<section id="H92D73906E6DC47CE841E317080619057" section-type="section-one"><enum>1.</enum><header>Short title; findings</header>
<subsection id="H49E9BD356E374282BDA2832FEDE21E9E"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>National Energy Workforce and Providing Recovery Opportunities to Manage the Industry’s Shifting Economics Act</short-title></quote> or the <quote><short-title>NEW PROMISE Act</short-title></quote>.</text></subsection> <subsection id="H0EC36680B50A40AF95B8EB91A533F9EE"><enum>(b)</enum><header>Findings</header><text>Congress finds that since 2010—</text>
<paragraph id="H4A230E1F60E7479CACED5DCCD89287BF"><enum>(1)</enum><text>the total output of coal-fired electric generation in the United States has declined 48 percent;</text></paragraph> <paragraph id="HA2B66E84140646148F97FE178D181834"><enum>(2)</enum><text>carbon capture, utilization, and storage technologies have continued to develop;</text></paragraph>
<paragraph id="H690130B550E446178C463B39DD39E3CF"><enum>(3)</enum><text>the downturn in coal-fired electric generation has led to a significant decrease in employment related to coal-fired electric generation, including at electric generating stations and mines;</text></paragraph> <paragraph id="H6D4419B33D0242C4ABA7CF8F943C2D1F"><enum>(4)</enum><text>in rural, economically distressed communities with significant coal-fired electric generation employment, the decrease in coal-fired electric generation has had negative impacts on covered net revenues contributing to municipal operating budgets;</text></paragraph>
<paragraph id="HD9B69215311B4246A15FF2361C28CB8C"><enum>(5)</enum><text>electric generation from the consumption of natural gas has increased 60 percent; and</text></paragraph> <paragraph id="HBCDA58D06D56422C93F8A7827F8551A9"><enum>(6)</enum><text>electric generation from affordable renewable energy sources including solar, wind, geothermal, and hydropower has increased.</text></paragraph></subsection></section>
<section id="HAE469C98403E41C4BF14A155FDD0A45F"><enum>2.</enum><header>White house council on energy transitions</header>
<subsection id="H513EE46A2D2C4275A8010ED97334B44A"><enum>(a)</enum><header>Establishment</header><text>There is established in the Executive Office of the President a White House Council on Energy Transitions. The Council shall be headed by a Director, who shall be appointed by the President by and with the advice and consent of the Senate.</text></subsection> <subsection id="HF30EBA117FC049BEB3A2BCDE5F7B3955"><enum>(b)</enum><header>Director</header> <paragraph id="HBD64B2E037CD41CFA8CAACC013C64A84"><enum>(1)</enum><header>Qualifications</header><text>The Director shall be a person who, as a result of training, experience, and attainments, has the requisite skills, abilities, and knowledge to—</text>
<subparagraph id="H0E1D87424BFD444A9150DB15FE7F3F6A"><enum>(A)</enum><text>carry out the duties and functions of the position and Council set forth in this Act; and</text></subparagraph> <subparagraph id="H3777503F3E8146148AF333561CA059B2"><enum>(B)</enum><text>formulate and recommend policies to assist workers and communities adversely disrupted due to the downturn of employment associated with coal-fired electricity generation amidst the Nation’s transition to significantly reducing greenhouse gas emissions across the economy.</text></subparagraph></paragraph>
<paragraph id="H71CCB8761E574EDDB4BADA969430F776"><enum>(2)</enum><header>Compensation</header><text>The annual rate of pay for the Director shall be fixed by the President at a rate that may not exceed the annual rate of pay for level IV of the Executive Schedule.</text></paragraph></subsection> <subsection id="H4818B38A8A1447688D396AEC93D22B4F"><enum>(c)</enum><header>Membership</header> <paragraph id="H96F839E2BB01445FAB80EEBC572E4E95"><enum>(1)</enum><header>Members</header><text>The Council shall be composed of the heads of the following:</text>
<subparagraph id="H8F66747E723B4415A3F72AD7DA021FC5"><enum>(A)</enum><text>The Department of Commerce.</text></subparagraph> <subparagraph id="H6314E4B1B3674CAA937A07F58378985F"><enum>(B)</enum><text>The Department of Energy.</text></subparagraph>
<subparagraph id="HCF2D2863232344CF84D8450088288F6C"><enum>(C)</enum><text>The Department of Labor.</text></subparagraph> <subparagraph id="H8F6164EC053D4C41AE61278747B79AFB"><enum>(D)</enum><text>The Department of the Treasury.</text></subparagraph>
<subparagraph id="H8A6A67138F5549E297A837F78DE18880"><enum>(E)</enum><text>The Department of Health and Human Services.</text></subparagraph> <subparagraph id="HE4D2858767614771B69EB70DE368B5F3"><enum>(F)</enum><text>The Department of the Interior.</text></subparagraph>

<subparagraph id="H79EEA22E544B41CB9BC7C9F41BAB7B8E"><enum>(M)</enum><text>The Economic Development Administration.</text></subparagraph> <subparagraph id="H3C8CB968034249A19CCE522902CDEBD0"><enum>(N)</enum><text>The Appalachian Regional Commission.</text></subparagraph>
<subparagraph id="H4C591B674F62475986F963A57BB16FC8"><enum>(O)</enum><text>The White House Office of Public Engagement.</text></subparagraph> <subparagraph id="H49D1E8A1069C45E7BD6E7743820C9D01"><enum>(P)</enum><text>Any other department, agency, or office of the executive branch as the President or Director may designate.</text></subparagraph></paragraph>
<paragraph id="H317F4CFFCFF3428A8C584C6AC051F3B1"><enum>(2)</enum><header>Designees</header><text>Any member of the Council may designate a senior-level official, who is employed full-time in the department, agency, or office of such member, to carry out the duties of the member under this section.</text></paragraph></subsection> <subsection id="H71285D37698F40A4B8AC33F69EC88996"><enum>(d)</enum><header>Duties of the director</header> <paragraph id="HECFDDCA4C02E46E7805C2DC58FCFA9DC"><enum>(1)</enum><header>Data on impacts of closures</header><text>The Director shall assess and publish, in a publicly available format and on the website of the Council, data on the economic and societal impacts of closures, occurring on or after January 1, 2010, of covered electric generating stations, including associated mines (as applicable), on economically distressed communities, and communities the Director believes based on available information, may become economically distressed communities.</text></paragraph>
<paragraph id="H5C23E55C40DB42AA988C8673578A451F"><enum>(2)</enum><header>Outreach</header><text>The Director shall conduct outreach activities—</text> <subparagraph id="H42FD66FF91244CA4B3A87F9672266359"><enum>(A)</enum><text>to increase awareness of the technical, financial, and policy assistance resources of the Council, for economically distressed communities, and communities the Director believes, based on available information, may become economically distressed communities; and</text></subparagraph>
<subparagraph id="HAD669CE9226C4F459531CE3E113382FE"><enum>(B)</enum><text>to facilitate the establishment of, and otherwise support, Regional Transition Advisory Committees.</text></subparagraph></paragraph> <paragraph id="H5866671E2AC84625AEA7111DA7DC5C19"><enum>(3)</enum><header>Regional transition advisory committees</header> <subparagraph id="HDA332ED42FF64D239576A6A93CF30249"><enum>(A)</enum><header>Facilitation and support</header><text>To the extent practicable, not later than 60 days upon receiving a request for assistance from an economically distressed community, the Director shall provide technical assistance, and other assistance the Director determines appropriate, to such community to facilitate the establishment by such community of a Regional Transition Advisory Committee and to otherwise support such Regional Transition Advisory Committee.</text></subparagraph>
<subparagraph id="HE907FD0DA5354A4F89D5B4A43FB72490"><enum>(B)</enum><header>Meetings</header><text>To the extent practicable, the Director shall meet with each Regional Transition Advisory Committee at least 2 times in the first full calendar year after the Committee is established, and at least once annually thereafter.</text></subparagraph> <subparagraph id="HD02093FCED154BD5B2D98E520EC7BB6D"><enum>(C)</enum><header>Economic development transition plans</header> <clause id="H90F39004F9B84E0C9053F1DAAEF17446"><enum>(i)</enum><header>Assistance</header><text>The Director may provide technical, policy, and financial assistance to a Regional Transition Advisory Committee for developing, implementing, assessing, and evaluating, an economic development transition plan.</text></clause>
<clause id="H9E7A032013364D82BEA125DD02813B11"><enum>(ii)</enum><header>Interim goals</header><text>In carrying out subparagraph (A), the Director shall evaluate any interim economic development transition goals that are voluntarily submitted to the Director prior to submission of an economic development transition plan by a Regional Transition Advisory Committee, and provide such Committee, within 90 days of receipt, an evaluation and recommendations with respect to such interim goals.</text></clause> <clause id="H264E5892D3D147BCB654D0F3855F50AE"><enum>(iii)</enum><header>Certification of commitment to submit and implement plan</header><text>In order to receive financial assistance pursuant to this subparagraph, the Director shall certify that a Regional Transition Advisory Committee—</text>
<subclause id="H3076D3E326B24920A6A272D65177B6AE"><enum>(I)</enum><text>has or will submit to the Director an economic development transition plan that meets the criteria described in section 3(c); and</text></subclause> <subclause id="H73D39895FF0C4890A4327896FF9282D7"><enum>(II)</enum><text>has committed to begin implementing such plan, including by adhering to the metrics developed pursuant to section 3(c), not later than 90 days after receiving a certification under clause (iv).</text></subclause></clause>
<clause id="HE5D8AD472AA44AAF9797DDAA540BDDFE"><enum>(iv)</enum><header>Certification of plan</header><text>Not later than 90 days after a Regional Transition Advisory Committee submits to the Director an economic development transition plan, the Director shall provide to the Regional Transition Advisory Committee—</text> <subclause id="H793AC283888E4572AD26BF882143980F"><enum>(I)</enum><text>a certification of such economic development transition plan; or</text></subclause>
<subclause id="H444943C5F2B44E00867116C89D073598"><enum>(II)</enum><text>recommendations, consistent with the criteria described in section 3(c), to improve the economic development transition plan.</text></subclause></clause> <clause id="H2B89DAB4D98040B491A71468173BA7B4"><enum>(v)</enum><header>Biannual review</header><text>Not later than every 2 years after the date in which the first economic development transition plan is submitted by a Regional Transition Advisory Committee and certified by the Director under clause (iv), the Director shall conduct periodic outreach to such Regional Transition Advisory Committee to review and assist in the revision of such economic development transition plan as necessary.</text></clause></subparagraph></paragraph>
<paragraph id="H18473BB8CC1845A98539BBEC060D9F03"><enum>(4)</enum><header>Coal community resource clearinghouse</header>
<subparagraph id="HAE6ACCF7A47C4134A74627E557845CA1"><enum>(A)</enum><header>Maintenance</header><text>Not later than 180 days after the date of enactment of this section, the Director shall publish, maintain, and make publicly available a clearinghouse, to be known as the Coal Community Resource Clearinghouse, on the website of the Council for the purpose of increasing awareness of Federal and State programs, grants, loans, loan guarantees, and other assistance resources the Director determines will assist economic development activities in economically distressed communities.</text></subparagraph> <subparagraph id="H7E6C02FB459847479EF89E583C3A1821"><enum>(B)</enum><header>Periodic updates</header><text>In maintaining the Clearinghouse, the Director shall, not less than once per calendar year, update the Clearinghouse to address changes to the needs of economically distressed communities, as determined appropriate by the Director.</text></subparagraph></paragraph>
<paragraph id="H9D0B9A0210744DFB89C3C18F00EEF6BC"><enum>(5)</enum><header>Grant specialists</header>
<subparagraph id="HEA063131668A4DEE9342C46272132CF5"><enum>(A)</enum><header>In general</header><text>The Director shall establish within the Council a team of grant specialists (referred to in this paragraph as the <quote>team</quote>) that shall—</text> <clause id="H7A15922F3CD64F26995EE9D3B755A689"><enum>(i)</enum><text>to the extent practicable, not later than 90 days upon receiving a request for assistance from a local government representing an economically distressed community, conduct a visit to the economically distressed community to survey the relevant assets and evaluate the requisite needs of the economically distressed community in order to fulfill the goals of the economic development transition plan, if applicable;</text></clause>
<clause id="H4E496ADB92A6425BA2CDE5ED04BD02CC"><enum>(ii)</enum><text>assist in soliciting applications from economically distressed communities for financial and technical assistance resources identified in the Coal Community Resource Clearinghouse; and</text></clause> <clause id="H27A453A8D6EA4E5F97EAA0D6425FC4AB"><enum>(iii)</enum><text>provide technical assistance to economically distressed communities with applications for resources described in clause (ii).</text></clause></subparagraph>
<subparagraph id="HF5951256577B4AD7988FE5432BF4FBE6"><enum>(B)</enum><header>Team positions</header>
<clause id="H77872E3685DC48F9A52D576AB153F7AD"><enum>(i)</enum><header>In general</header><text>The Director shall ensure that the team is comprised of the number of grant specialists necessary to assist each economically distressed community on an individual basis.</text></clause> <clause id="H0F66D1D6D9F44BC08390072B2CA46823"><enum>(ii)</enum><header>Filling of vacancy</header><text>A vacant position on the team shall be filled not later than 90 days after the date on which the position becomes vacant.</text></clause>
<clause id="H54ED12795BBE432180EF74AB586F47BE"><enum>(iii)</enum><header>Collaboration</header><text>The team shall collaborate with other Federal and State agencies that implement programs aimed at supporting economically distressed communities.</text></clause></subparagraph></paragraph></subsection> <subsection id="H83BCB218F5BF4A3D87428FAE2E04A126"><enum>(e)</enum><header>Meetings</header><text>Not later than 90 days after the date of the enactment of this Act, and at least four time annually thereafter, the Council shall convene a meeting of the Council. At such meetings—</text>
<paragraph id="H76854B5DD4804F02BD16B06E39558A2D"><enum>(1)</enum><text>each member of the Council shall share information regarding the efforts of the members’s department, agency, or office to support through technical assistance, or other policy or financial assistance the Director determines appropriate, the development and implementation of economic development transitions plans by Regional Transition Advisory Committees;</text></paragraph> <paragraph id="H7ECD46AF845D448EA220F0D23496248D"><enum>(2)</enum><text>the Council shall evaluate progress, as necessary, of economic development transition plan goals;</text></paragraph>
<paragraph id="HC88938DCA0624F759E09E6F548ED088C"><enum>(3)</enum><text>the Council shall discuss methods to identify and disseminate information to Regional Transition Advisory Committees on best practices to consider in developing economic development transition plans; and</text></paragraph> <paragraph id="HBA6159711ED047768555C0CD66D8BD48"><enum>(4)</enum><text>the Council shall discuss such other matters as the Director determines are essential to the Council providing support to the economic transition efforts of dislocated workers and local communities.</text></paragraph></subsection>
<subsection id="H3102ACBB9B424130A426D938189C7370"><enum>(f)</enum><header>Administration</header><text>To the extent permitted by law and subject to the amounts made available for such purpose, the Director (or staff designated by the Director) shall provide to the Council administrative support services and additional resources, as appropriate. The Director shall determine the amount of funding and personnel each department, agency, or office represented on the Council should contribute in order for the Council to carry out such duties. Such department, agency, or office, shall, upon the request of the Director, make available to the Council personnel, administrative support services, and information.</text></subsection> <subsection id="HFD73274BD5924CC4A92F68B127F2CEA3"><enum>(g)</enum><header>Transparency</header><text>The Director shall make available to the public, on a regular basis on the website of the Council and through open meetings, information regarding the activities of the Council and minutes from meetings of the Council under subsection (e).</text></subsection>
<subsection id="H1578CF6B2A08484CB216107C44AB8475"><enum>(h)</enum><header>Advisory body</header>
<paragraph id="HCE3D85B481A941DE83F3090F3B673AE9"><enum>(1)</enum><header>Establishment</header><text>The Council may establish an advisory body to advise and provide recommendations to the Council regarding the execution of its duties and, as necessary and with the approval of the Director, to support the development of economic development transition plans submitted by Regional Transition Advisory Committees under section 3.</text></paragraph> <paragraph id="H23BFE742732E4795B1AAB76AEAE49BE5"><enum>(2)</enum><header>Composition</header><text>The advisory body established under paragraph (1) shall, to the maximum extent practicable, be comprised of—</text>
<subparagraph id="H874DEEE028CA4ECA9225971855FDD1A2"><enum>(A)</enum><text>at least 2 representatives from a union or labor organization representing workers of covered electric generating stations, or associated mines;</text></subparagraph> <subparagraph id="H91124340700149B4812D075252C4093E"><enum>(B)</enum><text>at least 2 representatives from an electric utility organization with demonstrated experience providing workforce transition support to workers associated with the generation of electricity from coal;</text></subparagraph>
<subparagraph id="HA7469C49377443E2A5AEE1919FFE192B"><enum>(C)</enum><text>at least 2 representatives from an institution of higher education with demonstrated expertise in energy workforce disruption or labor development issues;</text></subparagraph> <subparagraph id="HE8AED594E77E404C81A8B9DA5B39BAF7"><enum>(D)</enum><text>at least 2 representatives from an environmental organization with demonstrated expertise in energy workforce disruption or labor development issues;</text></subparagraph>
<subparagraph id="H0BCBCA2418E34BFD98BB1DC5FB9A48EA"><enum>(E)</enum><text>at least 3 representatives from an economic development authority of a State or Indian Tribe;</text></subparagraph> <subparagraph id="HF4F1319575584749B064F10CDEFE8071"><enum>(F)</enum><text>at least 3 representatives from an environmental regulatory agency of a State or Indian Tribe;</text></subparagraph>
<subparagraph id="HC4036EC125FB4608B33C25F165484D61"><enum>(G)</enum><text>at least 3 representatives who are serving as the Chief Executive Officer of a State;</text></subparagraph> <subparagraph id="H1805181461E1446AB599656DD15636DE"><enum>(H)</enum><text>at least 3 representatives who are representatives of a Tribal government; and</text></subparagraph>
<subparagraph id="H8E4DA93193CB4C2594752B4FED39EA2B"><enum>(I)</enum><text>any other representative the Director may designate.</text></subparagraph></paragraph> <paragraph id="HFD5F933C493B43D5BF3E88FE167D22F8"><enum>(3)</enum><header>Duties</header> <subparagraph id="H89CEDBAA0A1F47CF94BAEA6FA612ED8B"><enum>(A)</enum><header>Public outreach</header><text>Not later than 90 days after the date of establishment of the advisory body under this section, and at least twice annually thereafter and in coordination with the Director, the advisory body shall hold a public meeting in an economically distressed community for the purpose of—</text>
<clause id="HE70581F1E02849F2A49335252761124A"><enum>(i)</enum><text>soliciting feedback from the public, units of local government and Indian Tribes, and dislocated workers on concerns related to the closure, or imminent closure, of a covered electric generating station; and</text></clause> <clause id="H69E98E85CAFC4F2BA8642E499C038E02"><enum>(ii)</enum><text>soliciting recommendations on actions the departments, agencies, and offices represented on the Council may consider to support the development and implementation of economic development transition plans.</text></clause></subparagraph>
<subparagraph id="HF0F40F4ED921402AAD47F243214DBE21"><enum>(B)</enum><header>Reports</header><text>Not later than 270 days after the first public meeting described in subparagraph (A), and at least once annually thereafter, the advisory body shall submit to the Director a report providing—</text> <clause id="HD843404E7C5B484EA6004174B1DD95B7"><enum>(i)</enum><text>a summary of recommendations approved by a simple majority of the members of the Advisory Body on actions the departments, agencies, and offices represented on the Council should take to better support, through resources provided by the Council, the development and implementation of economic development transition plans; and</text></clause>
<clause id="H1960E43C5F3246DDAB878DBDAE64D5FA"><enum>(ii)</enum><text>an assessment of applicable policies or guidance of the departments, agencies, and offices represented on the Council that the advisory body believes are barriers to a Regional Transition Advisory Committee fully implementing an economic development transition plan.</text></clause></subparagraph> <subparagraph id="H989635B7F69C4106A8F8E3906380BBA5"><enum>(C)</enum><header>Response</header><text>The Director shall, within 60 days of receipt of a report described in subparagraph (B), provide the advisory body a formal written response describing the Council’s findings on recommendations for potential actions described in such report.</text></subparagraph></paragraph>
<paragraph id="H1071F830BEEE4809A408CCD460F4FF43"><enum>(4)</enum><header>Faca exemption</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the advisory body established under this subsection.</text></paragraph></subsection> <subsection id="HED5FB83F70D546C9B1244549DA2A6380"><enum>(i)</enum><header>Reports</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the Director shall submit a report to the appropriate committees of Congress describing the activities carried out pursuant to this section.</text></subsection>
<subsection id="HB3CF5E5EA29C42E3A9A536AAE3A203E6"><enum>(j)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $50,000,000 for each of fiscal years 2022 through 2035.</text></subsection></section> <section id="H376E2F4D14834292838E86279E1C77F8"><enum>3.</enum><header>Regional transition advisory committees</header> <subsection id="HC6CCA5C344EF41188B6B8C91709128FE"><enum>(a)</enum><header>In general</header><text>An economically distressed community may establish a committee, to be known as a Regional Transition Advisory Committee, to develop and implement an economic development transition plan for the economically distressed community.</text></subsection>
<subsection id="HC16E2B7272D346EA86A4EE31097911C3"><enum>(b)</enum><header>Composition</header>
<paragraph id="HC535C9470DDB431EB0BB84773E9F7C35"><enum>(1)</enum><header>In general</header><text>Each Regional Transition Advisory Committee established pursuant to this section shall include, to the extent practicable—</text> <subparagraph id="H055C6301E409470389D1F84BBAB52FCF"><enum>(A)</enum><text>at least 1 representative from the union or labor organization representing workers of the applicable covered electric generating station or associated mine;</text></subparagraph>
<subparagraph id="HF2503464123D44B6915F060A96CD0714"><enum>(B)</enum><text>at least 1 representative who is the Chief Executive Officer, or a designee thereof, of each applicable State where the economically distressed community is located;</text></subparagraph> <subparagraph id="H63FF2C656E5D4DCA8A04858539FB0999"><enum>(C)</enum><text>at least 1 representative from each impacted local government;</text></subparagraph>
<subparagraph id="H22524F8E49E241AC97823454F01A9184"><enum>(D)</enum><text>at least 1 representative from each electric utility associated with an applicable covered electric generating station;</text></subparagraph> <subparagraph id="H77466212301245A6905ED95CBED6D52D"><enum>(E)</enum><text>at least 1 representative from an economic development agency;</text></subparagraph>
<subparagraph id="HDB1498B4494242588AA4662D7953D998"><enum>(F)</enum><text>at least 1 representative from an institution of higher education with demonstrated experience and expertise in energy workforce disruption or labor development issues;</text></subparagraph> <subparagraph id="HC203246FB130454F8E18E832F115F536"><enum>(G)</enum><text>at least 1 representative from an environmental organization with demonstrated experience and expertise in energy workforce disruption or labor development issues; and</text></subparagraph>
<subparagraph id="HD2B21090FF134D29903DF4944F2681B6"><enum>(H)</enum><text>at least 1 representative who is the Chief Executive Officer (or a designee thereof) of an impacted Tribal government within an economically distressed community (as applicable).</text></subparagraph></paragraph> <paragraph id="HDAFCE0CA07C24F56B099C98ADB3DED77"><enum>(2)</enum><header>Chair; co-chairs</header><text>Each Regional Transition Advisory Committee shall be led by a designee of an impacted local government within an economically distressed community, who shall serve as the Chair of the Committee. In the event multiple local governments are impacted by a closure of a covered electric generating station within an economically distressed community, designees from each such impacted local government shall serve as Co-Chairs of the Committee.</text></paragraph></subsection>
<subsection id="H20BD81B7FF92477DAAC28D6F6D873EC2"><enum>(c)</enum><header>Economic development transition plan</header>
<paragraph id="HC459B2FFAC2E4D4FAC3724B7C6211F19"><enum>(1)</enum><header>In general</header><text>A Regional Transition Advisory Committee may develop and implement an plan, to be known as an economic development transition plan.</text></paragraph> <paragraph id="HCADF219B977449C2BB33680E5803A188"><enum>(2)</enum><header>Contents</header><text>An economic development transition plan shall include, at a minimum, the following:</text>
<subparagraph id="H347F539CEAA841C7976E648AA68D855B"><enum>(A)</enum><header>Strategic vision</header><text>A strategic vision that reflects the values, characteristics, and general economic needs of the applicable economically distressed community to guide the development and implementation of the economic development transition plan, such as—</text> <clause id="HC50093C82504446CAC2753A698B44778"><enum>(i)</enum><text>geographic proximity to an urban area;</text></clause>
<clause id="HE1098C764BD04E8495870F09B10E390C"><enum>(ii)</enum><text>socioeconomic attributes of the general workforce; and</text></clause> <clause id="H173509313EFC47408745D7A31522BF39"><enum>(iii)</enum><text>such other characteristics the Regional Transition Advisory Committee determines are appropriate.</text></clause></subparagraph>
<subparagraph id="H65CD398798914A9D97FB4DD4FDAA35A9"><enum>(B)</enum><header>Steps to implement</header><text>The steps a Regional Transition Advisory Committee will seek to implement in the applicable economically distressed community with the goals of, at a minimum—</text> <clause id="HB3BC149518C64AD1B8CA399EE710A034"><enum>(i)</enum><text>increasing employment opportunities for dislocated workers, to the extent practicable, including jobs in energy-related industries;</text></clause>
<clause id="H08D96BB68C4049E481BB87E544B09466"><enum>(ii)</enum><text>increasing educational opportunities, to the extent practicable, at institutions of higher education or provided by labor organizations, for dislocated workers; and</text></clause> <clause id="H9C205C76899C484784D4AF9A083C09DC"><enum>(iii)</enum><text>generating revenue, to be received by the applicable unit of local government or Indian Tribe, that is equal to or greater than the covered net revenue received by such unit of local government or Indian Tribe in the last full fiscal year in which the applicable covered electric generating station was operating.</text></clause></subparagraph>
<subparagraph id="H922CF7B98B934566951B96DD8F292C18"><enum>(C)</enum><header>Assessment</header><text>An assessment and description of—</text> <clause id="HE1BF0C28E46F470A81CE1A9053F36517"><enum>(i)</enum><text>available infrastructure, including a status on the condition of such infrastructure, to support economic development in the economically distressed community related to essential community services;</text></clause>
<clause id="H8FD3495F0D65485DAF34F0F0FEEDC2E4"><enum>(ii)</enum><text>the extent to which such environmental restoration activities described in subparagraph (D)(iii) may prioritize the employment of dislocated workers previously employed at the covered electric generating station or associated mine to carry out such activities (to the extent practicable);</text></clause> <clause id="H6693B834938D46C39E4E21327950ED14"><enum>(iii)</enum><text>types of industries or occupations located in or near the economically distressed community which dislocated workers could likely transition to, including any available data on average wages and employment-related benefits associated for each occupation;</text></clause>
<clause id="H3D99FED429474132807F97A9EE88642D"><enum>(iv)</enum><text>covered net revenue losses incurred by the economically distressed community in the preceding fiscal year, or projected covered net revenue losses likely to be incurred, as a result of the closure of a covered electric generation station (including an associated mine), and the observed impact, or projected impact, such closure will impose on the provision of essential community services in the economically distressed community;</text></clause> <clause id="H2D4ED2F847E24728857EBF7F5A62F706"><enum>(v)</enum><text>the potential for distributed or renewable energy resources to provide electricity to electric consumers residing in the applicable economically distressed community;</text></clause>
<clause id="H10050F54A653471D8B0867C56E9867EF"><enum>(vi)</enum><text>any disruptions experienced by dislocated workers in the economically distressed community in terms of—</text> <subclause id="H029751BD20AB43BCBF3EAD2C0B0592B5"><enum>(I)</enum><text>real wages, calculated on a weekly average basis;</text></subclause>
<subclause id="H08730494407D4ADCA8245FB9B440EAE7"><enum>(II)</enum><text>access to a health insurance policy previously available through an employer operating a covered electric generating station or associated mine;</text></subclause> <subclause id="H39685551702C4F5D98BC772249952BA0"><enum>(III)</enum><text>earned benefits, including—</text>
<item id="H6128677FAE614C2F9FDE84ABDADC3DA7"><enum>(aa)</enum><text>the retirement and health benefits for coal miners; or</text></item> <item id="HEB21816C92304881941463E1347D93B6"><enum>(bb)</enum><text>the United Mine Workers of America Combined Benefit Fund established under <external-xref legal-doc="usc" parsable-cite="usc/26/9702">section 9702</external-xref> of the Internal Revenue Code of 1986; or</text></item></subclause>
<subclause id="HE74495583AFC446698783F94726EE9E2"><enum>(IV)</enum><text>benefits under any qualified employer plan (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72(p)(4)</external-xref> of the Internal Revenue Code of 1986); and</text></subclause></clause> <clause id="H6F8FBBEF0BE3427488EC06A3A11B213D"><enum>(vii)</enum><text>available institutions of higher education or labor organizations in or near the applicable economically distressed community offering professional certification, technical training, apprenticeships, or educational instruction on jobs in energy-related industries.</text></clause></subparagraph>
<subparagraph id="H02F42EDB370A4F41BD6CFCE274D17DBB"><enum>(D)</enum><header>Timeline</header><text>A timeline, with benchmarks to measure progress, to—</text> <clause id="HFB9544F84FF248A798E19A12BF648BF1"><enum>(i)</enum><text>promote infrastructure investments to maintain or expand essential community services through available Federal, State, or local programs, or from the private sector, in the applicable economically distressed community;</text></clause>
<clause id="HF9FA213FAF4340BF8E033C816E47DB8F"><enum>(ii)</enum><text>mitigate or replace the loss of covered net revenue for the economically distressed community to a level necessary to continue provide essential services and support the goals of a comprehensive economic development transition plan;</text></clause> <clause id="H888B5A86D26D4054930E67048E53B9C5"><enum>(iii)</enum><text>conduct environmental restoration activities with respect to any mines (including surface mines, underground mines, or mine openings), coal ash ponds, and other coal mining operations directly associated with a covered electric generating station that has ceased producing electricity, including any necessary decommissioning activities at the site of the covered electric generating station; and</text></clause>
<clause id="H9CBA346448284046A4C12193195C0ED0"><enum>(iv)</enum><text>increase technical training, professional certification, apprenticeships, or educational instruction opportunities for dislocated workers at institutions of higher education or provided by labor organizations in or near the applicable economically distressed community for jobs in energy-related industries.</text></clause></subparagraph></paragraph> <paragraph id="H9D28F84EBAF14A1285AB02BC6F79FAC0"><enum>(3)</enum><header>Metrics</header><text>A Regional Transition Advisory Committee shall, in consultation with the applicable economic development agency, develop measurable evaluation and performance metrics that the Regional Transition Advisory Committee shall adhere to throughout the implementation of the economic development transition plan.</text></paragraph></subsection></section>
<section id="HD3723DF354E84637AE30A147D9C9557A"><enum>4.</enum><header>Rural and remote communities electrification grants</header>
<subsection id="HACAC780E40D4460D808E0814CCAFB2DB"><enum>(a)</enum><header>In general</header><text>Section 609 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/918c">7 U.S.C. 918c</external-xref>) is amended—</text> <paragraph id="H9FB2B1E78515442E919120AC78C285DC"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="HF4B5C4A4A696405283E6109AA87FEDC3"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or municipality</quote> and inserting <quote>, municipality, or Indian Tribe</quote>;</text></subparagraph> <subparagraph id="H22469C209B284EB1945BB97681F0F5B8"><enum>(B)</enum><text>in paragraph (5), by striking <quote>10,000</quote> and inserting <quote>20,000</quote>; and</text></subparagraph>
<subparagraph id="HBD07AF68984146C3835EB859E3306ED6"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H3EA93C6E7DA64204BD03205CE9515B29" style="OLC"> <paragraph id="HFB2ADCBFFB28499EB5B15D3B79AEB6DB"><enum>(6)</enum><text>The term <term>economically distressed community</term> has the meaning given such term in section 8 of the <short-title>NEW PROMISE Act</short-title>.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H45FB8716250E4CC4B53076310F6D5517"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H1C8E5DB4D12E4B04964453062C9D11BF"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause id="HC061A040763E404EAC75AF760196169F"><enum>(i)</enum><text>by inserting <quote>or the deployment of energy storage technologies</quote> after <quote>energy efficiency</quote>;</text></clause> <clause id="H89320B3ECE7C4FBBB0C1BEBE62695FD7"><enum>(ii)</enum><text>by inserting <quote>or economically distressed communities</quote> after <quote>rural areas</quote>; and</text></clause>
<clause id="HAED594CE04BE4547AB672D0DF3BF1F54"><enum>(iii)</enum><text>by striking <quote>or</quote> at the end;</text></clause></subparagraph> <subparagraph id="H06AC9829098C4AA38927CC7750BA676A"><enum>(B)</enum><text>in paragraph (2)—</text>
<clause id="H03DA4D6E714B485586D616E3B736C5B1"><enum>(i)</enum><text>by inserting <quote>or economically distressed communities</quote> after <quote>rural areas</quote>; and</text></clause> <clause id="H9BC9CAB3E2D54DDBA2F357E33BA2D549"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></clause></subparagraph>
<subparagraph id="H02024BD059624DE8AE315CAF608560A0"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="HEC5849EFE35C4151BFAF3970AA9D25F0" style="OLC"> <paragraph id="HD93CDF3CA732431DB9F1E4FDCD3124CE"><enum>(3)</enum><text>refurbishing, redeveloping, or repurposing electric generating facilities that primarily consume coal as a fuel source that have recently ceased operation, or will cease operation in the near future, for manufacturing, including manufacturing clean energy technologies or materials.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HC22AA74A068647F184EC9DC4DA627A82"><enum>(3)</enum><text>in subsection (d)—</text> <subparagraph id="HC540E4D5844442E5854986F5D19E7710"><enum>(A)</enum><text>by striking <quote>$20,000,000</quote> and inserting <quote>$50,000,000</quote>; and</text></subparagraph>
<subparagraph id="H1AD1D12C22404DAB8E2D7411D245073A"><enum>(B)</enum><text>by striking <quote>2006 through 2012</quote> and inserting <quote>2022 through 2026</quote>.</text></subparagraph></paragraph></subsection></section> <section id="H71495F297A874AAF83D79F2104367D24"><enum>5.</enum><header>Advanced notice to communities potentially impacted by closure of an electric generating facility that primarily consumes coal as a fuel source</header> <subsection id="H5A2F1275A5B84C018EB481756E5E5F4E"><enum>(a)</enum><header>Federal standard</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H22BB8A399D8E43919F51B2BAD5FCB2FE"><enum>(20)</enum><header>Advanced notice of closure</header>
<subparagraph id="H5EB6AAD2BD5647E3B71AF17AF840911D"><enum>(A)</enum><text>Each electric utility shall provide to potentially impacted local governments and Indian Tribes (as applicable) a formal written notice of any closure of an electric generating facility (including any generating unit thereof) of such electric utility that primarily consumes coal as a fuel source.</text></subparagraph> <subparagraph id="H0E21F622AEFD4EF38C6A8E83D506A0F3"><enum>(B)</enum><text>With respect to an electric utility for which a State regulatory authority has ratemaking authority, notice under subparagraph (A) shall be provided by such electric utility to local governments and Indian Tribes within 7 days of submitting to the State regulatory authority any similar notice.</text></subparagraph>
<subparagraph id="HE15BA706A2514554886A42D5BC8950BB"><enum>(C)</enum><text>An electric utility providing a written notice under subparagraph (A) shall, to the maximum extent practicable, include in such notice—</text> <clause id="HE4A7A1730036454D8534FF43B3D17042"><enum>(i)</enum><text>a schedule describing the projected timeline—</text>
<subclause id="H8504164D0F474D00BD96F8FC9E196257"><enum>(I)</enum><text>for the closure, which shall, to maximum extent practicable, not occur prior to the date that is 3 years after the date of such notice, including dates of any phases of closure;</text></subclause> <subclause id="HAB9EFC6C9A4142F88678E170BB69A8A5"><enum>(II)</enum><text>for workforce transition activities sponsored by the electric utility for applicable employees of the electric utility, if applicable; and</text></subclause>
<subclause id="HD7B4650FD3A542B58BC952E4331A8162"><enum>(III)</enum><text>for future reclamation activities on the land of the electric generating facility (or generating unit thereof) that is closing; and</text></subclause></clause> <clause id="H492FFB833C51497ABB022901F1AD76F5"><enum>(ii)</enum><text>a description of the extent to which the electric utility will prioritize the use of the incumbent workforce of the facility or associated mine in carrying out reclamation activities described in clause (i)(III).</text></clause></subparagraph>
<subparagraph id="H12A4DDD4A25344C1B31BEECB61211E7D"><enum>(D)</enum><text>An electric utility providing a written notice under this subsection shall, within 7 days of obtaining new information that would refine, alter, or otherwise update any timeline described in subparagraph (C), provide such update in a new formal written notice to potentially impacted local governments and Indian Tribes (as applicable).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HE30A58EAD61D4E3F9DE00972330E3CB0"><enum>(b)</enum><header>Obligations To consider and determine</header> <paragraph id="H367B37D347B04E84A85F3219C903572A"><enum>(1)</enum><header>Time limitations</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H75A4D61F25544DD3A44E0FD131C698E6"><enum>(7)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="H23CB709A860646EC9E7F1C4A55AE1290"><enum>(A)</enum><text>Not later than 1 year after the date of the enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which it has ratemaking authority) and each nonregulated electric utility shall commence the consideration referred to in section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph> <subparagraph id="H4D90B1F89E514F9B97CBEFBF720E382F" indent="up1"><enum>(B)</enum><text>Not later than 2 years after the date of the enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which it has ratemaking authority), and each nonregulated electric utility, shall complete the consideration, and shall make the determination, referred to in section 111 with respect to the standard established by paragraph (20) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="HAA0E784278554CADA38FBDDD0939C26F"><enum>(2)</enum><header>Failure to comply</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended—</text> <subparagraph id="H6A1681784F3645E89D00AED0A6FD937C"><enum>(A)</enum><text>by striking <quote>subsection (b)(2)</quote> and inserting <quote>subsection (b)</quote>; and</text></subparagraph>
<subparagraph id="H4D31BCF293D44D2DA0A825F9CE1548BC"><enum>(B)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (20) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of such paragraph (20).</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H0F9ABC2AF842441FAAEB0A96F476DC0D"><enum>(c)</enum><header>Prior state actions</header><text>Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/20622">16 U.S.C. 20622</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H23CA55692F084E8EAB1E2FDF9136972B"><enum>(g)</enum><header>Prior state actions</header><text>Subsections (b) and (c) of this section shall not apply to the standard established by paragraph (20) of section 111(d) in the case of any electric utility in a State if, before the enactment of this subsection—</text> <paragraph id="H35D438CA0C9F4D958F14655F527D2AED"><enum>(1)</enum><text>the State has implemented for such utility the standard concerned (or a comparable standard);</text></paragraph>
<paragraph id="H0D71293D6BDA4B22A3211B328B905DCE"><enum>(2)</enum><text>the State regulatory authority for such State or relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard concerned (or a comparable standard) for such utility; or</text></paragraph> <paragraph id="H15A27D48D09C484D809FF47DE189B18D"><enum>(3)</enum><text>the State legislature has voted on the implementation of such standard (or a comparable standard) for such utility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HCE764C26886E445FBD58D09B169B3400"><enum>6.</enum><header>Workforce innovation and opportunity act pilot program</header>
<subsection id="H23E7643A3B4349CA9B5CBA55206959A6"><enum>(a)</enum><header>Pilot program</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Labor, in consultation with the Director, shall establish a pilot program under section 169(c) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3224">29 U.S.C. 3224(c)</external-xref>) to assist dislocated workers in economically distressed communities.</text></subsection> <subsection id="H81868FBFC3BD4DEE9BB288FDF3F876CC"><enum>(b)</enum><header>Eligibility</header><text>A dislocated worker shall be certified by the Secretary as eligible to participate in the pilot program under this section if—</text>
<paragraph id="HF2BE5F59E2CE40658ABC1CB3ECB65D6F"><enum>(1)</enum><text>the dislocated worker was, within the 60-month period prior to the date of enactment of this Act, employed in an occupation primarily associated with the generation of electricity from coal as a fuel source; or</text></paragraph> <paragraph id="H436DB60544E742F6AAC368296ABDE450"><enum>(2)</enum><text>the Secretary determines, based on available information that a worker, or significant proportion of the workers’ employment site that primarily generates electricity from coal, including an associated mine, has become totally, partially, or are likely to be separated from employment.</text></paragraph></subsection>
<subsection id="H14AFE7182E444BE2B1B3FAEAF1FD6C8A"><enum>(c)</enum><header>Authority To collect information</header>
<paragraph id="H0C1E108F1CCE457A9D30F3AF436AF5B2"><enum>(1)</enum><header>In general</header><text>The Secretary shall, in determining whether to certify a worker or group of workers under subsection (b), obtain information the Secretary determines to be necessary to make the certification from—</text> <subparagraph id="HE0FA458CE44D456E8D8ACF7F4A7AE44D"><enum>(A)</enum><text>the employer of the worker or group of workers;</text></subparagraph>
<subparagraph id="H207CB86312F34E039B47711207F3BD1C"><enum>(B)</enum><text>officials of certified or recognized labor organizations or other duly authorized representatives of the group of workers; or</text></subparagraph> <subparagraph id="HE921B0F588BE473896E115503685C0F3"><enum>(C)</enum><text>one-stop operators or one-stop partners (as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)).</text></subparagraph></paragraph>
<paragraph id="H00AC18C096924DAC8E726B0604B086FE"><enum>(2)</enum><header>Verification of information</header><text>The Secretary shall require an employer, labor organization, or one-stop operator or partner to certify all information obtained under paragraph (1) from the employer, labor organization, or one-stop operator or partner (as the case may be) on which the Secretary relies in making a determination under subsection (b), unless the Secretary has reasonable basis for determining that such information is accurate and complete without being certified.</text></paragraph></subsection> <subsection id="HEB188085F5424AB895E55EF250B24AF2"><enum>(d)</enum><header>Criteria</header><text>In establishing the pilot program under this section, the Secretary of Labor and the Director shall consider, in addition to other such criteria as the Secretary of Labor and the Director of the Council determine appropriate, the extent to which the pilot program will be able to provide dislocated workers in economically distressed communities education, employment search, or training opportunities to—</text>
<paragraph id="H21082CBE94544B999722AAC4523613B3"><enum>(1)</enum><text>support entrepreneurship and small business development; and</text></paragraph> <paragraph id="H54F8A0D1D542488E93223DDDA4714BDD"><enum>(2)</enum><text>enter jobs in energy-related industries, with an emphasis on construction, engineering, manufacturing, or retro-fitting jobs for renewable energy, energy efficiency, carbon dioxide removal, or carbon capture, utilization, and storage projects.</text></paragraph></subsection>
<subsection id="HABE784B6F8214F97A451A7C04BEBAC6C"><enum>(e)</enum><header>Consultation with state and local programs</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Labor shall consult with entities described in paragraph (2) to evaluate lessons learned, solicit best practices, and evaluate the feasibility of, and solicit best practices or lessons learned for establishing or expanding transitional support benefits through programs described in paragraph (1) for eligible dislocated workers participating in the pilot program established under this section.</text> <paragraph id="HDD5D6B9D74874140ABFF0BF769268934"><enum>(1)</enum><header>Transitional support benefits described</header><text>The programs described in this paragraph are as follows:</text>
<subparagraph id="H08EC48C7423047EE86D2F0E2A4A9ADFC"><enum>(A)</enum><text display-inline="yes-display-inline">Under a State plan amendment pursuant to section 1916A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o-1">42 U.S.C. 1396o–1</external-xref>).</text></subparagraph> <subparagraph id="H7BA1D87C0831449F8CBDA60EDEFCADF5"><enum>(B)</enum><text>Wage differential benefits, in terms of the difference in wages previously earned on a weekly basis by an employee from an employer that is directly associated with the operation of a covered electric generating station or associated mine in the final applicable calendar year of such operation, and compensation received by a dislocated worker who, as part of an unemployment fund administered by a State agency, is experiencing employment loss directly associated with the closure or cessation of operations at a covered electric generating station or associated mine (as the case may be).</text></subparagraph>
<subparagraph id="HAAB9FF1902304B0E9C4204A238F2C2FB"><enum>(C)</enum><text>Continuation coverage under a COBRA continuation provision (as defined in section 7333(d)(1) of the Employee Retirement Income Security Act of 1974) or a similar State program, or under section 8905(a) of title 5, United States Code.</text></subparagraph> <subparagraph id="HD93E0C8DAECC4CCC9C757694CFCD0C36"><enum>(D)</enum><text display-inline="yes-display-inline">Benefits similar in type, amount, and duration pursuant to chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2101">19 U.S.C. 2101</external-xref>). </text></subparagraph></paragraph>
<paragraph id="H7B112D5DBD994CD5A31B148959EBAD5E"><enum>(2)</enum><header>Entities described</header><text>An entity described under this paragraph shall have demonstrated experience providing one or multiple programs described in paragraph (1) to dislocated workers, including—</text> <subparagraph id="H69FAF8155C454461986E307F817B526C"><enum>(A)</enum><text>a Chief Executive Officer of a State;</text></subparagraph>
<subparagraph id="H14506EA396E24E84A3EF4E9EEB4203E5"><enum>(B)</enum><text>a State public health official;</text></subparagraph> <subparagraph id="H658C2FD6716B43419989B85C0525CC5D"><enum>(C)</enum><text>a Local workforce development board;</text></subparagraph>
<subparagraph id="HD4E8A0DE360749549B6792729461224A"><enum>(D)</enum><text>a State workforce development board; or</text></subparagraph> <subparagraph id="H7FD2191ED16F44FF9C5F72EC1D0A077B"><enum>(E)</enum><text>the head of a Federal agency.</text></subparagraph></paragraph></subsection>
<subsection id="H76780E53FA1249B8B51CEE42DC82FCE4"><enum>(f)</enum><header>Duration</header>
<paragraph id="H106F194F233B459A8E1DACB8B3CD76B4"><enum>(1)</enum><header>In general</header><text>The Secretary of Labor shall carry out the pilot program under this section for a period of not less than 10 years.</text></paragraph> <paragraph id="HB0A5649D5B7E48B5BCF04C1FD376EF37"><enum>(2)</enum><header>Worker participation period</header><text>A dislocated worker participating in the pilot program under this section may participate for a period to be determined by the Secretary and in consultation with the Director, until such point that—</text>
<subparagraph id="HFECE3A2DD32543598FA17F76E69B112B"><enum>(A)</enum><text>a dislocated worker obtains full-time employment; or</text></subparagraph> <subparagraph id="H1A5C88059C0648A9BB29533056361413"><enum>(B)</enum><text>a dislocated worker submits a request for an extension to participate in the pilot program to the Secretary due to the length of training, education, or job placement services received through the pilot program under this section exceeding the initial period for participation determined by the Secretary.</text></subparagraph></paragraph></subsection>
<subsection id="HF2519BD72F834768AAEC0EC65494ECA7"><enum>(g)</enum><header>Reports</header><text>In carrying out this section, the Secretary of Labor and the Director shall submit to the appropriate committees of Congress a report annually describing—</text> <paragraph id="H8C5502333A084B3791CEFC5975B5B8ED"><enum>(1)</enum><text>recommendations for establishing transitional support benefits as a benefit provided under the pilot program under this section for dislocated workers as described in subsection (e)(1);</text></paragraph>
<paragraph id="H003E651679C84EAEB7FF2988CBB55BBD"><enum>(2)</enum><text>recommendations for developing tailored educational and instructional curricula for dislocated workers to obtain skills, certification, or training required for emerging energy-related industries or other industries;</text></paragraph> <paragraph id="HCC07C5A909A94852864329550FF39063"><enum>(3)</enum><text>barriers impacting dislocated workers from entering emerging energy-related industries or finding employment in other industries; and</text></paragraph>
<paragraph id="HC5FD3BAB8C5F4DA3ADBD3333F526FA41"><enum>(4)</enum><text>such other information as the Secretary of Labor and the Director determine appropriate.</text></paragraph></subsection> <subsection id="H325A4CDD187B4D3E9EAAD8D8F69C36CA"><enum>(h)</enum><header>Authorization of appropriations</header> <paragraph id="H45B2704C912E4CBDAFE63FF4D24E9098"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary of Labor to carry out this section $100,000,000 for fiscal year 2022, which shall remain available until expended.</text></paragraph>
<paragraph id="HB7ABD9646D464F09A1C6BDB4C32589D2"><enum>(2)</enum><header>Administrative costs</header><text>Not more than 5 percent of the amount appropriated under paragraph (1) shall be used for administrative purposes.</text></paragraph></subsection></section> <section id="H969601A6EB0E453FB170A3FC3658B0FC"><enum>7.</enum><header>Covered electric generating station cessation mitigation fund</header> <subsection id="H28E177DC675C4125946CE3B85B37201F"><enum>(a)</enum><header>Establishment of fund</header> <paragraph id="H18335227A5BB40FBB224C20DF3CAF267"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Covered Electric Generating Station Cessation Mitigation Fund</quote> (referred to in this section as the <quote>Mitigation Fund</quote>) consisting of—</text>
<subparagraph id="H26C0F66F102A45C58AAE54249AC43C13"><enum>(A)</enum><text>such amounts as are deposited in the Fund pursuant to this section; and</text></subparagraph> <subparagraph id="H85C90E32E7B54C76ADFE86973D8EA6B6"><enum>(B)</enum><text>such amounts as may be appropriated to supplement the Fund.</text></subparagraph></paragraph>
<paragraph id="HBE3EEA65224B44AAA9F61AD628299DF1"><enum>(2)</enum><header>Use of fund</header><text>Amounts deposited in the Mitigation Fund shall be available to the Secretary of Treasury, in consultation with the Director, to make payments to economically distressed communities in amounts described in subsection (b) to mitigate the impact from the loss of covered net revenues.</text></paragraph> <paragraph id="HA5C11F22EE464E56B72B9A5A6480F6BF"><enum>(3)</enum><header>Timing</header><text>Subject to amounts available in the Mitigation Fund, not later than 180 days after the date of enactment of this Act, the Secretary of Treasury shall begin making payments under this section.</text></paragraph></subsection>
<subsection id="H62EC3CABCE1E4D2FAE05119F0EA0428E"><enum>(b)</enum><header>Payment to economically distressed communities</header>
<paragraph id="H2AD71B01797E458DAEAD32E4E6639223"><enum>(1)</enum><header>Assistance</header><text>The Secretary of Treasury may provide assistance, in the form of annual payments, to an economically distressed community representing a portion of the loss of covered net revenues due to the cessation of operations of a covered electric generating station.</text></paragraph> <paragraph id="H061BABC3E1B24D9899A860C4D7550216"><enum>(2)</enum><header>Annual payments</header> <subparagraph id="H17806200E5F44306AAB66DEA83A30DA7"><enum>(A)</enum><header>Determination of payment amount</header><text>The amount of an annual payment under this section shall be determined by the Secretary of Treasury.</text></subparagraph>

<subparagraph id="H6B6BDC7E7517408AB49429EB8F590506"><enum>(A)</enum><text>shall be eligible for not more than 1 payment under this section each fiscal year; and</text></subparagraph> <subparagraph id="HDC303F91313A40F8BCEC7C90647ED8A2"><enum>(B)</enum><text>may not receive payments under this section for more than 7 fiscal years.</text></subparagraph></paragraph>
<paragraph id="H8900AC038F0B4334BCE3643DCDCDBC91"><enum>(4)</enum><header>Application</header><text>The Secretary shall not provide any payment under this section to an economically distressed community until such time as the economically distressed community completes an application including such information in such form as the Secretary may require, including an affidavit that a covered electric generating station located in such community has, on or after January 1, 2010, closed (or is no longer generating electricity), and that such community has been significantly impacted by such closure.</text></paragraph> <paragraph id="H8E20B50065B84DC586500D0F3591D39C"><enum>(5)</enum><header>Order of payment</header><text>The date of submission of an economically distressed community’s application for assistance shall establish the order in which the Secretary of Treasury provides assistance under this section.</text></paragraph></subsection>
<subsection id="H2539B530CD8F4AAF9109CEA065311250"><enum>(c)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter for each fiscal year during which amounts in the Mitigation Fund are available, an economically distressed community receiving payment under this section shall submit to the Secretary a report that—</text> <paragraph id="H88228EC40E8F4F92822999FBEF007874"><enum>(1)</enum><text>describes how amounts from the Mitigation Fund support such economically distressed community in—</text>
<subparagraph id="H059644E3D8A34E5C89CC15F3527B49F6"><enum>(A)</enum><text>maintaining essential community services in such economically distressed community; and</text></subparagraph> <subparagraph id="H8515ECBFAE6549AC9496ECB5A9EE01C6"><enum>(B)</enum><text>fulfilling the objectives described in any applicable economic development transition plan; and</text></subparagraph></paragraph>
<paragraph id="HF7D8F68A47F04AADA637B25A680AD1E9"><enum>(2)</enum><text>includes any additional information that the Secretary determines appropriate.</text></paragraph></subsection> <subsection id="H6A72B9833DC4419B98AAC4787D2AECD6"><enum>(d)</enum><header>Authorization of appropriations</header> <paragraph id="H768D29ABA1E242D59BC38CC41A370188"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to deposit into the Mitigation Fund and to carry out this section $250,000,000 for fiscal year 2022, to remain available until expended.</text></paragraph>
<paragraph id="HF14AA6DCD6FC48AA941F811F54540E36"><enum>(2)</enum><header>Administrative costs</header><text>Not more than 5 percent of the amount appropriated pursuant to paragraph (1) shall be used for administrative purposes.</text></paragraph></subsection></section> <section id="HF8540B972F0E4CC39EAE3B0E9FC40A57"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H79C9EE9C7189455CA5D06E3FFCB09C94"><enum>(1)</enum><header>Apprenticeship</header><text>The term <term>apprenticeship</term> means an apprenticeship registered under the Act of August 16, 1937 (commonly referred to as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.).</text></paragraph> <paragraph id="HAA75C061E96841E5AA59A5634695BE8F"><enum>(2)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text>
<subparagraph id="H41EC7CEF9DA745D48E0E30FA629DBF90"><enum>(A)</enum><text>the Committee on Appropriations of the Senate;</text></subparagraph> <subparagraph id="H828098ED34C241338321DA2348BC5CB7"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></subparagraph>
<subparagraph id="H9C4C08F94A6A41ACB172B1E3C102190E"><enum>(C)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subparagraph> <subparagraph id="H8F9EBFEE92964DE7B356E231B4718A4C"><enum>(D)</enum><text>the Committee on Appropriations of the House of Representatives;</text></subparagraph>
<subparagraph id="HBF2640FFAA434D39895EB6185DA6F087"><enum>(E)</enum><text>the Committee on Education and Labor of the House of Representatives;</text></subparagraph> <subparagraph id="H0BF7F04F953640F4BC6FCC05A2B5198B"><enum>(F)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph>
<subparagraph id="H530A261F5559433EAE0DC67B507BF3D4"><enum>(G)</enum><text>the Committee on Way and Means of the House of Representatives.</text></subparagraph></paragraph> <paragraph id="HC89C286CF4DC49C6B343323C3E2BA4C4"><enum>(3)</enum><header>Council</header><text>The term <term>Council</term> means the White House Council on Energy Transitions established by section 2.</text></paragraph>
<paragraph id="HB7DB7D86A4D04D97A41B8723B3843F42"><enum>(4)</enum><header>Covered electric generating station</header><text>The term <term>covered electric generating station</term> means an electric generating station that primarily consumes coal as a fuel source.</text></paragraph> <paragraph id="HC3D33F309A3C4DD29564023D823316DF"><enum>(5)</enum><header>Covered net revenue</header><text>The term <term>covered net revenue</term> means revenue derived by a unit of local government or Indian Tribe in a fiscal year from a covered electric generating station in the form of annual real property taxes, royalty or lease payments, transaction privilege taxes, sales taxes, or payments in lieu of taxes imposed upon the covered electric generating station, exclusive of interest and penalties.</text></paragraph>
<paragraph id="H507CED1FCA4F43549B33B06B4EF12365"><enum>(6)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the White House Council on Energy Transitions.</text></paragraph> <paragraph id="H16D17D8804C145E58043F6D6F112437B"><enum>(7)</enum><header>Dislocated worker</header><text>The term <term>dislocated worker</term> has the meaning given such term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph>
<paragraph id="H1539A6850DCF4EC6971D80CF260BFFF6"><enum>(8)</enum><header>Economic development agency</header><text>The term <term>economic development agency</term> has the meaning given such term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph> <paragraph id="HB6443821AB454CB780AA88F758736565"><enum>(9)</enum><header>Economic development transition plan</header><text>The term <term>economic development transition plan</term> means a plan developed by a Regional Transition Advisory Committee in accordance with section 3.</text></paragraph>
<paragraph id="H93C1507207374898B061317875460A79"><enum>(10)</enum><header>Economically distressed community</header><text>The term <term>economically distressed community</term> means a unit of local government or Indian Tribe that is located within a 75-mile radius of a covered electric generating station and that is significantly impacted by the closure of such covered electric generating station occurring on or after January 1, 2010, including by, as a result of such closure experiencing—</text> <subparagraph id="HC41B05C9A504461ABE4BE5CAF6E26EDD"><enum>(A)</enum><text>a net labor loss of at least 50 workers who lost employment directly from or associated with the covered electric generating station, including an associated mine;</text></subparagraph>
<subparagraph id="H749AF142550545D79EEC159BCEA070CE"><enum>(B)</enum><text>a covered net revenue loss of over 25 percent compared to the previous fiscal year; or</text></subparagraph> <subparagraph id="HE455C122F52A4902A0CDCED7ADFAB05F"><enum>(C)</enum><text>at least a 10-percent increase in the cost of electricity for applicable electric consumers compared to the previous calendar year.</text></subparagraph></paragraph>
<paragraph id="HD5B41723316F46ED93619B68F43CDABC"><enum>(11)</enum><header>Electric consumer</header><text>The term <term>electric consumer</term> has the meaning given such term in section 3(5) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602(5)</external-xref>).</text></paragraph> <paragraph id="H43925CC6FE604FD1BCE73BD648DFE85D"><enum>(12)</enum><header>Employment loss</header><text>The term <term>employment loss</term> has the meaning given such term in section 2(a) of the Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2101">29 U.S.C. 2101(a)</external-xref>).</text></paragraph>
<paragraph id="HDCF01247F137409A963E5545C4F8CABE"><enum>(13)</enum><header>Essential community services</header><text>The term <term>essential community services</term> means infrastructure located entirely or partially within an economically distressed community and services that provide direct support to residents of a community, including services related to—</text> <subparagraph id="H9D997460D05F44DDAA4B7CDB5B18A50F"><enum>(A)</enum><text>health care;</text></subparagraph>
<subparagraph id="HF727E750A958478591BE671DCFFDA340"><enum>(B)</enum><text>transportation;</text></subparagraph> <subparagraph id="HE50F70AE7A43423D8D5601CC6DA336E5"><enum>(C)</enum><text>energy;</text></subparagraph>
<subparagraph id="HAC89026BB7E2407F9D088CE9CF8F7E2B"><enum>(D)</enum><text>telecommunications;</text></subparagraph> <subparagraph id="HC9E46740BFB949A08156D7A3CC18FC14"><enum>(E)</enum><text>public education;</text></subparagraph>
<subparagraph id="H03063B4EFCCE428B8D8439144A45A065"><enum>(F)</enum><text>public safety; and</text></subparagraph> <subparagraph id="H42ACCD78F58D42628540795117ACF684"><enum>(G)</enum><text>housing.</text></subparagraph></paragraph>
<paragraph id="HB46CDC568DB74FABA32632E306A0ED45"><enum>(14)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given such term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>), except that such term does not include institutions described in subparagraphs (A) or (C) of subsection (a)(1) of such section 102.</text></paragraph> <paragraph id="HB12EAE8DDD8A421FAEAB5172800F386C"><enum>(15)</enum><header>Jobs in energy-related industries</header><text>The term <term>jobs in energy-related industries</term> includes manufacturing, engineering, installation, construction, and retrofitting jobs in energy-related industries.</text></paragraph>
<paragraph id="HED6450A4B7384A5590BE9A795EFEAACB"><enum>(16)</enum><header>Labor organization</header><text>The term <term>labor organization</term> has the meaning given the term in section 7103 of title 5, United States Code.</text></paragraph> <paragraph id="H1DB5E9AE52C345579D6B56129813FF76"><enum>(17)</enum><header>Local workforce development board</header><text>The term <term>local workforce development board</term> means a local board, as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph>
<paragraph id="H20C680D7CE4F492BA712B7039015A0EC"><enum>(18)</enum><header>Regional transition advisory committee</header><text>The term <term>Regional Transition Advisory Committee</term> means a committee described in section 3 that is established by an economically distressed community.</text></paragraph> <paragraph id="HC7175CF9B58F46FAB37B5CA7D9A629A9"><enum>(19)</enum><header>State agency</header><text>The term <term>State agency</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/3306">section 3306</external-xref> of the Internal Revenue Code of 1986.</text></paragraph>
<paragraph id="H726C37A048FB48D48C52E3AFBA05BDA1"><enum>(20)</enum><header>State workforce development board</header><text>The term <term>State workforce development board</term> means a State board, as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph> <paragraph id="HD83B1E7A1A5F4007823C442434CEE497"><enum>(21)</enum><header>Unemployment fund</header><text>The term <term>unemployment fund</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/26/3306">section 3306</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></section>
