<section id="H3D503575E54F43AFB55F7F6685910F2B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Punitive, Unfair, School-based Harm that is Overt and Unresponsive to Trauma Act of 2021</short-title></quote> or the <quote><short-title>Ending PUSHOUT Act of 2021</short-title></quote>.</text></section> <section id="H0E7468B0A0024D23984E51ED7976BECC"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this Act to—</text>
<paragraph id="H84458E2EA24F4CF282C99C24D7167E8D"><enum>(1)</enum><text display-inline="yes-display-inline">strengthen data collection related to exclusionary discipline practices in schools and the discriminatory application of such practices, which disproportionately impacts students of color, particularly girls of color;</text></paragraph> <paragraph id="HA6D2133ED33744A4AB69D0202E3DB4AD"><enum>(2)</enum><text display-inline="yes-display-inline">eliminate the discriminatory use and overuse of exclusionary discipline practices based on actual or perceived race, ethnicity, color, national origin, sex (including sexual orientation, gender identity, pregnancy, childbirth, a medical condition related to pregnancy or childbirth, or other stereotype related to sex), or disability; and</text></paragraph>
<paragraph id="H349414A7B5D14778B3795B42AD3900B6"><enum>(3)</enum><text display-inline="yes-display-inline">prevent the criminalization and pushout of students from school, especially Black and brown girls, as a result of educational barriers that include discrimination, adultification, punitive discipline policies and practices, and a failure to recognize and support students with mental health needs or experiencing trauma.</text></paragraph></section> <section id="H590A6DB025AF4E2B8F44AEB5343CB18C"><enum>3.</enum><header>Strengthening civil rights data collection with respect to exclusionary discipline in schools</header> <subsection id="H5BA74850B92F44D5B3B4C28557EB8CEB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary for Civil Rights shall annually carry out data collection authorized under section 203(c)(1) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3413">20 U.S.C. 3413(c)(1)</external-xref>), which shall include data with respect to students enrolled in a public preschool, elementary, or secondary school (including traditional public, charter, virtual, special education school, and alternative schools) who received the following disciplinary actions during the preceding school year:</text>
<paragraph id="HF884740080164A7DAD91925BE3897A07"><enum>(1)</enum><text display-inline="yes-display-inline">Suspension (including the classification of the suspension as in-school suspension or out-of-school suspension), which shall include data with respect to—</text> <subparagraph id="H080E06FB2B0F4692A7781E8BEDE4EBAB"><enum>(A)</enum><text display-inline="yes-display-inline">the number of students who were suspended;</text></subparagraph>
<subparagraph id="HC65D30AF1B1545F38EF4C5D219926A65"><enum>(B)</enum><text>the number and length of suspensions each such student received;</text></subparagraph> <subparagraph id="H28E68534504F4502974B05AA93364922"><enum>(C)</enum><text>the reason for each such suspension, including—</text>
<clause id="H9617B8F5221E49ACBE953000B8A154C2"><enum>(i)</enum><text display-inline="yes-display-inline">a violation of a zero-tolerance policy and whether such violation was due to a violent or nonviolent offense;</text></clause> <clause id="H22C0A743849B43CB83CC4A8CFA74E81A"><enum>(ii)</enum><text>a violation of an appearance or grooming policy;</text></clause>
<clause id="HB428B8B2A9D5402D89709074C5112421"><enum>(iii)</enum><text>an act of insubordination;</text></clause> <clause id="H20053B5D6DA742389EC2A131FECEDF0C"><enum>(iv)</enum><text>willful defiance; and</text></clause>
<clause id="HD1F9F81CB7214D108D29AB937F44B472"><enum>(v)</enum><text>a violation of a school code of conduct; and</text></clause></subparagraph> <subparagraph id="H65E4FCF8589544DFBC211CA6799E1298"><enum>(D)</enum><text display-inline="yes-display-inline">the number of days of lost instruction due to each out-of-school suspension.</text></subparagraph></paragraph>
<paragraph id="HB2CBCB8479AD4D8F8BA88D7DF34E365E"><enum>(2)</enum><text display-inline="yes-display-inline">Expulsion, which shall include data with respect to—</text> <subparagraph id="HE58BC0268A0F42E19BC58433D63D9CF4"><enum>(A)</enum><text display-inline="yes-display-inline">the number of students who were expelled; and</text></subparagraph>
<subparagraph id="H0DB857E091054F01AD96D839C8FB9432"><enum>(B)</enum><text>the reason for each such expulsion, including—</text> <clause id="H74031B6814464E86AD63747270D52005"><enum>(i)</enum><text display-inline="yes-display-inline">a violation of a zero-tolerance policy and whether such violation was due to a violent or nonviolent offense;</text></clause>
<clause id="H435B0B8E8DF2488A9E7082D498E4293B"><enum>(ii)</enum><text>a violation of an appearance or grooming policy;</text></clause> <clause id="H22EB5BE787E841AA9652BD4415727E90"><enum>(iii)</enum><text display-inline="yes-display-inline">an act of insubordination, willful defiance, or violation of a school code of conduct; and</text></clause>
<clause id="H87EB293B83664E868AA15F8F43111B4F"><enum>(iv)</enum><text>the use of profane or vulgar language.</text></clause></subparagraph></paragraph> <paragraph commented="no" id="HB30EFF89ECD84013AB427F9C77780F0C"><enum>(3)</enum><text display-inline="yes-display-inline">The number of students subject to an out-of-school transfer to a different school, including a virtual school, and if so, the primary reason for each such transfer.</text></paragraph>
<paragraph commented="no" id="H6550687D5C29403C97154202362F8D38"><enum>(4)</enum><text display-inline="yes-display-inline">The number of students subject to a referral to law enforcement, including the primary reason for each such referral, and whether such referral resulted in an arrest.</text></paragraph></subsection> <subsection id="H8BA1A6AFDF3749919A109318C80550B7"><enum>(b)</enum><header>Report</header> <paragraph id="H3202E819A6C3454EA02FB53445E03B79"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the Assistant Secretary for Civil Rights shall submit to Congress a report on the data collected under subsection (a).</text></paragraph>
<paragraph id="HE39F3D7D459542A8A0FAB1804C1F6239"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall—</text> <subparagraph id="HCC039D66C12346C986D2E1967BBCE209"><enum>(A)</enum><text display-inline="yes-display-inline">identify, with respect to the data collected under subsection (a), schools, local educational agencies, and States that demonstrate, in the opinion of the Secretary, the overuse and discriminatory use of exclusionary disciplinary practices;</text></subparagraph>
<subparagraph id="H56486207C2B3437CB0FC3C4CDAD13FF6"><enum>(B)</enum><text>be disaggregated and cross tabulated by—</text> <clause id="H7A1BA3F2BF5B47AE819D728CB9BC63E1"><enum>(i)</enum><text display-inline="yes-display-inline">enrollment in a preschool or in an elementary school and secondary school by grade level;</text></clause>
<clause id="HAE6D99C3099B4245B4FD19E50EAD0368"><enum>(ii)</enum><text>race;</text></clause> <clause id="H1B06897F8FAE491988BF972C71E0F863"><enum>(iii)</enum><text>ethnicity;</text></clause>
<clause id="H68477ECE80F244B990BBE6203E64AF90"><enum>(iv)</enum><text display-inline="yes-display-inline">sex (including, to the extent possible, sexual orientation and gender identity);</text></clause> <clause id="H82B0125805674FC8BBA304E4742F736C"><enum>(v)</enum><text>low-income status;</text></clause>
<clause id="HB9DA98FF7639477C8934C76393FBC0DF"><enum>(vi)</enum><text display-inline="yes-display-inline">disability status (including students eligible for disability under the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref> et. seq.) or section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>));</text></clause> <clause id="H6C373F9ACF624AF88C487F5CE3EAA796"><enum>(vii)</enum><text>English learner status;</text></clause>
<clause id="HB516EB3E4F4F42DDA7A2F968A7B3945A"><enum>(viii)</enum><text display-inline="yes-display-inline">Tribal citizenship or descent, in the first or second degree, of an Indian Tribe; and</text></clause> <clause id="HF045BC69042F4F8F8377F94D58C93529"><enum>(ix)</enum><text display-inline="yes-display-inline">if applicable, pregnant and parenting student status;</text></clause></subparagraph>
<subparagraph id="HA476D974D77945649C4CE4ED4166277D"><enum>(C)</enum><text display-inline="yes-display-inline">be publicly accessible in multiple languages, accessibility formats, and provided in a language that parents, family, and community members can understand; and</text></subparagraph> <subparagraph id="H854F9C55C8524D7D9E8785D0F3B900AC"><enum>(D)</enum><text display-inline="yes-display-inline">be presented in a manner that protects the privacy of individuals consistent with the requirements of section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>), commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>.</text></subparagraph></paragraph></subsection></section>
<section id="H40E604321E3F4DA1A8A1B993B0667CEF"><enum>4.</enum><header>Grants to reduce exclusionary school discipline practices</header>
<subsection id="HD763F31E80E549DEB2E7A4296E8BA097"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall award grants (which shall be known as the <quote>Healing School Climate Grants</quote>), on a competitive basis, to eligible entities for the purpose of reducing the overuse and discriminatory use of exclusionary discipline practices in schools.</text></subsection> <subsection id="HF79187EE72E74127968C68B2BA9D0946"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including an assurance that the eligible entity shall prioritize schools with the highest rates of suspensions and expulsions. The Secretary shall make applications publicly accessible in an appropriate digital format. </text></subsection>
<subsection id="H25FFCE1DDACF46708AC1FA982ECEA5CC"><enum>(c)</enum><header>Program requirement</header><text>An eligible entity that receives a grant under subsection (a) shall prohibit the use of—</text> <paragraph id="H35E96B08D4B840418E6F6690D2D00BAF"><enum>(1)</enum><text display-inline="yes-display-inline">out-of-school suspension or expulsion for any student in preschool through grade 5 for incidents that do not involve serious bodily injury;</text></paragraph>
<paragraph id="H3BFB8D0CDA934349A5EAB7158D32F8D0"><enum>(2)</enum><text display-inline="yes-display-inline">out-of-school suspension or expulsion for any student in preschool through grade 12 for insubordination, willful defiance, vulgarity, truancy, tardiness, chronic absenteeism, or as a result of a violation of a grooming or appearance policy;</text></paragraph> <paragraph id="H9BFAC71AD8884CFA910545B12A038ABB"><enum>(3)</enum><text>corporal punishment;</text></paragraph>
<paragraph id="HF2F683B605C44835A82464139637C7F0"><enum>(4)</enum><text>seclusion;</text></paragraph> <paragraph id="H94A4B1F053F747BC9FE66F4B4D0F807D"><enum>(5)</enum><text>a mechanical or chemical restraint on a student; or</text></paragraph>
<paragraph id="H8AF64C8BBF1C43E18C6E0355E723B4AF"><enum>(6)</enum><text display-inline="yes-display-inline">a physical restraint on a student, except when—</text> <subparagraph id="H281803C70E0141BB8FFB0F8B77453CBC"><enum>(A)</enum><text>the behavior of a student poses a high risk of serious bodily injury to the student or another individual and less restrictive interventions would be ineffective in addressing such a high risk;</text></subparagraph>
<subparagraph id="H5F9B40B940854DDB92B3CB5735A23B87" display-inline="no-display-inline"><enum>(B)</enum><text>a limited amount of force is used to protect the student or another individual from an injury and such ends immediately upon the cessation of the imminent danger of serious bodily injury to the student or another individual;</text></subparagraph> <subparagraph id="H248F911DF6714B02A43CD1B94D8F0749"><enum>(C)</enum><text>the physical restraint does not restrict breathing or the flow of blood to the brain, including restraining in the prone or supine position;</text></subparagraph>
<subparagraph id="HA2C15C176679405DBFC58D50DD64FD87"><enum>(D)</enum><text>the physical restraint does not interfere with the ability of a student to communicate in the language or other mode of communication primarily used by such student;</text></subparagraph> <subparagraph id="H9D94F075213F455099EA7B4ACF2D86A8"><enum>(E)</enum><text>the physical restraint is imposed—</text>
<clause id="HF0F927D7BDD44BB297212DB7F297F229"><enum>(i)</enum><text>by personnel who are trained and certified by a State in crisis intervention; or</text></clause> <clause id="H3BD902FB4AFC4801B732E0A4CE69FC7E"><enum>(ii)</enum><text>when personnel described in clause (i) are not available, in the case of a rare and unforeseeable emergency; or</text></clause></subparagraph>
<subparagraph id="H84CC6AEF7A7D4F6F8D208CC077876A1F"><enum>(F)</enum><text>the physical restraint does not affect or interfere with, with respect to a student, a disability, health care needs, or a medical or psychiatric condition documented in a—</text> <clause id="H0CC579BD7FEE4FBFB1CB914C24F29F67"><enum>(i)</enum><text>health care directive or medical management plan;</text></clause>
<clause id="H122816FAEAAE4A75ABC0D319B7C5CBD3"><enum>(ii)</enum><text>a behavior intervention plan;</text></clause> <clause id="HA298DF7CFE06431CAC30A69E80A9B52D"><enum>(iii)</enum><text>an individualized education program or an individualized family service plan (as defined in section 602 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>)); or</text></clause>
<clause id="H8EE7EE1A2AD64E9A967F4B7F9E8986C8"><enum>(iv)</enum><text>another relevant record made available to the State or eligible entity involved.</text></clause></subparagraph></paragraph></subsection> <subsection id="HBD01878BAF0143F186E770131BB7F99C"><enum>(d)</enum><header>Use of funds</header> <paragraph id="H9E1D9AAC9DFB49798714490CE9FF06C7"><enum>(1)</enum><header>Required uses</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use funds to—</text>
<subparagraph id="HEFCCCD4BE3E64A2FADF088DA565BC1D2"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate the current discipline policies of a school and, in partnership with students (including girls of color), the family members of students, and the local community of such school, develop discipline policies for such school to ensure that such policies are not exclusionary or discriminately applied toward students;</text></subparagraph> <subparagraph id="H1087CED76080459CA2B6F0CD2CF614FF"><enum>(B)</enum><text display-inline="yes-display-inline">provide training and professional development for teachers, principals, school leaders, and other school personnel to avoid or address the overuse and discriminatory disproportionate use of exclusionary discipline practices in schools and to create awareness of implicit and explicit bias and use culturally affirming practices, including training in—</text>
<clause display-inline="no-display-inline" id="H7A14C992D5BD43DE883168C160CB0F35"><enum>(i)</enum><text display-inline="yes-display-inline">identifying and providing support to students who may have experienced or are at risk of experiencing trauma or have other mental health needs;</text></clause> <clause id="HFC88B7D44C784C2CB5669E7D9622B188"><enum>(ii)</enum><text display-inline="yes-display-inline">administering and responding to assessments on adverse childhood experiences;</text></clause>
<clause id="H008385B4EC584DEE9A08AE97AFB3E43A"><enum>(iii)</enum><text display-inline="yes-display-inline">providing student-centered, trauma-informed positive behavior management intervention and support that creates safe and supportive school climates;</text></clause> <clause id="H92DD8BA0C138446FA876B208822F6B2A"><enum>(iv)</enum><text display-inline="yes-display-inline">using restorative practices;</text></clause>
<clause id="HE33F9935363849B48F643F632B47580F"><enum>(v)</enum><text>using culturally and linguistically responsive intervention strategies;</text></clause> <clause id="HD819605E50074940818BB439213E5BA8"><enum>(vi)</enum><text display-inline="yes-display-inline">developing social and emotional learning competencies; and</text></clause>
<clause id="HDC56367632BD45E7926D8722226874E6"><enum>(vii)</enum><text display-inline="yes-display-inline">increasing student engagement and improving dialogue between students and teachers;</text></clause></subparagraph> <subparagraph id="HEE463CC6A68A4204941728B6D1EB09A5"><enum>(C)</enum><text display-inline="yes-display-inline">implement evidence-based alternatives to suspension or expulsion, including—</text>
<clause id="H34D16F396D704110A714F0E4D6512949"><enum>(i)</enum><text display-inline="yes-display-inline">multi-tier systems of support, such as schoolwide positive behavioral interventions and supports;</text></clause> <clause id="H7D93459408D645E2A2D24466E0842F90"><enum>(ii)</enum><text display-inline="yes-display-inline">social, emotional, and academic learning strategies designed to engage students and avoid escalating conflicts; and</text></clause>
<clause id="HB9AC282C667F4902BD11CDA955B352E0"><enum>(iii)</enum><text display-inline="yes-display-inline">other data-driven approaches to improving school environments;</text></clause></subparagraph> <subparagraph id="HAEE10C3E9AE742448050B143A47F6ED9"><enum>(D)</enum><text display-inline="yes-display-inline">improve behavioral and academic outcomes for students by creating a safe and supportive learning environment and school climate, which may include—</text>
<clause id="HF93A8825BA58467587BE77ACBD5B6CD0"><enum>(i)</enum><text>restorative practices with respect to improving relationships among students, school officials, and members of the local community, which may include partnering with local mental health agencies or nonprofit organizations;</text></clause> <clause id="H9960B843ADB24EA3B280724DCD642E4C"><enum>(ii)</enum><text display-inline="yes-display-inline">access to mentors and peer-based support programs;</text></clause>
<clause id="H935716789D604965AF8E862B0002EA8B"><enum>(iii)</enum><text display-inline="yes-display-inline">extracurricular programs, including sports and art programs;</text></clause> <clause id="HB411226E8E6B4667A65D1AF1B4C2562A"><enum>(iv)</enum><text display-inline="yes-display-inline">social and emotional learning strategies designed to engage students and avoid escalating conflicts;</text></clause>
<clause id="H5C3AE0A567054FBDB7199AD55924D135"><enum>(v)</enum><text>access to counseling, mental health programs, and trauma-informed care programs, including suicide prevention programs; and</text></clause> <clause id="HF0D099E8841F408698C7CD62BAA5BE60"><enum>(vi)</enum><text display-inline="yes-display-inline">access to culturally responsive curricula that affirms the history and contributions of traditionally marginalized people and communities;</text></clause></subparagraph>
<subparagraph id="H2CB225807F28402E8C0952521DACFB6A"><enum>(E)</enum><text display-inline="yes-display-inline">hire social workers, school counselors, trauma-informed care personnel, and other mental health personnel; and</text></subparagraph> <subparagraph id="HA149B84F1FF744DA816454B12DA561DE"><enum>(F)</enum><text display-inline="yes-display-inline">support the development, delivery, and analysis of school climate surveys.</text></subparagraph></paragraph>
<paragraph id="H6A9DBB481C5D4A3287EB318DED066548"><enum>(2)</enum><header>Prohibited uses</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section may not use funds to—</text> <subparagraph display-inline="no-display-inline" id="H448271D47D1D464BB1AF997814FCB9F0"><enum>(A)</enum><text>hire or retain school-based law enforcement personnel, including school resource officers;</text></subparagraph>
<subparagraph id="H809A481848D54120B933638948B18E1D"><enum>(B)</enum><text display-inline="yes-display-inline">purchase, maintain, or install surveillance equipment, including metal detectors or software programs that monitor or mine the social media use or technology use of students;</text></subparagraph> <subparagraph id="H92EEC15B69204618A3A2E0CCA3773690"><enum>(C)</enum><text display-inline="yes-display-inline">arm teachers, principals, school leaders, or other school personnel; and</text></subparagraph>
<subparagraph id="H5AAE018093694037B0975D56CBB344D1"><enum>(D)</enum><text display-inline="yes-display-inline">enter into formal or informal partnerships or data and information sharing agreements with—</text> <clause id="HE0A4F38DA8D044E7AEE025A1B31D2274"><enum>(i)</enum><text>the Secretary of Homeland Security, including agreements with U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection; or</text></clause>
<clause id="HB74DD6F5899D4A3F995938266A410C47"><enum>(ii)</enum><text display-inline="yes-display-inline">local law enforcement agencies, including partnerships that allow for hiring of school-based law enforcement.</text></clause></subparagraph></paragraph></subsection> <subsection id="H071BB02AD5C34DBE84196FB1C610E6F9"><enum>(e)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary, in carrying out subsection (a), may reserve not more than 2 percent of funds to provide technical assistance to eligible entities, which may include—</text>
<paragraph id="HBEC104254BD24E0294A8434F412DFE5D"><enum>(1)</enum><text>support for data collection, compliance, and analysis of the activities of the program authorized under subsection (a); and</text></paragraph> <paragraph id="H0E9A7C596119493B80BC2431E1C5B1DC"><enum>(2)</enum><text display-inline="yes-display-inline">informational meetings and seminars with respect to the application process under subsection (b).</text></paragraph></subsection>
<subsection id="H7729C21C74644A719ACA9B4814A809E2"><enum>(f)</enum><header>Report by grantees</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this section, an eligible entity receiving a grant under this section shall submit to the Secretary a report on the activities funded through the grant. The Secretary shall make each such report publicly accessible in an appropriate digital format. Such report shall include, at a minimum, a description of—</text> <paragraph id="H67A50FB3F1144B9F81710C0022951067"><enum>(1)</enum><text display-inline="yes-display-inline">the evaluation methods of disciplinary practices prior to the grant;</text></paragraph>
<paragraph id="H872AF4B576844EC39DE7BAB152292FF0"><enum>(2)</enum><text display-inline="yes-display-inline">training and professional development services provided for school personnel to address discriminatory discipline practices, implicit and explicit bias, and other uses described in subsection (d)(1);</text></paragraph> <paragraph id="H648EAB6E87014E7DB3A7E37FAB5D1700"><enum>(3)</enum><text display-inline="yes-display-inline">aggregated and de-identified behavioral, social emotional, and academic outcomes experience by students; </text></paragraph>
<paragraph id="H09C1F7064A174CDBB51E943B8FCEB017"><enum>(4)</enum><text>any instance of physical restraint used on a student with an explanation of a circumstance described in subsection (c)(6);</text></paragraph> <paragraph id="HBF91744DE10C4195A0CDAFC2C454B2A6"><enum>(5)</enum><text display-inline="yes-display-inline">the number of students who were referred to some form of alternative practice described in subsection (d)(1)(C);</text></paragraph>
<paragraph id="HFC96C1CC034B4895A51277DB0CE419B6"><enum>(6)</enum><text display-inline="yes-display-inline">disaggregated data on students suspended, expelled, and referred to the juvenile or criminal legal system, cross tabulated by—</text> <subparagraph id="HC9C73D96DB214B7A95FE8005807FF066"><enum>(A)</enum><text>reason for disciplinary action;</text></subparagraph>
<subparagraph id="H91816EE33CAF481589E9E4174EEA26FB"><enum>(B)</enum><text>grade level;</text></subparagraph> <subparagraph id="H2FA5A2F9FB8B44A7829DCC115C03B328"><enum>(C)</enum><text>race;</text></subparagraph>
<subparagraph id="H84F31BCF484F44BCB278B1E567BB29EC"><enum>(D)</enum><text display-inline="yes-display-inline">ethnicity;</text></subparagraph> <subparagraph id="H887F0A1307E142E28E8D6076F603C9AE"><enum>(E)</enum><text>sex (including to the extent possible, sexual orientation and gender identity); </text></subparagraph>
<subparagraph id="H8163874D4B7540558936D83BDD87EF9F"><enum>(F)</enum><text>low-income status; </text></subparagraph> <subparagraph id="HBE7C8357081A42E2B0DE2A3204E9DCC9"><enum>(G)</enum><text>disability status; </text></subparagraph>
<subparagraph id="HAF20D1C35BB747BF977F33C138D942A4"><enum>(H)</enum><text>English learner status; </text></subparagraph> <subparagraph id="H3F50F61714EB4B1CB6B20989784B67D5"><enum>(I)</enum><text>Tribal citizenship or descent, in the first or second degree, of an Indian Tribe; and </text></subparagraph>
<subparagraph id="HCBF749122E1D42D68681870F93477564"><enum>(J)</enum><text>if applicable, pregnant and parenting student status; and</text></subparagraph></paragraph> <paragraph id="H239AF9B6D60345A0A0A6150B3FC05731"><enum>(7)</enum><text>any other information required by the Secretary.</text></paragraph></subsection>
<subsection id="HE6B80E4551C1490FBD7FA0C0128ED34B"><enum>(g)</enum><header>Eligible entities</header><text>In this section, the term <term>eligible entity</term> means—</text> <paragraph id="HCEE7E8088CF24FBB93EFE0D694C1CB2C"><enum>(1)</enum><text display-inline="yes-display-inline">one or more local educational agencies (who may be partnered with a State educational agency), including a public charter school that is a local educational agency under State law or local educational agency operated by the Bureau of Indian Education; or</text></paragraph>
<paragraph id="H1D668C704DD44C39915DBB46362BF858"><enum>(2)</enum><text display-inline="yes-display-inline">a nonprofit organization (defined as an organization described in section 501(c)(3) of the Internal Revenue Code, which is exempt from taxation under section 501(a) of such Code) with a track record of success in improving school climates and supporting students.</text></paragraph></subsection></section> <section id="H097B8E47328D403CBCA0D02C43F7D3D1"><enum>5.</enum><header>Joint task force to end school pushout of girls of color</header> <subsection id="HDC3AB8D8DAB246318A8CFF7AD370E870"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary and the Secretary of Health and Human Services shall establish and operate a joint task force to end school pushout (in this section referred to as the <quote>Joint Task Force</quote>).</text></subsection>
<subsection id="HFFBF74490E4545F1B271D7F177B94ED0"><enum>(b)</enum><header>Composition</header>
<paragraph id="H3B49AE52132A47CB8C84C017AFF5F90B"><enum>(1)</enum><header>Chairs</header><text>The Secretary and the Secretary of Health and Human Services shall chair the Joint Task Force.</text></paragraph> <paragraph id="HE6F2FFD8E1DB4F5B815BA8576EE12ACD"><enum>(2)</enum><header>Members</header><text>The Joint Task Force shall be composed of—</text>
<subparagraph id="H8A5A15BD95104100BEE80936B3358885"><enum>(A)</enum><text>Native American girls;</text></subparagraph> <subparagraph id="H5A73B0F753284D4A918D298D271A2FA9"><enum>(B)</enum><text>students, including Black and brown girls;</text></subparagraph>
<subparagraph id="H4F8782B9F0A442AB9ECAB35CBDB2E7D0"><enum>(C)</enum><text>teachers;</text></subparagraph> <subparagraph id="H7D356E6E8EC14A04B656A8D05EF2E62C"><enum>(D)</enum><text>parents with children in school;</text></subparagraph>
<subparagraph id="HCD3C05FBB05E45D8BA47B047CDB05B52"><enum>(E)</enum><text display-inline="yes-display-inline">school officials;</text></subparagraph> <subparagraph display-inline="no-display-inline" id="HB65C24C6D80E40D18A03E1BE132A78B3"><enum>(F)</enum><text>representatives from civil rights and disability organizations;</text></subparagraph>
<subparagraph id="H66059D185A514F7891B4EA34E0E6DB27"><enum>(G)</enum><text>psychologists, social workers, trauma-informed personnel, and other mental health professionals; and</text></subparagraph> <subparagraph id="H66337F99FDEB47FDA8E9F90E55907A09"><enum>(H)</enum><text display-inline="yes-display-inline">researchers with experience in behavioral intervention.</text></subparagraph></paragraph>
<paragraph id="HB86C89CA0FDB4FB58C1BA0EB48D5C8F5"><enum>(3)</enum><header>Advisory members</header><text display-inline="yes-display-inline">In addition to the members under paragraph (2), the Assistant Attorney General of the Civil Rights Division of the Department of Justice and the Director of the Bureau of Indian Education shall be advisory members of the Joint Task Force.</text></paragraph> <paragraph commented="no" id="HF97604CA63534C75ADABD5D3B585B0A0"><enum>(4)</enum><header>Member appointment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary and the Secretary of Health and Human Services shall appoint the members of the Joint Task Force—</text>
<subparagraph commented="no" id="H63C3F8BF377C4D6CB8D1CB0E89321053"><enum>(A)</enum><text>in accordance with paragraph (2);</text></subparagraph> <subparagraph commented="no" id="H3141177005544FDC8CFA52B6FFCFE5F0"><enum>(B)</enum><text>using a competitive application process; and</text></subparagraph>
<subparagraph commented="no" id="H4857E3FC265349A381228E71950F0C9A"><enum>(C)</enum><text display-inline="yes-display-inline">with consideration to the racial, ethnic, gender, and geographic diversity of the Joint Task Force.</text></subparagraph></paragraph></subsection> <subsection id="HB1C6C890C5874B2D9F6B0EB90BFA64F1"><enum>(c)</enum><header>Study and recommendations</header><text>The Joint Task Force shall—</text>
<paragraph id="H328CFAA03C474CD483E2FEACB6F5E57F"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study to—</text> <subparagraph id="H55DE5299650A4CDAA332F5CD63A8FED7"><enum>(A)</enum><text display-inline="yes-display-inline">identify best practices for reducing the overuse and discriminatory use of exclusionary discipline practices; and</text></subparagraph>
<subparagraph id="H76D402BCB26D4AAFA96F0669D2563049"><enum>(B)</enum><text>determine to what extent exclusionary discipline practices contribute to the criminalization of—</text> <clause id="HF8804A6389F248B28437661079587B00"><enum>(i)</enum><text>girls of color;</text></clause>
<clause id="HE72F10E539584FE8A4DD42FB9D2CF557"><enum>(ii)</enum><text>English learners;</text></clause> <clause id="HEB0DB6043A5C4295B3BB9A017B13D2F3"><enum>(iii)</enum><text>Native American girls;</text></clause>
<clause commented="no" id="H6C64719EF555421286DD90D327054612"><enum>(iv)</enum><text display-inline="yes-display-inline">students who identify as lesbian, gay, bisexual, transgender, queer, or questioning; and</text></clause> <clause id="H5BF116419ABA4D2EBB8485B4CFDB0B6A"><enum>(v)</enum><text display-inline="yes-display-inline">students with disabilities; and</text></clause></subparagraph></paragraph>
<paragraph id="HEF9BE1D2605841C681BDD97D823BDC01"><enum>(2)</enum><text>develop recommendations based on the study conducted under paragraph (1).</text></paragraph></subsection> <subsection id="HB3493492EFEF484DAD84BB7ECBDA2FA2"><enum>(d)</enum><header>Report</header><text>Not later than 360 days after the date of the enactment of this Act, and biannually thereafter, the Secretary and the Secretary of Health and Human Services shall submit to Congress a report on the recommendations under subsection (c)(2).</text></subsection></section>
<section id="H545A001A837B451D8B757896C2CB68ED"><enum>6.</enum><header>Authorization of appropriation</header>
<subsection id="HA554DAB34F30491DA20238181CDA1E3C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated $500,000,000 for each of fiscal years 2022 through 2026 to carry out sections 4 and 5.</text></subsection> <subsection id="H34FEFBDAB8A14406807AF5E32032F386"><enum>(b)</enum><header>Additional funding to the Office for Civil Rights</header><text display-inline="yes-display-inline">There is authorized to be appropriated $500,000,000 for fiscal year 2022 through 2026, and each fiscal year thereafter, to carry out section 3.</text></subsection></section>
<section id="HA8A84112490448E6B9DCE4CD48297000"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph display-inline="no-display-inline" id="H3FB0612286924746B481F57040FB293A"><enum>(1)</enum><header>Act of insubordination</header><text display-inline="yes-display-inline">The term <term>act of insubordination</term> means an act that disrupts a school activity or instance when a student willfully defies the valid authority of a school official.</text></paragraph>
<paragraph id="H62EA07E152A04ED589665E39A8A77412"><enum>(2)</enum><header>Appearance or grooming policy</header><text display-inline="yes-display-inline">The term <term>appearance or grooming policy</term> means any practice, policy, or portion of a student conduct code that governs or restricts the appearance of students, including policies that—</text> <subparagraph id="H0634F9BF1D73497F8993E7DC4571CED9"><enum>(A)</enum><text display-inline="yes-display-inline">restrict or prescribe clothing that a student may wear (such as hijabs, headwraps, or bandanas);</text></subparagraph>
<subparagraph id="HCEEFDFF685864485A6105F9B1A483B43"><enum>(B)</enum><text display-inline="yes-display-inline">restrict specific hair styles (such as braids, locks, twists, bantu knots, cornrows, extensions, or afros); or</text></subparagraph> <subparagraph id="HAC4B1C6F030A49069CFDE5DE56FB6353"><enum>(C)</enum><text>restrict whether or how a student may apply make-up, nail polish, or other cosmetics.</text></subparagraph></paragraph>
<paragraph id="HF74C91F3764C44E9B3D0D612E356E53E"><enum>(3)</enum><header>Chemical restraint</header><text display-inline="yes-display-inline">The term <term>chemical restraint</term> means a drug or medication used on a student to control behavior or restrict freedom of movement that is not—</text> <subparagraph id="H3FD2CAD36FAE4EC586D14ABFA0EBDC71"><enum>(A)</enum><text display-inline="yes-display-inline">prescribed by a licensed physician, or other qualified health professional acting under the scope of the professional’s authority under State law, for the standard treatment of a student’s medical or psychiatric condition; and</text></subparagraph>
<subparagraph id="H15294CC290EE4BA880BF10F4E630E55B"><enum>(B)</enum><text display-inline="yes-display-inline">administered as prescribed by a licensed physician or other qualified health professional acting under the scope of the authority of a health professional under State law.</text></subparagraph></paragraph> <paragraph id="HD541783895B84F55BCC7E5E315F44077"><enum>(4)</enum><header>Direct supervision</header><text>The term <term>direct supervision</term> means a student is physically in the same location as a school official and such student is under the care of the school official or school.</text></paragraph>
<paragraph id="H158B69EF041949CDAFCAC1EAEBF042C8"><enum>(5)</enum><header>Disability</header><text display-inline="yes-display-inline">The term <term>disability</term> means a mental or physical disability that meets the conditions set forth in clauses (i) and (ii) of section 602(3)(A) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)(A)(i)</external-xref> and (ii)).</text></paragraph> <paragraph id="HB563A75ADEF1450C9B0B546180804CCC"><enum>(6)</enum><header>Elementary and Secondary Education Act terms</header><text display-inline="yes-display-inline">The terms <term>elementary school</term>, <term>English learner</term>, <term>local educational agency</term>, <term>secondary school</term>, and <term>State educational agency</term> has the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph>
<paragraph id="HBAE31307CC984EA6BEA9BCBBD3A3DAE4"><enum>(7)</enum><header>Gender identity</header><text display-inline="yes-display-inline">The term <term>gender identity</term> means the gender-related identity, appearance, mannerisms, or other gender-related characteristics of an individual regardless of the designated sex at birth of the individual.</text></paragraph> <paragraph id="H8D566A939540437B938863F9CDD0BA1A"><enum>(8)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text></paragraph>
<paragraph id="H4382212A71264F1DB127EDCD0DA62285"><enum>(9)</enum><header>In-school suspension</header><text display-inline="yes-display-inline">The term <term>in-school suspension</term> means an instance in which a student is temporarily removed from a regular classroom for at least half a day but remains under the direct supervision of a school official.</text></paragraph> <paragraph commented="no" id="HDB53B368E7E74382892E6ABA3329274D"><enum>(10)</enum><header>Mechanical restraint</header><text display-inline="yes-display-inline">The term <term>mechanical restraint</term> has the meaning given the term in section 595(d)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290jj">42 U.S.C. 290jj(d)(1)</external-xref>), except that the meaning shall be applied by substituting <quote>student</quote> for <quote>resident</quote>.</text></paragraph>
<paragraph id="HB7A8C70A002044E099A6E0137FACE19F"><enum>(11)</enum><header>Multi-tier system of supports</header><text display-inline="yes-display-inline">The term <term>multi-tier system of supports</term> means a comprehensive continuum of evidence-based, systemic practices to support a rapid response to the needs of students, with regular observation to facilitate data-based instructional decision making.</text></paragraph> <paragraph commented="no" id="HE93B542266B143D9BE07E60B6FD7F650"><enum>(12)</enum><header>Out-of-school suspension</header><text display-inline="yes-display-inline">The term <term>out-of-school suspension</term> means an instance in which a student is excluded from school for disciplinary reasons by temporarily being removed from regular classes to another setting, including a home or behavior center, regardless of whether such disciplinary removal is deemed as a suspension by school officials.</text></paragraph>
<paragraph id="H186D70884A094D1991994F0F7332E93F"><enum>(13)</enum><header>Physical escort</header><text display-inline="yes-display-inline">The term <term>physical escort</term> has the meaning given the term in section 595(d)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290jj">42 U.S.C. 290jj(d)(2)</external-xref>), except that the meaning shall be applied by substituting <quote>student</quote> for <quote>resident</quote>.</text></paragraph> <paragraph commented="no" id="HA2F10F9000474FEFB97C234934C7237D"><enum>(14)</enum><header>Physical restraint</header><text display-inline="yes-display-inline">The term <term>physical restraint</term> means a personal restriction that immobilizes or reduces the ability of an individual to move the individual’s arms, legs, torso, or head freely, except that such term does not include a physical escort, mechanical restraint, or chemical restraint.</text></paragraph>
<paragraph id="H8994BAB891534CE09E425C9CF77C7B21"><enum>(15)</enum><header>Positive behavior intervention and support</header><text display-inline="yes-display-inline">The term <term>positive behavior intervention and support</term> means using a systematic and evidence-based approach to achieve improved academic and social outcomes for students.</text></paragraph> <paragraph id="HF2E1F17576754B71AC384694766A3D7D"><enum>(16)</enum><header>Pushout</header><text display-inline="yes-display-inline">The term <term>pushout</term> means an instance when a student leaves elementary, middle or secondary school, including a forced transfer to another school, prior to graduating secondary school due to overuse of exclusionary discipline practices, failure to address trauma or other mental health needs, discrimination, or other educational barriers that do not support or promote the success of a student.</text></paragraph>
<paragraph id="HA57E2A412C9A482CB015DE0F2CE282A2"><enum>(17)</enum><header>School-based law enforcement officer</header><text>The term <term>school-based law enforcement officer</term> means an individual who—</text> <subparagraph id="HA20BADA3A97D4BAFAAAA8D2E045A8C67"><enum>(A)</enum><text>is—</text>
<clause id="H2D422CEA7DEE4DA1A9444613B93B288D"><enum>(i)</enum><text>assigned by a law enforcement agency to a secondary or elementary school or local educational agency;</text></clause> <clause id="HEE7759F167F54C4CB1505AE662C7CA50"><enum>(ii)</enum><text display-inline="yes-display-inline">contracting with a secondary or elementary school or local educational agency; or</text></clause>
<clause id="HF9DB4059AA844645A4CA1FA9BC43F663"><enum>(iii)</enum><text display-inline="yes-display-inline">employed by a secondary or elementary school or local educational agency;</text></clause></subparagraph> <subparagraph id="H91AC64198C5F4379826CBEFA9BBE6463"><enum>(B)</enum><text>has the power to detain, arrest, issue a citation, perform a custodial investigation, or refer a person to a criminal or juvenile court;</text></subparagraph>
<subparagraph id="H57F771187F7B4E5895C6591B7494437C"><enum>(C)</enum><text>meets the definition of a law enforcement personnel under State law; or</text></subparagraph> <subparagraph id="HACBF7831A41444CE901A94F7D1DAA8B5"><enum>(D)</enum><text>may be referred to as a <quote>school resource officer</quote>, a <quote>sworn law enforcement officer</quote>, or a <quote>school police officer</quote>.</text></subparagraph></paragraph>
<paragraph id="HF85CABC29C294640B29059408A372906"><enum>(18)</enum><header>School official</header><text display-inline="yes-display-inline">The term <term>school official</term> means a teacher, school principal, administrator, or other personnel, not considered school-based law enforcement, engaged in the performance of duties with respect to a school.</text></paragraph> <paragraph commented="no" id="H67D1942074374A628AA7B4790C410F1B"><enum>(19)</enum><header>Seclusion</header><text>The term <term>seclusion</term> means the involuntary confinement of a student alone in a room or area where the student is physically prevented from leaving, and does not include a time out.</text></paragraph>
<paragraph id="H0F2F006CF2F24535BD30416F47FC7B8A"><enum>(20)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph> <paragraph commented="no" id="H23CE86E320F54EE09DD3E9E5B98DE395"><enum>(21)</enum><header>Serious bodily injury</header><text display-inline="yes-display-inline">The term <term>serious bodily injury</term> has the meaning given that term in section 1365(h)(3) of title 18, United States Code.</text></paragraph>
<paragraph id="HF5456E4EB7474DA38EE78DE85A827D11"><enum>(22)</enum><header>Sexual orientation</header><text display-inline="yes-display-inline">The term “sexual orientation” means homosexuality, heterosexuality, or bisexuality.</text></paragraph> <paragraph id="H8522EF254ECA4E0789639D7091958E8B"><enum>(23)</enum><header>Special education school</header><text display-inline="yes-display-inline">The term <term>special education school</term> means a school that focuses primarily on serving the needs of students who qualify as <quote>a child with a disability</quote> as that term is defined under section 602(3)(A)(i) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)(A)(i)</external-xref>) or are subject to section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>).</text></paragraph>
<paragraph id="H2B51501FD2B04735AFBEBC207B2096C9"><enum>(24)</enum><header>Time out</header><text display-inline="yes-display-inline">The term <term>time out</term> has the meaning given the term in section 595(d)(5) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290jj">42 U.S.C. 290jj(d)(5)</external-xref>), except that the meaning shall be applied by substituting “student” for “resident”.</text></paragraph> <paragraph id="H8E8D5C566EFE4B79834CE07C04D7C8D9"><enum>(25)</enum><header>Zero-tolerance policy</header><text>The term <term>zero-tolerance policy</term> is a school discipline policy that results in an automatic disciplinary consequence, including out-of-school suspension, expulsion, and involuntary school transfer.</text></paragraph></section>
