Maloney of New York</cosponsor>, and <cosponsor name-id="S001204">Mr. San Nicolas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Voter Registration Act of 1993 to treat the lease for a dwelling unit under certain federally assisted housing programs as a simultaneous application for voter registration in elections for Federal office, to designate owners of dwelling units under certain federally assisted housing programs as voter registration agencies for purposes of such Act, and for other purposes.</official-title></form><legis-body id="H2BA69DBD3A4F4F58A6BC92C850FF0009" style="OLC"><section id="HB3D0193545364E918D7B191F2DA0A85D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Our Homes, Our Votes Act</short-title></quote>.</text></section><section id="H100FCC8F3F19413F9846849712526C92"><enum>2.</enum><header>Promoting voter registration for residents of units under certain federally assisted housing programs</header><subsection id="H682E834F974841F69002BD3DD1243F73"><enum>(a)</enum><header>Treatment of lease as simultaneous application for voter registration</header><paragraph id="HA0D1745771004175AD9157623B0236A6"><enum>(1)</enum><header>In general</header><text>The National Voter Registration Act of 1993 is amended by inserting after section 5 (<external-xref legal-doc="usc" parsable-cite="usc/52/20504">52 U.S.C. 20504</external-xref>) the following new section:</text><quoted-block style="OLC" id="H7613DBCAD4E24850B82957620A8F7E41" display-inline="no-display-inline"><section id="H4D84972AB07F45998CF3260F2F8B7022"><enum>5A.</enum><header>Simultaneous application for voter registration and lease for PHA-assisted housing</header><subsection id="H0452F011BAAC45A880E11440C246A682"><enum>(a)</enum><header>In general</header><paragraph id="HA6A61FB3727048ACA2811CF012A20538"><enum>(1)</enum><header>Application for voter registration</header><text display-inline="yes-display-inline">Each lease and annual income recertification for a PHA-assisted dwelling unit (as such term is defined in subsection (e)) submitted to the applicable public housing agency for such unit shall serve as an application for voter registration with respect to elections for Federal office for each lessee who signs the lease unless the lessee fails to sign the voter registration application.</text></paragraph><paragraph id="H1F60592DC6A04A2696972BA59D7DE80A"><enum>(2)</enum><header>Update</header><text>An application for voter registration submitted pursuant to paragraph (1) shall be considered as updating any previous voter registration by the applicant.</text></paragraph></subsection><subsection id="H652A50AAD1FB4C668B640206FE4AFB9A"><enum>(b)</enum><header>Limitation on use of information</header><text display-inline="yes-display-inline">No information relating to the failure of a lessee of PHA-assisted dwelling unit to sign a voter registration application may be used for any purpose other than voter registration.</text></subsection><subsection id="H87F3956B1765427FA0EAF250F71C79BB"><enum>(c)</enum><header>Forms and procedures</header><paragraph id="H64B7EB809906429494FB2579C47BEEFE"><enum>(1)</enum><header>Inclusion</header><text display-inline="yes-display-inline">Each owner of a PHA-assisted dwelling unit shall include a voter registration application form for elections for Federal office as part of a lease for such dwelling unit.</text></paragraph><paragraph id="HE022D599AD7F4FD9A1ED956D53A4A835"><enum>(2)</enum><header>Included information</header><text display-inline="yes-display-inline">The voter registration application portion of a lease for a PHA-assisted dwelling unit—</text><subparagraph id="HA33088DD05CD4C759F2808ABA90385D4"><enum>(A)</enum><text>may not require any information that duplicates information required in the lease portion of the form (other than a second signature or other information necessary under subparagraph (C));</text></subparagraph><subparagraph id="H878C75499E0E4E3E948D5F84CDB1F8BE"><enum>(B)</enum><text>may require only the minimum amount of information necessary to—</text><clause id="H99AD8EBE2B8A4CF1B682C96DD6A250D5"><enum>(i)</enum><text>prevent duplicate voter registrations; and</text></clause><clause id="H2E375BB5810E485AB06ED30AF66B6282"><enum>(ii)</enum><text>enable State election officials to assess the eligibility of the applicant and to administer voter registration and other parts of the election process;</text></clause></subparagraph><subparagraph id="H4668DF573CEC44F7A3F86B7B56BB5AE1"><enum>(C)</enum><text>shall include a statement that—</text><clause id="HB0581C7CAC9B42E4A8953AB2A25CB408"><enum>(i)</enum><text>states each eligibility requirement (including citizenship);</text></clause><clause id="HB64187B81C194BFB9022673FBFEE8AFE"><enum>(ii)</enum><text>contains an attestation that the applicant meets each such requirement; and</text></clause><clause id="H4DAB8EAAFF934DCABD865A4058A499CD"><enum>(iii)</enum><text>requires the signature of the applicant, under penalty of perjury;</text></clause></subparagraph><subparagraph id="H0116B3534810452B98D6C85E4402B084"><enum>(D)</enum><text>shall include, in print that is identical to that used in the attestation portion of the application—</text><clause id="H5BC1B7EB72264B5686E50CA527440F6C"><enum>(i)</enum><text>the information required in subparagraphs (A) and (B) of section 8(a)(5) of this Act;</text></clause><clause id="H1251AC2615354B87891E03A4617A1932"><enum>(ii)</enum><text>a statement that, if an applicant declines to register to vote, the fact that the applicant has declined to register will remain confidential and will be used only for voter registration purposes; and</text></clause><clause id="HD9C855DE66254633ABC467B7B89EC8B7"><enum>(iii)</enum><text>a statement that if an applicant does register to vote, the office at which the applicant submits a voter registration application will remain confidential and will be used only for voter registration purposes; and</text></clause></subparagraph><subparagraph id="H9CEA810E91824E109475DCE21B670D62"><enum>(E)</enum><text>shall be made available (as submitted by the applicant, or in machine readable or other format) to the appropriate State election official as provided by State law.</text></subparagraph></paragraph></subsection><subsection id="H81EE5769369D4E70A0E351898A8CAC9E"><enum>(d)</enum><header>Transmittal</header><paragraph id="H5CAACD83D86D4562A3EDCA5491FEF27D"><enum>(1)</enum><header>By owner</header><text display-inline="yes-display-inline">In the case of lease or annual income recertification for a PHA-assistance dwelling unit described in subsection (e)(1)(B), the owner of the dwelling unit shall transmit a completed voter registration portion of a lease or annual income recertification to the public housing agency providing assistance with respect to such unit not later than 10 days after the date of acceptance.</text></paragraph><paragraph id="H6163F28538614B888EE3CE1E61AD1BA8"><enum>(2)</enum><header>By PHA</header><text display-inline="yes-display-inline">Subject to paragraph (3), a completed voter registration portion of a lease or annual income recertification for a PHA-assisted dwelling unit accepted by the public housing agency as owner of such a dwelling unit, or pursuant to paragraph (1), shall be transmitted to the appropriate State election official not later than 10 days after the date of acceptance.</text></paragraph><paragraph id="HBE6676A0B66B4E6C8C9BEDC946142C82"><enum>(3)</enum><header>Applications accepted within 5 days of registration deadline</header><text>If a registration application is accepted by a public housing agency pursuant to paragraph (2) within 5 days before the last day for registration to vote in an election, the application shall be transmitted to the appropriate State election official not later than 5 days after the date of acceptance.</text></paragraph></subsection><subsection id="HFD6E525D98964CD5BF39E7B64AEF6885"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section:</text><paragraph id="H051965079F9446CC9CBDB161DBE3EBDD"><enum>(1)</enum><header>PHA-assisted dwelling unit</header><text>The term <quote>PHA-assisted dwelling unit</quote> means a dwelling unit—</text><subparagraph id="H677BFFB3AFDE42FAA57167EBDE749668"><enum>(A)</enum><text>in public housing, as such term is defined in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>); or</text></subparagraph><subparagraph id="H598DDF20672D47939FF2B3E1A50833CB"><enum>(B)</enum><text display-inline="yes-display-inline">that is assisted under the program for tenant-based rental assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>), including the program under paragraph (13) of such section 8(o).</text></subparagraph></paragraph><paragraph id="H81D9B4823AC248F2A7C08D575D9BAE5E"><enum>(2)</enum><header>Public housing agency</header><text display-inline="yes-display-inline">The term <quote>public housing agency</quote> has the meaning given such term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph><paragraph id="H8ECD8205274E472F904FD996C5CD0A4B"><enum>(3)</enum><header>Owner</header><text>The term <quote>owner</quote> means, with respect to a PHA-assisted dwelling unit—</text><subparagraph id="H6469108C36224262A1BAE12ED23C1CD1"><enum>(A)</enum><text>in the case of a unit described in paragraph (1)(A) of this subsection, the public housing agency that owns or operates such unit; or</text></subparagraph><subparagraph id="H7FEC598EAA51410C91DE948A88BA4C3D"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a unit described in paragraph (1)(B) of this subsection, the private person or entity having the legal right to lease such unit.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H3436A0B3CD9B41739DB90208F9BC8224"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply with respect to leases entered into on or after the expiration of the 90-day period beginning on the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H275959A66D6B4139B78E29582CC5D902"><enum>(b)</enum><header>Treatment of owners of units as voter registration agencies</header><paragraph id="H32F7ED25B892494BB6014FD773C8C6F4"><enum>(1)</enum><header>In general</header><text>Section 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20506">52 U.S.C. 20506</external-xref>) is amended—</text><subparagraph id="H087BED5A1C6E4AD9A43D5760DB131F6F"><enum>(A)</enum><text>in subsection (a)(2)—</text><clause id="H3D72EA5A3FE94F85834C310B4662FB48"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> at the end;</text></clause><clause id="H9DA0C5AD2801478A990E2FADF48AA2DB"><enum>(ii)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H2CEF13ACD8EB4BD3BD199E75B9100509"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H51A666C27ECA4C06B5991D68E9F70274" display-inline="no-display-inline"><subparagraph id="HE0DA29436C574068A64F8E37D17477CA" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">each owner (as such term is defined in subsection (e)) of a dwelling unit assisted under a covered federally assisted housing program (as such term is defined in such subsection) located within such State, subject to section 5A in the case of an owner described in subparagraph (A) or (B) of subsection (e)(1), except that such an owner shall be a voter registration agency for purposes of this section only with respect to lessees of such dwelling units of such owner located within such State.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H49F3E8F1E124468AADA8D88001146E6F"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H430516FB9A6842C696E17BA34E975B36" display-inline="no-display-inline"><subsection id="HCF5B42F90DEE44D188E64924507FAC44"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section:</text><paragraph id="HFD6DBE6584E0412F8DD1C7B875F90E50"><enum>(1)</enum><header>Covered federally assisted housing program</header><text>The term <quote>covered federally assisted housing program</quote> means—</text><subparagraph id="H16AFE637AF0A4CAC9CA6684EFF8CB2D8"><enum>(A)</enum><text>the public housing program under title I of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437</external-xref> et seq.);</text></subparagraph><subparagraph id="H7871E8428DCB45259BCD347B1238E9B0"><enum>(B)</enum><text display-inline="yes-display-inline">the programs for rental housing assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>), including—</text><clause id="H0BC74D6EB2504B63B6D028C0C45D39FD"><enum>(i)</enum><text>the program for tenant-based rental assistance under subsection (o) of such section 8; and</text></clause><clause id="HCFD32E8183C64AC7B61D87589813347B"><enum>(ii)</enum><text>the program for project-based rental assistance under such section 8;</text></clause></subparagraph><subparagraph id="HA70C7561821D46449B576BFFC193E858"><enum>(C)</enum><text display-inline="yes-display-inline">the program for supportive housing for the elderly under section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>);</text></subparagraph><subparagraph id="H10BF7FE5410A40438E548F0509A3590D"><enum>(D)</enum><text>the program for supportive housing for persons with disabilities under section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>);</text></subparagraph><subparagraph id="H1C6A1F8B39C3468A9F7E772097896541"><enum>(E)</enum><text>the program for housing opportunities for persons with AIDS under subtitle D of title VIII of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12901">42 U.S.C. 12901</external-xref> et seq.);</text></subparagraph><subparagraph id="HC365EBE5826A4022955A28EFCB5064EC"><enum>(F)</enum><text>the program under subtitle A of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref> et seq.);</text></subparagraph><subparagraph id="H46F7E42497094B73A3A1C64C01AAE463"><enum>(G)</enum><text>the HOME Investment Partnerships Program under subtitle A of title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12741">42 U.S.C. 12741</external-xref> et seq.);</text></subparagraph><subparagraph id="HE014A6ED882A41B686BA551E7321F292"><enum>(H)</enum><text>the program under paragraph (3) of section 221(d) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715l">12 U.S.C. 1715l(d)(3)</external-xref>) that bears interest at a rate determined under the proviso under paragraph (5) of such section 221(d);</text></subparagraph><subparagraph id="HF09E24B0174F44CEAAF940EEFE46FE16"><enum>(I)</enum><text>the rental assistance program under section 236 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-1">12 U.S.C. 1715z–1</external-xref>);</text></subparagraph><subparagraph id="H54367ACC393943EBB747AB39CD804412" commented="no"><enum>(J)</enum><text>the programs for rural housing assistance provided under sections 514, 515, 516, 522, and 538 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1484">42 U.S.C. 1484</external-xref>, 1485, 1486, 1490m, and 1490p–2);</text></subparagraph><subparagraph id="HC68894F6CA124F6199A2909D49CC1A7B"><enum>(K)</enum><text>the low income housing tax credit program under <external-xref legal-doc="usc" parsable-cite="usc/26/42">section 42</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/42">26 U.S.C. 42</external-xref>);</text></subparagraph><subparagraph id="HC1A405836DC24F31991F24C32D0E1065"><enum>(L)</enum><text display-inline="yes-display-inline">the program for rural housing vouchers under section 542 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490r">42 U.S.C. 1490r</external-xref>); and</text></subparagraph><subparagraph id="H1157EB6CEDBB47C896CE52804CF7F2DA"><enum>(M)</enum><text display-inline="yes-display-inline">the program for assistance from the Housing Trust Fund established under section 1338 of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4568">12 U.S.C. 4568</external-xref>).</text></subparagraph></paragraph><paragraph id="HB09238A4E7054B598DB9F5B638B639BD" display-inline="no-display-inline"><enum>(2)</enum><header>Owner</header><text>The term <quote>owner</quote> means, with respect to a dwelling unit assisted under a covered federally assisted housing program—</text><subparagraph id="HEF35F3C0C4574008B1F1A78739D9F739"><enum>(A)</enum><text>in the case of a dwelling unit assisted under a program specified in subparagraph (A) or (B)(1) of paragraph (1) of this subsection, the public housing agency that owns or operates such unit or provides rental assistance with respect to such unit, as applicable; or</text></subparagraph><subparagraph id="H702DB1F7B0E84FCAB8E70892E2CDCBE7"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a dwelling unit assisted under any other covered federally assisted housing program, the private person or entity having the legal right to lease such unit.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF6B69E9F45D447968210A3DFC76DC831"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by paragraph (1) shall apply with respect to assistance provided on or after the expiration of the 90-day period beginning on the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
