which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to provide for a minimum annual cost-of-living increase for Social Security benefits, and for other purposes.</official-title></form><legis-body id="H6C721C9497F74E409F3DB47C38211426" style="OLC"><section id="HC315A3B664A94389BFC11E1721B4B148" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Certainty for Older Living Americans Act of 2021</short-title></quote> or the <quote><short-title>COLA Act of 2021</short-title></quote>.</text></section><section id="HFE4B60E9EEF24D34A58BE49D2AB6B689" section-type="subsequent-section"><enum>2.</enum><header>Computation of cost-of-living increases</header><subsection id="H2152B6CF2D1145DC95EEB99321A1741C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 215(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(i)</external-xref>) is amended—</text><paragraph id="HC6658902B93A434EB18B8D7D81F64D6B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by striking <quote>with respect to which the applicable increase percentage is greater than zero;</quote>; and</text></paragraph><paragraph id="HFF6CD2FF2D5E4D1B92CDDED096BD07C9"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H10F00296775141B8AE725D562F973E58"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H16E21C3D1D7740B0BAF0A0DD79D35348"><enum>(i)</enum><text>in clause (ii), in the matter following subclause (III), by striking <quote>applicable increase percentage</quote> and inserting <quote>the increase percentage determined under clause (iv) for such year</quote>; and</text></clause><clause id="H323A691BE4E340D9818AFE6C2F6CFF05"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2545F8864E8D4CDBBB83294B0F467B17" display-inline="no-display-inline"><clause id="H700832AD5AB642DAB3D8A4CB0472F1BF" indent="up3"><enum>(iv)</enum><text>The increase percentage determined under this clause for a year shall be the greater of—</text><subclause id="H6A07D69D06834C99AB416A1872233BF6"><enum>(I)</enum><text>the applicable increase percentage with respect to a cost-of-living computation quarter in such year; or</text></subclause><subclause id="H8D59E7205CF7431A91CA1A76E9C07E75"><enum>(II)</enum><text>the arithmetical mean of the increase percentages determined under this clause for each of the years in the 10-year period ending with the year before such year.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H597B54B6EF7349C4AF3C94609D12130C"><enum>(B)</enum><text>in the first sentence of subparagraph (D), by striking <quote>and the percentage thereof</quote> and inserting <quote>, the percentage thereof, and the increase percentage determined under subparagraph (A)(iv) for the following year</quote>.</text></subparagraph></paragraph></subsection><subsection id="H95B1A62195DB465CB00E7BFB172F14BC" commented="no"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to cost-of-living computation quarters ending on or after September 30, 2021.</text></subsection></section><section id="HB610DFFEBABC43F5A0D5BF50B6158CBE"><enum>3.</enum><header>Working group on use of national accounts data</header><subsection id="HEF526C604B394F9CB4AAA75CE02B1619"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Labor and the Secretary of Commerce shall establish a working group (in this section referred to as the <quote>Working Group</quote>) to provide recommendations to the Bureau of Labor Statistics on incorporating national accounts data to produce—</text><paragraph id="HD1426C236A224E839E84645F6B288FD6"><enum>(1)</enum><text>an accurate, timely, and relevant Consumer Price Index; and</text></paragraph><paragraph id="HC9F3D6AE48644784B99035E7C8B8B4D9"><enum>(2)</enum><text>up-to-date expenditure weights.</text></paragraph></subsection><subsection id="H2B6CD72E461A4D2493DD90590C19B202"><enum>(b)</enum><header>Membership</header><paragraph id="HD1C2D9CDD6EF422E8EF19D557F29C99C"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Secretary of Labor and the Secretary of Commerce shall appoint to the Working Group individuals with expertise relating to statistical and computational methods, survey research, and economic, social, and demographic measurement.</text></paragraph><paragraph id="H2CC60FE369B5429981BEDC3599AAAFC3"><enum>(2)</enum><header>Representation</header><text display-inline="yes-display-inline">In appointing representatives to the Working Group, the Secretary of Labor and the Secretary of Commerce shall consider appointing members from relevant Federal agencies and non-Federal stakeholder groups, including—</text></paragraph><paragraph id="H8C02B14C3F9741D7BD67C73791BCA9B9"><enum>(3)</enum><text display-inline="yes-display-inline">the Bureau of Labor Statistics;</text></paragraph><paragraph id="H7E06F068B505427AAB140CEB5FA23856"><enum>(4)</enum><text>the Bureau of Economic Analysis; and</text></paragraph><paragraph id="H6AA7A8F41E1B49858964919E90DC6284"><enum>(5)</enum><text>the Federal Economic Statistics Advisory Committee.</text></paragraph></subsection><subsection id="H7FD58E7E023A4940AD60B20E9F29E96D"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, the Working Group shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report that includes the findings and recommendations of the Working Group under subsection (a).</text></subsection><subsection id="HE19E4F34145B43548D81F3FC666AFF13"><enum>(d)</enum><header>Termination</header><text>The Working Group shall terminate upon submission of the report required under subsection (c).</text></subsection></section></legis-body></bill>
