="HE000A722ED2D4130B9549F0132D3FF23"><enum>(a)</enum><header>Assistance</header><text display-inline="yes-display-inline">Upon request of the Governor of any State, the Secretary shall provide, subject to the availability of funds, Federal financial assistance to such State to assist such State in the implementation, improvement, or expansion of a State energy savings performance contracting program.</text></subsection><subsection id="H427F6E15E2864123A93B6AD18E0BF1CB" commented="no"><enum>(b)</enum><header>Funding</header><paragraph id="H66F2836C8C1D441D92673520CF8B9C14" commented="no"><enum>(1)</enum><header>Supplement</header><text>Federal financial assistance provided to a State pursuant to this section shall be used to supplement, not supplant, any Federal, State, or other funds otherwise made available to such State under—</text><subparagraph id="H18AA09437E1A48CCA734C61D0EB4E1D9"><enum>(A)</enum><text>this part; or</text></subparagraph><subparagraph id="HF7B95091978F4F7FBE1F8D4491DD2D3E"><enum>(B)</enum><text>the weatherization assistance program developed and conducted under part A of title IV of the Energy Conservation and Production Act.</text></subparagraph></paragraph><paragraph id="H8A0560CD163C46B09F9EF494AC139FD4"><enum>(2)</enum><header>Availability</header><text>A State may only receive Federal financial assistance under this section if the Governor of such State submits a request for such financial assistance not later than 1 year after the date of enactment of this section. </text></paragraph><paragraph id="H3692214810EA42229EF33B278EADE148" commented="no"><enum>(3)</enum><header>Financing</header><text>To the extent practicable, a State shall implement a State energy savings performance contracting program primarily utilizing private financing, public financing, or any other sources of funds.</text></paragraph><paragraph id="H850FF3025A024CEDAC2FC7B981FC9031" commented="no"><enum>(4)</enum><header>Allocation</header><text display-inline="yes-display-inline">In providing Federal financial assistance to States under this section, the Secretary shall—</text><subparagraph id="HB41E87A8EA514E018427AC47FFEDC303"><enum>(A)</enum><text display-inline="yes-display-inline">to the extent practicable allocate funds made available for such purpose—</text><clause id="H3171C4550A404DB5B652E5B3C76F6824"><enum>(i)</enum><text>in accordance with the formula for allocating funds described in section 420.11 of title 10, Code of Federal Regulations, as in effect on January 1, 2021; and</text></clause><clause id="HC7D08032A0DF430FA1877941FC90908A"><enum>(ii)</enum><text display-inline="yes-display-inline">for a fiscal year during such fiscal year; and</text></clause></subparagraph><subparagraph id="H9B87EFBD4051499F94976D0278098ACB"><enum>(B)</enum><text>require any State that is provided financial assistance and that has not expended such funds within 5 years of receipt to return such funds for reallocation, to the extent practicable, in accordance with the formula described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="H03DB6374280740E9880F441D4DA09F1D" commented="no"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H23D106EB8EC24925A36FBFD10F471646" commented="no"><enum>(1)</enum><header>Energy savings performance contract</header><text display-inline="yes-display-inline">The term <term>energy savings performance contract</term> means a contract that provides for the performance of services for the design, acquisition, installation, testing, and, where appropriate, operation, maintenance, and repair, of an energy conservation measure, water conservation measure, resiliency-related measure, utility cost savings measure, or series of measures, at 1 or more locations. </text></paragraph><paragraph id="H2E48767EB4C94A7CA3A18FB385CF32AB" commented="no"><enum>(2)</enum><header>State energy savings performance contracting program</header><text display-inline="yes-display-inline">The term <term>State energy savings performance contracting program</term>—</text><subparagraph id="HCF2202BF45524F7FBEDCA6E0519AE0D8" commented="no"><enum>(A)</enum><text>means a State program to support the design and implementation of energy savings performance contracts, including (to the extent authorized by law) energy savings performance contracts entered into by local governments, public educational institutions, and other public, governmental, and quasi-governmental entities; and</text></subparagraph><subparagraph id="H706CB27E58AA49539C701E00C6570E44" commented="no"><enum>(B)</enum><text>may include—</text><clause id="H1A1FAB61B744467CB1D7ABB2E91E547C" commented="no"><enum>(i)</enum><text>the development and provision of model, template, or standardized contracts, guidelines, procedures, manuals, and other related documents;</text></clause><clause id="H0975A5629B354A4E858C4B1E0A8797AA" commented="no"><enum>(ii)</enum><text>a State program for pre­qual­i­fi­ca­tion and certification of energy savings performance contractors;</text></clause><clause id="H91C264BEDCDB4E6FAD8DE534B56BF685" commented="no"><enum>(iii)</enum><text>provision of technical and administrative assistance; and</text></clause><clause id="HA83EE9FD977449B98B2C91B26088A435" commented="no"><enum>(iv)</enum><text>monitoring, tracking, and reporting of energy savings performance contracts, including identifying the number and value of contracts, energy savings, water savings, and financial performance.</text></clause></subparagraph></paragraph><paragraph id="H163A3823410C49E19EAB86ECFBD43038" commented="no"><enum>(3)</enum><header>Water conservation measure</header><text display-inline="yes-display-inline">The term <term>water conservation measure</term> means a measure that improves the efficiency of water use, is life-cycle cost-effective, and involves water conservation, water recycling or reuse, more efficient treatment of wastewater or stormwater, improvements in operation or maintenance efficiencies, retrofit activities, or other related activities, not at a Federal hydroelectric facility.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H7D4D432D5C5B42EA89B345175FF034B0"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="H6DDF035992194E0B8F07CDC1BB5188D5"><enum>(A)</enum><header>State energy conservation plan inclusion</header><text>Section 362(d)(5)(A) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322(d)(5)(A)</external-xref>) is amended by inserting <quote>(including State energy savings performance contracting programs, as provided in section 367)</quote> after <quote>performance contracting programs</quote>.</text></subparagraph><subparagraph id="H9594C4FAC92A40D19019447C90A6C28A"><enum>(B)</enum><header>Table of contents amendment</header><text>The table of contents for the Energy Policy and Conservation Act is amended by adding after the item relating to section 366 the following: </text><quoted-block style="OLC" id="H40D1983D97EE49EE8C0D0BE8BD1BABC5" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 367. State energy savings performance contracting program expansion.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H152145059DF84ED6B9DD96B8251272E0"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 365(f) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6325">42 U.S.C. 6325(f)</external-xref>) is amended—</text><paragraph id="HCB64FB52479141D88E8C67CC2AACE75F" commented="no"><enum>(1)</enum><text>by striking <quote>For the purpose of carrying out this part</quote> and inserting <quote><header-in-text level="paragraph" style="OLC"><enum-in-header>(1) </enum-in-header></header-in-text>For the purpose of carrying out this part</quote>;</text></paragraph><paragraph id="H2B4BBE047D184F268791E4CD14F1776C" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>$125,000,000 for each of fiscal years 2007 through 2012</quote> and inserting <quote>$100,000,000 for each of fiscal years 2022 through 2026</quote>; and </text></paragraph><paragraph id="H571CF2DC0593498DA00BB47EFC226D32"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H44EC5CBD8BA74D7D95D4D0325EC9DC32"><paragraph id="H5869331474094D19A300065C3FB6797C"><enum>(2)</enum><text>In addition to the authorization of appropriations under paragraph (1), for the purposes of carrying out section 367, there are authorized to be appropriated $50,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HEAAB60BD86C2438E925291032F38712B"><enum>3.</enum><header>Other assistance</header><subsection id="HAE941452C8634D8FA00A962F89C207E6"><enum>(a)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">Upon request by a State energy agency, the Secretary shall provide information and technical assistance in the development and implementation of a State energy savings performance contracting program.</text></subsection><subsection id="H44E9B39ED3624851A46B6485CCE0B095"><enum>(b)</enum><header>Project facilitator certification program</header><paragraph id="H8BB788DC0A19430B81439E3DF5570E71"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, in consultation with States and the private sector, shall establish a national project facilitator certification program to expand the availability of individuals, including State and local government employees and independent private sector professionals, who are trained and certified to work on behalf of the State and local government as project facilitators who will—</text><subparagraph id="HDFB704EDE14348548A5EEE39239BBAFD"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that a project carried out under an energy savings performance contract under a State energy savings performance contracting program achieves the energy cost savings and performance requirements set forth in the contracts developed under such State energy savings performance contracting program; and</text></subparagraph><subparagraph id="H07A2B9038FD54F8586EDBDB651C0AB41"><enum>(B)</enum><text>otherwise assist with the oversight of projects described in subparagraph (A). </text></subparagraph></paragraph><paragraph id="H70EDB18AF17B4E978F1A8777C657BDBE"><enum>(2)</enum><header>Contents</header><text>In carrying out the program established pursuant to paragraph (1), the Secretary may—</text><subparagraph id="H4BE61AEE80F8404690F8BC8A0ABA5736"><enum>(A)</enum><text>train and certify individuals as project facilitators described in paragraph (1); </text></subparagraph><subparagraph id="H50188D7D6DE94D80814EB70169E1140D"><enum>(B)</enum><text>develop model criteria for the certification and training of individuals to become project facilitators described in paragraph (1); and</text></subparagraph><subparagraph id="H19AABDAD35934E60A62189C7D3B25219"><enum>(C)</enum><text>transition, over a four-year period, the training and certification activities of the Secretary with respect to a State to a non-profit entity managed by the applicable State energy agency, and funded with fees generated through the certification process. </text></subparagraph></paragraph></subsection><subsection id="HC2F3426578F24D259A80C232EA24284B"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4305AAD09D65495EBC2C03CA7EA04C50"><enum>(1)</enum><header>Energy savings performance contract and State energy savings performance contracting program</header><text>The terms <term>energy savings performance contract</term> and <term>State energy savings performance contracting program</term> have the meaning given such terms in section 367(c) of the Energy Policy and Conservation Act (as added by section 2 of this Act)).</text></paragraph><paragraph id="H705B1A059D2A41658B540FD001744BDF"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="HD431970AEC14451A9DED28B24933FEED"><enum>(3)</enum><header>State energy agency</header><text display-inline="yes-display-inline">The term <term>State energy agency</term> has the meaning given such term in section 391(10) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6371">42 U.S.C. 6371(10)</external-xref>).</text></paragraph></subsection><subsection id="H439573DF8CC244E4B5792EA1DF59C7E4"><enum>(d)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary may use amounts made available to carry out the programs and activities of the Office of Strategic Programs within the Office of Energy Efficiency and Renewable Energy of the Department of Energy to carry out this section. </text></subsection></section></legis-body></bill>
