R. 2228</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210326">March 26, 2021</action-date><action-desc><sponsor name-id="K000380">Mr. Kildee</sponsor> (for himself and <cosponsor name-id="W000815">Mr. Wenstrup</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To allow for payment of outpatient critical access hospital services furnished through telehealth under the Medicare program.</official-title></form><legis-body id="H09FE7679673549AA84CF40D8BBD86589" style="OLC"><section id="H97F06BA7259A4B1E9FDA16961F493C22" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Behavioral Health Access Act of 2021</short-title></quote>.</text></section><section id="HC94CA2A7C21E47C19317383D9A9124D2"><enum>2.</enum><header>Allowing for payment of outpatient critical access hospital services furnished through telehealth under the Medicare program</header><subsection id="HFB4EB1A944E74E99A1C0DE670F0AE1D4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) and subject to subsection (b), the Secretary of Health and Human Services shall provide payment under section 1834(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(g)</external-xref>) for outpatient critical access hospital services consisting of behavioral therapy services furnished by a critical access hospital to an individual on or after January 1, 2021, via telecommunications technology, notwithstanding the fact that such individual is not located at such hospital.</text></subsection><subsection id="H442BF77D7CE4400AA69D66DE020056F9"><enum>(b)</enum><header>Initiation of services via telehealth</header><text>In the case of an individual receiving services described in subsection (a) from a critical access hospital, if such individual has not, prior to receiving such services, received in-person care at such hospital, payment shall be made to such hospital in accordance with such subsection only if such services complement a plan of care that includes in-person care to be furnished at such hospital not later than 1 year after the date such services are furnished.</text></subsection><subsection id="H4BD5D605E7D04C41BAA7D9A582398954"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="H5EC7A5EF26DD490FBA928B25381EF7AB"><enum>(1)</enum><header>Critical access hospital</header><text display-inline="yes-display-inline">The term <quote>critical access hospital</quote> has the meaning given such term in section 1861(mm)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(mm)(1)</external-xref>).</text></paragraph><paragraph id="H3569F9AFCCE845C7940F0DD6652C8104"><enum>(2)</enum><header>Outpatient critical access hospital services</header><text>The term <quote>outpatient critical access hospital services</quote> has the meaning given such term in section 1861(mm)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(mm)(3)</external-xref>).</text></paragraph><paragraph id="H5CFCA70A3D39455ABA0AE96B797C97F1"><enum>(3)</enum><header>Telecommunications technology</header><text display-inline="yes-display-inline">The term <quote>telecommunications technology</quote> means a communications system permitting two-way, real-time interactive communication between the individuals and health care professional and includes a communications system consisting of only audio capabilities, but only if such individual does not have access to a communications system with audio-visual capabilities.</text></paragraph></subsection></section></legis-body></bill>
